I am responding to the letter you wrote to Michael E. Haag since Mr. Haag has left the employment of
the City of Boynton Beach,
Per your request, I am granting you a sixty-day extension in order for you to make application for your
wall variance and move forward in securing the variance or constructing the waiL I will expect that
you have your variance application submitted to the Planning & Zoning Division by December 13,
2000 so that it will be heard by the Planning & Development Board on January 23, 2001. Otherwise, I
will have no recourse than to move this item to the City Attorney's office concerning forfeiture of your
cash bond,
Your letter of December I, 1999, stated that within 90 days of the June 2000 Planning & Development
Board meeting, you would have either had your variance approved or the wall constructed, Currently,
your site permit #96-4225 for the Riverwalk Shopping Center still remains open and has not received a
full building finaL

As per my conversation with you and Don Johnson, this is a request to extend us
some time for our wall variance, As you know Mike, we have posted a cash bond ( See
Attached) for $13,612,50, At this time we have completed everything on the cites
punchlist except our final inspection which we will have in the next few days, We would
greatly appreciate this short extension, Again, I would like to thank you and the city for
its patience and understanding,

As per our meeting yesterday, Riverwalk Plaza gave you a check (cash bond) for
$13,612,50 (check #1874), Riverwalk Plaza will try to get its variance approved by the
city no later than June, 2000, However, if not approved by that date Riverwalk Plaza will
construct said wall within 90 days,

In regards to the "Buffer" wall being replaced by chain link
fence: We at Crown Colony, Kings Bay House feel the Buffer
wall will be more in keeping with a residential district. Since
this will keep it more private and block the view of delivery
trucks, noise and litter i.e.: (stacks of pallets plastic milk
carriers, bales of cardboard etc.)
In as much as this is one of a few commercial properties on
the intracoastal waterway in Boynton Beach it would
behoove the city to try to make it as attractive as possible.
At this time, we also want to mention our complaint of
excessive lighting and the terrible view of machinery on top
of the building. The city would be doing a justice to the
community if regulations were made on height and
candlepower of lights as well as enclosures (walls) to hide
roof top machinery.
We hope that the concerns expressed in this letter will be
considered at the May 12 th meeting.

Thank you for your notification of a request for a variance in constructing the required buffer wall to
allow a chain link fence between property that I am part owner of and the petitioners property.
We are opposed to a variance for the following reasons:
When the project was originally built a cRain link fence was erected over our objections. The chain
link fence did not achieve what the developers promised which was to keep the debre and trash off
our property. The fence has been knocked down, tom etc. allowing their trash from their
dumpsters which are located on the property line along the fence, to be deposited on our property.
This causing us financially hardships in keeping the property cleaned up along with numerous
citations from your code enforcement department None of these problems were directly brought
about by any actions on our part. To allow them to create the same undesirable situation by
constructing a fragile fence again is ludicrous,
Therefore, we reque.c;t that the planning and zoning dep2rtMent comply with the regulations as
written and were justly created to protect the adjoining property,
