REVIEW COMMENTS MEMORANDUM December 9, 1988 TO: CHAIRMAN AND MEMBERS PLANNING AND ZONING BOARD FROM: CARMEN S. ANNUNZIATO, PLANNING DIRECTOR RE: REQUESTS FOR ANNEXATION, FUTURE LAND USE ELEMENT AMENDMENT AND REZONING SUBMITTED BY BILL RAY WINCHESTER, APPLICANT, FOR THREE (3) PARCELS WEST OF CONGRESS AVENUE BETWEEN OLD BOYNTON ROAD AND WEST BOYNTON BEACH BOULEVARD INTRODUCTION Bill Ray Winchester, applicant, is proposing to annex into Boynton Beach three (3) parcels of land (see Exhibit A) currently zoned AR (Agricultural Residential) as follows: Parcel 1 - This 18.02 acre parcel is located at the southwest corner of North Congress Avenue and Old Boynton Road and is owned by Bill and Elsie Winchester. The parcel is occupied by a rented, single-family home. Parcel 2 - This 28.88 acre parcel is located at the northwest corner of Winchester Park Boulevard and West Boynton Beach Boulevard and is owned by Bill and Elsie Winchester and Ernest Klatt. The parcel is occupied by a rented, single-family home and is used for cattle grazing. Parcel 3 - This 3.43 acre parcel is located at the north- west corner of Winchester Park Boulevard and the L.W.D.D. L-24 canal and is owned by Bill and Elsie Winchester. The parcel is vacant and is used for cattle grazing. Paralleling these requests for annexation are requests to amend the Future Land Use Element of the Comprehensive Plan to show each annexed parcel as Agriculture and to rezone each parcel to AG, Agriculture, as a holding category for future commercial development. PROCEDURE These applications for annexation, amendment to the Future Land Use Element of the Comprehensive Plan and rezoning are being processed consistent with State Statutes, and Boynton Beach Codes, Ordinances and Resolutions as follows: 1. F.S. 163.3161: Local Government Comprehensive Planning and Land Development Regulation Act. 2. F.S. 166.041: Procedures for Adoption of Ordinances and Resolutions. 3. F.S. 171.011: Municipal Annexation and Contraction Act. 4. Boynton Beach Code of Ordinances, Appendix A, Section 3A5(e): Boundary and Zoning. 5. Boynton Beach Ordinance #79-24. 6. Boynton Beach Resolution #76-X: Procedures for Annexation. -2- 7. Boynton Beach Ordinance ~86-54: Comprehensive Plan Evaluation and Appraisal Report. These regulations have been listed for informational purposes. Paraphrasing, these regulations require review by the City Department Heads, newspaper advertisements, review by the Treasure Coast Regional Planning Council, the State Department of Community Affairs, and Palm Beach County, public hearings with the Planning and Zoning Board and the City commission and commission adoption of ordinances to annex, amend the Future Land Use Element and rezone. CURRENT LAND USE AND ZONING As previously discussed, these parcels are zoned AR (Agriculture Residential). Parcels 2 and 3 are primarily vacant and are used for cattle grazing, however, parcels I and 2 each have a single- family home on them. Muck removal operations have occurred on these parcels in the past. Winchester Park Boulevard and parcel 1 of this request (a rented, single-family home on large tract of land) . Vacant, undeveloped parcel which will result in a small unincorporated area upon annexation. -4- FUTURE LAND USE AND REZONING The question of future land use in the area south of the Boynton Beach Mall was revisited by Palm Beach County in 1984. What resulted was an action on the part of the Palm Beach County Board of County Commissioners to allocate future potential for commercial uses for the property located east of Knuth Road, north of West Boynton Beach Boulevard, west of Congress Avenue and south of Old Boynton Road. Given the consideration that the decision of commercial versus non-commercial land use has to a great degree been made and that the remaining County unincorporated areas as shown in Exhibit B will develop in the City as they are bordered by current corporate limits, future land use intensity decisions will be left up to the Planning and Zoning Board and City Commission. The City's Comprehensive Plan recommendation for this area, land use conflict area 51 and 52, (see Exhibit C) is Office Commercial land use for parcels lying west of a line 500 feet west of Winchester Park Boulevard, and Local Retail Commercial for parcels lying east of this line and parcels along the north side of Boynton Beach Boulevard, east of Knuth Road. It further states that it would be desirable for these parcels to develop as planned commercial developments. These land use recommendations are considered appropriate due to the proximity of the Winchester parcels to the Boynton Beach Mall and separation from residential uses. Typically, office development and satellite retail development surround regional malls. This recommendation was the basis for previous annexations/land use amendments in this area (e.g. Greentree Plaza II, Diaz Plaza, Capitol Professional Center Planned