which shall include location and descri tion of bench marks (minimUl'1
of one per major water control structure .
Overall map of the area showing where runoff presently goes and size,
location, topography, and land use of off-site areas which drain

Identification of seasonal water table elevations. If the project
is in the known f1ood.way of a natural stream, it should be identified
and approximate ,"looding depths determined. The 100 year flood plain
elevations and limits should be identified if applicable.
E. Description of vegetative cover. Wetland areas should be identified.

F. A recent aerial photograph of the project area with project boundaries
delineated.
G. Paving, grading and drainage plans, with special attention to
perimeter site grading.
H. Percolation tests must be submitted if percolation or exfiltration
systems are proposed. Percolation tests shall be representative of
design conditions.

II. Master Drainage Plan showing:
A. Location of all water bodies with details of size, side slopes,
elevations and depths.
B. Location and details of all major water control structures. Control
elevations of the control structures must be included along with any'
seasonal water level regulation schedules.
C. Drainage basin boundaries showing direction of flow, taking into
account off-site runoff being routed through or around the project.
D. Locations of roads and buildings along with their proposed elevations.

E. Right-of-way and easement locations for the drainage system including
all areas to be reserved for water management purposes.
F. Location and size of internal minor watl" management facilities.
G. Nearby existing offsite water management facilities such as wells,
lakes, etc. which might be affected by the proposed construction or
deve 1 opment. The names 'and addresses of the owners of such facil it i es
should also be submitted.

III. Drainage Calculations including:
A. Design storms used including depth, duration and distribution.
B. Off-site inflows.
C. Stage-storage computations for the project and stage-discharge
computations for the outfall structure(s).
D. Acreages and percentage of property proposed as:
1. Impervious surfaces (excluding water bodies)
2. Pervious surfaces (green areas)
3. Lakes, canals, retention areas etc.
4. Total acreage of project
E. Runoff routing calculations showing discharges, elevations, and
volumes retained and/or detained during applicable storm events.
Included should be the necessary mathematical computations to
demonstrate that the proposed development will not remove
net storage from the basin for events up to the 100 year frequency.
F. Calculations required for determination of minimum building floor
and road elevations.
IV. Legal and Institutional Information including:
A. Identify entity responsible for operation and maintenance of the
surface water management system.
B. If the operation and maintenance entity is to be a public body such
as a city or drainage district, a letter of potential acceptance from
the pUblic body must be submitted prior to staff report approval.
If the entity is a homeowners association, then documents verifying
the existence of such an organization and its ability to accept
operation and maintenance responsibility must be submitted prior to
commencement of construction (assuming the permit is issued).
~ Indicate how water and wastewater service will be supplied. Letters
of commitment from off-site suppliers must be included.

D. Identify agencies, organizations, etc. contacted. Include meeting
summaries and/or responses. Give status of local approvals indicating
if site plan and/or subdivision approval has been granted, final
plats recorded and building or construct,Jn permits issued.
Present and proposed zoning: Evidence of compatible density and classi-
fication under the Local Government Zoning or Comprehensive Plan
must De submltted; include the status under the DRI process,
iT appllcable. The number of proposed dwelling units and/or square
feet of conunercial area must be suppl ied. If the project is a DRI, then
a copy of the final approved development order must be supplied.
Submit a copy of a boundary survey and a CODY of the recorded warranty
deed, if the Applicant is a contractual bu er then a co of t e

"A certificate of need shall terminate 1 year after the
date of issuance unless the applicant has commenced con-
struction, if the project provides for construction, or
incurred an enforceable capital expenditure commitment
for projects not involving construction, or unless the
certificate of need validity period is extended by the
Department for an additional period of up to 6 months,
upon showing.good cause by the applicant for the extension.
The Departmerit shall monitor the progress of the holder
of the certificate of need in meeting the timetable' for
project development specified in the application and may
revoke the certificate 'of need,after consideration of
recommendations of the health systems agency, if the holder
of the certificate of need is not meeting such timetable
and is not'making a good faith effort to meet it."

B. Rule 10-5.13(2), Florida Administrative Code, states:
"An appll.9-ant desiring a 6 mom:.h validity extension to a
certificate of need shall submit such request to ~he
Department, in writing, not later than 15 days prior to
the certificate termination date providing documentation

support of a request for a validity time period extension
is documentation that each of the following has been satisfied:
(a) If applicable, a site has been firmly secured.
(b) Project financing has been firmly secured.

