THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING ABANDONMENT OF A 20 FOOT
WIDE ALLEY, 150 FEET IN LENGTH, LOCATED
WESTERLY OF LOTS 9, 10 AND 11, BLOCK 1 OF
LAKE ADDITION; RESERVING A 20 FOOT WIDE
UTILITY EASEMENT TO THE CITY OF BOYNTON
BEACH, FLORIDA , BELLSOUTH AND ANY AND
ALL OTHER AFFECTED UTILITIES; SAID
PROPERTY BEING MORE PARTICULARLY
DESCRIBED IN EXHIBIT "A" ATTACHED HERETO;
PROVIDING THAT THIS ABANDONMENT SHALL
NOT BE CONSTRUED TO AFFECT ANY EXISTING

II WHEREAS, Gene Moore, Esq., agent for Stein Faily Limited Partnership, the

adjacent to lots 9, 10 and 11, Block 1 of the Lake Additional, Book 11, page 71 of
the Public Records of Palm Beach County, Floria; reserving a 20 foot wide utility
easement to the City of Boynton Beach, Florida, BellSouth and any and all other
affected utilities; and
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City's Planning and
Development Board and the City Commission on the proposed abandonment; and
, I WHEREAS, based on the foregoing information, the said alley to be

, abandoned no longer serves any useful purpose; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA THAT:

Section 1. The City Commission of the City of Boynton Beach, Florida
does hereby abandon a 20 foot wide city alley located within blocks 10, 11 and 12 of
i the Bowers Park subdivision, located westerly of and adjacent to lots 9, 10 and 11,
I Block 1 of the Lake Additional, Book 11, page 71 of the Public Records of Palm
Beach County, Florida; reserving a 20 foot wide utility easement to the City of
Boynton Beach, Florida, BellSouth and any and all other affected utilities in the City
of Boynton Beach, Florida and depicted on Exhibit "A" attached hereto, subject to
staff comments.
Section 2 This Resolution shall not be construed to abandon, surrender,
dedicate, transfer, or otherwise give away any access easement, whether written or
prescriptive, enjoyed by BellSouth and any other recognized utility.
Section 3. The Mayor and City Clerk are hereby authorized and directed to
execute and deliver the attached Disclaimer and cause the same to be filed in the
Public Records of Palm Beach County, Florida.
Section 4. This Resolution shall take effect immediately upon passage.

documents for the above-referenced abandonment application. The $500.00 application fee for
staff processing and review has been forwarded to the Finance Department.
A legal advertisement for same has been prepared for the July 14, 1998 Planning and
Development Board meeting and the July 21,1998 Commission meeting and will be forwarded
to your office after review by the City Attorney. In order for our department to meet the
deadline for preparing Planning and Development Board agenda materials for this request,
comments from staff and the various concerned parties must be received by our office by July
2,1998.

of the CITY OF BOYNTON BEACH, FLORIDA, will conduct PUBLIC HEARINGS at CITY
HALL COMMISSION CHAMBERS, 100 E. Boynton Beach Boulevard, Boynton Beach, Florida,
on Tuesday, July 14, 1998 and on Tuesday, July 21, 1998, respectively, at 7:00 p.m. to
