Dear Tambri,
Thank you for meeting with me on Monday, December 5, 1994, in regard to the
proposed Master Plan for Sausalito Groves PUD. Attached please find eight (8) sets and
reduction of revised Master Plans addressing those issues we discussed. I have the
following additional information to offer in regard to this project.
This project was previously approved by Palm Beach County in two (2) parts, an adult
congregate living facility along Lawrence Road and a mobile home condominium park
off of Gateway Blvd. These approvals were extinguished by Palm Beach County on
May 11, 1994 concurrent with their approval of a 164 unit residential development.
Therefore, there is no current Resolution approved for this project. Additional right-of-
way required by Palm Beach County for Lawrence Road and Gateway Boulevard as part
of the original zoning approvals have been dedicated even those these approvals were
subsequently extinguished. Attached please find copies of the recorded right-of-way
deeds. This site was recently approved by the Palm Beach County Final Development
Review Committee as a subdivision under the straight RM zoning district requirements.
For your information, I have attached a copy of a letter from Palm Beach County
reflecting the abandonment of the Resolutions and approval of the subdivision plan. I
have also included a copy of the traffic report prepared by Simmons & White, Inc. for the
Palm Beach County approval.
The proposed plans have been amended to address concerns raised in regard to the
recreation areas. Parking has been provided for the recreation area based on the
parking calculation included in Section 11.H.16.e.(12). Twenty-five parking spaces are
required and have been accommodated within the 0.98 acre recreation tract. Minor site
plan adjustments have been made to this recreation area to accommodate the parking
and relocate the shuffle board courts. Discussions with the proposed project developer
indicate that he would prefer to keep the shuffle board courts as an integral part of the

0.98 acre recreation tract instead of relocating them to the open space tract on the west
side of the road due to public health, safety and welfare concerns of residents crossing
the main entry road to utilize any amenities provided on the west side of the main road.
Also, the 0.3 acre recreation tract adjacent to the Lawrence Road entry has been
amended to reflect a picnic area including picnic tables and a bar-be-que. The site data
on the Master Plan has been amended to reflect a breakdown of required and provided
areas for the five recreational amenities.
The landscape buffer along Gateway Boulevard has been clarified as well as the height
requirement for the proposed wall within the Lawrence Road and Gateway Boulevard
buffer. A typical cross-section of these buffers has been accommodated on the
conceptual landscape plan. Also, this section has been noted to provide for a five foot
clear zone between any proposed screen enclosure and the wall for fire access. A
maturity specification for the trees consistent with the City's code has also been added.
This site supports old citrus trees on a majority of the property. Along the irrigation
canals, invasive vegetation including large Australian Pines and Brazilian Pepper have
grown. There is no significant native vegetation on-site, therefore, no preservation area
has been provided for. A note has been added to the conceptual landscape plan that
if any significant native vegetation falls within the proposed landscape buffers, it will be
preserved at the discretion of the City Forester.
In regard to the buffering between this project and the existing single family residents to
the southeast, we visited the site and noted that many of the lots already have fences of
varying design. To further establish this buffer and promote safety and security for all
parties, we proposed a 5' height chain link fence with a hedge planted directly adjacent
to it. The hedge will grow and infill the fence to provide a soft barrier.
Additional notes including signage easements, limited access easements and street
lighting have been added to the plans. Engineering issues including a minimum twenty-
two foot (22') pavement width to meet City Code and notes on sodding and ilTigating
swale areas have also been added. We have proposed a sidewalk along the Lawrence
Road frontage which will connect into the sidewalk conditioned as part of the Boynton
Nurseries PUD approval to the north. A review of the aerial indicates that the bike path
has been provided for on the east side of Lawrence Road. As part of the widening
project for Gateway Boulevard, a sidewalk has been provided on the north side of
Gateway Boulevard. This existing sidewalk is shown on the site plan.
We have added a typical lot detail to address those lots which back up to a right-of-way,
either external or internal. Also, pursuant to your request, we have designated which
typical lot detail is applicable for each lot within the project. There are several irregular
shaped lots on this plan. The area designated as buildable area per lot is meant to
reflect the minimum setback requirements. Needless to say, any proposed structures

must meet all City of Boynton Beach Zoning Code and proposed setback requirements.

