Justification Statement
This City owned 13.03 acre parcel of land is presently desig-
nated for recreational use on the adopted comprehensive land
use plan. Current zoning is REC - Recreational. Existing use on
the northern part is for an outdoor pistol range under a lease
arrangement with the Fraternal Order of Police, #49. A building
on the site is used for meetings of sheriff's deputies and their
families during firearm practice.
Access to the site is by way of an unimproved trail driveway
through private property on the west. See attached survey.
Continued use of this parcel in a recreational land use cate-
gory cannot be justified because of its location, size and shape.
The size would restrict its park functional useage to a neighborhood
type, Because of its location at the intersection of Interstate 1-95
and the NW 22 Avenue overpass, children could not walk to the site
safely from eastern or northern city neighborhood. The shape of
the site, and topographic character, restrict its functional use for
softball, baseball and football use.
Specialized recreational useage, such as a pistol range, is
similarly difficult to warrant because of nearby traffic on Inter-
state-95 and NW 22 Avenue. Although trained professionals practice
the use of firearms, there are risks involved, especially as the vac-
ant land surrounding the parcel is built up with light industrial/
office/hotel uses, Firearm practice sites belong indoors in a
controlled environment, or in totally uninhabited, isolated areas.
It is proposed that this parcel be rezoned Planned Commercial
Development (PCD) for development as offices and/or hotel alter-
nate. A future interchange at NW 22 Avenue with Interstate-95 -
especially in connection with the proposed relocation of High Ridge
Road - will provide exceptionally improved access to the parcel, and
thus increase the land's capacity to carry office useage with mini-
mal negative impact. But the very nature of these needed highway
improvements, makes park use even less desireable,
As one or more office sites, the 13.03 acre parcel could be
developed with a total of about 287,750 square feet of general office
use and still comply with the PCD restrictions, parking requirements
and building height limitation, The sloping character of the site
will encourage a multi level design for office buildings and garage
structures (if used), and result in an open site solution,

Comparison of Impacts
Continued use of this parcel for a pistol range will not cre-
ate significant traffic impacts on the public transportation sys-
tems since the number of sheriff's vehicles entering the facility
are minimal. Further impact to the environment, most public facil-
ities, and economy are also minimal. However, there are very serious
potential impacts on public safety of persons using abutting public
streets. There are also increasing safety problems for employees
and visitors to the newly developed light industrial uses to the
north, and future uses planned in the Boynton Beach Park of Commerce
abutting this site.
Specific impacts are addressed below.
1. No residential units are proposed or permitted by the exist-
ing zoning.
2. The proposed zoning, Planned Commercial Development (PC),
will allow all office and commercial uses listed in Section
6 Cl, Zoning Code, Boynton Beach, including ancillary to
permitted uses, and commercial uses not listed in Section
6 Cl approved by the Planning and Zoning Board.

4. Office Market Analysis
An analysis of office space use and vacancy is discussed for (1)
Southeast Florida, (2) Palm Beach County, and (3) Boynton Beach,
within 1.5 miles of the subject site.
Southeast Florida
The most recent and available information on occupancy is taken
from surveys by Hunter Moss and Company and the Clark-Biondi
Company, This shows occupancy levels in the Palm Beach, Broward
and Dade County areas have decreased over the past two years:

Dade County experienced the largest percent of reduction (9,0%),
due largely to a flight north along 1-95. Palm Beach County's
occupancy level remained stable, partly because of leasing of
additional space by International Business Machines, Inc. , in
Boca Raton.
Palm Beach County
A survey of existing office space, and its geographic distribution
is shown on Table 1. Prepared by Goodkin Research Corporation and
Hunter Moss and Company, occupancy levels are shown as of August
1983 - the most recent countywide data available.
Approximately 5 million square feet of space was surveyed. More
than 75% of this space is located in the following geographic
market areas:
West Palm Beach 33%
Delray 16%
Boca Raton 33%