Commercial Development and Bedding Barn) . Since this request is for a land use element amendment/rezoning to Agriculture as a holding category for the purpose of future commercial development, a more detailed discussion of the reasons for the above recommendation, including the applicability of the recommendations in the Urban Design Plan proposal for this area, will be necessary upon submittal of land use amendments/rezonings for commercial development in the future. Therefore, the Winchester requests should only be considered within the context of the above discussion. COMPREHENSIVE PLAN POLICIES: There are three policies in the Comprehensive Plan which address annexations as follows: 1. "Annex only property which is reasonably contiguous to present municipal boundaries;" 2. "Annex property only after the preparation of a study evaluating the fiscal benefits of annexation versus the cost of providing service;" and 3. "Annex only properties which are of sufficient size to provide efficient service and on which urban development is anticipated." In order to determine the consistency of the Winchester requests with the Comprehensive Plan policies, each of the three pOlicies will be addressed individually. POlicy 1 - "Annex only property which is reasonably contiguous to the present municipal boundaries." Parcel 1 is contiguous to current municipal limits along its entire northern, eastern, western and a portion of its southern property boundaries (approximately 2,599 feet or 73% of its total property boundary). Parcel 2 is contiguous to current municipal limits along a portion of its northern, eastern, southern and -5- western property boundaries (approximately 2,376 feet of 40% of its total property boundary). Parcel 3 is contiguous to current municipal limits along its property boundary). In addition, each of these parcels lies in the path of urban development. Policy 2 - Annex property only after the preparation of a study evaluating the fiscal benefits of annexation versus the cost of providing services." In response to policy two, you will find accompanying this memorandum Exhibit D, which attempts to evaluate the costs to the City of annexing these parcels and the dollars returned to the City in taxes. As indicated, the projected municipal taxes were derived based on the 1987 current assessed values of the three parcels within unincorporated Palm Beach County. Although this study reflects the existing land uses (two single-family homes and agricultural exemptions on parcels 2 and 3) that will continue to exist after annexation of parcels until future commercial development, policy two may not be appropriate in that annexation of these parcels will allow the City to issue a development order when commercial zoning is requested in the future. The benefits received from municipal taxes when this development does occur in the near future, an estimated $406,098.05, would greatly outweigh the cost to serve future development (see Exhibit D for a summary on the derivation of this figure). Incidentally, the two existing single-family homes are served by private wells and septic systems which will continue to exist after annexation until City water and sewer service is required with future development. Policy 3 - "Annex only properties which are of sufficient size to provide efficient service and on which urban development is anticipated." As previoiusly reported, the three parcels are 18.02 acres, 28.88 acres and 3.43 acres, respectively, (a total of 50.33 acres) and are located in an area already developed in urban land uses. RECOMMENDATION The Planning Department recommends that the applications submitted by Bill R. Winchester, applicant, for three parcels west of Congress Avenue between Old Boynton Road and West Boynton Beach Boulevard for annexation, future land use element amendment and rezoning be approved subject to staff comments which accompany this Memorandum as Exhibit E. This recommendation is based in part on the following: 1. The parcels are contiguous to the Corporate limits; 2. The parcels are within a County pocket and are in the path of urban development; 3. The parcels are located within the City's municipal service area; 4. The intensity of land use desired at this time for each parcel is appropriate for the location; 5. The requests are consistent with the Comprehensive Plan Policies for annexation; 6. The land use categories requested must be considered as a part of an overall strategy for annexation and are appropriate; 7. The zoning is consistent with the current use of each parcel pending future commercial development; 8. The requests will not impair the value of future use of lands in the surrounding area; and, -6- 9. The cost to serve versus the benefits received indicate a positive return for the City. 10. Annexation of these parcels will allow the City to issue a Development Order when cornrnercia1 zoning is requested in the future.
