FLORIDA, APPROVING THE PLAT FOR STONEHAVEN
PLAT NO. 1 (PUD) IN SECTION 30 TOWNSHIP 45
SOUTH, RANGE 43 EAST

WHEREAS, the final plat for Stonehaven Plat No. 1 (PUD)
hereby submitted for approval; and
"~EREAS, a performance bond in the amount of $1,282.325.00
is being held to insure that improvements are installed, and all
fees paid including a $42,143.87 recreation fee in accordance with
applicable requirements.
NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That the plat is hereby resolved to have re-
ceived final plat approval by the City Council of the City of
Boynton Beach, Florida, with all conditions previously agreed upon
and subject subdivision is hereby affirmed and adopted.
Section 2. That the bond in the amount of $1,282,325.00
will be held by the City in accordance with the provisions set
forth in the Charter and Code of Ordinances for the City of
Boynton Beach, Florida.

AGREEMENT ON REQUIRED IMPROVEMENTS
STONEHAVEN P.U.D., PLAT NO.1
The Party of the First Part, Stonehaven Development Corporation,
hereinafter referred to as the "Developer", hereby agrees and contracts
with party of the Second Part, CITY OF BOYNTON BEACH, FLORIDA, hereinafter
referred to as "City", that as consideration for the platting and sub-
dividing of Stonehaven, P.U.D. Plat No. I according to Plat Book 48,
Pages 1 - 5, Public Records of Palm Beach County, Florida, pursuant to
the Subdivision and Platting Regulation Ordinance have been constructed
pursuant to the specifications of the Ordinance. Further, should the
Required Improvements fail or otherwise become defective during a period of
one year from the date of acceptance of said Required Improvements, due to
the defective materials or workmanship, the Developer shall, upon each
occasion, be responsible in all respects for such failure or defect. The
Developer shall immediately, upon thirty (30) days written notice by the
City, correct such failure or defect at the Developer's sole cost and ex-
pense and bring them into compliance with the requirements of the above
referenced Subdivision and Platting Regulation Ordinance of Boynton Beach,
Florida
In the event the "Developer" fails to begin repair of the
defective Required Improvements within the thirty (30) days
as specified above, the City shall have the right to make
such needed repairs and the "Developer" shall be liable for
the actual cost expended by the City for such repairs and
any costs incident to the collection of such sums, including
but not limited to, reasonable attorneys fees and costs of
litigation.
IN WITNESS WHEREOF, Developer has hereunto set his hand and seal

comments, a copy of which are enclosed.
Prior to submitting your Final Plats to the City Engineer, all
staff comments adopted by the Council in their approval shall
be provided for.

Dear Tom:
As you know, the construction of the required improvements at
the subject project have been ongoing for some time. Through-
out this construction period we have coordinated with both the
contractors and representatives of your office and have reviewed
in the field the construction that has been completed. Recently
the final field review of the construction was held-with Mr. Dick
Griffith, of The Satter Companies, Mr. John Voygt, of your office
and Mr. Tony Grandbois, of thc Utility Department.
It was noted at these final inspections that the construction of
all required improvements, as outlined in the orieinal cost
estimates, are now complete with the exception of some sidewalks
and swale sodding that must be done with the construction of the
house.
Based on this, The Stonehaven Development Corporation is requesting
that the City Council accept this subdivision as being completed,
release the remainder of the orginal development bond, and begin
the warranty period. Pursuant to this request we have enclosed
herewith the following items:
1. Two copies of the construction documents for the
subject project, Satter Architects & Engineering
Group, Inc. Construction plans in 15 sheets,
showing the record drawing information.
2. Reproducible mylar copies of the plan sheets and
profile sheets (showing the record drawing infor-
mation) .
3. The owner certificate and warranty executed by the
project developers.
4. The engineers statement for the subject project and
the test reports for the site.

Also enclosed is a engineer's cost estimate for the rema~n~ng
sidewalk and swale construction. Since these are required
improvements, but because they must be constructed with the
homes, the developer will post a bond for these items ,as we:
discussed in our recent telephone conversation.
We are requesting that you prepare the resolution for the
acceptance of this development, notlng the sidewalk and sodding
bond, and present it to the City Council for their approval.
It is my understanding that a technical review board meeting
will be held to discuss this request. Please notify me as to
the date, time and location of this meeting so that I may notify
the developer so he can have a representive present. We would
appreciate it if you could prepare the necessary resolution and
have this item available for council action as soon as possible.
Please contact me if you have any question or comments regarding
this matter.

ENGINEER'S STATEMENT
I declare that, as a registered engineer in the State of
Florida, to the best of my knowledge and belief, based on
field reviews under my respondib1e charge, the required
improvements for the Stonehaven P.U.D. - Plat No.1 subdi-
vision have been constructed in substantial accordance with
the approved construction plans and the Subdivision and
Platting Regulations of The City of Boynton Beach, Florida
in effect on the date of plan approval. Attached, are copies
of the tes,t reports made on the work and materials during the
progress of construction. Also enclosed is a record drawing
copy of the construction plans on a high-quality, time stable,
reproducible mylar showing the actual finished work in compari-
son to the original design.
