between EBG INSURANCE AGENCY, INC., party of the first part, and the CITY OF~
BOYNTON BEACH, party of the second part, whose mailing address is 100 East Boynton
Beach Blvd., Boynton Beach, Florida 33435.
WITNESSETH:
That party of the first part, for and in consideration of the sum of TEN ($10.00) DOLLARS,
and other good and valuable consideration to him/her in hand paid, receipt of which is
hereby acknowledged, has granted, bargained and sold, and by these presents does
grant, bargain, sell and release unto the party of the second part, its successors and
assigns, a temporary easement for the purpose of providing a temporary drainage
retention pond which may be granted to others by the second party, within that parcel of
land located in Palm Beach County, Florida, described on Exhibit "A" attached hereto and
made a part hereof as if recited at length. This easement is granted pursuant to an
Agreement between the parties dated November 4, 1994, is temporary in nature and shall
be released upon appropriate request, made consistent with said Agreement.
First party shall grant no other easements, erect no buildings or effect any other kind of
construction or improvements or plant any trees or shrubs upon the property described in
Exhibit "A".
Party of the first part does hereby specially warrant the title to said land and will defend
the same against the lawful claims of all persons whomosever claiming by, through or
under it, that it has good right and lawful authority to grant the above described easement
and that the same is unencumbered. Where the context of this easement deed allows or

permits, the same shall include the successors or assigns of the parties.

WARRAN'l'Y DEED
~I_ THIS WARRANTY DEED made and executed the ~ day
of ~V. A.D., 1984 by CARRILLA MELEAR, LARRY WAYNE
MELEAR, and MICHAEL RAYMOND MELEAR, hereinafter called the
Grantors to CITY OF BOYNTON BEACH, a Florida Municipal Corporation,
whose post office address is P. O. Box 310, Boynton Beach,
Florida 33425-0310, hereinafter called the Grantee.

WITNESSETH: That Grantor for and in consideration
of the sum of $10.00 and other valuable consideration, receipt
whereof is hereby acknowledged, by these presents does grant,
bargain, sell, alien, remise, release, convey and confirm
unto the Grantee, all that certain land situate in Palm Beach
County, Florida, viz:
SEE ATTACHED EXHIBIT WAn
SUBJECT TO:
1) Zoning and/or restrictions or prohibitions imposed
by governmental authority.
3) All other restrictions, reservations, covenants and
easements of public record.
4) Rights-of-way of record.
5) Taxes for the year 1984 and subsequent years.
6) Within six (6) months from the recordation of this
Deed, Grantee shall fence the above-described property and
buffer the property with trees that when fully grown will
provide a visual buffer from the water repump facility planned
for construction thereon.
7) In the event Grantees locate another site, other than
the above-described property, for the water repump facility,
the property shall revert to Grantors, their heirs, successors
or assigns.
Together with all the tenements, hereditaments and appurten-
ances thereto belonging or in anywise appertaining.
To have and to hold the same in fee simple forever.
And the Grantors hereby covenant with said Grantee that
Grantors are lawfully seized of said land in fee simple; that
Grantors have good right and lawful authority to sell and
convey said land; that Grantors hereby fully warrant the title
to said land and will defend the same against the lawful claims
of all persons whomsoever.
