Request for Rezoning (REZN 95-001)
INTRODUCTION
The City of Boynton Beach, owner of Lots #9 and #10 of the Palm Beach
country Club Estates Subdivision, proposes to change the zoning of these
two, 0.26 acre parcels located on the south side of NE 8th Avenue,
approximately 150 feet and 100 feet, respectively, west of NE 1st Street
(see Attachment "A"-Location Map). The current zoning on these parcels
is Public Usage (the land use classification will remain Medium
Density), and is to be rezoned to R-2, single & Two Family District.
Pursuant to the city's zoning code (Appendix A, Section 9.C.2), a
comprehensive analysis of this rezoning is not required, as this
rezoning does not include an amendment of the Comprehensive Plan Future
Land Use Map. However, the following information has been provided in
order to adequately describe the purpose of the proposed zoning,
describe the land uses and zoning of the adjacent area, and to declare
consistency with the comprehensive plan.
PURPOSE/JUSTIFICATION
This rezoning is necessary for use of the subject parcels in the city's
Infill Housing Program. The Infill Housing Program promotes home
construction on vacant lots wi thin the Community Redevelopment Area
through program marketing, identification of qualified applicants,
assistance through the loan process, and most importantly, the provision
of property at no cost to the participant. With respect to residential
demand for the subject lots, the bank has just closed on a construction
loan for one of the lots, while a second loan is currently being
processed for another infill project. The construction stage for one
home could be reached as early as May 1, 1995.

The land use and zoning in the surrounding area is presented in the
table that follow:

It should be noted that with the exception of the multi-family complex,
all adjacent uses would be reasonably compatible with the proposed use
of the subject properties. Regarding the multi-family use, this

apartment complex is a legal, nonconforming use unless the zoning and
land use classifications were to be changed to accommodate multi-family
uses. However, given that the predominant zoning district in the area
is R-2, the addition of a multi-family zoning district to this area
would constitute spot zoning. Due to the proximity to single family
uses, staff would likely oppose the addition of multi-family zoning and
land use at this location. Therefore, land uses within this area would
become more compatible with the removal of the multi-family use.
SITE HISTORY AND ZONING
The city acquired the subject lots in 1951 from the State of Florida.
Although there has not been a specific public use planned for these
lots, they have always been zoned for public use, most likely to
recognize the public ownership status. It should be noted that no
language exists within the comprehensive plan designating or
recommending uses for the subject lots that would be inconsistent with
the proposed use.
CONSISTENCY WITH COMPREHENSIVE PLAN
The proposed rezoning is consistent with the Comprehensive Plan Future
Land Use Map, as the R-2 zoning district corresponds with the existing
future land use classification, Medium Density Residential.
With respect to comprehensive plan goals, objectives and policies,
Objectives 6.1 and 6.3, and policies 6.1.1 and 6.3.1 generally support
the city's Infill Housing Program, this proposed rezoning, and the
intended use (see Attachment "B" for excerpts from comprehensive plan).
No other policies within the comprehensive plan apply directly to this
proposed rezoning or the proposed use .
RECOMMENDATION
The Planning and Zoning Department recommends that this application
submitted by the City of Boynton Beach be approved, based on the
following:
1. The proposed zoning for the subject parcels is consistent with the
comprehensive plan Future Land Use Map;
2. The proposed zoning and use is consistent with all goals,
objectives, and policies in the Comprehensive Plan; and

As requested, I have reduced to writing our meeting regarding my
receipt of the attached BUilding Division Memorandum #95-181,
from Al Newbold, Deputy Building Official, regarding the above-
referenced property. I was aware of the points discussed in Mr.
Newbold's memorandum when making my decision to not require a
variance for this nonconforming lot, which is part of the city'S
infill housing program. My determination continues to be that a
variance is not required prior to issuing a permit for this lot
(or lot 10 when it comes in for permit), due to the difference in
ownership between lot 9 and 10. I respectfully request my
determination to be honored by the Building Division. Thank you
for your assistance.

On May 2, 1995, Bucci Enterprises submitted an application for Permit
No. 95-1910 to construct a single family home. Our records listed the
City of Boynton Beach as the owner, and the Zoning as P.U. (Public Use
District). The ownership was changed when Mrs. Sherrod submitted a
copy of the Special Warranty Deed recorded on April 6, 1995 in
Official Record Book 8689, Page 526.
Our Plans Reviewer, Bob Donovan, could not complete his review until
he knew what Zone it would be, other than the P.U., to apply the codes
for setbacks, etc. After informing members of your staff of the code
on non-conforming lots and PU Zoning, it was our understanding that
your department would address this as it would be required of other
owners of more than one lot side by side by making application to the
Board for relief of the code requiring owner of lots or combination of
lots with the total frontage and/or area equal to or greater than that
which is required for the district to develop them as one conforming
lot.
Since both Lot 9 and Lot 10 was, per tax roll, owned by the City of
Boynton Beach at the effective date of the ordinance, we need proof
that relief by the Board was granted or proof that the City Ordinances
do not apply to the City-owned property.
If you know of any section of the code that exempts City-owned
property or you have knowledge of some other law of zoning which
applies, please submit a copy to the Permitting Section. Until we
receive same, we will place the above referenced application on hold.

Therefore, Mayor Taylor declared the public hearing closed.

Commissioner Jaskiewicz moved to approve Proposed Ordinance No. 095-08 on second
and final reading. Mayor Pro Tern Matson seconded the motion. A roll call vote