SITE DATA
The subject parcel is located generally in the northwest quadrant
of the intersection of Lawrence Road and N.W. 22nd Avenue and
contains approximately 31 acres. The unimproved site is
currently vested for a 203-unit A.C.L.F. and a 143-unit mobile
home park under Concurrency Exemption Extension No. 0518004X1
(expiration August 20, 1994) and 0518005X1 (expiration June 15,
1994), respectively. Proposed site development consists of a
164-unit multi-family, duplex development with access to both
N.W. 22nd Avenue and Lawrence Road. For additional information
concerning site location and layout, please refer to the site
plan prepared by Kilday and Associates.
TRAFFIC GENERATION
The Palm Beach County Unified Land Development Code Article 7,
Section 7.9 (I) C - Traffic Per1'ormance Standards, APPLICABILITY,
Subsection 2 (A) requires that for any application for a site
specific development order on property on which there is a
previous approval shall be subject to the Palm Beach County
Traffic Performance Standards to the extent the traffic
generation projected for the site specific development order
exceeds the traffic generation of the previous approval. The
generation rates and capture rates of the previous approval shall
be updated to current pro forma traffic generation and pass-by
rates and shall be used to calculate previous approval traffic.
The previous approval traffic from the A.C.L.F. and mobile home
development may be calculated as follows in accordance with the
rates provided in Table 10.8-1 Fair Share Road Impact Fee

Dear Ms. Heyden,
Pursuant to our discussions at our recent meeting of November 8, 1994, I am
submitting six (6) copies of the Sausalito Groves Master Plan for your review. This
master plan has been updated from the existing approved master plan within
Palm Beach County to include the data and requirements of the City of Boynton
Beach. By providing this additional data to you, I have hopefully clarified some
of the outstanding issues that we have discussed.
Additional information has been added to this plan in accordance with the topics
we discussed during our meeting. While we would appreciate your reviewing the
entire plan, I would like to highlight a few of these issues:
1. The private recreation facility plan has been upgraded to include the
minimum five (5) recreational uses as well as the required acreage
to meet the code requirements of the City of Boynton Beach.
2. The landscape buffer along Lawrence Road has been increased
from it's existing approved width of ten (10) feet to fifteen (15) feet.
Additionally, the landscape buffers along both Lawrence Road and
Gateway Boulevard will contain a wall to further mitigate the impact
of these roads on the adjacent residential lots.
3. Additional information has been provided regarding proposed
setbacks for building units, pools, and screened enclosures. In
developing a plan for the setbacks, we have relied upon some of
staffs previous comments and concerns which we received during
the review of the adjacent Planned Unit Development to the north.
Pursuant to our discussion, it is our intent to submit this plan at this time for your
review so that the plan can be attached as an exhibit to the annexation

agreement. It is our understanding that the Rezoning Ordinance which
accompanied the Annexation and Land Use Ordinances must be readvertised to
reflect the proposed zoning of Planned Unit Development (PUD). It is also our
understanding that first reading of the new Planned Unit Development Ordinance
will be scheduled for December 6, 1994, and that second reading and public
hearings will be scheduled for December 20,1994. As I indicated at our meeting,
our clients will be responsible for the cost of advertising the revised Ordinance.
I will be in contact with you shortly to determine what other coordination should
be provided by our office in this matter.
After you have had a chance to further review the plan, I will make myself and my
clients available to review the plan with you. If any changes are required to the
plan, we will be prepared to promptly update the plan so it can be included with
the final adopted annexation agreement. Please call me if you have any

Pursuant to your request, my office has had an opportunity to review and
compare the City of Boynton Beach Planned Unit Development (P.U.D.)
regulations outlined in the City of Boynton Beach Zoning Code, Appendix B,
against the approved Palm Beach County site plan for the above referenced
project. Currently, this piece of property is within the unincorporated Palm Beach
County area. It went before the Development Review Committee (DRC) on May
11, 1994. The project is known as Petition No. DRC-89-101 and the current
approved plan (a copy of which is attached) is known as Exhibit 23.
This 31.5 acre site is currently approved for 164 units. The units are comprised
of an attached two (2) unit town home as classified by the Palm Beach County
Zoning Code. These are similar to villa or duplex units and are proposed to be
located on a fee simple lot along a dedicated 50' wide right-of-way.
The table below compares the LUI ratings outlined in the City of Boynton Beach
Code against the currently approved Palm Beach County site plan. This project
corresponds to an LUI rating of 5.00.

