to utilize the city's traffic consultant for
review of the traffic impact analysis prior
to review by Palm Beach County, then the

prescribed above may delay approval of the application.

development shall be required where more than
fifty (50) dwellings, or 50 sleeping rooms in the
case of group housing, would be allowed under the
proposed zoning.
At the request of the Plal\ning Department,
Planning and Zoning Board, or City Commission, the
applicant shall also submit proposals for
minimizing land use conflicts with surrounding
properties. The applicant shall provide a summary
of the nuisances and hazards associated with
development under the proposed zoning, as well as
proposals for mitigation of such nuisances and
hazards. Such summary shall also include, where
applicable, exclusion of particular uses,
limitations on hours of operation, proposed
location of loading areas, dumpsters, and
mechanical equipment, screening of service areas
and mechanical equipment, location of driveways
and service entrance, and specifications for site

lighting. Nuisances and hazards shall be' abated
or mitigated so as to conform to the performance
standards contained in the City's zoning
regulations and the standards contained in the
city's noise control ordinance. Also, statements
concerning the height, orientation, and bulk of
structures, setbacks from property lines, and
measures for screening and bUffering the proposed
development shall be provided. At the request of
the Planning and Zoning Board or City Commission,
the applicant shall also state the type of
construction and architectural styles that will be
employed in the proposed development.
At the request of the Planning Department,
Planning arid Zoning Board, or cit:y Commission, the
applicant shall also submit the following
information:
(a) Official soil conservation service
classification by soil associations and all
areas subject to inundation and high ground
water levels.
(b) Existing and proposed grade elevations.
(c) Existing or proposed water bodies.
(d) Form of. .ownership and form of organization to
maintain common spaces and recreation
facilities.
(e) A written commitment to the provision of all
necessary facilities for storm drainage,
water supply, sewage' collection and
treatment, solid waste disposal, hazardous
waste disposal, fire protection, easements or
rightS-Of-way, roadways, recreation and park
areas, school sites, and other 'public
improvements or dedications as may be
required.
For rezonings to planned zoning districts, the
specific requirements for submission of
applications for rezoning to such districts shall
also be satisfied. Furthermore, all materials
required for a subdivision master plan shall also
be submitted.
Where conformance with the County's
Environmentally Sensitive Lands Ordinance is
required, an Application for Alteration of
Environmentally Sensitive Lands (Environmental
Impact Study) must be submitted to the Palm Beach
County Department of Environmental Resources
Management (copy to city) prior to or concurrent
with the submittal of the Land Use Amendment andl

BOYNTON COMMONS
JUSTIFICATION STATEMENT
The subject property is located on the southwest corner of Old Boynton Road and Congress Avenue.
The total site area is:!: 24.74 acres. Currently, the property is zoned C-3 with a future land use
designation of LRC. We are proposing to rezone the property to a Planned Commercial
Development (PCD). The rezoning request is necessary in that the PCD designation requires a
unified approach to the planning and unified approach to the planning and design of the shopping.
As the site plan indicates, we are proposing a clock tower in the middle of the center. There will be
30utparcels along Congress Avenue and 225,600 sq. ft. of inline retail.
The project better satisfies the definition of a planned commercial development more so than the
C-3 zoning category.
I. The land is under unified control, planned and developed as a whole project.
2. The proposed zoning provides for a commercial district of efficient and harmonious
design so arranged as to create an attractive project readily integrated with and
having no adverse effect on adjoining or surrounding areas and developments.

Boynton Commons far exceeds the minimum standards for a PCD.
I. The site is located near the major intersection of Congress Avenue and Boynton
Beach Boulevard. The public bus system has several stops along Congress Avenue
and Boynton Beach Boulevard. The project is located just south of the Boynton
Beach Mall. In addition, most of the surrounding land is zoned C-3 and has been
developed as retail centers. Please refer to the traffic analysis prepared by Kimley-
Horn for traffic impacts.

COMPARISON OF IMPACTS
1. We are currently approved for C-3 zoning and could proceed with development
under that approval. There is very little difference between the square footage allowed
under the C-3 zoning and what we are proposing under the PCD designation.
2. We are proposing 5000 sq.ft of bank, 7500 sq.ft. restaurant, 15,930 sq.ft. pharmacy
and 225,600 sq.ft. of inline retail. The "types" of inline retail which we are
proposing are Office Max, Barnes & Noble, and other similar uses. We are not
proposing any prohibited uses.
3. We are preparing for a fast track approval process. On November 7,1995, we hope
to have our second reading before the City Council. In October/November of 1995,
we are planning to submit for site plan approval which will include a submittal of the
engineering plan.

and a 5,000 square foot drive-in bank. You will note that the size of the retail
has been reduced from the 250,000 square feet addressed in the traffic impact

Scope of Work: A total of 10 - 10' Auger Borings, 10 - 15' Auger

SUMMARY
As can be seen from the attached boring logs, the majority of the
foundation soils consists of a grey and brown medium fine sand.

