Accompanying this memorandum you will find an application and supporting documentation
for the above-referenced case. A check in the amount of $1,000,00 to cover the review and
processing of this application has been forwarded to the Finance Department.
The legal advertisement for this request will be forwarded to your office after review by the
City Attorney. This request is scheduled for the December 8, 1998 Planning and
Development Board meeting and the December 15,1998 City Commission meeting. Please
advertise in the newspaper and notice property owners accordingly.

James Harlow, Agent for Steak 'n Shake, Inc., property owner, has requested the following parcel
located at the southwest corner of Old Boynton Road and Winchester Park Boulevard to be considered for
Conditional Use approval to construct a drive-thru/sit down restaurant.
Legal Description:
A portion of Lot 42 of Subdivision Section 19, Township 45 South, Range 43
East as recorded in plat Book 7, at Page 19, of the Public Records of Palm
Beach County, Florida, less the South 320.00 feet and less the North 20,00
feet for road right-of-way and being more particularly described as follows:
Commencing at the Northeast Corner of said Lot 42; thence run along the
East line of said Lot 42 on the assumed bearing of South 01006'03" East a
distance of 20.00 feet to a point of intersection of the South right-of-way line
of Old Boynton Road and the West right-of-way line of Winchester Park
Boulevard as now exists, said point also being the Point of Beginning; thence
continue South 01006'03" East along said West right-of-way line of
Winchester Park Boulevard a distance of 243,08 feet, to the Southeast corner
of lands described in Official Records Book 5805, at Page 1429 of the Public
Records; thence South 88009'06" West along the South line of said lands a
distance of 217.65 feet; thence North 01000'33" West parallel with the West
line of said Lot 42, 121,95 feet; thence North 89050'16" East a distance of
50.00 feet; thence North 01000'33" West a distance of 127.53 feet to a point
on the said South right-of-way line of Old Boynton Road; thence North
89050'16" East along said South right-of-way line a distance of 167.26 feet to
the Point of Beginning.

PUBLIC HEARINGS TO CONSIDER THE REQUEST ARE SCHEDULED BEFORE THE PLANNING AND
DEVELOPMENT BOARD AND THE CITY COMMISSION AT THE CITY HALL COMMISSION

AND DECEMBER 15, 1998, RESPECTIVELY, AT 7:00 P. M.
All interested parties are notified to appear at said hearings in person or by attorney and be heard or file
any written comments prior to the hearing dates. Any person who decides to appeal any decision of the
Planning and Development Board and City Commission with respect to any matter considered at these
meetings will need a record of the proceedings and for such purpose may need to ensure that a verbatim

Request for a Determination of "FDEP - Notice of Intent to Use General Permit
for Wastewater Collection / Transmission System" Permitting Requirements
Dear Mr. Russell:
Please allow this letter to serve as a follow-up to our telephone conversation on October 12, 1998,
regarding the proposed on-site wastewater collection system, for this project. Please review the
attached "Utility Plan Sheet" depicting the proposed on-site single service wastewater collection
system, consisting of a 6" service lateral with a connection to an adjacent City of Boynton Beach
manhole. The proposed single service lateral will contain six (6) sanitary sewer clean-outs. Due to
the nature of this project, it is our belief that the planned Steak 'n Shake facility will not require
FDEP Wastewater Collection System Permitting.
Following your review, if you are in agreement, please sign the designated space provided below,
thereby verifying your concurrence with this issue. Once again, thank you for your assistance in this
matter, and I would greatly appreciate whatever you can do to help expedite the review of this

I. Project Overview
The project consists of a 214,000 sf retail shopping center. The total site area is
30.41 acres (Boynton Commons - 23,03, offside roadways - 3.08 acres, South
outparcel - 1.42 acres, offsite lakes - 1.07 acres, Steak and Shake - 1.08_ acres,)
The site is bounded to the north by Old Boynton Beach Boulevard, to the south
by the LWDD L-24 Canal, to the east by Congress Avenue, and to the west by
Winchester Park Boulevard and vacant land, It is situated in Section 19,
Township 45 South, Range 43 East.
This site is situated entirely within the C-16 Basin, The existing property is
vacant land and was used primarily for agriculture. The current surfacewater
management system is based on the topography of the existing lands.
Stormwater is conveyed, via surface runoff, to an existing onsite lake and than
through an existing control structure to the L-24 Canal. Water quality is achieved
by ground storage,
The proposed surfacewater management system will be comprised of a system
of underground culverts, French Drains, and lakes. The system will be designed
to accommodate approximately 30.41 acres (Boynton Commons - 23,03 acres,
Winchester Park Blvd. - 3,08 acres, south outparcel - 1.42 acres, offsite lake -
1.80 acres, Steak and Shake - 1.08 acres). Stormwater runoff is directed, via
underground culverts, to the onsite lake for detainment prior to discharge into the
L-24 Canal. Water quality will be achieved within the lakes. Dry pretreatment
will be achieved within the French Drains, parking islands, and the 0.26 acre
retention area. Two control structures are utilized to obtain the required pre-
treatment. These structures are located at the outfalls into the lakes, They are
necessary in order for the French Drain system to function adequately. A third
control structure is used to restrict offsite flow into the LWDD L-24 Canal. The
total discharge from this structure will be at or below the allowable discharge rate
for the C-16 Basin, The allowable discharge rate is 62,6 CSM. The maintained
water elevation in the L-24 is 8,50 NGVD.
Turbidity barriers will be utilized during any work within the vicinity of any existing
surfacewater management facilities,
Potable water and sanitary sewer service will be provided by The City of Boynton
Beach Utilities,

The owner of the shopping center and Steak and Shake will be responsible for
maintaining their respective surfacewater management system,
The developer is applying for a SFWMD Surfacewater Management Permit
Modification for only the addition of the 1,08 acre Steak and Shake parcel. The
modification will encompass the total 30.41 acres (Boynton Commons, offsite
road, south outparcel, offsite lake, and Steak and Shake).
