Review under this section is initiated by filing a request for review with the Land and Water Adjudicatory Commission and serving a copy on the Department of Environmental Regulation and any person named in the Order within 20 days after rendering of the District's Order, However. when the order to be reviewed has statewide or regional significance, as detarmined by the Land and Water Adjudicatory Commission within 60 days after receipt of a request for review, the commission may accept a request for reviaw from any affected person within 30 days after the rendaring of the order. Review under section 373. I 14, Florida Statutes, is limited solely to a determination of consistency with the provisions and purposes of Chaptar 373, Florida Statutes, This review is appellate in nature and limited to the record beiow. 5. A party who is adversely affected by final agency action on the permit application is entitled to judicial review in the District Court of Appeal pursuantto section 120.68, Florida Statutes, as provided therein. Review under section 120,68, Florida Statutes in the District Court of Appeal is initiated by filing a petition in the appropriate District Court of Appeal in accordance with Florida rule of appellate Procedure 9.110. The Notice of Appeal must be filed within 30 deys of the final agency action, 6. Section 373.617(2). Florida Statutes, provides: Any person substantially affected by a final action of any agency with respect to a permit may seek review within 90 days of the rendering of such decision and request monetary damages and other relief in the circuit court in the judicial circuit in which the affected property is located; however. circuit court review shall be confined solely to determining whether final agency action is an unreasonable exercise of the state's police power constituting a taking without just compensation. Review of final agency action for the purpose of determining whether the action is in accordance with existing statutes or rules and based on component substantial evidence shall proceed in accordance with Chapter 120. 7. Please be advised that exhaustion of administrative remedies is generally a prerequisite to appeal to the District Court of Appeal or the seeking of Circuit Court review of final agency action by the District on the permit application. The developer has a current site plan approval dated January 21, 1986 for Chalet IV (plats 3 & 4), a reduced xerox copy of which I have also enclosed for your review. After discussions with Urban Design Studio and the owner of the property (Chalet IV Corporation - Jack Armarnik) the eight foot (8') required bike path was relocated to the northern side of the loop roadway and was subsequently designed and landscaped in accordance with the approved plat and construction drawings submitted to Boynton Beach. This relocation was endorsed so as to better serve these initial phases of development with adjacent pedestrian access along the loop road and to adequately provide for Phase I and II residents. As stated earlier, the developer is requesting for clarification regarding the sidewalk and landscaping requirements opposite his project along the western and southerly sides of the loop road. There appears to be considerable confusion regarding the required time of installation and who is responsible for these require- ments. Our client's understanding was that his obligation was limited to that portion of the roadway adjacent to his development and that the opposite side would be landscaped along with a five foot (5') sidewalk provided as the future development parcels were submitted and approved during the review process. Unfortunately, at the present time, we are a little more than apprehensive as to whether we wish to remain herel We feel that our safety, as well as the safety of the other residents and any guests is in jeopardy beoause of the deplor- able lighting conditions within the development as well as along Oongress Avenue. The darkness within the development is appallingl. A person literally takes his life into his own hands when he or she attempts to go to the mailboxes at night. Itis so dark inside the development that you oan't even see the numbers on the.mailboxes, let alone even try to get your key into the slot to get the mail out, all the time keefing a watchful eye over your shoulder to make sure that there s no one lurking in the darkness. We ~ to enjoy taking a walk after our evening meal; that ie now out of the question due to all of the recent assaults, rapes, and attemp,ted rapes within the Sandalwood development and the surrounding areas. We are literally prisoners in our own homes because we are fearful of going out into the place where we live in the evening hours. Having been a resident of the City of Boynton Beaoh for the past 3e years, and a retired member of the Oity of Boynton Beach Fire Department (22 years of service), we feel that we are entitled to live safely in our home and to be able to enjoy the surrounding community without fearing for our safety. If an emergency were to occur, such as a Pire or First Aid Call, it would be very difficult for the responding vehicle(s) to find their way into the development at night because of the