In reviewing the City of Boynton Beach Landscape Code for landscape
requirements, the currently approved Palm Beach County Site Plan exceeds all
requirements with the exception of the safe site corners provided. The City of
Boynton Beach requirement is for a 35' safe site corner whereas the County's is
a 25' safe site corner. This change can easily be accommodated on the site plan.

As I indicated to you on the telephone recently, this project was recently approved for 164
multi-family units by the Palm Beach County Development Review Committee. This
approval took place on May 11, 1994. The County has not yet sent us a formal approval
letter but we expec1 one momen1arily and we will make it available to you as soon as it
is received. I am attaching a copy of the approved site plan for your review.
You also are requesting a bit of information about the recent DRC approval and the basis
for our request. I am attaching a copy of our Justification Statement which was submitted
with our DRC application. If you need more information than is provided in that
statement, please feel free to give me a call.
This projec1 had two (2) previous Concurrency Exemptions in place based upon the 1wo
previous development orders. When we filed the new Development Review Committee
application, we submitted to the Palm Beach County Planning Division a Concurrency
Equivalency Determination which compared the impac1s of the approved projec1s with the
proposed project in terms of all eight of the Concurrency items recognized by the Palm
Beach County Planning Division. You will note on our Concurrency Equivalency
Determination Worksheet and the attached documentation that none of the Concurrency
impac1s of the new project exceeded any of those already available from the old ones.
I am also attaching for your use a copy of the newly issued Concurrency Exemption
Extension Certificate which reflects the latest approved site plan.

JUSTIFICATION STATEMENT
FOR
SAUSAUTO GROVES
This property consists of 31.51 acres at the northwest corner of Lawrence Road
and NW 22nd Avenue west of Boynton Beach, Florida. Presently this property has
two active zoning approvals in place. Petition 89-101 (R 90-370) is for 143 mobile
homes on the west 21.7 acres of this property. Petition 89-102 (R 90-371) is for
203 ClF units on the east 9.7 acres. The property is platted as one parcel - Plat
Book 60, Pages 44 and 45.
It is the property owner's desire to abandon both of the above zoning approvals.
Per UlDC Section 5.1.N.2.a., these development orders may be abandoned
simultaneously with the issuance of subsequent development orders. Therefore,
two abandonment applications will be filed concurrently with this Development
Review Committee application, one for each of the two existing development
orders. Neither of the old development orders were implemented even though
they both complied with their conditions of approval.
Simultaneously with the approval of the abandonments, a new Development
Review Committee approval will be secured for a multi-family residential project
consisting of 164 duplex units in 82 buildings on the entire 31.5 acres. The new
plan will retain an access point on Lawrence Road and one on NW 22nd but will
otherwise be completely re-site planned.
One Hundred and Sixty Four units on 31.5 acres yields a gross density of ~ 5'. Z I
dwelling units per acre. This property has a Comprehensive Plan designation of
HR-8 and is currently zoned RM-Multi-Family Residential (Medium Density). This
project will conform to standard density. It does not seek a density bonus and
does not exceed the thresholds found in Table 6.4-3. Therefore, the project will
not be a planned development. The use is permitted in the zoning district. Per
UlDC Section 5.6. D.10.a., "permitted uses may occur.... in place of the approved
use." Both the existing site plans and the existing special exceptions will be
abandoned so the new site plan will completely supplant the old development
order and will become the only existing development order.
Both of the existing projects have Concurrency Exemptions. These exemptions
will be "converted" via a Concurrency Equivalency Determination to reflect the new

development order. The new project will not exceed any of the Concurrency
impacts of the two prior projects combined.
The reason for the conversion of this project from mobile home and ClF uses to
multi-family is the fact that multi-family projects of this type are more marketable
in today's economy than either ClFs or mobile homes.
For purposes of this DRC approval, this project will utilize the existing plat in lieu
of having a new survey prepared. This is acceptable to the County, according to
Mr. Murnan, because the property will need to be ra-platted in any case. The ra-
plat will eliminate Tract B and the drainage easement along Lawrence Road which
was to serve Tract B. The landscape buffers also will need to be removed from
the plat because they will no longer be needed for the new site plan.

