CONSTRUCTION OF MINER ROADIMELEAR P.U.D. (MISSING LINK)
The Engineering Department, for the City of Boynton Beach, Florida, is in
receipt of the above referenced letter from Mr. James T. Bisesi, of the
Gene B. Glick Company, Inc., 8330 Woodfield Crossing Blvd., P.O. Box 40177,
Indianapolis, Indiana 46240, telephone #(317) 469-0400.
This department transmitted a demand letter to the Gene B. Glick Company, Inc.,
a copy of which was previously provided to you, requesting that the Gene B. Glick
Company, Inc. submit to the City an appropriate amount of monies, based upon a
Palm Beach County Engineer's Opinion of Cost, for the construction of Miner Road.
The request for the subject monies specified that the Gene B. Glick Company, Inc.
should submit said funds to the City within 10 days of the receipt of the certified
letter which was formally received by the Gene B. Glick Company, Inc. on 5/28/91.
The previous demand letter provided the Gene B. Glick Company, Inc. to commence
construction of Miner Road, along the north property line of the Melear P.U.D.,
within 30 days from receipt of the same certified letter, providing Gene B. Glick
an opportunity to commence construction of the subject roadway section in lieu of
providing the requested monies.
Attached for your review and consideration is the above referenced May 23, 1991
response from the Gene B. Glick Company, Inc., stating within paragraph #2, last
sentence, " We are prepared and willing to fulfill any obligation we have pursuant
to this subdivision". Additionally, they are requesting a copy of the subdivision
improvement plans which for the most part constitutes the development plans for
their section of Miner Road, now in the custody of Palm Beach County Traffic
Engineering Department. It appears from their last paragraph that they are also
requesting a statement identifying the incomplete improvements and I recommend that
Richard Staudinger, P.E., Gee & Jenson Consulting Engineers provide the certified
verification that Miner Road is not constructed along the north property line of
the Melear P.U.D., for that portion owned by Gene B. Glick Company, Inc.
Paragraph #1, of Mr. Bisesi's letterJncorrectly indicates that the City was to
provide documentation relative to certain roadway improvements that were required
in conjunction with the rezoning of the Melear property from AR to PUD.

Dear Mr. Annunziato:
Palm Beach County Traffic Division staff has reviewed the proposal submitted
by Mr. Kieran J. Kilday to modify the Melear P.U.D. agreement for roadway
improvements.
The following comments are provided for your consideration in responding to
this request:
1) A review of the original traffic distribution done for this project by Mr.
William F. Mulhearn, P.E. in 1983 does not appear realistic in light of
current land use patterns in the Vicinity of the site and because of the
distribution procedure used (which did not consider nearby trip destinations
within the cordon area).
2) The revised traffic distribution done by Mr. Ken Rogers, P.E'. for the
commercial portion of this project is stated to be based "upon the projected
1995 population patterns within a two mile project area", The intent of the
County Traffic Performance Standards is, however, that the traffic
distribution be representative of conditions that will exist at the time the
development is assumed to be built out,
3) The revised traffic distribution done by Mr, Ken Rogers, P.E. for the
residential portion of the project appears reasonable.
4) Given the revised traffic distribution, it appears that at least one
additional road segment (Congress Avenue south of Boynton Beach Boulevard)
will qualify as Category A. A construction project which will widen this
segment to 4 lanes is currently scheduled to begin September 1987.
5) Given the severe overcapacity conditions on Ilypoluxo Road between 1-95 and
Congress Avenue (which has a volume/capacity ratio of 1.66), it is imperative
that no additional traffic be placed on this roadway segment until the 4 lane
section is ooen to traffic.

6) Although it is difficult to anticipate the results of a redistribution of
traffic from the commercial portion of the site, it appears that Lantana Road
from 1-95 to Congress Avenue will be carrying less traffic (435 trips) than
the significant impact/Category "A" threshold for a two-l ane roadway (575
trips), The condition that Lantana Road be four-laned as a prerequisite for
issuance of building permits of the commercial property and remaining 50% of
the residential units could therefore be dropped.
7} The following revision of paragraph #6 of the agreement appears to be
warranted:
"The project development shall be 1 imited to fi fty percent (50%) of the
residential units approved on the subject property. The balance of the
residential units and all of the commercial property shall not be issued
building permits until such time as HVDOluxo Road from 1-95 to Conqress Avenue
and Conqress Avenue from Bovnton Beach Boulevard to L-28 Canal are constructed
as 4 lane facilities."

