NOTICE OF RIGHTS
ThiS Notice of Rights is intended to inform the recipient of the administrative and judicial review which may be available as
man'dated by section 120,60(3), Florida Statutes. Be advised that although this notice is intended to be comprehenSive, the review
proGedures set forth herein have been the subject of judicial construction and interpretation which may affect the administrative of
judicial review available. Recipients are therefore advised to become familiar with Chapters 120 and 373, Florida Statutes, and the
judicial interpretation of the provisions of these chapters. .

If a substantially affected person objects to the staff's recommendation, that person has the right to request an administrative
hearing on the proposed agency action. The substantially affected person may request either a formal or an Informal hearing.

A request for informal hearing shall be considered as a waiver of the right to request a formal section 120.57(1), F,S., hearing. A
request for a section 120.57(1). F.S., formal hearing not in substantial compliance with the provisions of rule 40E-l .521, FAC..
may be considered by the District as a request for informal hearing. If a petition for administrative hearing is not timely filed. the
staff's proposed agency action will automatically mature into final agency action.

Pursuant to section 373. I 14, Florida Statutes. a party to the proceeding below may seek review of a Final Orderrendered on the
permit application before the Land and Water Adjudicatory Commission. as provided therein. Review under this section is
initiated by filing a request for review with the Land and Water Adjudicatory Commission and serving a copy on the Department
of Environmental Regulation and any person named in the Order within 20 days after rendering of the District's Order,
However. when the order to be reviewed has statewide or regional significance, as detarmined by the Land and Water
Adjudicatory Commission within 60 days after receipt of a request for review, the commission may accept a request for reviaw
from any affected person within 30 days after the rendaring of the order. Review under section 373. I 14, Florida Statutes, is
limited solely to a determination of consistency with the provisions and purposes of Chaptar 373, Florida Statutes, This review
is appellate in nature and limited to the record beiow.

A party who is adversely affected by final agency action on the permit application is entitled to judicial review in the District
Court of Appeal pursuantto section 120.68, Florida Statutes, as provided therein. Review under section 120,68, Florida Statutes
in the District Court of Appeal is initiated by filing a petition in the appropriate District Court of Appeal in accordance with
Florida rule of appellate Procedure 9.110. The Notice of Appeal must be filed within 30 deys of the final agency action,

Section 373.617(2). Florida Statutes, provides:
Any person substantially affected by a final action of any agency with respect to a permit may seek review
within 90 days of the rendering of such decision and request monetary damages and other relief in the circuit court
in the judicial circuit in which the affected property is located; however. circuit court review shall be confined
solely to determining whether final agency action is an unreasonable exercise of the state's police power
constituting a taking without just compensation. Review of final agency action for the purpose of determining
whether the action is in accordance with existing statutes or rules and based on component substantial evidence
shall proceed in accordance with Chapter 120.

Please be advised that exhaustion of administrative remedies is generally a prerequisite to appeal to the District Court of
Appeal or the seeking of Circuit Court review of final agency action by the District on the permit application. There are,
however, exceptions to the exhaustion requirement, The appiicant is advised to consult the case law as to the requirements of
exhaustion exceptions.

40E-1.521 Initiation of Formal Proceedings.
(1) Initiation of formal proceedings shall be made by petition to the District. The term petition as used herein includes any
application or other document which expresses a request for formal proceedings. Each petition should be printed. typewritten or
otherwise dupiicated In legible form on white paper or standard legal size. Unless printed, the impression shall be on one side of the
paper only and lines shall be double-spaced and indented,
(2) All petitions filed under these rules shall contain:
(a) The name and address of the District and the District's file or identification number, if known;
(b) The name and address of the petitioner or petitioners;
(c) An explanation of how each petitioner's substantial interests will be affected by the District's determination:
(d) A statement of when and how petitioner received notice of the District's decision or intent to render a decision:
(e) A statement of all disputed issues of material fact. 'If ihere are none,.ihe peti~on must so indicate;
(f) A concise statement of the ultimate facts which petitioner believes entitle petitioner to the relief sought as well as the
rules and statutes which support petitioner's claim for relief;
(g) A demand for the relief to which the petitioner deems himself entitled; and
(h) Other information which the petitioner contends is material.

