SUBJECT: Mr. Mark Brandon's Property; Inquiries concerning
Land Use Amendments and Rezoning Generally
I have discussed the use of this property at length with Mr.
Brandon. I informed him that a more intensive use of the
property may be warranted, and informed him that he could submit
applications for land use plan amendment, rezoning, and
annexation at any time. Since the language in the Land Use
Problems and opportunities Section is incorporated by reference
into the Plan, it would be necessary for the application
submitted by Mr. Brandon to be accompanied by a request to revise
the text for Area 6.C. As with all such inquiries, I informed
Mr. Brandon that the Planning Department would take a position
only after an application is submitted and the Planning
Department is able to make an in-depth analysis of the
application and conditions related to the application, and that
ultimately, the decision rests with the City Commission. All
inquiries concerning land use or zoning changes are handled in
this fashion, unless it is very obvious that either the existing
land use/zoning or that which is proposed by the applicant are
inappropriate. Mr. Brandon was also informed that the
application would need to be accompanied by a traffic impact
analysis, which would need to demonstrate compliance with the
Palm Beach County Traffic Performance Standards Ordinance.
Furthermore, he was informed that approval of the application may
need to be conditioned upon building permits not being issued
until the new water treatment plant is in operation, since it is
very likely that the level of service for water which is in the
Comprehensive plan is not being met, and since additional
connections to the City'S water system at this time may be
prohibited by DER regulations. All applicants and prospective
applicants for land development orders or permits are being
informed of the water supply situation.
The low density residential land use category assigned to the
property was the result of discussions between Palm Beach County
staff and the City staff. You will find this to be the case with
respect to many of the land use recommendations contained in the
comprehensive Plan, for property located in the unincorporated
area. In d~afting the Future Land Use Element, the City staff

attempted, w~erever possible, to recommend land uses in the
unincorporated area which were agreeable to both the Boynton
Beach city Commission and the Palm Beach County Commission. In
fact, if you examine the attached copy of the Palm Beach County
land use plan, you will find that, with the exception of
Santaluces High School, all of the property in the vicinity of
the Hypoluxo Road/Lawrence Road intersection is in the County's 5
du/acre residential category. It is also worth noting that the
Countywide Planning Council is currently preparing a Countywide
Land Use Plan, and that once the Countywide Land Use Plan is
adopted, any amendments to this plan will require approval by the
County Commission. I have been informed that the adoption of the
Countywide Land Use plan will probably occur in mid-1991.
Due to the location, size, orientation of the parcel, a more
intensive land use could be justified--either to' a higher density
residential category, or to a commercial category. A primary
concern, however, would be compatibility with surrounding
properties, Therefore, setbacks, height restrictions, bUffering
measures, and use restrictions would be desirable in order to
protect the single-family residences which lie to the south.
Therefore, if the owner submits an application for commercial
zoning, it is highly recommended that it be submitted as a
Planned Commercial Development (peD). This option was discussed
with Mr. Brandon.
My reply to your inquiry concerning the status of the
Comprehensive Plan with respect to the development of the subject
property or any other property is that, according to Florida
statutes, the Plan is in full force and effect upon adoption,
regardless Ot whether DCA has found the Plan to be in compliance.
The objections which were made by DCA in their finding of
non-compliance actually have little or no substantive
relationship to applications for land development. The one issue
of sUbstance--roadway levels of service--is not an issue at this
point in time, since the levels of service adopted in the City's
plan have been entirely superseded by the Palm Beach county
Traffic Performance Standards Ordinance.
You should also know that DCA will not process land use
amendments unless the applications are accompanied by an analysis
which demonstrates that public facilities (water, sewer,
drainage, solid waste, roads, and parks and recreation
facilities) are available, consistent with the adopted levels of
service for these facilities. Since the City'S concurrency
management system is far from being adopted or in operation, the
Planning Department has been requiring that this analysis be done
by the applicant, using information provided by the City. The
City staff will then review and comment on the applicant's
analysis prior to it being sent to DCA. The current level of
staffing does not permit the Planning Department to
simultaneously produce a written concurrency report for each land
use amendment application and develope a concurrency management
system. It is anticipated that after June 1, 1990 that the City

staff will be able to evaluate the availability of public
facilities, with the exception of roads, since applicants will
continue to be required to submit a traffic impact analysis. The
June 1, 1990 date reflects the fact that Florida law requires
that a concurrency management system be adopted and implemented
by this date.

INSTRUCTIONS
All properties within a single application must be contiguous and
immediately adjacent to one another, or be the subject of
separate applications.
No application shall be accepted unless it is presented on the
official form of the City of Boynton Beach, Florida. The
applicant must submit two copies of this application and other
required information.
Before an application may be accepted, it must fully comply with
all required information as stated below.
ATTACH THE FOLLOWING REQUIRED. INFORMATION TO THIS APPLICATION:

A copy of the recorded subdivision plat if the subject
property is a lot or lots of record.

b. All other property must be shown on a certified legal
survey made by a surveyor registered in the State of
Florida and drawn to a scale appropriate to the size of
the subject property. The legal survey shall include
an accurate legal description of the subject property
to be annexed, and a computation of the total area of
the subject property, computed in square footage and to
the nearest one-tenth (1/10) of an acre.
2. A statement of the applicant's interest in the property to
be annexed, including a copy of the last recorded Warranty
Deed, and:
a. If joint and several ownership, a written consent to
the annexation petition by all owners of record, 2E
b. If a lessee, a copy of the Lease Agreement and written

c. If an authorized agent, a copy of the Agency Agreement
or written consent of the seller/owner, or

JUSTIFICATION STATEMENT
The applicant is requesting annexation and simultaneous Land
Use and Rezoning approval for an a.2 acre parcel located at
the Southeast corner of the intersection of Lawrence Road and
Hypoluxo Road,
This request is justified in that the parcel is not only
located within the City of Boynton Beach future annexation
area, but it is also specifically called out in the City's
Comprehensive Plan, Section VIII, Land Use Problems and
Opportunities in Planning Area 6.c. Unincorporated Parcels
Adjoining Northwest Corner of the city (presently
unincorporated). Annexation of this parcel, in addition to
several adjacent parcels to the south, "will square off the
City's boundary and will allow the city to control the use of
these parcels."
The benefits for this annexation request are that it will
1) reduce pockets of unincorporated areas, which in turn
reduces conflicts for providing public services,
2) will increase the City's tax base.
3) will bring additional revenue to the City in terms of
Impact Fees and Building Permit Fees.
4) commercial uses proposed for this site will have less
impact on water and sewer demand than residential uses.
Furthermore, the applicant will probably be required to
extend an a'inch water main to their east property line for
future extension by other parcels to the east, and
