the captioned matter. My reading of this verifies that the
contract for the road widening of Hypoluxo Road from Congress
to I -95 has been let as of September 27, 1988. Therefore,

Dear Javier:
Accompanying this letter you will find correspondence related
to the issuance of permits at the Melear Planned unit Development
located in Boynton Beach.
As a condition of the approval of the PUD, development of the
final 50% of the project was conditioned upon the letting of
contracts to construct Hypoluxo Road as a four-lane divided
highway from Congress Avenue to I-95. Ms. Rezzonico advises in
her letter that contracts have now been let. Will you please
confirm her findings.

Dear Mr. Wantman:
Ron Bucina and Maziar Keshavarz met with Palm Beach County to
discuss the comments letter on Miner Rd.
Palm Beach County indicated that they were asked by the City of
Boynton Beach to proceed as rapidly as possible on the review and
approval of the plans. To speed up this process Palm Beach County
would be agreeable to a system which provided retention in the
right of way and then discharged directly into the L-20 Canal.
This would eliminate the problem of getting an easement from the
Melear P.U.D.
The following is a summary of the items taken from the comments
letter and discussed at the meeting.

most concern to you, on which the county refused to yield.

Showing beginning and end of project on both plan and
profile of the drainage area map is a minor drafting task
which we can do.
The roadway profile will have to be completed on the
drainage map.
Structures will be numbered and shown on all sheets.
The county was adamant in their refusal of shell rock
base. They claim that the availabe shellrock in the
county does not meet their requirements.
The county agreed to the 2" of Type S-1 modified
asphaltic concrete in two lifts.
The county was adamant on their requirement of paved four
foot shoulders on both sides of the roadway.

The county wants to see the profiles changed on Miner Rd
to make the road in compliance with the 300 L.F. maximum
run to a drainage inlet; They said that they may allow
some flexibility on the West end where the project meets
with the adjacent project.
Adding a 2' sump to the drainage structure should not be
a problem.
Palm Beach County agreed that only the drainage for the
half section will need to be done. The structures and
pipes do not have to be constructed to the ultimate
section as requested on the comments lette~.
We obtained a bench mark from Palm Beach County which can
be added to the plans.

Re: Melear PUD - Credit for Repump Facility Site
Dear Carmen:
As you know, I have forwarded the proposed deeds on to Jim Vance
for review and comment. As you will recall, the water repump
facility site is being conveyed, subject to our receiving a
credit against the City's required payment of capital facilities'
fees. This is as per our agreement confirmed in my letter of
October 31, 1983. On or about December 5, 1983, we discussed
the amount of the credit, and agreed between us that a reasonable
figure was $40,000.00 per acre, or about $7,000.00 per unit.
I believe that we should have confirmation of that figure prior
to the time we actually convey the property, so that this stone
is not left unturned.
At your earliest convenience, please discuss the matter with
the appropriate authority, and confirm that to me - preferably
in writing. I might also add that should another repump facility
site be found, any credits received by the Melears would be
rebated.
If you have any questions or comments, please don't hesitate
to call me.

Please find enclosed proposed Warranty Deeds to be used for
the dedication of the governmental site and the water repump
facility. I have attempted to include the restrictions previously
agreed upon in the Deeds.
If you have any comments regarding those restrictions, please
call me. As soon as you approve the form of the Deeds, I will
have the Melears execute them, and they will be placed back
in your hands, to be held in trust pending approval of the annex-
ation.
Please provide me with your comments as soon as possible, because
one of the Melears is in North Carolina, and the Deeds have
to be Federal Expressed for execution.

Pursuant to our conversations on December 27th and 28th, my
clients have agreed that the percentage of development which
can be completed prior to construction of the major thoroughfares
set forth in the Agreement, is fifty percent (50%). You have
indicated that the revised language in Paragraph 6 is acceptable,

Dear Carmen:
I've been informed that the City Council postponed the vote
on the Annexation request for thirty (30) days. I have also
been informed that the reason for the postponement was because
the County has not yet acted on the 2-year waiver provision.
I'm receiving this message second hand, and have not confirmed
it.
I'm enclosing a copy of the County's policy on granting the
2-year waiver, which was adopted by the County pursuant to the
adoption of Ordinance No. 82-26. Paragraph I of Section 4 indicates
n9rior to receiving a waiver, the municipali~y shall have annexed
the property in question and shall have amended its comprehensive
plan to include the property for which the waiver is requested."
Based on this provision, the County can not grant the waiver
until such time as the City annexes the property. In addition,
whether or not the County grants the 2-year waiver, has no bearing
on whether this property should be annexed into the City. In
the unlikely event the County failed to waive the 2-year provision,
the property would still be annexed~ however, we would have
to wait 2 years before we were able to develop the property
within the City.
I should add, however, that we have agreed to the County Traffic
Engineering Department's requirements, and we are in conformity
with the Palm Beach County Comprehensive Plan, and therefore,
I have little doubt that the 2-year waiver will be granted.

Please find enclosed a proposed Agreemeent Between the City
of Boynton Beach and the Melear Family for Construction of Roadway
Improvements. The substance of the Agreement is as provided
by Charlie Walker via his previous correspondence. I'm sending
copies to Charlie, Jim Vance, and John Corbett for their review
and comments, as well. I've attempted to keep the Agreement
as simple as possible. As I mentioned to you over the telephone,
in Paragraph 6 I left out the percentage that the project devel-
opment would be limited to, because our traffic consultant believes
that it is slightly higher than Charlie does. In any event,
we will certainly work that number out prior to the execution
of the Agreement.
I would appreciate anybody having comments about the Agreement
to relay them to me at their earliest convenience.

This office has completed its review of the materials you furnished concerning
the proposed planned unit development. Based on information supplied in the
project's traffic impact analysis, it appears that two roads, Hypo1uxo Road
between Congress Avenue and 1-95 and Lantana Road between Congress Avenue and
1-95, are already operating at level of service "D". This project has a signi-
ficant traffic impact on both of these links and is, therefore, a "Category A"
project.
The County engineering staff will be glad to meet with the City and this developer
to discuss measures which could be taken by this project to mitigate its traffic
impact.
As you are aware the County has included both Lantana Road and Hypo1uxo Road in
its 2~ gas tax for road improvements program. Both roads are scheduled for
four 1aning within the next five years. Congress Avenue in the vicinity of
this project is also scheduled to be four 1aned in the immediate future.
In order for this project to satisfy the requirements of the performance stan-
dards, this project should accomplish the following:
1) Construct left and right turn lanes on Congress Avenue to serve Miner
Road and the project's entrance road. These turn lanes should be con-
structed as a part of the Congress Avenue widening program.
2) Dedicate 108 feet of right-of-way for and construct Miner Road across the
project's north property frontage,

3) Pay the cost of signalization at both project entrances when warranted
as determined by the County Engineer.