Dear Angela,
The purpose of this letter is' to explain our calculations found on the attached
Concurrency Equivalency Determination.
SOLID WASTE: According to a memorandum prepared by Dr. Marc Bruner of
the Solid Waste Authority dated August 3, 1993, Mobile Homes generate 1.14 tons
per unit per year of solid waste. CLFs are treated the same as nursing and
convalescent homes according to Dr. Bruner, so they therefore generate 5.9 Ibs
per square foot per year. Multi-Family units such as the duplexes being proposed
on the new site plan generate 0.8 tons per unit per year according to Dr. Bruner.
Therefore, the reserved capacity for the existing approvals may be calculated as
follows:
143 Mobile Homes x 1.14 t!u/y = 163.02 tons per year
203 CLFs (CLF Building is 180,000 S.F.) x 5.9 tons per S.F. per year = 1,062,000
+ 2,000 = 531 tons per year
Therefore, a total for the approved project is 694 tons per year. The proposed
project may be calculated as 164 multi-family units x 0.8 tons per unit per year =
131.2 tons per year.
TRAFFIC: According to the traffic report prepared by Simmons & White, Inc.
(copy attached), the existing project generates 1,150 ADTs and the proposed
project will generate 1,148 ADTs.

TRANSIT: Per Mr. Blackshear of the Metropolitan Planning Organization in a
conversation on March 31, 1994, this project does not lie on a mass transit route.
DRAINAGE: According to the Drainage Statement prepared by Simmons & White,
Inc. (copy attached), this project does have legal positive outfall via the Lake
Worth Drainage District L-21 Canal.
WATER: According to calculations provided by Kilday & Associates, Inc. to the
City of Boynton Beach Utilities Department and accepted by that department, the
water requirements of the new project will be lower than the requirements of the
existing approvals. See attached letters.
SEWER: According to calculations provided by Kilday & Associates, Inc. to the
City of Boynton Beach Utilities and accepted by them, the existing approval for
this project would have a higher sewer requirement than the proposed
development. See attached letters.
PARKS AND RECREATION: This project will provide on-site recreation in
accordance with the formula found in the Palm Beach County Subdivision
Ordinance.
FIRE RESCUE: According to Lieutenant Ellis of the Palm Beach County Fire
Rescue, this project is covered by Station No. 41 which is four miles from the
project.
Please feel free to call me if you have any further questions concerning this
Concurrency Equivalency Determination. As you may know, we have submitted
an application for Development Review Committee approval of our revised project

issued by the Environmental Resources Manaqement (ERM)
Department. Failure to obtain a permit prior to commencement
of site alteration will result in appropriate administrative
enforcement actions necessary to bring the site into
compliance. Your vegetation application will remain valid for
six months on file with ERM. After six months the applicant
or property owner is required to inform our office in writing
that the site vegetation and layout information is consistent
with the original application on file. If site conditions or
modifications to site design are requested, a revised

