NATURE OF REQUEST
Gator Engineering Services, Inc. agent for Ridgeway Plumbing, Inc., is requesting to appeal Chapter 7.5, Article II, Section
5(E). This section of the landscape code pertains to the perimeter landscape strip that is required between a vehicle use area and
an abutting property line. The subject site is located at 640 East Industrial Avenue, which is on the east side of the street,
between East Industrial Avenue and the S.A.L. Railroad right-of-way (see Exhibit "A" - Location Map).
BACKGROUND
This request is submitted in connection with, and concurrent with, an application for major site plan modification to add 18,971
square feet of warehouse and office space (please see MSPM 98-003 and Department of Development Memorandum No. PZ
298). Exhibit "B" - Site Plan delineates the area of the subject landscape appeal.
ANALYSIS
The following text is an excerpt from Section 5. E. of the landscape regulations:
"E. Perimeter landscaping relating to abutting properties. On the site of a building or structure or open lot use providing an
off street parking area or other vehicular use area, such area shall be provided with a landscaped barrier, preferably a hedge
not less than four (4) feet rwr greater than six (6) feet in height to form a continuous screen between the off-street parking area
or other vehicular use area and such abutting property. Such landscape barrier shall be located between the common lot line
and the off-street parking area or other vehicular use area in a planting strip of not less than two and one-half (2 0) feet in
width."
As indicated in Exhibit "B", the request is to omit approximately 450 lineal feet of hedge to be planted 18 inches tall, spaced
2.0 feet on center and installed in a 2.5 foot wide landscape strip. This area includes 170 feet adjacent to the existing portion of
the business, and 456.64 feet adjacent to the proposed addition.
The intent of this portion of the code, applied to this site, is to screen view of the parking, circulation, and loading/unloading
areas of Ridgeway Plumbing, Inc. from adjoining properties which consists of the S.A.L. Railroad right-of-way and 1-95. The
required landscaping placed along this property line would not meet the intent of these regulations at this location.
With respect to buffering for the 1-95 right-of-way, this buffering is already accomplished by a significant berm and vegetation
that has grown in excess of 15 feet, located between 1-95 and the railroad right-of-way. This existing vegetation towers above
the property due to the mature state of the vegetation and the elevation difference between it and the subject property. As for
the potential for screening the passing trains from the property, the railroad tracks are also situated well above the elevation of
the subject property (approximately 5 feet to 7 feet). Given that seats in train passenger cars are another 5 feet to 7 feet above
the rails, not accounting for those cars with multi-level seating, the hedge would have to exceed a minimum of 10 feet, and be
ideally in excess of 14 feet to adequately screen the railroad right-of-way. No other properties have view of the subject use
from an east perspective.
RECOMMENDATION
The Planning and Zoning Division recommends that this request, by Gator Engineering Services, Inc., for a landscape appeal to
Section 5. E. of Article II - Landscape Code, be approved. Should the ultimate approval of this request include conditions, said
conditions shall be placed in Exhibit "C" - Conditions of Approval.
