RE: NEWPORT PLACE AND QUESTIONS FROM RON
AYLAR REGARDING ADDED FACILITY:
This is just a reminder that we need to
respond to Mr. Aylar's request regarding
the expansion of Newport Place.
If my memory is accurate, his request
specifically relates to these four
issues/subjects: density (what is his
limit and how is it calculated), parking
(current facilities should meet needs of
potential expansion?), traffic study (what
capacity exists and would a new study be
needed), and LUI (how is this calculated
and does it affect the proposal?).
If I could have responded to these
requests for us I would havej however,
following our first meeting I spent
considerable time attempting to figure out
how the density could be calculated, and
am unc.ertaiu_
One methodology, using entire PUD
(acreage), is 22.06 * 4.84= 106 (units)'
*2.3 (conversion) = 244 (beds). Given the
number of I, 2, and 3-bedroom units, their
are 356 beds in the Newport Place ACLF'.
No documentation exists from original. . ,
calculation.
If the lack of time precludes a meeting,..
between the three of us, perhaps you may
have direction/information for me to test
or use in the. interim. Let me know.

REOUIRED INSPECTIONS
After permits have been applied for, the Field Inspection
division requests a status check field inspection of the
buildings and structures be conducted prior to the issuance of
any building permits.
The purpose of this inspection would be to ascertain if any
damage has occurred since this project was abandoned. This
status check will be performed by appointment after the owner has
made application for permit. It would also be requested that the
owner have the building completely open and supply all necessary
lighting, ladders, and necessary access to the roof and rooms.
All permits require inspections in order to final permits
and issue a Certificate of Occupancy.
Current codes in effect are the standard Building, Plumbing,
Mechanical, Gas Codes - 1991 Edition as amended, and the 1990
National Electrical Code. All new construction must comply with
these codes.

The entrance roadway is generally acceptable, with the following comments noted:
1. Provide swale elevations to assure positive drainage along NW 7th Court.
2. Provide alignment of existing roads along High Ridge Road (east side) to check
for conflicts in alignment with proposed entry.
3. Provide topographic information on lots 7 & 8 and along High Ridge Road north
to determine drainage direction of existing properties. Provide calculations and
drainage basin map.
4. Provide traffic count data to determine advisability of a traffic signal at High Ridge
Road and entrance road, or possible turn lane requirements.
5. 8 ft. stabilized shoulder should be reduced to 5 ft. width maximum.
6. Increase lane widths in entrance road to 11 ft. Detail is provided for 6' flush
header curb, but it is not called out on the typical section. Why is it only provided
at SW 7th and not at High Ridge Road?
7. Provide traffic striping plan including sign locations.
8. Provide updated SFWMD permit allowing this roadway to drain through the existing
development.
9. Asphalt section requirements (appendix C, Art X, Section 1 a.F) requires 1 %" of
type II and 8" of base, and a FBV of 75. Commercial subdivision entrances must'

form you requested that it should be more formally presented for further review by the City.

revised paving and parking. You will note that no revised grading has yet been added, this will
be done if and when you can tell me that the new layout is acceptable.
We are proposing to take out the existing parking lot on the south side of the buildings so as not
to increase our impermeable runoff area, please see revised Land Use Table that in fact
demonstrates that the revised percentage of impervious is less than the permitted by 1 % (these
figures were double checked).
,Please inform me as soon as you can as to the acceptability of the new parking layout so my
client, Mr. Gibson and Mr. Clifton, can proceed forward with their closing documents. Needless
to say it is of the utmost importance to them to have a more practical parking layout like the one
proposed to ease ingress and egress for the residents_
It is hoped that the parking layout if approved can be considered an administrative approval as
to avoid the site plan review process.
Incidently the landscaping for the parking will be designed and installed per the current landscape
code_

In response to you letter of March 25, 1993 regarding confirmation
of information regarding stanford Park, I offer the following:
1. stanford Park is zoned Planning Unit Development, P. U. D. ;
2. The current comprehensive plan designation for stanford
Park is Low Density Residential;
3.
The 220 unit adult congregate
permitted and is consistent
comprehensive plan;
living facility
with the zoning

4. The P.U.D. zoning is consistent with the comprehensive
plan;
5. The master site plan dated April 25, 1988 is the current
approved master plan and that the plan complies with the
setbacks;
6. stanford Park is an A(19) project and is exempt from
meeting all levels of service standards;
7. The modifications to the approved plans relating to
parking, on-site traffic circulation, access onto High
Ridge Road and walkways between buildings are not
substantial changes and do not require amendment to the
P.U.D. zoning or a public hearing before the City
Commission and that these changes will be reviewed
administratively;