The Department gives notice of its intent to find the
Amendment to the Comprehensive Plan for the City of Boynton Beach,
adopted by Ordinance No. 094-54 on January 3, 1995, IN COMPLIANCE,
pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.
The adopted City of Boynton Beach Comprehensive Plan Amendment
and the Department's Objections, Recommendations and Comments Report,
(if any), are available for public inspection Monday through Friday,
except for legal holidays, during normal business hours, at the city
of Boynton Beach, City Hall, Planning and Zoning Department, 100 E.
Boynton Beach Boulevard, Boynton Beach, Florida 33425.
Any affected person, as defined in Section 163.3184, F.S., has
a right to petition for an administrative hearing to challenge the
proposed agency determination that the Amendment to the City of
Boynton Beach Comprehensive Plan is In Compliance, as defined in
Subsection 163.3184(1), F.S. The petition must be filed within
twenty-one (21) days after publication of this notice, and must
include all of the information and contents described in Rule 9J-
11.012(7), F.A.C. The petition must be filed with the Agency Clerk,
Department of Community Affairs, 2740 centerview Drive, Tallahassee,
Florida 32399-2100, and a copy mailed or delivered to the local
government. Failure to timely file a petition shall constitute a
waiver of any right to request an administrative proceeding as a
petitioner under Section 120.57, F.S. If a petition is filed, the
purpose of the administrative hearing will be to present evidence and
testimony and forward a recommended order to the Department. If no
petition is filed, this Notice of Intent shall become final agency
action.
If a petition is filed, other affected persons may petition
for leave to intervene in the proceeding. A petition for interven-
tion must be filed at least five (5) days before the final hearing
and must include all of the information and contents described in
Rule 60Q-2.010, F.A.C. A petition for leave to intervene shall be
filed at the Division of Administrative Hearings, Department of
Management Services, 1230 Apalachee Parkway, Tallahassee, Florida
32399-1550. Failure to petition to intervene within the allowed time
frame constitutes a waiver of any right such a person has to request a
hearing under Section 120.57, F.S., or to participate in the adminis-

On January 3, 1995 the ordinance to annex the Sausalito Groves
property was approved by the City. As part of the annexation
process, the City entered into an agreement with the property
owner which, in part, established the existing master plan (as
certified in Palm Beach County on May 11, 1994) as an approved
master plan in the City of Boynton Beach. In accordance with the
City's Concurrency Management Ordinance, the Sausalito Groves
master plan has concurrency certification for the following
facility categories: drainage, roads, and neighborhood parks.

Dear Ms. Dunham:
The Sausalito Groves PUD property, located approximately 632 feet
west of the intersection of Gateway Boulevard (N.W. 22nd Avenue)
and Lawrence Road; more particularly located as specified within
the attached legal description, is currently being processed for
annexation from unincorporated Palm Beach county, Florida into
the City of Boynton Beach, Florida. concurrently with this
application for annexation, applications for land use amendment
and rezoning are being processed. These applications are being
processed so that upon annexation, city land use and zoning
designations will be established that are comparable to the
current Palm Beach county land use and zoning designations on the
property and recognize Palm Beach county master plan/site plan
approvals that have been granted to date on the property.
Land use amendment applications require transmittal to the
Florida Department of community Affairs (DCA). The Sausalito
Groves land use amendment is currently being reviewed by DCA and
based on the time frames established by state law, the
annexation, land use amendment and rezoning should become
effective within approximately 60 days. After the effective
date, the land use will be Moderate Density Residential and the
zoning district will be PUD (planned unit development) - see
attached annexation, land use amendment and rezoning ordinances
approved by the City of Boynton Beach on January 3, 1995, prior
to transmittal to DCA. .

Lastly, the city of Boynton Beach has no development moratoriums
in effect. I hope this information is sufficient to verify the

Dear Mr. Pennock:
Enclosed you will find five (5) copies (individual copies have been
simultaneously sent to the Treasure Coast Regional Planning Council,
the FDOT-District Four, the South Florida WMD, and the Department of
Environmental Protection) of the required documents for the above-
referenced comprehensive Plan amendment. You will recall that the
adoption of Amendment #3 (a.k.a. Epstein Property) was delayed due to
the development and approval of an annexation agreement, therefore
only five (5) amendments of 94-1 were originally transmitted.
This amendment consists of only an amendment to the Future Land Use
Map of the Comprehensive Plan (please note that no goal, objective, or
policy was amended), and is also City-initiated in connection with the
City's Annexation Program.
With respect to date of adoption, Item #3 was finally adopted on
January 3, 1995.
Regarding provision of the Plan to other agencies, the Plan and
adopted support documentation has been provided to the reviewers and
were informed that their copy would be updated, rather than replaced
by subsequent amendments (new versions of the map will be provided).
With respect to the remaining submittal requirements outlined in the
amended Rule 9J-11.011, the following has also been provided;

