AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE NO. 80-19 OF
SAID CITY BY REZONING A CERTAIN PARCEL OF
LAND LOCATED IN SECTION 33, TOHNSEIP 45
SOUTH, RANGE 43 EAST, MORE PARTICULARLY
DESCRIBED HEREAFTER FROM R-1AA TO PUD WITH
LAND USE INTENSITY OF 7 (LUI) , PROVIDING FOR
A SAVINGS CLAUSE, ~EPEALING PROVISION, AN
EFFECTIVE DATE AND FOR OTHER PURPOSES.
WHEREAS, the City Council of the City of Boynton Beach,
Florida, has heretofore adopted Ordinance No. ~~-19 in which a
Revised Zoning Map was adopted for said City; and
WHEREAS, SUMMIT INVESTMENT, INC. has heretofore filed
I a Petition with the City of Boynton Beach, Florida, pursuant to
I Section 31-1 of the Codified Ordinances of said City, for the
: purpose of rezoning certain property consisting of approximately

WHEREAS, the Planning and Zoning Board of the City of
Boynton Beach, Florida, has heretofore approved said development
plans and specifications and has recommended approval thereof
by the City Council subject to certain conditions; and
~rnEREAS, the City Council deems it to be in the best
interests of the inhabitatns of the said City to amend the afore-
said Revised Zoning Map as hereinafter set forth.
NOl-J, THEREFORE, BE IT ORDAINED BY THE CITY COU!lCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1. That the following described land located in
the City of Boynton Beach, Florida:

A parcel of land located in Government Lot 12,
Section 33, TOvffiship 45 South, Range 43 East,
City of Boynton Beach, Florida, being more
particularly described as follows:
A parcel of land bounded on the West by the
right of way of Interstate 95, on the North and
East by High Point Apartments Subdivision, and
on the South by the right of way of Southwest
23rd Avenue and lands owned by the State of
Florida (Department of Transportation).
Containing 5.75 acres, more or less.

be and the same is hereby rezoned from R-lAA to Planned Unit
Development (PUD) with a Land Use Intensity (LUI) of 7 which
intensity is determined to be appropriate under the circumstances
represented to the City in said application and is in conformity
with the Comprehensive Plan of the City of Boynton Beach, Florida.
Section 2. The aforesaid Revised Zoning Map of the City
shall be amended accordingly.
Section 3. That the application of SUMMIT INVESTMENT,
INC. for rezoning of subject tract is hereby granted for the
purpose of permitting the development of said land as a Planned
Unit Development (pun) is specific in accordance with development
'plans and specifications therefore now on file in the office of
the City Planner in the City of Boynton Beach, Florida, and all
requirements, terms and conditions established and set forth in
the minutes of the Municipal Planning and Zoning Board and the
City Council of the City of Boynton Beach pertaining to the review
and approval of said application which minutes are hereby made a
party hereof for reference.
Except as provided herein, the applicant shall proceed in
strict accordance with all ordinances of the City of Boynton

Beach, including, but not limited to, its building, electrical,
plumbing, subdivision, planning and zoning codes, and all rules
and regulations of the State of Florida Department of Environ-
mental Regulation. In satisfaction of the recreation dedication
requirements of the City ordinances, this approval incorporates
a payment by the Developer consistent with City Planning and
Zoning Board approval.
Section 4. That should any section or provision of this
Ordinance or any portion thereof be declared by a Court of com-
petent jurisdiction to be invalid, such decision shall not affect
the remainder of this Ordinance.
Section 5. All ordinances or parts of ordinances in con-

With specific reference to your letter of November 28, 1980,
addressed to Summit Investment Corporation (copy attached)
and the attached Memorandum from Perry A. Cessna, Director
of utilities, enclosed is a copy of the deed dated January 5,
1970, recorded in O. R. B. 1780, pa.ge 237, Palm Beach County
Public Records, wherein Robert J. Rose et a.l. conveyed Lot 11,
Sec. 33, T45S, R43E, Palm Beach County, Florida (now High
Point Sec. 4), and reserved to themselves (grantors) and their
"assigns" (now Summit Investment (Florida) Corp.) as owners of
the adjoining properties (Lot 12, Sec. 33, T45S, R43E) proposed
Bethesda Park "the right to connect on to and thereby extend
into their adjoining properties . . . any water or sewer line
on services installed in the conveyed premises". (Lot 11).
Thus the right and easement to connect to the existing lift
station in High Point does in fact exist and is a matter of
public record.

According to our records the Health Department applications
were signed by Perry on May 6, 1981.
These applications require that construction be started with-
in a 12 month period or that the application be extended
every 12 months or they will expire.
We are requesting that the owner supply copies of valid
permits from the P.B. Co. Health Dept. If the permits
have not been kept current, then the utilities Department
will require that the details of the project meet our
current criteria.
If the permits have been kept up to date, then the criteria
on which they were approved will stand.
please advise if there are any questions regarding this.

Reference is made to my memo of August 27, 1981.
A T.R.B. meeting was held on August 28, 1981 to review the
plans for the subject revised plat.
Comments are as follows:
1. The traffic impact fee is $9,600 as per Charles
Walker's letter of September 16, 1980.
2. A stop sign should be shown at the intersection
with S.W. 23rd Ave.
3. Details for culvert headwall should be added.
4. Dedication should include driveways and drainage
easements.
5. Cost estimate should include quantities of materials
and unit prices. The cost shown for the recreation
room is low.
6. The P. & Z. Board called for a westbound deceleration
lane. No construction is shown for this although
striping is shown as requested by Charles Walker in
his letter of September 16, 1980.
7. The book and page number should be entered for the
offsite utility easement.
8. Condominium documents are to conform with Jim Wolf's
letter of September 10, 1980.
Approval is recommended subject to above.