(3) Upon receipt of a petition for formal proceedings. the District shall review the petition for the degree of compliance with
subsection (2) and shall accept those petitions in substantial compliance therewith which have been timely filed and which state a
dispute which is within the jurisdiction of the District to resolve. If accepted. the District shall designate the presiding officer, The
District shall promptly give written notice to all parties of the action taken on the petition. and shall state with particularity its
reasons therefor.
(4) If the District designates a Hearing Officer assigned by the Division of Administrative Hearingsas the presiding officer, the
District Clerk shall forward the petition and all materials filed with the District to the Division of Administrative Hearings, and shall
notify all parties of its action.

attached application letter. I would appreciate if you would bring
this postponement request to the P1annning and Zoning Board's

Dear Carmen:
The developer of Sandalwood at Boynton is requesting
clarification of requirements regarding landscaping and
pedestrian access along the above project's internal 80' loop
roadway. You will note on the enclosed exhibit, this particular
roadway splits the Melear P.U.D. by connecting Miner Road on the
parcel's north with Congress Avenue on the parcel's easterly
property line. The developer has a current site plan approval
dated January 21, 1986 for Chalet IV (plats 3 & 4), a reduced
xerox copy of which I have also enclosed for your review. After
discussions with Urban Design Studio and the owner of the
property (Chalet IV Corporation - Jack Armarnik) the eight foot
(8') required bike path was relocated to the northern side of the
loop roadway and was subsequently designed and landscaped in
accordance with the approved plat and construction drawings
submitted to Boynton Beach. This relocation was endorsed so as
to better serve these initial phases of development with adjacent
pedestrian access along the loop road and to adequately provide
for Phase I and II residents.
As stated earlier, the developer is requesting for clarification
regarding the sidewalk and landscaping requirements opposite his
project along the western and southerly sides of the loop road.
There appears to be considerable confusion regarding the required
time of installation and who is responsible for these require-
ments. Our client's understanding was that his obligation was
limited to that portion of the roadway adjacent to his
development and that the opposite side would be landscaped along
with a five foot (5') sidewalk provided as the future development
parcels were submitted and approved during the review process.

Reference is made to the revised plans (dated May 20, 1987)
for the subject project.
I have reviewed the plans and a turn lane has been added at
the intersection with Congress Avenue.
Predicated on our recent telephone conversation that the pro-
posed construction is acceptable to the County, the said plans
are also acceptable to the City of Boynton Beach and we have
no objection to the County issuing the required permits for
construction.
I recommend that a Pre-construction conference be scheduled
prior to construction. Please advise when this is scheduled
since representatives from the City may like to attend.

error of the two above mentioned Plats at Boynton Lakes. We
have revised the two plats so as to correct the overlap-
encroachment. In the interest of time, and so that the City
Departments will know of our revision, and the process of
correcting said problem, we would like to request a meeting
with the City Manager (or Assistant), City Attorney and any
other departments that you feel necessary. Your assistance

Dear Mayor:
My wife and I are residents of Sandalwood of Boynton,
Phase One. Unfortunately, at the present time, we are a little
more than apprehensive as to whether we wish to remain herel
We feel that our safety, as well as the safety of the other
residents and any guests is in jeopardy beoause of the deplor-
able lighting conditions within the development as well as
along Oongress Avenue.
The darkness within the development is appallingl. A
person literally takes his life into his own hands when he or
she attempts to go to the mailboxes at night. Itis so dark
inside the development that you oan't even see the numbers on
the.mailboxes, let alone even try to get your key into the
slot to get the mail out, all the time keefing a watchful eye
over your shoulder to make sure that there s no one lurking
in the darkness. We ~ to enjoy taking a walk after our
evening meal; that ie now out of the question due to all of
the recent assaults, rapes, and attemp,ted rapes within the
Sandalwood development and the surrounding areas. We are
literally prisoners in our own homes because we are fearful
of going out into the place where we live in the evening
hours.
Having been a resident of the City of Boynton Beaoh
for the past 3e years, and a retired member of the Oity of
Boynton Beach Fire Department (22 years of service), we
feel that we are entitled to live safely in our home and to
be able to enjoy the surrounding community without fearing
for our safety. If an emergency were to occur, such as a
Pire or First Aid Call, it would be very difficult for the
responding vehicle(s) to find their way into the development
at night because of the substandard lighting conditions. In
addition to the poor lighting, the landscaping has obscured
the numbers on the buildings whioh would bs sssential to the
responding agency in the event of an emergency. We happen
to know from personal experience that the City of Boynton
Beaoh Polioe Department (1) didn't even know where Sandalwood
of Boynton was, and (2) they had to be given explicit direo-
tions on how to get to the building in the darkness. Something
has to be done to afford the residents of Sandalwood soms
feeling of safety and well-being in their community I

