SUBJECT: Winchester Boulevard Restaurant (f.k.a. West Boynton
Beach Boulevard Retail/Oil Lube) - Ordinances for
Annexation, Land Use Element Amendment, and Rezoning.
Attached please find, and consider on First Reading at the City
Commission meeting scheduled for December 4, 1990, the ordinances
for annexation, land use amendment, and rezoning in connection
with the Winchester Boulevard Restaurant (f.k.a. Retail/Oil Lube)
applications. The applications are briefly described as follows:
Kieran J. Kilday, agent for Bill and Elsie Winchester, William A.
Zeiher, and Michael A. Schroeder, property owners, is proposing
to annex into Boynton Beach a 0.84 acre tract of land located
at the northeast corner of Winchester Park Boulevard and West
Boynton Beach Boulevard (see attached legal advertisement). The
property is currently zoned AR (Agricultural Residential) in Palm
Beach County and it is vacant. In addition, the applicant is
requesting that the Future Land Use Element of the Comprehensive
Plan be amended to show this land as "Local Retail Commercial",
and that it be rezoned from AR to C-3. The proposed use is a
restaurant; however, if rezoned to C-3, it could be developed for
any use permitted in the C-3 zoning district, unless otherwise
restricted by the City Commission as a condition of zoning
approval.
The applications were approved by the Planning and zoning Board
on July 10, 1990, and by the city Commission on July 17, 1990.
The land use plan amendment was then forwarded to the Florida
Department of Community Affairs for review, and the City was
notified that the proposed amendment was approved without
comments in the Objections, Recommendations, and Comments report
dated October 24, 1990. It should also be noted that there were
no objections from the Treasure Coast Regional Planning council,
and that Palm Beach County supports the annexation (see attached
comments) .
The Planning Department continues to recommend that the
applications submitted by Kieran J. Kilday for Bill & Elsie
Winchester, William A. Zeiher and Michael A. schroeder be
approved. This recommendation, as stated in the Planning
Department Memorandum No. 90-211, is based in part on following:
1) That the parcel is contiguous to the corporate limits;
2) That the parcel lies within a county pocket and it is in the
path of urban development;
3) That the parcel is located within the City's utility service
area;
4 That the parcel is located at the intersection of an
arterial road and a collector road and it is suitable for
commercial development;
5) That the intensity of the land use and zoning desired is
consistent with the language for Area 7.g. of the
comprehensive Plan Future Land Use Element support
Documents;
6) That the request is consistent with the comprehensive Plan
annexation policies; and

7) That the zoning category requested is consistent with the
proposed use of the site for a restaurant or other local
retail land uses.

.Introduction
Pursuant to the provisions of the Local Government
Comprehensive planning and Land Development Regulation Act,
Chapter 163, Florida statutes (FS), the Council must be
provided an . opportuni ty to review and cOlDIDent on
comprehensive plan amendments prior to their adoption. The
city of Boynton Beach has submitted a proposed amendment to
the State Department of COlDIDunity Affairs (DCA) F which in
turn is seeking Council's COlDIDents.
Council's review of the information provided by the DCA is
to focus on the consistency of the proposed amendments with
the Regional Comprehensive Policy Plan developed pursuant to
Section 186.507, FS. A written report, containing any
obj ections, recolDIDendations for modification, and COlDIDents
(as defined in Chapter 9J-ll, Florida Administrative Code)
is to be provided to the DCA within 45 calendar days of
receipt of the plan, elements or amendments.
Backaround
On January 10, 1990 F the DCA issued a Notice of" Intent to
find the comprehensive plan for the City of Boynton Beach
not in complianceF pursuant to section 163.3184, FS. As
part of this finding, the ADOPTED plan was found to be
inconsistent with the Regional Plan.
The City of Boynton Beach is considering one draft amend-
ment to the Future Land Use Element. The 0.84 acre parcel
is located on the northeast corner of Winchester Park
Boulevard and West Boynton Beach Boulevard and is shown on
the attached maps. The parcel has been proposed for
annexation into the city and the proposed land use change is
from the County's COlDIDercial High Intensity to the City's
Local Retail cOlDIDercial. The amendment is not related to
the finding of noncompliance by the DCA. .

Evaluation
The proposed amendment has been reviewed in accordance with
the requirements of Chapter 163, FS; CouncilFs review
procedures; and Council's adopted Regional Comprehensive
Policy Plan. The subject property has been proposed for
annexation and is currently vacant. The change in land use
is necessary in order to incorporate the property onto the
Boynton Beach Future Land Use Map.
Development on this property is required to connect to the
city's central water and sewer lines. Sufficient water
treatment capacity will not be available until July 1991,
according to the City of Boynton Beach utilities Department.
Development should <\lso comply with the Countywide Traffic
Performance Standards to ensure consistency with the
Regional Plan.

Palm Beach County planning Division has coordinated the review of
the proposed annexation of .84 acres, located in general, north
side of Old Boynton Beach Rd., and west of congress Ave. Annexation
reviews do not address the question of whether a future development
order for the proposed annexation would be considered a previous
approval vested against the 1990 Countywide Traffic Performance
standards. staff comments are as follows:
1. PLANNING DIVISION: Steve Morales, Planner
The Planning Division has reviewed the proposed annexation for
"statutory deficiencies," pursuant to Chapter 171, F.S. and
Palm Beach County I s Interim Annexation Review Policy. The
Annexation of this parcel eliminates an existing unincor-
porated enclave area within the City of Eoynton Beach. Palm
Beach County supports..this type of annexation.
2. ENVIRONMENTAL RESOURCES MANAGEMENT: Bob Kraus, Environmental
Analyst
This site is not listed in a well field protection zone nor is
it considered environmentally sensitive. ERM recommends that
the oil-Lube facility provide secondary containment for any

annexation, but residents will receive a quicker response from
Boynton Beach. It will also remove one eastern County enclave.

serve these parcels.
In order to minimize land use conflicts with the
residential land uses which lie to the west, those
parcels which abut the east side of Knuth Road should
be placed in the Office Commercial land use category.
The City should require that commercial development of
these properties includes the provision of adequate
buffers to protect the residential land uses which lie
to the west.
High Density Residential or mixed-use residential and
commercial development should be considered to be an
alternative land use, if roadway capacity proves to be
a problem. Residential densities up to 10.8 dwelling
units per acre would be permitted in this case.
The rights-of-way for Congress Avenue, Knuth Road, Old
Boynton Road, abutting this area should also be
annexed, as well as any platted Palm Beach Farms roads
within the area.
