Cheney, City Manager FROM: Tom Clark, City Engineer Re: Final Plat, C&H Plat No.1 (Meadows 300) The Technical Review Board has reviewed the final plat and development plans for the subject project and approval is recommended subject to the following: 1. No underground garbage cans will be permitted. 2. Acceptable Home Owner's documents (being reviewed by Jim Vance). 3. Revisions on the plat documents as required for the dedication of the recreation areas as previously approved. 4. A satisfactory bond for the improvements in the amount of $1,523,268.00. 5. Deeds for the 10-ft. right of way for Congress and Hypoluxo Road as per the commitment for approval of the Master Plan. One set of prints of the final plat is included herewith. The mylar originals of the plat are presently in the possession of the Design Engineer (and Land Surveyor), Dan Carnahan, where a change in the name is being made along with the corrections to the dedication. If a resolution is prepared at this time I recommend it be subject to items 1 through 5 as listed above. .,. The cost esti- mate for improvements submitted with said letter has been reviewed and found to be satisfactory at this time. I would like to advise, however, that as stipulated for the pre- liminary plat approval (see letter of Sept. 24, 1979 from the City Planner to Mr. Carnahan), Parcels B, C, and D dedicated for private recreation purposes shall reflect specific recreation facilities to be provided as described in subdivision regulations and such facilities shall be bonded for an amount equal to 110 per cent of the estimated cost. Consistent with the above requirements it is requested that the plans show and/or itemize the said specific recreation facilities that are planned. You indicated to me that this may not be possible because the ordinance states that the land development permit shall be issued in conjunction with formal approval of the final plat by the city council. We filed the final plat with Tom Clark today. I would appreciate it if you would check with your city attorney and city engineer to see if at least an earthwork permit could be issued. even if it was by special action by council. As you knO\>T. we have been working for over a yea:r to try to reach a master water and sewer agreement for the a:rea. The pieces seem to be coming together now on this agreement and economics dictate that my client moves quickly on the project to be able to justify the consid- erable oapital outlay. especially at today's interest rates. As noted in Mr. Carnahan's letter, the zoning to PUD for the Meadow's 300 development was approved on 11/8/78. In the fall of 1979, the developer commenced platting procedures by filing a Preliminary Plat with the City. Said preliminary plat was approved by the City Council on 11/21/79. The developer's final plat is awaiting a developer's agreement for sewer and water service to his property. Therefore, in answer to Mr. Carnahan's questions (letter attached) I interpret the ordinances as follows: l. mitted and the zoning as long Preliminary and Final development plans were sub- procedure has been comenced. Dear Mr. Cheney: I have been in contact with Carmen Annunziato, your city planner regarding my client's concern about the possibility of the time limit expirin~ on his P.U.D. zoning, especially in light of the unavailib~lity of potable water sUDolv and sanitary sewage'''disposal at th~s t:ime. Our p.U.D. zoning was approved, I believe, November 8, 1978 and,~accordin~ to your city oridnance (Sec. 31-1, Page 420.l0~ the prelim~nary development plan and final development plan must be com- menced within 18 months (by May 8, 1980) to preserve the zoning. Several months ago we had:nur final preliminary plat approved and are ready to submit for final approval and recordation when the water and sewer agreement is fin- alized. I would like, if possible, to secure the following: 1. Your confirmation that we have indeed commenced the preliminary and final development plan. 2. A one year extension on the 18 month time limit if you feel this is necessary to protect our zoning. In light of the above (1), it would not seem necessary, but most everyone appears con- fused on this point and I undersstan& that Lennar Cor~oration has obtained such an extension on theu P.U.D. No person shall excavate or remove the topsoil or sub- soil from any lands. within the corporate limits of the city so as to create or cause to exist an excavation pit or de- pression therein or thereupon, or cause the topopraphicaI level of such lands to be lowered without first having pro- cured a permit so to do, as is hereinafter provided. COrd. No. 198, 8-7-46) Sec. 10-2. Sam_Abandonment of work, violation of permit, cancellation. In case or in the event any person to whom a permit as provided for in section 10-3 has been granted shall abandon such work so authorized and permitted, or should such per- son attempt to excavate to a level of greater depth, or re- move a greater amount of soil than is shown by such appli- cation and permit the city council shall be authorized to cancel the permit so granted and to direct, within the time so fixed by it, the fill and refill of such excavation pits and depressions, and the restoration of such premises to the topographical level so fixed by it, as fully and completely in 'I each instance as though such work had been completed in accord with the permit so granted. Any person desiring to exca va te or remove any topsoil , or subsoil from any lands within the corporate limits of the city shall file a written application with the city council and therein set forth the description of the lands from which he desires to remove such soil, the approximate amount of soil to be removed, and the depth to which he desires to excavate upon such lands. \: ( 179 ~ 10,3 , BOYNTON BEACH CODE ~ 10c4 Upon the filing of such application, the city council shall fix a reasonable level commensurate with the topographic level ,of lands adjacent to and 'surrounding the lands upon which such excavation is sought to be made, to which it will require such lands to be filled when such excavation has been completed, and shall also fix a reasonable time within which it will require such fill to be made, and shall likewise fix the amount 01 the performance bond that it will require from such applicant. Upon an applicant's entering into a contract with the city to make such fill, or refill, within the time, to the topo- graphic level so prescribed by the city council, and upon the applicant's further entering into a good and sufficient performance bond, in an amount and with sureties to be approved by the city council for the faithful performance of such contract by the applicant, the city council shall 'issue such permit for such excavation and removal of soil. It shall be unlawful for any person to excavate or remove earth from any street or alley or within twenty feet of the side line or curb of a!1Y designated 'street or alley within the city limits without first getting a permit from the city clerk.