8. 42 parking spaces can be added to the approved plan
raising the total number of spaces to 210. In addition,
this is not a substantial change that would require a
P.U.D. zoning review or a public hearing before the City
commission;
9. If Lots 7 and 8 of the High Ridge Subdivision are
acquired and annexed into the City and zoned RlAA (single
family residential) they can be used for a road providing
access from Stanford Park to High Ridge Road without an
amendment to the P.U.D. and City Commission approval;
10. If a portion of tract 3 of the P.U.D. is purchased to
obtain an access to Hypoluxo Road, a new plat will'not be
required.
I must add a disclaimer to 7, 8, 9 and 10. Confirmation of #7 and
#8 are based on my preliminary reviews of very rough drawings done.

drawings are submitted to us and reviewed.
Confirmation of #9 is based on the fact that the City Commission
will have on opportunity to review a plan as part of the land use
.amendment and zoning process.
Confirmation of #10 is for submission of a full plat. A waiver of
platting, as indicated by Appendix C, City Code of Ordinances, may
be needed.
Let me assure you, however, that despite my disclaimers that even
if modifications of the master plan and waiver of plat were to be
required that they could be blended into the land use plan
amendment and zoning process assuming that we receive the necessary
documentation by April 16, 1993.

stanford Park was approved together with the rest of the stanford

renderings for all buildings (City Commission approved them on
May 17, 1988).
We would like to know the changes yeu are pla~niLg to ~o with
this building and how they would affect the previously approved
color rendering to determine whether these changes warrant
another City Commissinn approval. If it is determined that the

Ridge Subdivision) are acquired, annexed into the
City, and assigned an appropriate City single
family residential zoning district (Le. RIAA),
the lots can be used for a road providing access
from Stanford Park to High Ridge Road wi thout
requiring an amendment to the P.U.D. zoning
and/or City Council approval.
10. Confirmation that if our clients purchase a
potion of Tract 3 of the P.U.D. in order to
obtain access to Hypoloxi Road (and
simultaneously grant the other owners an access
easement) that such a purchase would not trigger
any new subdivision or platting requirements.

Dear Mr. Finizio:
Thank you for taking the time from your busy schedule to meet with myself
and Armand Nault both representing Stanford Park Realty Development Corp.,
a subsidiary of the construction lender on the Stanford Park project, Don
Johnson, Building Code Compliance Administrator, and Bob Borden from the
Fire Department, on Wednesday, September 5, 1990. Although there is still
work to be accomplished to bring all parties together, I believe the
meeting was successful in clearing the air and providing a basis from which
to begin.
First, let me state that Stanford Park Realty Development Corp. understands
the City's position of requiring a bond or other guarantee for the
estimated costs of the necessary site improvements. The performance hond
that Dr. McCoy had submitted to you was for $655,011.25 and covered
essentially the installation of water and sewer lines from Miner Street to
Hypo1uxo Road and for the construction of N.W. 7th Court. As you know,
the water and sewer lines have been installed and N.W. 7th Court has mostly
been constructed. Work remaining to be completed on N.W. 7th Court
includes the surface course of asphalt, sidewalks, and landscaping.
Stanford Park Realty Development Corp. is prepared to retain the project's
Civil Engineer, Michael Schorah, to provide a reasonable estimate of the
costs to complete the necessary items of work and present that estimate to
you in his certifying letter. Stanford Park Realty Development Corp.
would then propose to provide an irrevocable letter of credit for the
amount of those costs to replace Dr. McCoy's bond.
The aforementioned letter of credit could be issued under the following
conditions.

1. The amount of the letter of credit would be based on costs to complete
those items of work that were covered by the original performance bond
provided by Dr. McCoy. The amount of the letter of credit could be
reduced as work was completed provided appropriate Engineer's
Certificates were provided to the City.
2. It is Stanford Park Realty Development Corp.'s intention to sell the
project to a prospective buyer. The prospective buyer would be
required to place a bond with the City at which time the City would
release the letter of credit provided by Stanford Park Realty
Development Corp.
3. Since it is not known when the sale of the project will occur, it is
necessary that Stanford Park Realty Development Corp. be given
sufficient time to obtain title to the property and conduct the sale.
We request a 12-month time with the right to extend as necessary to
close the sale.
4. During the time Stanford Park Realty Development Corp. has title to
the property, it proposes to do the following things:
A. The landscaping around the small office building and on the
property fronting Hypoluxo Road would be maintained on a regular
basis. Please be advised that Stanford Park Realty Development
Corp. does not own the small office building property but is
willing to maintain it should the owner fail to do so. This
provision will terminate when the sale is complete.
B. Remove all debris from the grounds and from the roofs of the
buildings.
C. Backfill ditches which had been excavated to install piping near
buildings.
D. Remove debris from all units and relocate any usable material to a
secured area.
E. Provide hardware for securing all exterior doors.
F. Rough grade the site and control all brush and weeds.
G. Install flood lights in sufficient numbers to provide night time
security.
H. Erect a fence across N.W. 7th Court and extending across the front
of the property to~the golf course fence with three gates for
access.