Comparison of Impacts
The lowest occupancy level is in the Boca Raton area - 78,7% -
compared to the County - 83.4% - as a whole. The rest of the
County from Delray north averages 85,8%.
About 813,000 square feet of space available for lease. Boca
Raton has 42%, Delray Beach 12% and suburban West Palm Beach
29%.
Boynton Beach
Presently, Boynton Beach has very little available office space.
Citywide, existing space amounts to approximately 589,993 square
feet, based upon a survey by the Boynton Beach Planning Depart-
ment in 1985, Of this total, only 90,000 square feet are within
1.5 miles of the subject site, and half is currently occupied,
45,000 square feet. Occupancy of the remaining 499,993 square
feet of space is more than 75%.
Absorption Rate/Expansion Plans
In Palm Beach County, an estimated 1.1 million square feet of
office space was leased during the past year. During the same
period, 868,000 square feet were leased in Broward County. As
noted earlier, IBM, Inc., accounts for a major percentage of
the Palm Beach County Space. More than 75% of this space is
in the Boca Raton area,
There was almost three million square feet of office space
proposed or under construction in 1983. Of this total, 1.2
million - 40% - was under construction. About one-third of
the under construction space is in the Boca Raton area, 400,000
square feet, and about 235,000 is in Boynton Beach. Within 1.5
miles of the subject site, there is 90,000 square feet of existing
space but no new projects are under construction within that
radius, east or west of 1-95.
Rental Rates
In Palm Beach County, a survey was conducted by Goodkin Research
Corporation, Hunter Moss Company of rental rates. Table 2 illus-
trates the results of that survey by maximum rental rates and
median of the maximum rate/square foot by geographic area. These
rates are expressed as gross rentals, and include the minimum
base rental plus an estimate of fixed charges plus other operating
expenses which are tenant costs.
Rates in the Boca Raton area have a 1983 median of $23.25 rate.
Palm Beach Town rates are, of course, highest with a median of
$23.50 rate.

5. Traffic Impact Analysis
The proposed new use, general occupancy offices, will generate
a greater level of activity than the existing recreational zon-
ing. These new activities would increase traffic to the site.
However, existing and future transportation improvements in
the area will mitigate any negative traffic impacts. NW 22
Avenue and High Ridge Road will be fourlaned as part of the
Boynton Beach Park of Commerce development. A new interchange
at 1-95 and NW 22 Avenue is also planned.

High Ridge Road to the north, and High Ridge Road to the C-16
Canal to the south. These mains will be extended to this site
as part of the Boynton Beach Park of Commerce.
A letter of commitment from the City Utilities Department is
attached.
The existing recreational use does not presently use public
water.
This Health Department standard mentioned above, is high because
they assume irrigation of the site with public water supply. The
PCD Project site will utilize wells for irrigation source, there-
fore water demand will be less.

10(a).
Soil Association
All of the subject property is of the ScB, St. Lucie Sand,
o to 8% slopes, soil type. This nearly level to sloping,
excessively drained deep, sandy soil is on long narrow,
dune-like coastal ridges and on isolated knolls. This soil
has the pedon described as representative of the series. The
water table is below a depth of 6 feet.
Included with this soil in mapping are small areas of Paola,
Palm Beach, and Pomello soils. Also included are small areas
of soils that have either a dark-colored, organic-stained layer,
or a brownish yellow, iron-stained layer within a depth of
80 inches, In a few places are soils that have a seasonally
high water table within a depth of 6 feet.
The natural vegetation is sand pine, scrub oak, saw-palmetto,
rosemary, cati, reindeer moss, and sparse clumps of pineland
three-awn and natalgrass. Large areas are in native vegeta-
tion, and some areas have been cleared for future urban
development.
There are existing scattered clumps of sand pines with under-
growth on the site. A building, parking area and shooting
range occupy the cleared areas, The site is also utilized
for dumping fill material which contains rubble.

Existing/Proposed Grades
The subject property has a gradual slope from the east/west
property line toward to the center, See topographic map
attached. The low elevation is 18.2 and the highest natu-
ral grade is approximately 25 feet. Existing grades for
NW 22 Avenue and 1-95 will not change. The proposed new
alignment for High Ridge Road will approximate the exist-
ing average grade along the western property line - 25 feet.
Site elevations will be determined by individual building
construction, but will comply with the 100 year flood require-
ments. See attached drainage master plan.
10(c), Existing/Proposed Water Bodies
There are no existing water bodies on the subject property.
Drainage plans will comply with engineering requirements
of the City and South Florida Water Management District for
on-site ponding. See attached drainage master plan.
10(d), A master property owners association will be formed to
maintain common areas.
