These properties are currently undeveloped and zoned ex; (General Cbrrmercial) and AG (Agriculture) in Palm Beach (bunty. In connection with these requests for annexation, the =ers are proposing that the Comprehensive Plan Future Land Use Elsnent be a1IEI1ded to include these properties as Local Retail and that the properties be zoned C-3 (Cbrrmunity Conmercial). It is the =ers' intention that these properties would be developed into a regional mall plus ancillary office, banking, and retail functions. PROCEDURES These applications for annexation, amenclment to the future land use element of the Comprehensive Plan and rezoning are being processed consistent with state statutes, and Boynton Beach rodes, ordinances and resolutions as follows: 1. F.S. 163.3161: Local Gove:rnrnent Comprehensive Planning Act; 2. F.S. 166.041: Procedures for Adoption of Ordinances and Resolutions; 3. F.S. 171.011: Municipal Annexation or Cbntraction Act; 4. Boynton Beach Code of Ordinances, Appendix A, Section 3A5 (e): Boundary and Zoning; 5. Boynton Beach Ordinance #79-24: Adopting the Boynton Beach Ccroprehensive Plan; and, 6. Boynton Beach Resolution #76-X: Procedures for Annexation. These procedures have been tabulated for infonnational purposes and for ease of processing as noted in the attached annexation timetable (See Exhibit 'B'). Paraphrasing the timetable, these requests require review by the City Department Heads, newspaper advertisements, public hearings with the Plarming and Zoning Board and the City (buncil and (buncil adoption of ordinances to annex, amend the future land use element and rezone. Also included is a consistency review by the Board of Cbunty Cbnmissioners. These procedures take approximately three rronths to canplete. REGULAR CITY COUNCIL MEETING July 20, 1982 VII. DEVELOPMENT PLANS: Request to accept applications and for city planner to follow timetable to accomplish appropriate procedures for Annexation, Rezoning, Land Use Amendment 1. Boynton Beach Mall 2. Boynton Beach Mall Peripheral (out parcel #2 & #3) 3. First Federal savings and Loan Association of Lake Worth Office Complex Recei Date Jime (irt. C! ~ ~ - CURRENT LAND USE AND ZONING The properties which are the subject of these annexation requests are =rently undeveloped in Palm Beach County. The current zoning is primarily CG (old limits of mall parcel) and secondarily N;. The mall parcel has been demucked while the remaining parcels have remained uninproved. Concerning traffic inproverrents, the owners of the mall property oontracted with Palm Beach County to pay 1. 7 million dollars as their share of the improvements to widen Congress Avenue and construct intersection inprovernents and necessary signalization. This rroney was matched against the state's contribution ,for MJtorola and resulted in the road inprovernents nON in place. The benefits of these improvements flON to the First Federal tract and the mall out-parcels. With respect to utilities, there =rently exists a 16 inch sewage force main and a 16 inch water main along the entire frontage of these properties on Congress Avenue. The current land use and zoning varies and is presented for your information in the following table. The requirEments of high intensity developrent are, arrong others, the following: 1. availability of public infrastructure such as sewer and water facilities, roads, schools and other governmental functions; 2. availability of large tracta of land in close proximity to the aboVEmentioned infrastructure; and, 3. location not only with respect to the County, Region and State, but also with respect to existing and proposed population concentrations. The Homart-Boynton and First Federal tracts lie in the approximate center of this high intensity developnent area with the properties to the north =ently developed as a trailer park and proposed to be developed as a 1260 unit Plarmed Unit Developnent, the property to the east exhibiting a potential for 734 units at 7 units per acre, the property to the south plarmed for high intensity canmercial or industrial uses and the property to the west developed into a single- fanily residential neighborhood. Based on the intensity of development either existing, developing, proposed or potential in the Congress Avenue oorridor, and the oonsistency of this proposal with both the Palm Beach County and Boynton Beach Corrprehensive Plans, a land use classification of Local Retail and a zoning classification of C-3 are appropriate. CDMPREHENSIVE PIAN POLICIES There are three policies in the Corrprehensive Plan which address armexations as follows: 1. "Armex only property which is reasonably contiguous to present municipal boundaries;" 2. "Armex property only after the preparation of a study evaluating the fiscal benefits of armexation versus the cost of providing service; " 3. "Armex only properties which are of sufficient size to provide efficient service and on which urban developnent is anticipated." In order to determine the oonsistency of the Hanart-Boynton and First Federal armexation requests with the Corrprehensive Plan policies, each of the three policies will be addressed individually. Policy 1 "Armex only property which is reasonably contiguous to present municipal boundaries." The Homart-Boynton tracts are contiguous with the Corporate limits of the City for approxilllately 2,300 linear feet, and when taking into account armexation application~in currently process the contiguity increases to approximately 4670 linear feet. "---/ The First Federal tract is oontiguous with the Corporate limits of the City for approxilllately 600 feet, and when taking into account armexation requests =rently in process, the oontiguity increases to approximately 2,100 feet. Policy 2 "Annex property only after the preF'<TI'ation of a study evaluating the fiscal benefits of annexation versus the oost of providing services. II In response to Policy 2, you will find aCaJIrpanying this merrorandum Exhibit 'c' which compares projected ad valorem taxes with required expenditures. Policy 3 "Annex only properties which are of a sufficient size to provide efficient service and on which urban developnent is anticipated." As stated previously, the combined acreages of the Homart-Boynton and First Federal tracts is 135 Z acres, and, owning to their proxirrate location with respect to municipal se:rvices, should be able to be se:rved efficiently. Furtherrrore, because of the availability of public utilities and in-place