Attached is the amended master plan modification submittal for the above referenced
project for your final review and recommendation, Please review the amended plans
and exhibits submittal to determine if the plans have been adjusted to satisfy the
comments previously made by your department.
If your comments have been satisfied or if your comments can be met at time of
building permit, please advise this office in writing. If your comments have not
been met, please indicate this in writing to my office.
Finally, include in your memorandum a recommendation as to whether the project
should be forwarded to the Planning and Development Board for consideration, Please
return your memorandum and the amended plans (Building Division shall keep
their plans) to Planning and Zoning by 5:00 P.M. on Wednesday July 30,1997.

developer's expense to accommodate the increase in land use density,
3) City Water may not be used for irrigation where other sources are readily available,

I have reviewed the above plans and have the following
comments/recommendations:
1. I do not recommend the "proposed entrance" on N. Congress Ave. This type of
entrance would create traffic concerns for N. Congress Ave. Adding another
development entrance/exit would further complicate the traffic flow. The
property currently has access from Sandalwood Drive and I recommend Phase 2
be accessed from there also. The conceptnal plans for Phase 2 shows a security
gate entrance. This suggests that Phase 2 is being marketed as a gated
community. An entrance/exit from a major road (N. Congress Ave.) would
invite an additional criminal element. An entrance/exit on Sandalwood Drive
would be less inviting and visible from N. Congress Ave.
2. The "Proposed Exit Only" for Phase 2 is not recommended. I am told that this is
for emergency use only and I am not sure of the intent. If it is for emergency
vehicle use, it is not usuaDy an exit that is desired. We usually look for
ways to access a development quicker, not leave it.
3. The "Commercial" area proposed for Sandalwood Drive is not a desirable
location. Placing commercial businesses inside a planned community invites
outside elements (both criminal and non-criminal), I recommend relocating the
commercial acres to the north side of the project; at Miner Road and
Sandalwood Drive. The commercial business would still be accessible to
residents, but the outside element would not have to travel into the middle of
the development to access it.

I, To maintain the intent of the basic design of access points to planned unit developments (PUD) and to
remain consistent with the location of the access points that are existing to the adjacent single family and
multifamily planned unit developments (Meadows POO and Dos Lagos POO) it is recommended that
the access points to Phase 2 be located on the internal access road (Sandalwood Drive) rather than
Congress Avenue,
2, To maintain a consistent width of the streetscape, landscape buffer and building setback along the east
property line of the Melear PUD, it is recommended that the width of the buffer and building setback for
Phase 2 remain 50 feet rather than the proposed 40 feet.
3, No objection to the redistribution of unit types,
4, Remove the note indicating setbacks to be determined at time of platting, Setbacks are determined at
time of master plan,
Engineering Division
The Melear PUD was designed and approved to handle all the traffic within the development. The 80'
right-of-way known as Sandalwood Drive is a collector road and can be widened to a three or four lane
roadway to handle all internal traffic, The existing approved master plan does not allow any other
openings onto Congress Avenue, Creating another Congress Avenue entrance for the proposed 364
apartments violates the integrity of the existing PUD plan and creates dangerous left turn crossover
maneuvers for vehicles onto the six lane, high speed Congress Avenue corridor.
The intent and purpose of a planned unit development is to promote efficient and economical land use,
improved amenities, creative design, improved living environment and orderly development in the City and
the protection of adjacent, existing and future City development. It is the intent of PUD regulations to
promote and encourage development in this form to be planned and developed as unified and coordinated
units,
We see no real justification for any of the proposed changes that would benefit the City or the subject
PUD, We recommend that the Mclear PUD master plan remain as originally approved and deny the new
request in it's entirety,

The subject traffic analysis only addresses the traffic generated by the proposed new development
and doesn't provide an overview of the area at build-out. It is in the City's best interest to not
modify the existing master plan which would allow traffic onto Congress Avenue, Therefore it is
recommended that the proposed access to Congress Avenue be relocated to Sandalwood Drive,
The following is an analysis of traffic at the subject PUD: When the Melear PUD is fully
developed, it will generate traffic along Sandalwood Drive from 996 units plus traffic from the
commercial site (664 units from Melear and 332 units from Chalet IV Development), Directly
across from Sandalwood Drive, on the cast side of Congress Avenue, is the main (and only)
entrance to the Dos Lagos Development which now generates traffic from 428 units (s,f,[, duplex
and townhouses), It is possible the total build out traffic onto Congress Avenue will warrant full
signalization at this intersection rather than at Miner Road, There is only a small, undeveloped
parcel on the north side of the new Miner Road Extension that ean generate any additional traffic

onto Miner Road between High Ridge Road and Lawrence Road, Therefore it is possible the
warrant for a full signal light at this location will not be met. Additionally, using the County's
minimum, one-half mile spacing for traffic signal lights makes the Sandalwood Drive light location
more desirable for it is approximately that distance from there to the light at Meadows Boulevard
(it is only 1300' from the Meadows light to Miner Road),
Allowing an opening onto Congress A venue may dilute/weaken the justification for a light at
Sandalwood Lane, [LDR Chapter 2,5, Section g,A, & c. and attached 12/31/91 letter]