This letter serves as an invoice for the cost for notifications and
the legal advertisement, as required in connection with the
revisions to the Sausalito Groves land use amendment and rezoning.
You will recall that these costs were agreed to be paid to the
City, pursuant to discussions at our November 8, 1994 meeting.
The total amount ($858.56 for December 2nd and December 13th
advertisements in the "Boynton Beach News", required for
readvertisement, and $37.10 for postage, copying, and supplies,
necessary for renotification to property owners within 400 feet) is

Dear Carrie, Jim, and Tambri:
Enclosed please find a draft of a Annexation Agreement for the Sausalito
Groves property. I have used a form of this ,1i,.g:l:'aelllent in other
municipalities to accomplish similar goals.
The Agreement seeks to preserve the property o1lme~,qs rights under his
existing approved site plan in Palm Bead! County, subject to an
Administrative Review by the city to insure compliance with the City's
Codes to the maximum extent possible without a reduction in density.
It also provides that in the event the property owner or any successor
chooses to change the zoning of the property; then, in that event, they
will have to proceed through the entire City process. In other words,
it only protects the existing approved development.
After you have had an opportunity to review the Agreement, I would
appLeciate any comments you may have so that we may move the annexation,
Plan Amendment, Re-zoning Designation and Annexation Agreement through
the process as quickly as possible.

(hereinafter referred to as the "City").
WIT N B S B T H:
WHEREAS, certain real property currently located in the
unincorporated portion of Palm Beach County, Florida, owned by the
Owner and described in Exhibit "A" attached hereto, is being
considered by the City for annexation into its municipal boundaries:
and,
WHEREAS, the Owner has certain valid County land use and
zoning approvals: and,
WHEREAS, the City and the Owner have agreed to retain the
existing County approvals on said property and to make City
approvals compatible with the existing County approval, and to
provide for an orderly transition of the property from the County
to the City.
NOW THEREFORE, the Owner and the City agree to the above
recitals and to the following terms and conditions:
1. REAL PROPERTY SUBJECT TO AGREEMENT. The real property
subject to this Agreement is described in Exhibit "A" hereto (the
"Property").
2. EXISTING ZONING APPROVAL AND LAND USE PLAN DESIGNATION.
The Property is presently zoned in the County as RM-Multifamily
Residential and is designated on the County Land Use Plan as HR-8,
High Residential 8. The Property has an approved site plan in the
certified May 11, 1994.

is more fully described in the site data attached as Exhibit "B".
3.
THE CITY'S ZONING AND LAND USE PLAN DESIGNATION.
The
City agrees that in order to allow the Owner to develop the
Property in accordance with its existing approval, it shall be
annexed into the city and simultaneously be given the future Land
Use Designation of Moderate Density Residential, and be zoned
esidential PUD.
The owner agrees to submit a site plan to the

5. STATUS OF AGREEMENT. The parties agree and acknowledge
that this Agreement is not a "development agreement" as contemplated
by Sections 163.3220 - 163.3243, Florida Statutes, and that the

provisions of said sections are not applicable to this Agreement.
The parties acknowledge and agree that no infirmity or defect in
the City's actions described herein shall nullify or otherwise
affect the annexation of the Premises into the City.
5.
AGREEMENT TO RUN WITH THE LAND.
It is the express
intent of the parties that this Agreement run with the land, and
this Agreement shall inure to the parties, the respective heirs,
legal representatives, assigns and successors in interest, as the
case may be.
6.
ENTIRE AGREEMENT. This Agreement constitutes the entire

There are
oral or written
promises, conditions, representations, understandings or terms of
any kind as conditions of inducement to the execution hereof, and
none have been relied upon by either party.
Any subsequent
conditions, representations, warranties or agreements shall not be
valid and binding upon the parties, unless they are in writing and
signed by both parties and executed in the same manner as this
Agreement.
7.
SEVERABILITY.
In the event any term or provision of

shall be enforceable to the fullest extent permitted by law as if

8. EFFECTIVE DATE. This Agreement shall become effective
upon its execution by the City and the Owner and upon the
annexation of the Premises into the City.
9. ATTORNEY'S FEES. In the event either party must enforce
this Agreement through legal proceedings, the prevailing party
shall be entitled to reasonable attorney's fees and costs incurred.