road inproverrents these properties will soon experience urban developnent oonsistent wi th the requested zoning. Based on the findings of fact noted in the discussion of the policies as applied to these armexation applications, it is apparent that these requests are consistent with the Comprehensive Plan policies concerned with annexation. RECXlI1MENDATIONS The Planning Deparbnent reoorrrnends that the applications submitted by Homart- Boynton and First Federal Savings and loan Association of lake W::lrth for annexation and future land use amendment and rezoning be approved as requested. These recommendations are based on the following: 1. the parcel is oontiguous to the corporate limits; 2. the parcel is in the path of urban developnent; 3. the request is mnsistent with the Comprehensive Plan policies for annexation; 4. the land use and zoning catagories requested are mnsistent with the land use plans and policies of both Palm Beach County and Boynton Beach; 5. the requested annexation and zoning will not ilTpare the surrounding properties in a manner that will inhibit future developnent; and, 6. the mstjbenefit analysis of this request indicates that the inpact of this proposal on rmmicipal staff and prograns will be limited, and that the taxes realized will offset projected municipal expenses. Annunziato City Planner September 1, 1982 SUBJECT: Departmental Review Forms - Fiscal Impact Analysis Boynton Beach Mall; First Federal; and Out Parcels Attached you will notice a form which will be used by this department for the purpose of evaluation of the Growth Fiscal Impact of planned construction within the City. The multipliers and standards used are taken directly from an evaluat- ion of our currently available reports and records, and are intended to give a close analysis for the establishment of costs. The capacity of the department has a built-in absorption potential by its very nature, but as other; or perhaps even this project is added the capacity to ab- sorb may have reached zero. We will be taking a hard look at this as we proceed through the first fiscal year after its opening. Due to the nature of the function of this dapartment, patrol and response to calls for service, single projects are difficult to project as far as manpower and expenditures go. We gather our statistics on previous time periods. To prog- nosticate without a comparison is not very accurate. Needless to say, the Mall and its out buildings will impact on our department. At this time, an accurate figure as to how much impact is not possible to obtain. Due to the rapid growth and its patterns in our northwest section of the city, a better handle on the situation can be had by considering the entire area under development rather than considering each small piece at a time. Taking this approach, over the next two budget years if construction proceeds as planned in that area, I estimate the need for a minimum of eight patrolmen and two additional patrol cars, to maintain an effective patrol of the area in question. With the increase of activity and the addition of new residents to the area, there will also, more than likely, be the need for two additional Detectives. These estimates do not include special units such as K-9, Traffic or Vice. It has to be assumed also that support services will also grow to keep pace requiring additional clerks and administrative positions. I imagine that our department will grow at the same rate as most of the other city departments. General Background: The total annexation area would involve a commercial area totaling about 135 acres as illustrated on the attached map. Commercially zoned property includes about 104 acres while the balance of 31 acres would be potentiall rezoned from AG to CG. The currently zoned AG parcels are located between Congress Avenue to the east and the large commercial property (De Bartolo Mall) located to the west. Due to the location of these "out-oarcels", commercial uses would be appropriate. . Existing Traffic: Congress Avenue's current (1981 annual count) traffic situation is summarized below: Existing Traffic: Total Background Traffic: Sub-Total: Existing Deficiency 8,984 ADT .22,000 ADT 30,984 27,600 ADT 3,384 ADT Four Lane Capacity at Level of Service "D" Potential Traffic From Out-Parcels: The projected traffic generation from the De Bartolo Mall and the Motorola Corporation are included in the background traffic projection indicated above. Making the assumption that only 20% of the 31 acres of land is available fc actual building construction, the total acreage could accommodate about 270,000 square feet of office/commercial uses. Based on a discussion with Jim Zook Kimley-Horn & Associates, a general traffic generation rate of 60 trips per 1,000 square feet would be reasonable. Petitioner submits this Petition for Voluntary Annexation with the understanding that it shall be specifically contingent upon the following conditions: a. Rezoning of those portions of the Property now zoned Agriculture to Community Commercial, Category C-3. b. Adoption of a resolution by the County Commission of Palm Beach County consenting to the rezoning of the Property and including a finding of consistency with the Palm Beach County Comprehensive Plan. c. Agreement by the City to adopt the necessary approva~s by the City to permit development of the Property for any commercial use permitted in zoning Category C-3. d. Agreement by the City that no traffic improvements other than those that are the obligation of the Developer as set forth in the Agreement attached hereto as Exhibit "B" will be required to permit development of the Property in accordance with the provisions of Paragraph 3 c of this Petition. 4. In return for the acceptance by the City of Boynton Beach of the Petition for Voluntary Annexation, Petitioner agrees to have provided the improvements as set forth in the Agreement attached hereto as Exhibit "B". 5. Petitioner reserves the right to withdraw or to modify this Petition (i~cluding exhibits) for Voluntary Annexation at any time prior to enactment of the ordinance required by Chapter 171.044(2), Florida Statutes, annexing the Property. 6. Agreement that rezoning, land use amendment, etc., will be processed concurrently with this petition, so that final approval of all of these matters by the Boynton Beach City Council (the "Council") will occur at the same meeting at which final approval by the Council of the annexation occurs.
