II. PROPOSED AMENDMENT. The undersigned hereby petitions the
Planning and Zoning Board and City Commission of the City of
Boynton Beach, Florida, to amend the text of the Comprehen-
sive Plan for the reasons stated below:

the Comprehensive plan which the applicant desires to be
amended:

Nature of Amendment requested:
The nature of the
proposed text amendment is somewhat of a "house-cleaning"
because both the City and Palm Beach County alreadv have publicly
recognized that a Commercial Land Use desi~nation is far more
appropriate than a residential use. In fact. this sit~ currently
is approved in the unincorporated area for Comrn~rcial deve]opm~nt,

4, Statement of conditions, hardships, or.other reasons
justifying the proposed amendment:
As stated in the proposed text language, because of the site
configuration, residential development would be difficult, part-
icula when the issue of access to Hypoluxo Road is concerned.
The main justification for the amendment is that both the City
and Palm Beach County have agreed or approved Commercial use
for this parcel,
III. LIST OF AFFECTED PROPERTY OWNERS. For all proposed Compre-
hefi~ive Plan amendments which would change the permitted use
of property, the applicant must submit the following
materials in two (2) copies:
1. A complete list of all property owners, mailing
addresses, and legal descriptions for all properties for
which the permitted uses of said properties would be
changed, as recorded in the latest official tax rolls in
the county court house shall be furnished by the
applicant. Mailing labels for these addresses must also
be provided. Said list shall be accompanied by an
affidavit stating that to the best of the applicant's
knowledge, said list is complete and accurate. Notifi-
cation of affected property owners will be handled by
the City Clerk of the City of Boynton Beach.

2. A copy of the Palm Beach County Property Appraiser's
maps showing all of the properties referred to in
paragraph 1, above.
IV. APPLICATION FEES, Fees shall be paid at the time that the
application is submitted, according to the attached
schedule. All fees shall be paid by check, payable to the
City of Boynton Beach.

With the exception of the ~ acre parcel adiacent to Hypoluxo
Road. these parcels should be annexed and placed under the
Low Density Residential land use category, in order to ensure
compatibility with existing and future residential land uses
in the vicinity. Annexation of these properties will square
off the City's boundary and will allow the City to control
the use of these parcels. Development of these parcels
should be compatible with existing low-density single family