Deposits of organic material must be removed in their entirety
from the building pad area (the building pad area is defined as an
area a minimum of five feet beyond the proposed building lines).
Dewatering of the excavation will be required to ensure proper
placement and compaction of backfill material.
All building area's will require vibratory compaction using a
Vibratow III or equivalent with a minimum of six passes. The
compactor used should be one that will increase the density of the
soil 8' below point of application.
Building pads shall be filled in one-foot lifts to the finished
pad elevation using the same compactive effort noted above for
each lift.
The above recommendations are based upon preliminary soil borings.
Additional soil borings will be required when final building de-
signs and column loads are available.
3.0 EXCLUSIONS
Note should be made that this investigation may not depict varia-
tions that possibly exist' intermediate of the attached boring
locations or in untested areas of the property. Should variations
become evident, this office must be contacted to re-evaluate our
preliminary recommendations based upon on-site inspection and/or
testing of the variant conditions.
Note should be made that "proper consideration by the
contractor shall be given for the protection of the
buildings and properties, prior to the commencement
owner or
adjoining
of work".
Any pumping action of the soils "soft spots" encountered during
grubbing or compaction procedures must be brought to the immediate
attention of the geotechnical engineer for further evaluation
and/or testing.

1.0 INTRODUCTION
Per your request, we have completed a Phase One Environmental
Audit for the above referenced property. The following is a
report of the investigation and information we obtained. This
study was conducted the period of June 23, through July 12, 1995.
The scope of the audit was to make an evaluation based on the
available information as to whether there had been a release, or a
threat of a release of petroleum products, or hazardous material/
waste to the environment on the subject property.
2.0 SITE DESCRIPTION
LOCATION:

The subject property is located in Sections 19 and 30,
45 South; Range 43 East, Palm Beach County, Florida.

SQUARE FOOTAGE: The subject property consists of approximately
1,089,000 +/- square feet.
ACREAGE:

The subject property consists of approximately 25 +/-
IMPROVEMENTS: A vacant 8,346 +/- square foot office building and
asphalt parking are situated in the southeast quadrant of the
property. Storm water drainage is handled by the LWDD L-24 Canal.
A small residential structure is situated towards the center of
the property. The majority of the improvements were made several
years' ago and are in a decript unmaintained condition.
ASSOCIATED INDIVIDUALS/FIRMS: Klatt-Winchester.
ADJACENT SURROUNDING PROPERTIES: The properties contiguous to the
northeast and south are commercial/retail. The property con-
tiguous to the west is residential/agricultural.
ACCESS: The property is accessed from the east by Congress Avenue
a divided six lane state road, from the north by Old Boynton West
Road a five lane road the center lane being a turn lane, and on
the west by Winchester Park Blvd. (AKA Mall Road) a divided four
lane road.
3.0 SITE HISTORY
PAST USAGE: The site was primarily used for dairy farming prior
to the construction of an office building circa 1977.

The structure located in the south-
east portion of the property is no
longer visible. A larger building
is visible due west of the previous
location.
Of the original three structures,
only the foundation of one is vi-

to the northwest appears to be in

4.0 REGULATORY REVIEW
As part of this audit, the following agencies were visited and/or
contacted to review records and determine if any information
exists pertaining to a release of petroleum products or hazardous
waste/material on, or near the subject property.
UNITED STATES ENVIRONMENTAL PROTECTION AGENCY (EPA)
EPA Databases were researched for information pertaining to prop-
erties within a 500' radius of/and including the subject property.
The databases researched were the Comprehensive Environmental
Response, Compensation and Liability Act Index (CERCLIS), National
Priorities List (NPL) also known as "Superfund List," Resource
Conservation and Recovery Act Inpex System List (RCRIS), Site

