A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, SUPPORTING
A REQUEST BY KILDAY & ASSOCIATES, INC., TO PALM
BEACH COUNTY FOR ROADrrRAFFIC IMPACT FEE
CREDITS FOR THE CONSTRUCTION OF KNUTH ROAD;
AND PROVIDING AN EFFECTIVE DATE.

WHEREAS, the Boynton Beach Comprehensive Plan, Ordinance 89-38,
identifies Knuth Road as a City Collector; and
WHEREAS, the City of Boynton Beach has obtained and protected the right-of-
'. way for Knuth Road as part of its adopted Thoroughfare Plan; and
WHEREAS, Knuth Road provides a critical north/south alternative to Congress
,
: Avenue between Woolbright Road and Old Boynton Road; and
WHEREAS. the City of Boynton Beach has approved Knuth Road PCD
: (Ordinance 090-70) and Tara Oaks PUD (Ordinance 090-75) and subsequently
granted time extensions as amended, which both front on Knuth Road; and
WHEREAS, the City of Boynton Beach has required petitioners of Knuth Road
.. PCD and Tara Oaks PCD to construct the missing link of Knuth Road between Boynton
: Beach Boulevard and Woolbright Road; and
'I WHEREAS, the construction of Knuth Road is considered part of completion of
: I the major road network of the City of Boynton Beach; and
! I WHEREAS, the citizens of Boynton Beach and unincorporated Palm Beach
,
. County will benefit from the completed link of Knuth Road between Woolbright Road
and Old Boynton Road; and
WHEREAS, Article 10.1 X.1.g. of the Palm Beach County Unified Land
Development Code provides impact fee credits where construction of a portion of a
major road network is proposed; and
WHEREAS. the City of Boynton Beach has determined that the construction of
Knuth Road meets the standards for credit of road impact fees.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The City Commission of the City of Boynton Beach, Florida hereby
does support the request by Kilday & Associates, Inc., to Palm Beach County for
road/traffic ir;'act fee credits for the construction #' Knuth Road.
! Section 2. This Resolution shall become effective immediately upon passage.

WHEREAS, the City Commission of the City of Boynton
Beach, Florida, has heretofore adopted Ordinance No, 80-19,
in which a Revised Zoning Map was adopted for said City; and
WHEREAS, Kilday & Associates, Inc., agents for The
Winchester Family Partnership, Ltd,; Bill R, Winchester,
Ruby A, Winchester and Elsie A, Winchester, individually and
Elsie A, Winchester as trustee, collectively referred to as
the property owners, has heretofore filed a Petition with
the City of Boynton Beach, Florida, pursuant to Section 9 of
Appendix A-Zoning, of the Code of Ordinances, City of
Boynton Beach, Florida, for the purpose of rezoning a
certain parcel of land consisting of approximately 13,871
acres located within the municipal limits of said City, said
property being more particularly described hereinafter, from
AR (Agricultural Residential) to PCD (Planned Commercial
Development), which requests that the 13.871 acre parcel be
removed from the boundaries of the AR to allow for the
processing of the rezoning application; and
WHEREAS, Ordinance 89-38, which is the Comprehensive
Plan for the City of Boynton Beach, shows the property in
the Agricultural Residential land use category, and section
163,3202(1), Florida Statutes, requires that the City's land
development regulations be amended in order to bring these
regulations into compliance with the Comprehensive Plan; and
WHEREAS, the City Commission deems it in the best
interests of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1:
The following described land, located in
the City of Boynton Beach, Florida, to-wit:
All of Tracts 9 and 10 lying south of
New Boynton Road (State Road No. 804)
and Tracts 23 and 24, Palm Beach Farms
Company Plat No.8, according to the
Plat thereof recorded in Plat Book 5 at

SUBJECT: Knuth Road Text Amendment (7.j)
As part of the Knuth Road land use plan amendment it is necessary
to amend the text of the future land use element support document
entitled Land Use Problems and Opportunities planning Area 7,
7. j.
In the original supporting document specific language was
included to delineate which portions of the property should be
given land categories of Local Retail Commercial and Moderate
Density Residential. To allow the entire Knuth Road property to
be changed, this language must be taken out of the support
document.
This amendment was reviewed as part of the annexation land
use/zoning/text amendment package for the Knuth Road Property.
Staff recommended denial of this request. The Planning and
Zoning Board recommended approval of this request. The City
commission voted to forward this request to the Florida
Department of Community Affairs for review by a 3-2 vote on June
19, 1990.
The Department of Community Affairs has commented negatively on
this petition. These comments are based on a degradation of *
traffic levels of service, whether a need for the proposed type
of land use exists and the compatibility of the proposed land use
and surrounding land uses. The applicant has submitted
information for staff that would deal with the latter two reasons
but no information on traffic.
Based on the above information staff recommends that this
amendment to the supporting document of the future land use
element of the comprehensive plan be denied.

SUBJECT: Future Land Use Support Document, Area 7.f - Ordinance
for Comprehensive Plan Text Amendment
Attached please find, and consider on First Reading at the city
Commission meeting scheduled for December 4, 1990, an ordinance
amending the text of the comprehensive plan Future Land Use
Support Document in connection with the Mall Corner Inc. and
Winchester Boulevard Restaurant (f.k.a. Retail/Oil Lube)
proposals. The request is described as follows:
Kilday and Associates, agent for Bill R. Winchester, one of
several affected property owners, are requesting an amendment to
the text for Area 7.f of the Comprehensive Plan Future Land Use
support Document, as indicated in the attached legal
advertisement. The nature of the change requested is to allow
parcels less than (3) three acres in size to be rezoned to C-3
(Community Commercial) instead of PCD (Planned Commercial
Development) if the intent of planned zoning district setbacks
and greenbelt standards are met. The application was submitted
in connection with two applications for annexation, land use
amendment to "Local Retail Commercial" and rezoning to C-3 within
the boundaries of Area 7.f. The two applications are Mall Corner
Inc. and Winchester Boulevard Restaurant.
There may be specific situations, such as Mall Corner Inc. and
Winchester Boulevard Restaurant where, owing to small parcel size
and where there is different ownership or control from
surrounding properties, it may be warranted to rezone to C-3
instead of PCD, if certain limitations are placed on the
development of the property. However, the text amendment
proposed by the applicant would allow larger properties to be
divided into parcels less than 3 acres size and there would not
be a limit to he number of smaller parcels that could be created
and developed by different property owners.

The Planning and Zoning Board approved this application for
transmittal to the Department of community Affairs (DCA) for
review on June 12, 1990, followed by the City Commission on June
19, 1990. The proposed amendment was subsequently transmitted to
the Florida Department of community Affairs for review, and the
City was notified that the proposed amendment was approved
without comments in the in the Objections, Recommendations, and
Comments report dated October 24, 1990.
The Planning Department continues to recommend that the
ordinance amending text within the Comprehensive Plan Future Land
Use Support Document be approved in order to address the logical
concerns as described above.

Also accompanying this advertisement you will find the newspaper
advertisement for the above requests. I have included with the
advertisement the original scale map so that it may be utilized
by the newspaper, if necessary, to print the advertisement
without losing the details shown on the map.
It is recommended that these applications be advertised as
follows:
Notice to Property OWners - at least 30 days prior to Planning
and Zoning Board public hearing.
First Map Ad - at least 15 days prior to Planning and Zoning
Board public hearing.
Second Map Ad - at least 6 days prior to Planning and Zoning
Board public hearing.

The above schedule exceeds statutory requirements and is