To emphasize a p01nt, 1t seeme that someone "m1ssed the
boat" when it came to the lighting requirements for both the
Sandalwood development and Oongress Avenue. Many a t1me in
the even1ng, we have driven right past the entrance to the
development because we couldn't see the entrance road. And
when we finally get into the development, unless you happen
to know where you're going, you could get lost in a heartbeat.
It seems hard to believe that the 01ty of Boynton Beach Zoning
Department would allow the construction of a facility for
residential purposes which does nothing to promote the health
safety and welfare of the future inhabitants and the future
guests to the area. Surely there is some manner in wh1ch the
Oity and its development personnel can "convince" the develop-
er that it would be in his best interests and the interests
of those who have purchased homes to provide adequate light-
ing which will be suff1cient to light the streets and parking
areas of an otherwise dark, unlit area of town. As taxpayers
of thie Oity for the past 30 years, we feel that we are jus-
tified in demand1ng that someth1ng be done to afford the res1-
dents of Sandalwood safety 1n their homesl
Unfortunately, we w1ll not be in town for the next
C1ty Oounoil meet1ng; henoe we make our appeal to you in
writ1ng. Please be assured that if we were to be in town,
we would eurely present our case before. the City Council in
person. Please - 1t 1s absolutely necessary that some add1-
tional form of l1ghting be 1nstalled in the Sandalwood dsvel-
opment to promote the safety and general welfare of the resi-
dents. What type of devastating crime has to occur before the
Oity of Boynton Beach takes aff1rmat1ve action?1

Reference is made to your letter of March 5, 1987 requesting
approval of the subject plans in response to my letter of
March 2~ 1987 addres$e~ to Michael L. Kirk.

The revised plans have addressed my concern withthe_.deuails
of construction; ie., items 2,3 & 4 of my above said letter of
March 2, 1987.
Subject to the approval of Palm Beach County, the plans will be
acceptable to the City when the following items (Nos. 1,5' & 6
of my March 2, 1987 letter) are included in said plans.
1. Street lighting for Miner Road with plans and installation
by Florida Power & Light Company and cost paid for by the
Developer. This is standard operating procedure for all
developments. An appropriate note on the plans referencing
F.P. & L. Co. lighting plans and the commitment from the
developer is requested.
2. Plans should be submitted to show the additional construc-
tion of Miner Road extending to the west limits of the
Melear property as shown on the Master Plan. This con-
struction is bonded and should be completed within 21
months from the Land Development Permit date of January
9, 1987, ie., October 9, 1987. This time frame is im-
portant so that the existing 16 inch water transmission
line can be maintained from the new roadway and will also
provide access to the ground storage tank to be constructed.
And the roadway is needed to serve the property to the west
that is b~ing annexed. .

3. A left turn storage lane on Miner Road will be required
at Miner Road and Congress Avenue. This should be in-
cluded in the proposed construction and will serve the
Chalet IV property and also the fire apparatus from the
soon to be constructed Fi~e Station on the City parcel.
The improvements shown in c'o~gress Avenue as " By Others
when Miner Road is built to the ultimate section" are
related to the direct 'impact of the Chalet IV traffic.
and should be considered to mitigate the cost to the
Developer for the left turn lane requested.

