Dear Ms. Heyden:
Thank you for meeting with me yesterday, I am writing this letter to confirm the process
that we discussed yesterday, as well as to confirm the existing status of the above-
referenced project. I would appreciate your written response and/or confirmation of the
facts contained in this letter, as the issues contained herein are important in our
negotiations with potential users of the Boynton Beach Planned Commercial Development
site.
Yesterday, we agreed that the existing Master Plan approval for the Planned Commercial
Development had expired. Furthermore, we agreed that the existing Planned Commercial
Development Zoning District requires a Master Plan. Finally, we agreed that the ultimate
development of the Boynton Beach Planned Commercial Development will most likely
result in a different building configuration and layout than what was shown in the original
1989 approved plan.
We also agreed that the property currently continues to maintain a designated zoning on
the Boynton Beach zoning map of PCD, and an underlying Comprehensive Plan
designation of Commercial Local Retail. It is my understanding from our discussion that
the property currently is vested in terms of the Comprehensive Plan's land use and the
concurrency associated with the original approval (intensity as indicated by the original
square footage). However, when the site is ready to develop, a new Master Plan and
Rezoning application will need to be submitted to the City of Boynton Beach for its review.
The new application would need to contain all materials associated with a normal zoning
request, along with any justification for concurrency needs which would exceed those of
the original approval.

clients continue to market the client to the ultimate end user, and at such time the users
are determined, make the appropriate applications to the City.

Dear Mr. Kessler:
Accompanying this letter you will find materials which are
related to Comprehensive Plan Amendments for the City of
Boynton Beach. These plan amendments were considered by the
Planning and zoning Board, sitting as the Local Planning
Agency, and also by the City Council, at public hearings
which were.held after due public notice. The City Council
of Boynton Beach has approved the transmittal of these plan
amendments to the Department of Community Affairs. One
previous plan amendment has been submitted to the Department
of Community Affairs in 1986 - an application for a Future
Land Use Plan Amendment submitted by Knuth Road Associates,
Inc., which was received by the Department of Community
Affairs on March 14, 1986. None of the plan amendments
accompanying this letter are directly related to a proposed
development of regional impact or are required due to an
emergency as defined in section 163.3187(1), Florida
Statutes. The materials which are being transmitted consist
of ten (10) copies of the following:
Attachment "A", which is the current Comprehensive Plan
including the Future Land Use Plan.
Attachment "B", which is the proposed Comprehensive Plan
Evaluation and Appraisal Report, and which includes the
proposed Future Land Use Plan. The addendum which is
attached to the inside cover of the Evaluation and Appraisal
Report contains those changes which the City Council has
made to the report document, and should be considered to be
part of the Evaluation and Appraisal Report.

Attachment "C", which consists of support data upon which
the Evaluation and Appraisal Report is based.
Attachment "D" which is a letter from the Department of
Community Affairs dated October 21, 1985 confirming the
City's ability to proceed with the adoption of the
Evaluation and Appraisal Report. The Evaluation and
Appraisal Report was begun prior to the effective date of
the 1985 Local Government Comprehensive planning and Land
Development Regulation Act, and therefore does not entirely
conform to the requirements of this act.
Attachments "E", "F", and "G" which consist of the fOllowing
amendments to the Future Land Use Plan contained in the Land
Use Element:

Gentlemen:
In accordance with the revi ew of access, at this mornings TRB
meeting the applicant hereby wishes to amend the access plan as
follows:
1) Access shall be limited to three points along High Ridge
Road, as illustrated on the enclosed exhibit "A" drawing.
2) Each of the access points shall allow left turns in and
out and right turns in and out.

As per the dicussion at the T.R.B. meeting on 13 May 1986, I feel the
entrance on N.W. 22nd Ave. has to be eliminated. The entrance is too
close to the intersection of both 1-95 (S.R. 9) and to High Ridge Rd.
I also feel the number of entrances onto High Ridge Rd. from the site is
excessive. I feel the number should be reduced to one with an enclosed
loop road or at most two entrances with a loop connector road.

I have been contacted by Mr. Roy Barden of Roy Barden Planning Group,
in regards to two rezoning applications.
Application number one is a 13.03 acre parcel of land located at the
Southwest corner of I-95 and N.W. 22nd Ave. This parcel will be
rezoned to a planned commercial district if rezoning is approved.
Application number two is a 10.84 acre parcel of land located at the
Southwest corner of High Ridge Road and the proposed Miner Road extension.
This parcel will be rezoned to planned industrial district if rezoning is
approved. This parcel is not yet in the city but is planned to be annexed
in the near future.
Mr. Barton inquired as to police service to the two parcels and was in-
formed by me that police service is t~ing provided in the case of application
number one and will be provided regai"less of rezoning. I also advised

TRAFFIC IMPACT ANALYSIS
A traffic impact statement for the proposed office site to be located west of 1-95
and south of Northwest 22nd Avenue in Boynton Beach, Florida was completed.
This traffic impact statement examined six intersections through which the office
traffic will travel. The analysis utilized data from the Boynton Beach Park of
Commerce DRI and Palm Beach County.
PlanninR; Data
Land use data for the subject property was provided by the Roy Barden Planning
Group. The site will consist of 287,750 square feet of office space to be
constructed in one phase in a ten-year time frame.
Trip Generation
The Palm Beach County trip generation rate of 11.0 trips per 1,000 square feet was
used which resulted in 3,165 trips per day. An internal capture rate to and from
the entire Boynton Beach Park of Commerce of 5% was determined resulting in
3,007 external daily trips with a total of 599 external PM peak hour trips (124
inbound and 475 outbound).
Traffic Distribution and Assignment
The traffic distribution used for the additional office use was essentially the same
distribution used in the previous analysis of the overall Boynton Beach Park of
Commerce. For purposes of this analysis, it was determined that the additional
office traffic would distribute in the following manner:

This traffic was then assigned to the adjacent street network within the study area,
including the overall Boynton Beach Park of Commerce.
The impact traffic and total traffic for the full build-out of the Boynton Beach
Park of Commerce and the City/County Comprehensive Land Use Plans for the PM

Roadway Needs
Critical movement analyses were performed at six intersections using the method
prescribed in the Transportation Research Board Circular No. 212. The total
traffic volumes shown in Figure I were used to determine the Level of Service at
each of the six intersections. The roadway requirements for each of the six
intersections to operate at Level of Service "D" or better are shown in Figure 2.
These are the roadway needs for full build-out of the Boynton Beach Park of
Commerce and the area's comprehensive plans, and not just for the full build-out of

per day. If any effective form of Traffic Systems Management is implemented,