Enforcement Tracking System (SETS), Facility Index System List
(FINDS), RCRA Administrative Action Tracking System (RAATS), and
the Toxic Releape Inventory (TRI).
Six Facilities appeared in the EPA Database on the FINDS or RCRIS
Lists. Four of the facilities appeared on both lists. Refer to
Figure 1, Page 1 of the Appendices for a Summary of Sites Found,
to Figure 2, Page 3 for a Sites/Location Map, and to Figure 3,
Pages 4 and 5 for Site Specific Information.
FLORIbA DEPARTMENT OF ENVIRONMENTAL REGULATION (DER)
DER Databases were researched for information pertaining to prop-
erties within a 500' radius of/and including the subject property.
The databases researched were the Solid Waste Facilities (SWF),
Stationary Tank Inventory System List"(STI), Florida Sites List
(SITES), and the Leaking Underground Storage Tanks (LUST).
Five facilities appeared in the DER Database on the STI List.
Three of the facilities also appeared on the LUST List. Refer to
Figure 1, Page 2 of the Appendices for a Summary of Sites Found,
to Figure 2, Page 3 for a Sites/Location Map, and to Figure 4,

5.0 SITE VISIT/INVESTIGATION
The purpose of the site visit is to identify those
potential contamination on-site and off-site that may
impact the subject property. A site visit was conducted

CURRENT USAGE: Vacant office building/cow pasture.

SOILS: According to the United States Department of Agriculture
(USDA) Soil Survey of Palm Beach County, Florida published 1978,
the soil on the subject property is classified as Ba--Basinger
fine sand. This is a nearly level, poorly drained, deep, sandy
soil in broad grassy sloughs in the eastern part of the county.
This soil has the pedon described as representative of the series.
The water table is within 10 inches of the surface for 2 to 6
months in most years and within 10 to 30 inches for the rest of
the year.
In a representative pedon, the surface layer is gray fine sand
about 4 inches thick. The subsurface layer in the upper 21 inches
is white fine sand, and in the lower 4 inches it is dark grayish
brown fine sand. The subsoil is dark reddish brown fine sand
about 7 inches thick. The substratum extends to a depth of 72
inches or mo~e and is pale brown fine sand.
On the extreme west portion of the property "On" may be present.
On--Okeelanta muck. This is a nearly level, very poorly drained,
organic soil that has sandy mineral material within a depth of 40
inches. It is in large, fresh water marshes and small, isolated
depressions. It has the pedon described as representative of the
series. Under natural conditions, the soil is covered by water,
or the water table is within 10 inches of the surface for 6 to 12
months in most years, except during extended dry periods.
In a representative pedon the surface layer is black muck
material) about 8 inches thick. Below this is a layer
reddish brown muck that extends to a depth of 31 inches.

HYDROLOGY: The regional groundwater flow and gradient through the
site and in the nearby vicinity of the surficial aquifer is to the

WELLFIELDS: The subject property is not located within a well-
field and/or wellfield cone of influence at this time.

6.0 SUMMARY
POLYCHLORINATED BIPHENYLS (PCB'S): Pad mounted and aerial trans-
formers were observed on the subject property. No obvious leakage
or staining is present at this time. Transformers may be tested
for PCB content at the owner's request and expense (approximately
$300.00 per transformer). However, Florida Power and Light
assumes responsibility for their own equipment.
IRRIGATION AND POTABLE WELLS: Two wells were observed on the sub-
ject property. Due to the age and past usage of the subject prop-
erty . it is suspected that additional wells may be present.
Abandoned wells are of environmental concern as they provide a
direct conduit to the surficial aquifer for any contaminants re-
leased on the surface or introduced directly into the unplugged
well.
ON-SITE SEWAGE DISPOSAL SYSTEMS: Two on-site sewage disposal
systems are at unmarked locations in the vicinity of the existing
structures. Due to the age, past usage and prior existence of
three structures on the subject property it is suspected that
additional sewage disposal systems may be present. Septic tanks
and drainfields are primarily a geotechnical concern. However,
health risks and environmental concerns are also associated with
improper abandonment and/or design.
WATERWAYS: A pond, canal, and two retention areas were observed
on the subject property. No petroleum sheen or obvious environ-
mental concerns were observed in relation to the waterways.
ASBESTOS CONTAINING MATERIAL (ACM)
ACM was identified in the vacant office building by a previous
consultant. Due to the age of the residential structure located
on the subject property, it is assumed that ACM is present.
Local, State and Federal Regulations require that an Asbestos Sur-
vey be performe~ prior to structural renovation or demolition.
RESOURCE CONSERVATION AND RECOVERY ACT INDEX SYSTEM LIST (RCRIS)
The RCRIS List reports those facilities and/or locations that are
handling, storing or transporting hazardous substances or waste.