SPECIAL WARRANTY DEED TO TRUSTEE
UNDER LAND TRUST AGREERENT
THIS INDENTURE, mAde AS of the 27th day of April, 1979,
between SECTRAS CORPORATION, a Delaware corporation, whose address

WITNESSETH:
Grantor, for and in consideration of the sum of TEN and
NO/100 DOLLARS ($10,00) and other good and valuable consideration
to Grantor in hand paid, the receipt of which is hereby
acknowledged, hereby grants, conveys and specially warrants unto
RALPH BIERNBAUM, not individually, but as Trustee under the
provisions of A certain Land Trust Agreement dated April 23, 1979,
pursuant to Florida Statutes Section 689.071 (hereinafter referred
to as -the Trust Agreement") that real property lying, situate and
being in Palm Beach County, Florida, and more particularly
described in Exhibit A attached hereto and made a part hereof
(hereinafter referred to as .the Property.),. subject .toa purchase
money mortgage of even date herewith from Trustee to Grantor.
TO HAVE AND TO HOLD the Property in fee simple with the
appurtenances upon the Trust and for the purposes set forth in
this Deed and in the Trust Agreement.

Full power and authority is granted by this Deed to Trustee,
or his successors, to protect, conserve, sell, lease, encumber or
otherwise to manage and dispose of the Property or any part
thereof.
In no case shall the Grantor or any other party dealing with
the Trustee in relation to the Property,or to whom the Property or
any part thereof shall be conveyed, contracted to be sold, leased
or mortgaged by Trustee, be obliged to see to the application of
any Purchase Honey, rent or money borrowed or advanced on the
Property, or be obliged to see~that the terms of this Trust have
been complied with, or be obliged to inquire into the necessity or
expediency of any act of the Trustee, or be obliged or priviliged
to inquire into any of the terms of the Trust AgreementJ and every
Deed, Trust Deed, Mortgage, Lease or other instrument executed by
Trustee in relation to the Property shall be conclusive evidence
in favor of every person relying upon or claiming under any Buch
conveyance, lease or other instrument (a) that at the time of its
delivery the Trust created by this Indenture and by the Trust
Agreement was in full force and effect, (b) that the conveyance of
other instruments was executed in accordance with the trusts,
conditions and limitations contained 'in this Indenture and in the
Trust Agreement and is binding upon all beneficiaries under those
instruments, (c) that Trustee was duly authorized and empowered to
execute and deliver every such Deed, Trust Deed, Lease, Mortgage
or other instrument and (d) if the conveyance is made to a
successor or successors in trust, that such successor or
successors in trust have been appointed properly and vested fully
with all the title, estate, rights, powers, duties and Obligations
of the predecessor in trust.
Any contract, Obligation or indebtedness incurred or entered
into by the Trustee in connection with the Property may be entered
into by him in the name of the then beneficiaries under the Trust
Agreement, as their attorney in fact, bY this Deed irrevocably
appointed for that purpose, or, at the election of Truatce, in his
own nu~e, as Trustee, of an express trust and not indivi~u~lly,

The interest of each beneficiary under this Deed and under
the Trust Agreement and of all persons claiaing under the. or any
of them shall be only In the earnlogs~ avails and proceeds arising
from the sale or other disposition of the Property. and that
interest is hereby declared to be personal property, and no
beneficiary under this Deed and under the Trust Agree.ent shall
have any title or interest, ~ega1 or equitable, in or to the
Property as Buch, but only an interest in the earnings, avails and
proceeds from the Property as aforesaid.
And The Grantor by this Deed specially warrants tbe title to
the Property and will defend the title against the lawful claUos
of all persons whomsoever, clai.ing by, through or under the said
Grantor.
Grantor has conveyed hereby to Trustee all of Grantor's legal
and equitable interest in and to the Property, and notwithstanding
any contrary provision set forth in this indenture, nothing herein
shall render Grantor the agent, partner, joint venturer,
co-trustee, or beneficiary of Trustee, nor shall anything herein
charge Grantor with notice of any of the terms or provisions of
the Trust Agreement.