In accordance with the Technical Review Board comments which
accompanied preliminary plat approval for Chalet IV - Plats 3 and
4, we have revised the plan sheets of the construction drawings
(job number 85110-0, dated November, 1985, revised February 12,
1986) and the plat documents to address the following:

A. ENGINEERING DEPARTMENT
1. Blank spaces in the dedication have been filled in on the
plat documents.
2. The utility easements for City water and sewer lines have
been dedicated to the City on the plat documents.
3. The location map for Plat 3 has been corrected.

In response to your letter of May 13th, 1985 please find enclosed
one (1) copy of the revised excavation report which incorporates
the suggested additions. More specifically I am referring to the
following additions:
l) All haul roads will be constructed with rock, and a
sprinkler truck will be available for dust control;
2} Two (2) fences shall be installed along Congress Avenue
and Miner Road (proposed) to trap blowing sand;
3} The developer will limit construction to only those
areas necessary to perform excavation and fill
functions.
Also enclosed is one (1) copy of the earthwork site restoration
estimate, (1) copy of the excavation plan, (1) copy of the
earthwork profiles and (1) copy of the paving and drainage for
plats 1 and 2..
A restoration bond in the amount of $30,000 will be sent under
separate cover shortly.
It is my understanding that once this information is received by
your office the procedure for Council approval will be resumed.
If at all possible this application should be reviewed by Council
at the next meeting date of August 6th, 1985.

Palm Beach County, Florida
Dear Mr. Vance:
As I explained to you during our telephone conversation, our
firm represents Chalet IV Corporation with respect to the above
property. Our client purchased Phase I of the Melear Property as
set forth in the Melear Property Conceptual Plan as prepared by
Gee & Jensen, a copy of which is enclosed for your easy reference.
The Melear family owns the land comprising the remaining four
Phases of the Melear Property.
As part of the prerequisites for the recording of the above
Plat, the City of Boynton Beach has requested that a l1aster
Homeowners Association for the entire Melear Property be formed to
administer the 1.8 acre recreational area and 1.2 acre
recreational area in Phase I and Phase II respectively of the
Melear Property. Due to the fact that our client and the Melears
have different objectives with respect to the land and the
development thereof, we are having some difficulty in agreeing
upon the rights and responsibilities of the Master Homeowners
Association.
Rather than create a Master Homeowners Association, both our
client and the Melears would rather execute and record a Covenant
which binds and burdens the respective parcels and which would
provide substantially as follows:
1. Chalet IV corporation would be responsible for building
the 1.8 acre recreational facility to be constructed in Phase I.

Upon completion of this recreational area it will be conveyed to
and thereafter maintained by the Chalet IV Homeowners Association.
The Chalet IV Homeowners Association has or will be formed to
administer all of the property owned by Chalet IV (i.e., Phase I
of the Melear Property).
2. If and when Phase II of the Melear Property is developed
the owners of the Melear Property will construct the recreational
area to be located in Phase II. Upon completion thereof this
recreational facili ty will be conveyed to and thereafter
maintained by the Homeowners Association which would administer
Phase II of the Melear Property.
3. All of the homeowners in Phase I of the Melear Property
will have the non-exclusive right to use the Phase II recreational
area in common with the homeowners in Phases II, III and IV on a
non-discriminatory basis.
4. All of the homeowners in Phases II, III and IV will have
the non-exclusive right to use the Phase I recreational area in
common with the homeowners of Phase I, on a non-discriminatory
basis.
We believe that such a covenant will ensure that the intent
of the County of Palm Beach and City of Boynton Beach is served
with respect to the mutual useage of the recreational facilities
for all of the homeowners in the Melear Property.
If the foregoing is acceptable please advise us and we will
prepare such a Covenant for your review and comments.

In this regard, Mr. Wantman reported that his estimate of
$54,000+ was based on a different level of construction that what
will be-permitted. However, the impression given by Mr. Armarnik
is that he is committed to the improvement, regardless of the
bond value. Mr. Wantman reported that the plans for Phase 2 of
the Miner Road construction project were 30% complete and that
plans should be sUbstantially complete in three weeks.
In conclusion, I suggested to Messrs. Armarnik and Wantman that
it was unlikely that the City would release or reduce bonds which
remain until such time as the landscaping, sidewalks, and Miner
Road issues have been resolved.