Due to the activities relating to the handling of hazardous sub-
stances or waste, these sites possess the potential for environ-
mental contamination. Inclusion on RCRIS does not necessarily
indicate contamination but rather the potential due to the
presence and handling of hazardous substances.

by the major environmental programs within the EPA. The FINDS
list is concerned with operations conducted at sites and indicates

The Florida Administrative Code requires registration of under-
ground and above ground stationary petroleum storage tanks. In-
clusion on this list indicates the presence of stationary
petroleum storage tanks and therefore the potential for environ-
mental problems. It does not necessarily indicate existing
problems.

EMERGENCY RESPONSE NOTIFICATION SYSTEM (ERNS)
The EmeFgency Response Notification System is a national computer
database used to store information on releases of oil and hazar-
dous substances. Since its inception in 1986, more than 160,000
releases have been entered into ERNS. The ERNS List identifies
those facilities and/or locations that have been reported to USEPA
under the Emergency Response Notification System because of the
releuse of potentially hazardous material. The majority of these
types o[ incidences are responded to on a local level by Haz-Mat
Teams,' Fire Departments and County Emergency Response Teams.
Site #12 as identified in the Summary of Sites Found, Figure 1,
Page 2 of the Appendices, appeared in the ERNS Database.
7.0 CONCLUSIONS/RECOMMENDATIONS
POLYCHLORINATED BIPHENYLS (PCB's): It is our recommendation that
Florida Power and Light be requested and given the opportunity to
remove electrical transformers, subject to damage, prior to
demolition and/or earthwork activities.
IRRIGATION AND POTABLE WELLS: In accordance with local regula-
tions, it is our recommendation that a State Licensed Water Well
Contractor be employed to properly abandon all wells located on-
site, including those discovered during earthwork activities.
ON-SITE SEWAGE DISPOSAL SYSTEMS: It is our recommendation that a
Licensed Contractor be employed to properly abandon all on-site
sewage disposal systems located on site, including those dis-
covered during earthwork activities.
WATERWAYS: It is our recommendation that appropriate precautions
be taken when earthwork activities become intrusive to the LWDD L-
24 Canal. To include, but not limited to the deployment of silt
booms during construction of stormwater drainage.
ASBESTOS CONTAIN1NG MATERIALS: It is our recommendation that a
Certified Asbestos Consultant be employed to address Local, State,
and Federal Laws, Rules and Regulations, governing building demo-
lition.

reported contamination in the groundwater.

Site #4, DER File #508514347 is involved in an ongoing State reim-
bursed clean~up. The groundwater flow and gradient through this
site is generally to the east, southeast or away from the subject
property.
Site #8, DER File #508514713 is involved in an ongoing State reim-
bursed clean-up. The groundwater flow and gradient through this
site is generally to the east, southeast or away from the subject
property.
It is our opinion that Sites #4 and 8 have not and will not
negatively impact the environment on the subject property.
Site #5, DER File #508513926 located at 301 North Congress Avenue
is contiguous to the eastern 190' of the subject properties
southern boundary line. This facility has been issued a warning
letter by Palm neach County Environmental Resources Management,
the local governing body of the DER for failure to timely complete
a Contamination Assessment Report. Access for well installation
on state road right-of-way for final plume delineation is the
apparent delay and no fines or enforcement actions have been taken
to date.
The groundwater flow and gradient through this site has been re-
ported to the east, northeast. No visible petroleum sheen was
detected in the LWDD L-24 Canal water which generally would indi-
cate migration of the contaminants to the north. A strip of the
subject property 24' wide is situated south of the LWDD L-24
Canal.

It is our opinion that Site #5 has not negatively impacted the
environment on the subject property. The future possibility of
contamination migrating from Site #5 and impacting the subject
property is offset by the responsibility of the facility for
clean-up costs and the requirement that the facility cleans up all
impacted properties to be eligible for State Funded Reimbursement.
8.0 CLOSING
It is not possible to rule out the presence of any or all
hazardous or toxic materials at all locations within a subject
site without considerable field and laboratory investigations.
Nonetheless, prudent and professional assumptions are made to re-
duce the number of possibilities that are present within that
particular project site. Site investigations are performed based
on sound background information, hydrogeologic evidence and cost
consideration.
Based on the results of the Environmental Audit performed, we feel
that there is no direct evidence that a release of hazardous
substance (s) or hazardous waste (s) has occurred at this site.
It is the Environmental Professional's opinion that no further
environmental investigative action is necessary for the property
at this time.
The undersigned understands that the contents of this report are
being relied upon to provide basic information possible for the
purpose of securing a loan or property evaluation. Nevertheless,
the undersigned shall have no liability to any party other than
yourself (and your successors or assigns) for the use of this
information. To the best of our knowledge and belief, the
information presented and conclusions drawn thereof represent all
the available information.