STANFORD PARK P.U.D.
VEGETATION STUDY
The site of the proposed Stanford Park P.U.D. has several stands of
sizeable vegetation consisting mostly of Slash Pine (Pinus ell iotti),
interspersed with Live Oaks (Quercus virginian~and Cabbage Palms (Sabal
palmetto) in infrequent locations.
The majority of the site contains wild grasses and sporadic occurrances
of Cabbage Palms and Slash Pines with some intrusion of exotic pest
species (Austral ian Pine, Florida Holly and Melaleucca).
The significant groupings of trees are as follows:

Review and building permit review '(with respect to proposed development conflicting

increase in underground utility-line, cuts during construction, we are now requiring
that certain petitioners review their surveys and proposed master/or site plans with
the appropriate dr.ainage district. Southern Bell, Florida Power. and Light-Company,

your survey and proposed master/or site plan "which will be marked by each reviewer

Dear Mr. White:
This will confirm our discussions whereby the undersigned, as
Trustee (Trustee), holding title to the land described in the
at tached exh ibi t hereby grants to Southern Senior Group (Southe rn)
an option to purchase said land upon the following terms and
conditions:
A. This option is subject to an agreement being executed
by Southern and the Trustee on terms and conditions sat-
isfactory to both parties and in the event that an agree-
ment satisfactory to both parties is not executed by
March 15, 1983, this option shall be null and void.
B. The subject land is tJresently subject to a mortgage and
this option is expressly subject to the Trustee obtaining
a release of said land on terms and conditions sat is-
factory to both the mortgage0 and the Trustee.
C. The land consists of l~ acres +.
D. The price per acre is
E. In the event that an agreement satisfactory to both
parties is executed, and all other terms and conditions
are satisfied. the closing will take place no later than
April 30, 1983.
F. Southern will complete the installation of sewer, water
and a shell-packed road from Miner Road to the northern
boundary of the property to he acquired by Southern pur-
suant to the option hereinabove described. The water,
sewer. and road shall be constructed in accordance with
the appropriate specifications so that the installation

will be sufficient to service the remaining property
owned by the Trustee and will comply with all of the re-
quirements of the appropriate governing authorities.
G. In consideration of the installatioh.of the sewer, water
and roads hereinabove described and in further considera-

tion of the purchase by Southern of the 10 acres which is
the subject of the ubove described option, the Trustee
agrees to grant, concurrently with the closing of the 10
acres, the appropriate easements for the installati0n of
the water, sewer and right-of-way for the road hereinabove
described. The location of the road through the remain-
ing property will be determined by the Trustee.
H. Subject to all of the foregoing this will confirm that
Southern, as optionee-buyer, hns the permission of the
Trustee to apply for any needed rezoning and special ex-
ceptions for the creation of a P.U.D. for a nursing home,
commercial and congregate health facility use in connection
with the 10 acres that is the subject of the above described
option.
I. The granting of easements and the permission to apply for
any changes in zoning is b.:lsed upon general conformance
with the attached exhibits; however should the 10 acres
not be sold to Southern then the easements, permission,
and any other rights granted to Southern pursuant to this
letter agreement shall be null a~d void.
If, prior to Harch 1, 1983, (i) the .:lpplication by Southern for
the rezonlng and special excepti.ons lS rejected or (ii) either
party determines in its sole judgment, that an agreement satis-
factory to it cannot be concluded and executed and so notifies
the other party by written notice, then the option herein granted
shall terminate and be null and void'and the parties shall have
no liability each to the other.
Our signatures below constitute our agreement to all the terms
and conditions set forth in this letter agreement.

SITE
The site is a 21.29 acre parcel of land located on the
South side of Hypoluxo Road approximately 320 feet West of
High Ridge Road in Section 8, Township 45 South, Range 43
East in Palm Beach County, Florida. Presently 11.29 acres
of the site is in the unincorporated area of Palm Beach County
and 10.0 acres inside the city limits of the City of Boynton
Beach. It is being proposed to annex the 11.29 acres into the
City of Boynton Beach. Figure 1 shows the location of the
site relative to the roadway system.
The Sanford Park P.U.D., according to the site plan as
prepared by Urban Design Studio, will consist of a 120 bed
convalescent center, 220 adult care units and a 16,000 square
foot medical office center. The site plan also shows one
entrance road off of Hypoluxo Road running through the property.
Access to all development tracks will be both off of this en-
trance road and directly from Hypoluxo Road.
GENERATION
Based upon information obtained from the Palm Beach County
Fair Share Ordinance, "Trip Generation - Second Edition",
Institute of Transportation Engineers, 1979, and from observa-
tion of generation characteristics of similar types of land
uses, the fOllowing generation rates have been calculated:

vehicular trips were calculated. These trips are:

TRAFFIC DISTRIBUTION
Based upon a review of the pattern of existing and approved
developments in the Lake Worth - Boynton Beach area, the exist-
ing roadway network and from observation of established travel
patterns, the traffic distribution for the external gener-
ated tri~s for both the residential and medical office land
uses have been calculated and are shown on the table below:

Figure 2 graphically shows the daily traffic generation
distributed onto ther adjacent roadways.
PEAK HOUR.
The peak hour of traffic for the individual land uses
in this P.U.D. are not concurrent. The peak hour of traffic
for the residential uses (ponvalescent center and adult care
center) happens between 3:00 and 4:00 p.m. during the major
employee shift change. The peak hour of traffic for the offices
occurs between 4:30 and 5:30 p.m. at the end of the work day.
Thus, for the purposes of this report, the following percent-
ages of total volume will be used for the peak hour of traffic
for this P.U.D.:

EXISTING ROADWAY CONDITIONS
Hypoluxo Road is a County maintained arterial roadway.
Presently from just East of Congress Avenue to immediately
East of High Ridge Road, Hypoluxo Road is a two lane facility.
Palm Beach County is presently widening Hypoluxo Road from
Congress Avenue West to Military Trail to a four lane divided
roadway. Hypoluxo Road was widened to four lanes from just
East of High Ridge Road Easterly to East of 1-95 as a part
of the initial 1-95 construction. There are presently no
turn lanes at the intersection of Hypoluxo Road and High Ridge
Road.
The present average annual daily traffic (AADT) based
upon counts taken in 1982 for Hypoluxo Road West of 1-95 is
13,002 trips per day according to Mr. Paul Larson of the Palm
Beach County Area Planning Board. Mr. Larson also indicated
that there was a mix-up in the Hypoluxo Road traffic counts
in the publication "1981 Traffic Counts" published by the
Metropolitan Planning Organization. It appears that the
counts taken on the East side and West side of 1-95 were
mixed up. The true 1981 AADT for Hypoluxo Road West of 1-95
should read 13,811 trips per day.
CONCLUSIONS AND RECOMMENDATIONS
The affected intersections were analyzed and the follow-
ing recommendations are presented.
1. A left turn lane, East approach, should be
constructed on Hypoluxo Road at the project's
Easterly entrance.

2. A left turn lane East approach and West
approach should be constructed on Hypoluxo
Road at the intersection with High Ridge
Road.
3. The intersection of Hypoluxo Road and High
Ridge Road should be signalized when war-
ranted as determined by the City Engineer.
It should be noted that Recommendations #2 and #3 are
necessary at the present time because of existing traffic
and are necessary to bring the intersection to operate at
an acceptable level of service. In addition, it should also
be noted that there are other projects which have been recently
approved which similarly impact this intersection and have ob-
ligations to improve the intersection.

INTRODUCTION
After submitting the application for the Sanford Park P.U.D.
and as a result of subsequent meetings with City Staff, it was
decided to reduce the scope of the Medical Office portion of the
P.U.D. It has been decided to delete 6,000 square feet of gross
floor area. It is now proposed to construct a 10,000 square foot
medical office building at the Northern end of the P.U.D.
It is the purpose of this Report to re-evaluate the traffic
impact of this P.U.D. as a result of this revision.
GENERATION
As the proposed uses have not changed, the same generation
rates for each land use still apply. The total generation for
the P.U.D. is:
Convalescent Center:
120 beds @ 2.7 trips/bed
Adult Care Center:
220 units @ 3.0 trips/unit

TRAFFIC DISTRIBUTION
The traffic distribution has not changed as a result of
the revisions to the P.U.D. Figure 2 has been revised to show
the revised daily traffic generation.
PEAK HOUR
The peak hour percentages and directional splits also remain
the same. Figure 3 has been revised to reflect the proposed
change.
CONCLUSIONS AND RECOMMENDATIONS
The proposed change to the P.U.D. has the effect of reducing
the volume of traffic generated on the adjacent roadways. Com-
paring the revised volumes shown in Figure 2 to the original
volumes, it can be seen that the proposed changes will cause
over a 207. reduction in the external trips generated by this
P.U.D.
My analysis of the revised volumes reveals that there are no
changes to the roadway improvements recommended for this P.U.D.
The recommended improvements are:
1. A left turn lane, East approach, should be
constructed on Hypoluxo Road at the project's
Easterly entrance.
2. A left turn lane, East approach and West
approach, should be constructed on Hypoluxo
Road at the intersection with High Ridge Road.
3. The intersection of Hypoluxo Road and High Ridge
Road should be signalized when warranted by the
City Engineer.
It should be noted that Recommendations #2 and #3 are
necessary at the present time because of existing traffic and
are necessary to bring the intersections to operate at an
acceptable level of service.