TRAFFIC DISTRIBUTION STUDY
FOR
MELEAR PUD
This office has been retained to prepare a Traffic
Distribution Study for the Melear PUD. This 154.6 acre PUD is
located on the west side of Congress Avenue and on the south
side of Miner Road, in Section 18, Township 45 South, Range 43
East, in Boynton Beach, Florida.
This PUD was approved by the City of Boynton Beach
approximately four years ago. At that time, the project was
approved with a condition which limited the construction for
up to 50% of the residential units until certain road
improvements were completed. These limitations were based
upon the volume of traffic expected to be generated on the
affected roadway links. Since this project's approval, there
has been significant development in the project's study area
which would have an effect on the distibution and assignment
of this project's traffic. It is the purpose of this Study to
revisit the traffic distribution originally prepared for this
project, adjust the distribution where warranted as a result
of land use changes in the project study area and to determine
what effect, if any, the modification to the distribution and
road assignment will have on the phasing of this development.
Included as a part of the PUD Application was the
"Traffic Impact Analysis for a Portion of Section 18-45-43",
January 27, 1983, prepared by William F. Mulhearn, P.E. The
phasing controls placed on the PUD approval were based upon
the distribution and roadway assignment presented in that
analysis.

In the past four years, there has been a significant
amount of development in the project area which has a major
effect of the distribution of this project's traffic. These
recent improvements include the opening of the Boynton Mall,
the start of development of the Quantum Industrial Park, the
major office development on Congress Avenue south of Boynton
Beach Boulevard, the construction of two major strip shopping
centers at the intersection of Hypoluxo Road and Congress
Avenue and the expansion of the Atlantis Plaza at Lantana Road
and Congress Avenue to include a large Zayre Department Store
and other local retail shops.
There are several different methods available to a
Traffic Engineer in performing a Distribution Analysis. A
weighted gravity distribution shall be performed in this
Analysis. As this is a mixed use PUD, separate distributions
for both the residential and commercial uses have been
performed. The residential distribution was calculated by
performing separate distributions for each of the six primary
trip purposes (work, shopping, school, recreation, social and
miscellaneous), identifying the major at tractors for each of
these trip purposes.
To verify the north-south distribution along Congress
Avenue, this office performed a 24 hour turning movement count
of the existing project entrance. The distribution, as
calculated, was within one percent (1%) of the observed
north-south split, thus verifying the major north-south
distribution.

For the commercial portion of this project, a weighted
gravity distribution was performed based upon the projected
1995 population patterns within a two mile project area. The
residential, commercial and total distribution and roadway
assignment are shown in Figure 1.
There are significant differences comparing the
distribution and assignment in this Study with that presented
in the Analysis prepared by William F. Mulhearn, P.E. The
main reason for these differences is the different
distribution methods utilized. Mr. Mulhearn used the External
Cordon Study Method. As acknowledged by Mr. Mulhearn, "The
only fallacy with regard to using this methodology is that the
trip generation represents an overestimation, i.e., all trips
are assumed to enter and exit at the cordon line (no trips are
dissipated within the cordon area)." This method assumes that
all trip ends will be at least five miles from the PUD. This
method's accuracy decreases as the distance away from the
project increases. This method greatly overestimates the
traffic at the fringe of the study area. Again, in comparison
of distributed volumes from the two reports reveals that the
degree of discrepancy increases as the distance from the
project increases. The primary reason for this is the amount
of traffic which is dissipated within four miles of the
subject site. In addition, the distribution prepared by Mr.
Mulhearn assumes that all traffic attracted to the commercial
portion of this PUD will originate in excess of five miles
from the site. In fact, this type of commercial use generally
has a market area of two miles.