Dear Mr. Vlahos:
I have discussed the ramifications of your letter dated March 21,
1989 (copy attached) with Mr. Hallahan, the City's Urban Forester,
and he advises that the two slash pines that you are, requesting
to remove are among the 10 largest on the site. This fact,
suggests to me that every effort should be made to reroute the
power lines to an area where the impact on the env,ironment would
not be as great. My reasons for arriving at this conclusion are
as follows:
1. the size of these trees (approximately 6'2" in diameter and 50'
in height and 7'7" in diameter and 70' in height) makes them
special in character, unlike other slash pines;
2. because of the historical significance of these trees, it may
be impossible to place a value on the loss; and,
3. alternate routes for the location of the power poles must be
explored,as removal of these trees should be considered as a
last and.least desirable alternative.
By copy of this letter, I am requesting that the Urban Forester
continue to meet with you in order to explore alternatives to the
tree removal option.

This letter is in response to the necessity to remove two (2) existing Slash
Pines (Pinus elliottii), located on the east side of N.W. 7th Ct., that we have
indicated on our plans to remove.
The two Slash Pines are in the way of as Florida Power and Light utility
easement. They are located directly underneath high tension overhead wires
that service the entire south area off N.W. 7th Ct. Consequently, because of
their location and height, they are a safety hazard.
We have discussed trimming the pines but that will ruin their character and not
necessarily el iminate the hazard. Re-routing the wires around the existing
pines is very expensive (Florida Power and Light) quoted a minimum price of
$4,000.00) and quite unsightly (four poles located around existing pines).
Relocating the pines is impossible due to their size and tap root system.
The best solution to this problem, bearing your approval, would be to remove
both existing pines and replace them with native trees of equal value. We have
assessed their value at $1,200.00 for both pines. That would be equivalent to
replacing both pines with six (6) Quercus virginiana (Live Oak), 12~140x80 O.A.
or twelve (12) Pinus ell iottii (Slash Pine), 15G, 7' O.A. We feel that this
solution is the most cost effective and environmentally sensitive. This
proposal 1 imits the visual impact of additional electrical power poles,
el iminates any safety hazards by not locating any tree types under the power
1 ines and benefits the environment by replacing the two Slash Pines with a
larger number of other approved natives.
We hope that you approve of our final solution to this hazard as our intentions
are to add, not to detract from the environment and our design solution.
Please feel free to contact me with any suggestions and/or your approval.

yesterday. By way of this correspondence, I am requesting a letter of
clarification from you relative to the City of Boynton Beach's expectation
relative to the Stanford Park PUD and its retirement community.
As you recall, the issue is whether the City of Boynton Beach is expecting
the Stanford Park Club retirement community to be a licensed ACLF which
means that various services relative to "assistance with daily living" will be
delivered. Your letter needs to clarify that your use of the term "ACLF"
is a generic one referring to a retirement community such as the one approved
in our site plan and not to a licensed ACLF.
As I suggested to you yesterday, this letter is required by the bank's
attorney that will be funding this project. That closing is scheduled for
the latter part of next week so that your immediate attention to this matter
would be sincerely appreciated. For your convenience, I have enclosed a
return Federal Express envelope.
Should you have any questions or need further clarification relative to this
request, please contact me at your earliest convenience. I will be in my
office Monday and most of Tuesday, August 22nd and 23rd.

Dear Mr. Clark:
In response to your recent request, please accept this
letter as further explanation regarding our plat submission
for Stanford Park P.U.D. .
As you have noted, the current mortgagee, Joseph Fearnley,
has not signed the plat. In order to resolve this matter,
we have made arrangements for a substitute mortgagee to acquire
Mr. Fearnley's Mortgage. The substitute mortgagee has agreed
to pay a substantial sum to Mr. Fearnley to acquire an
assignment of the mortgage provided the plat has been approved
by the City of Boynton Beach. After such approval, the
substitute mortgagee will execute the plat so that the Mayor,
City Manager and others may finalize the signatures on the plat
which, in turn, can be recorded.
Accordingly, the only way we can obtain the mortgagee endorsement
on the plat is for the City Council to approve the plat
subject to obtaining the mortgagee's endorsement.
With that, we can proceed promptly to finalizing the plat
endorsements, recording the plat, and commencing the project.

Attached to this letter you will find a
master plan and traffic impact analysis for the proposed
Stanford Park Planned Unit Development. This proposed
development is currently located in part in unincorporated
Palm Beach County; however, the applicant is seeking
annexation into the City of Boynton Beach.
Consistent with previously established
procedures, Boynton Beach is requesting by this letter
a cursory review on the part of the County Traffic Engineer's
office to determine impact on County roadway systems and
consistency with adopted County plans and policies. This
item has been advertised for a public hearing with the
Boynton Beach Planning and Zoning Board for January 11,1982.
Please return your comments to me no later than December 28,
1982 for inclusion in the public hearing proceedings.