Stanford Park
Environmental Assesment
Persuant to the Boynton Beach Comprehensive Plan an environmental assesment was
conducted at the Stanford Park Site. Performing this evaluation was Mrs. Karen
Sjoholm, ASLA, Florida State registered Landscape Architect and Botanist. Field
data was collected on April 15, 1988 from 10:00 a.m. to 2:00 p.m. in the
afternoon. Method of evaluation was on foot visual analysis.
The majority of the site has been cleared during the inital first phase site
development of Stanford Park. Open water exist in the portion of the water
management tract that has been developed to date. The enbankments of the water
managements tract have been invaded by Typha spp. (Cat Tails). The typha will
be removed during the littoral zone development.
The disturbed upland areas have reestablished a herbacious grass cover
consisting of primarily Bahia grass, angropogan (broom sedge) flavaria, (yel low
top) and other first level successional grasses, The undisturbed areas of the
site consist of pineflat wood and melaluca. There are Two (2) dense stands of
melaluca, which will be removed during site development. The pine flatwoods
have sustained same minor disturbance of the understory level. Many areas have
been the victim of illegal dumping. The pines (Pinus ell iottii var, densa)
range from 2"-30" in cal iper. Some larger specimans exist on the fringe. In the
denser area of pine, the following understory was identified, slash pine, saw
palmnetto, coco plum, wax myrtle, myrisine, wild coffee, ardisia, poision ivy
and other species typical of this habitat. Particular attention was spent
trying to identify rare and endangered species (those most often found asso
ciated with this habitat are terrestial orchids and the wild Pine bromelid
(Tillandsia fasicilata). Since a few scattered sand pine (pinus clausia) exist
on the northern edge of property a search for the endangered four (4) leaf
pappau was also conducted. No threatened or endangered species of Florida
vegetation was observed.
A search was conducted to identify any endangered birds or animal s, as
classified by U.S. Fish and Wildlife Service and the Florida Game and
Freshwater Fish Commission, residing or nesting on the site, Particular
attention was focused on identifying the Gopher tortus, the Florida Scrub Jay,
the Wood Stork and the Red-Cockaded Woodpecker. None of the species or other
Federal and State endangered or threatened birds, reptiles or mammals were
observed.
In conclusion no endangered species of plants, birds or other animals were
found to be on site.

Stanford Park
Environmental Assesment
Persuant to the Boynton Beach Comprehensive Plan an environmental assesment was
conducted at the Stanford Park Site, Performing this evaluation was Mrs. Karen
Sjoholm, ASLA, Florida State registered Landscape Architect and Botanist. Field
data was coll ected on Apri 1 15, 1988 from 10:00 a.m. to 2:00 p.m, in the
afternoon, Method of evaluation was on foot visual analysis.
The majority of the site has been cleared during the inital first phase site
development of Stanford Park. Open water exist in the portion of the water
management tract that has been developed to date. The enbankments of the water
managements tract have been invaded by Typha spp. (Cat Tails). The typha will
be removed during the littoral zone development.
The disturbed upland areas have reestablished a herbacious grass cover
consisting of primarily Bahia grass, angropogan (broom sedge) flavaria, (yel low
top) and other firs t 1 eve 1 success iona 1 grasses. The und i s turbed areas of the
site consist of pineflat wood and melaluca. There are Two (2) dense stands of
melaluca, which will be removed during site development. The pine flatwoods
have sustained same minor disturbance of the understory level. Many areas have'
been the victim of illegal dumping. The pines (Pinus elliottii var. densa)
range from 2"-30" in cal iper. Some larger specimans exist on the fringe. In the
denser area of pine, the following understory was identified, slash pine, saw
palmnetto, coco plum, wax myrtle, myrisine, wild coffee, ardisia, poision ivy
and other species typical of this habitat, Particular attention was spent
trying to identify rare and endangered species (those most often found asso
ciated with this habitat are terrestial orchids and the wild Pine bromel id
(Tillandsia fasicilata). Since a few scattered sand pine (pinus clausia) exist
on the northern edge of property a search for the endangered four (4) leaf
pappau was also conducted. No threatened or endangered species of Florida
vegetation was observed.
A search was conducted to identify any endangered birds or animals, as
classified by U.S, Fish and Wildlife Service and the Florida Game and
Freshwater Fish Commission, residing or nesting on the site. Particular
attention was focused on identifying the Gopher tortus, the Florida Scrub Jay,
the Wood Stork and the Red-Cockaded Woodpecker. None of the species or other
Federal and State endangered or threatened birds, reptiles or mammals were
observed.
In conclusion no endangered species of plants, birds or other animals were
found to be on site.
