Dear Mr. Rumpf,
This letter is to request the deletion of Fire Condition No. 10 from the development
order.
Condition 10 reads: Wood frame construction wil1 require fire sprinklers and the
location of Fire Department connections must be shown, BBCC 9-6 and LDR 6-16".
Based on the Fire Protection and Prevention Code (1999-S-10) Section 7-1.1 A 6. single
family homes and duplexes are exempt from this requirement.
A townhome is defined by the Standard Building Code Page 26 as a single family
dwelling unit constructed in a series or group of attached units with property lines
separating each unit. It is important to note that the townhouse buildings have been
designed to allow for a two (2) hour separation between units.

In conjunction with the attached rectified site plan submittal, this letter is to serve
as a request to amend the existing Melear PUD conditions of approval.
Specifically, we are seeking to amend the maximum permitted building height to
30 feet, from the current 25 feet. There are no other amendments to the PUD
approval conditions being sought at this time.