substandard lighting conditions. In addition to the poor lighting, the landscaping has obscured the numbers on the buildings whioh would bs sssential to the responding agency in the event of an emergency. We happen to know from personal experience that the City of Boynton Beaoh Polioe Department (1) didn't even know where Sandalwood of Boynton was, and (2) they had to be given explicit direo- tions on how to get to the building in the darkness. Many a t1me in the even1ng, we have driven right past the entrance to the development because we couldn't see the entrance road. And when we finally get into the development, unless you happen to know where you're going, you could get lost in a heartbeat. It seems hard to believe that the 01ty of Boynton Beach Zoning Department would allow the construction of a facility for residential purposes which does nothing to promote the health safety and welfare of the future inhabitants and the future guests to the area. Surely there is some manner in wh1ch the Oity and its development personnel can "convince" the develop- er that it would be in his best interests and the interests of those who have purchased homes to provide adequate light- ing which will be suff1cient to light the streets and parking areas of an otherwise dark, unlit area of town. As taxpayers of thie Oity for the past 30 years, we feel that we are jus- tified in demand1ng that someth1ng be done to afford the res1- dents of Sandalwood safety 1n their homesl Unfortunately, we w1ll not be in town for the next C1ty Oounoil meet1ng; henoe we make our appeal to you in writ1ng. Please be assured that if we were to be in town, we would eurely present our case before. the City Council in person. More specifically I am referring to the following additions: l) All haul roads will be constructed with rock, and a sprinkler truck will be available for dust control; 2} Two (2) fences shall be installed along Congress Avenue and Miner Road (proposed) to trap blowing sand; 3} The developer will limit construction to only those areas necessary to perform excavation and fill functions. Also enclosed is one (1) copy of the earthwork site restoration estimate, (1) copy of the excavation plan, (1) copy of the earthwork profiles and (1) copy of the paving and drainage for plats 1 and 2.. Our client purchased Phase I of the Melear Property as set forth in the Melear Property Conceptual Plan as prepared by Gee & Jensen, a copy of which is enclosed for your easy reference. The Melear family owns the land comprising the remaining four Phases of the Melear Property. As part of the prerequisites for the recording of the above Plat, the City of Boynton Beach has requested that a l1aster Homeowners Association for the entire Melear Property be formed to administer the 1.8 acre recreational area and 1.2 acre recreational area in Phase I and Phase II respectively of the Melear Property. Due to the fact that our client and the Melears have different objectives with respect to the land and the development thereof, we are having some difficulty in agreeing upon the rights and responsibilities of the Master Homeowners Association. Rather than create a Master Homeowners Association, both our client and the Melears would rather execute and record a Covenant which binds and burdens the respective parcels and which would provide substantially as follows: 1. Chalet IV corporation would be responsible for building the 1.8 acre recreational facility to be constructed in Phase I. James W. Vance, Esq. July 23, 1985 Page - 2 - Upon completion of this recreational area it will be conveyed to and thereafter maintained by the Chalet IV Homeowners Association. The Chalet IV Homeowners Association has or will be formed to administer all of the property owned by Chalet IV (i.e., Phase I of the Melear Property). 2. If and when Phase II of the Melear Property is developed the owners of the Melear Property will construct the recreational area to be located in Phase II. Upon completion thereof this recreational facili ty will be conveyed to and thereafter maintained by the Homeowners Association which would administer Phase II of the Melear Property. 3. All of the homeowners in Phase I of the Melear Property will have the non-exclusive right to use the Phase II recreational area in common with the homeowners in Phases II, III and IV on a non-discriminatory basis. 4. All of the homeowners in Phases II, III and IV will have the non-exclusive right to use the Phase I recreational area in common with the homeowners of Phase I, on a non-discriminatory basis. We believe that such a covenant will ensure that the intent of the County of Palm Beach and City of Boynton Beach is served with respect to the mutual useage of the recreational facilities for all of the homeowners in the Melear Property. If the foregoing is acceptable please advise us and we will prepare such a Covenant for your review and comments. However, the impression given by Mr. Armarnik is that he is committed to the improvement, regardless of the bond value. Mr. Wantman reported that the plans for Phase 2 of the Miner Road construction project were 30% complete and that plans should be sUbstantially complete in three weeks. In conclusion, I suggested to Messrs.