In response to your request, a traffic study was conducted at the subject
intersection. This study indicated that signalization of the intersection was
not warranted. Due to the findings of this study, we cannot recommend the
installation of a signal at this intersection as of this date. We will continue
to monitor this intersection as traffic demands change.

The following is a list of comments regarding the first review of the above-
referenced project.
1, The width of the proposed landscape/setback buffer along Congress Avenue
is reduced from the previously approved fifty (50) feet to forty (40) feet.
Provide landscape specifications to justify the proposed reduced buffer.
Provide also design guidelines and landscape specifications for all proposed
peripheral buffers,
2, The original master plan and Chalet IV plat laid out Sandalwood Drive as a
local road to funnel the traffic generation by the uses in PUD, as the main
PUD thoroughfare, Traffic from Sandalwood Drive is networked to empty its
traffic onto Miner Road to the north and Congress Avenue to the west. The
function of Sandalwood Drive is to tie all phases together and to provide
vehicular access (main access point) to all phases of development. The
proposed access from Congress Avenue is believed to increase traffic
hazards in this area and violates LOR Chapter 6, Article IV, Section 1.A.
Points of Access, (Subdivisions shall be designed to provide access to all
lots by the use of local streets,) Therefore, eliminate the Phase 2 access
onto/from Congress Avenue and convert the other "exit only" driveway
access into a main access point to the development.
3, Provide a vicinity sketch that would include areas adjacent immediately to the
site, Specifically, show all existing median cuts and traffic lanes configuration

of Congress Avenue and Miner Road within the vicinity of the project. Also,
show proposed deceleration/turn lanes and proposed dedication area if
Congress access is proposed,
4, Provide a revised storm water management plan, as required by the Land
Development Regulations, Chapter 3, Article IV, Section 3,T.
5, Submitted traffic study was forwarded to the Palm Beach County Traffic
division for review and determination whether the traffic generated by the
proposed development triggers adjacent street improvements and to evaluate
the difference between what is vested and what is proposed. Additional
conditions may be generated upon receiving Palm Beach County evaluation
of the report,

review the plans and exhibits and transmit formal written comments to the Director of
Planning and Zoning no later than 5:00 P.M. on June 27, 1997. When preparing your
comments, please separate them into two categories; code deficiencies with code
sections referenced and recommendations that you believe will enhance the project.
If you believe the plans are substantially complete with regard to code compliance and
that your outstanding comments and/or recommendations may be addressed at time of
rectification of the master plan following City Commission approval, rather than requiring
the applicant to prepare amended plans for a 2nd submittal, indicate in your 1st review
written comments that you recommend the request proceed to the Planning and
Development Board and City Commission for approval. If you recommend the request
move forward for approval with one review, please attach the 1st review plans to your

Adhering to the following review guidelines will promote a comprehensive review and enable
the applicant to efficiently obtain Technical Review Committee approval:
1, Use the review standards specified in Part III, Land Development Regulations, Chapter
3, Master Plan Review and the applicable code sections of the Code of Ordinances to
review and formulate comments,
2, The documents submitted for the project were determined to be substantially complete,
however, if the data provided to meet the submittal requirements is insufficient to
properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be
requested by the reviewer by contacting Jerzy Lewicki.
3, Each comment shall reference the section of the code that is incorrectly depicted on the
documents,
4, Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements,
5, When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the
review specified,
6, If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within
the time frame stated above, to the Planning and Zoning Director. The memorandum shall
state that the plans are approved and that they do not have any comments on the plans
submitted for review and that they recommend the project be forwarded through the
approval process,
All comments shall be typed, addressed and transmitted to the Director of the Planning and
Zoning Division for distribution to the applicant. Please include the name and phone number of
the reviewer on this memorandum, Jerzy Lewicki will be the Planning and Zoning staff member
coordinating the review of the project.
Planning and Zoning staff will send the applicant a cover letter which includes the comment(s)
and directions to amend the plans to comply with the comments and the procedures for
resubmission, When Planning and Zoning staff receives the amended plans, we will distribute
the plans with a cover memorandum to all TRC Members for review and approval.
