CITY BY AMENDING THE LAND USE ELEMENT OF
THE COMPREHENSIVE PLAN OF THE CITY BY
ADOPTING THE PROPER LAND USE OF CERTAIN

HEREINAFTER; SAID LAND DESIGNATION IS

WHEREAS, the procedure for amendment of a Land Use
Element of a Comprehensive Plan as set forth in Chapter 163,
Florida Statutes, has been followed; and
WHEREAS, after public hearing and study, the City
Commission deems it in the best interest of the inhabitants
of said City to amend the aforesaid Land Use Element of the
Comprehensive Plan as adopted by the City herein.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION

163.3202(1), Florida Statutes, requires that the City's land
development regulations be amended in order to bring these
regulations into compliance with the Comprehensive Plan; and
WHEREAS, the City Commission deems it in the best
interests of the inhabitants of said City to amend the
aforesaid Revised Zoning Map as hereinafter set forth.

Section 2:
That Section 6 and 6(a) of the Charter
of the City of Boynton Beach, Florida, is hereby amended to
reflect the annexation of said tract of land more
particularly described in Section 1 of this Ordinance.
Section 3:
That by Ordinance adopted simultaneously
herewith, the proper City zoning designation and Land Use
category is being determined as contemplated in Section
171.162(2) Florida Statutes.
Section 4:
All ordinances or parts of ordinances in
conflict herewith are hereby repealed.
Section 5:
Should any section or provision of this
Ordinance or any portion thereof be declared by a court of
competent jurisdiction to be invalid, such decision shall
not affect the remainder of this Ordinance.
Section 6:
This Ordinance shall not be passed until
the annexation has been advertised for four (4) consecutive
weeks in a newspaper of general circulation in the City of
Boynton Beach, Florida, as required by Section 171.044,
Florida Statutes.
Section 7:
This Ordinance shall become effective
immediately upon its final passage.
Section 8:
Specific authority is hereby given to
codify this Ordinance.
Section 9:
This Ordinance, after adoption, shall be

The adopted City of Boynton Beach Comprehensive Plan amendments and the
Departmtlnt's Objections, Recommendations, and Comments Report, are available for
public inspection Monday through Friday, except for legal holidays, during nonnal
business hours, at the City Hall, Planning Department, 100 East Boynton Beach
Boulevord,.Boynton Beach, Florida 33435.
Any affected person, as de~ned in Section 163.3184, F.S., has 0 right to petition
for an administrative hearing to challenge the proposed agency dete~ination that the
amendments(s) to the City of Boynton Beach Comprehensive Plan ore in compliance,
as defined in Subsection 163.318411 ), F.S. The petition must be Wed within twenty~one
(21 ) days after publication of this notice, and must include all of the infonnation and
contents described in Rule 9J-11.012(8), F.A.C. The petition shall be ~Ied with the
Agency Clerk, Department of Community Affairs, 2740 Centerview Drive, Tallahassee,
Florida 32399- 2100. Failure to timely ~Ie a petition shall constitute a waiver of any right
to request on administrative proceeding as a petitioner under Section 120.57, F.S. If
a petition is ~Ied, the purpose of the administrative hearing will. be to present evidence
and testimony and forward a recommended order to the Department. If no petition is
~Ied, this Notice of Intent shall become ~nal,agency action. .
If a petition is ~Ied, other qffected persons may petition for leave to intervene in the
proceeding. A petition for intervention must be ~Ied at l8?st~ve (5) days before the ~nal
hearing and must include 011 of the infonnation and contents described in Rule 221-
6.010, F.A.C. A petition for leave to intervene sholl be ~Ied at the Division of

stories within 400 feet of these single-family
lots.

Accompanying this memoranmdum you will find a copy of the
application and supporting documentation for annexation, text
amendments, land use element amendment and rezoning for the
following:
1. Boynton Beach Boulevard PCD
2. Knuth Road PCD
The application fees for the above have previously been
transmitted to the Finance Department.
Also accompanying this advertisement you will find the newspaper
advertisement for the above requests, I have included with the
advertisement the original scale map so that it may be utilized
by the newspaper, if necessary, to print the advertisement
without losing the details shown on the map.
It is recommended that these applications be advertised as
follows:
Notice to Property Owners - at least 30 days prior to Planning
and Zoning Board public hearing.
First Map Ad - at least 15 days prior to Planning and Zoning
Board public hearing.
Second Map Ad - at least 6 days prior to Planning and Zoning
Board public hearing.
Third Map Ad - at least 7 days prior to City Commission public
hearing.
The above schedule exceeds statutory requirements and is
consistent with past City policy for these applications. Also
note that both of these applications include annexation and
should be advertised for four consecutive weeks, consistent with
Chapter 171.044, F.S., if approved by the City Commission and the

placed in the "Local News" section of the Palm Beach Post. It
would be permissible for the newspaper to retype these
