Dear Kevin,
Pursuant to your comments at last Tuesday's Development Review Committee (DRC) meeting, this
letter is to inform you of the plans for the existing vegetation on the above referenced project. Due
to the nature of the type of development, the expanse of asphalt that is to be constructed as well as
the large commercial buildings, the existing vegetation on the Boynton Commons PCD will be
rcmoved and a new landscape program shall be designed and installed. This new landscape program
will adhere to the City of Boynton Beach landscape code.

Vegelation consists ofheavily grazed weeds and grasses. Brazilian Pepper (Schinus terebinthifolius)
and Slash Pine (Pinus ellio((ii) are scaftered on the southern half of the parcel. The norlheastern
quadrant consists of 1110re suh~lanlial slands of Brazilian Pepper, two Banyan trees as well as
Melaleuca (Melaleuca quinqllencrvia) and Mango tree~. The southwest corner of the ~ite has Iwo

Enclosed, please find a copy of the recently revised Boynton COl11l11ons PCD plan. The changes that
have occured have been a flip of the Bed, Bath & Beyond and the local retail on the northwest side
of the property. Also, the access to Old Boynton Road is now proposed to be eliminated. Both of
these changes should be favorable to some of the staff's concerns. I realize that your office is
currently working on the staff report for the previous plans to go forward to the public hearings on
the property. I would request, if possible, that we be able to make this change, and still proceed
forward on the same approval schedules.

The City of Boynton Beach has completed its first review of the
documents submitted for the above-referenced project. Attached are
comments made by the reviewing departments during their initial
review of your project.
After amending the plans and documents, to comply with the
comments, please submit twelve (12) complete sets (including
surveys) of the plans to the Planning and Zoning Department. When
the amended plans and documents have been submitted to the Planning
and Zoning Department, they will be distributed to the reviewing
departments for second review and recommendation to the appropriate
boards for approval or denial. A recommendation for denial may be
made if there are major comments that have not been addressed on
the resubmitted plans.
Dates pertaining to the remainder of the review process including
the Planning and Development Board and City Commission meetings,
are identified on the attached Review Schedule. To maintain the
original approval schedule the amended plans and, where applicable,

The dumpster enclosure behind major #4 located at the southwest corner of the property is
unacceptable. In its present location it would cause the sanitation vehicle to back blindly into
oncoming traffic around a curve. This location needs to be moved either east or west to avoid

I have reivcwed the above plans and find the following:
-Congress Ave Ingress/Egress - the plans show a median or island as requested in previous
memorandums. This, alone. is insufficient for proper traffic controL Attached is a sugessted
plan for properly controlling traffic in this area, and to prevent left turns from either shopping
plaza. This area should also be controlled with proper signage (NO LEFT TURN, RIGHT
TURN ONLY) both on the median facing the egress traffic and at the STOP SIGNS at the
egress of both shopping plazas. Addtionally, one of the egress lanes should be omitted and
only a single lane present for exiting traffic.
-Old Boynton Road Ingress/Egress - this area appears to be a veIY congested/hazardous traffic flow
concern. The plans show two drive-through lanes ofthe Walgreens, two way traffic flow for the
aisle to the north of that; two-way travel for large semi trucks from the west side of the ingress/
egress, and normal traffic flow traveling north and south from this area. All of this is within the
first 30 feet of entering the property.
My recommendation is to make the ingress/egress a RIGHT TURN IN/RIGHT TURN OUT
ONLY. This can only be accomplished by construction of a traffic triangle (concrete,raised
curb), along with appropriate signage (NO LEFT TURN, RIGHT TURN ONLY). This triangle
will also prevent left turn into the property from westbound traffic on Old Boynton Road. There
is not enough room for a left turn storage lane to accomplish left turn traveL The triangle will
also prohibit left turn out and crossover travel, which is not recommendable in this area.
I would also recommend that the aisle on the north side of the Walgreen's drive-through should
be a one-way only, for west bound traveL(see attached drawing) At the end of the drive-
through lanes and the one-way aisle, there should be "DO NOT ENTER" signs.

I. Revise documents to reflect all comments.
2. Provide proof of unity of title.
3. All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following:
site lighting, paving, drainage, curbing, landscaping, irrigation and tIaffic control

In addition. we have the following recommendations:
A, Locate all sets ofH/C stalls along northern fire lane at least one aisle over to the
west to line up in front of the entrances to Sports Authority, Bed, Bath, etc., and
the retail office building.
B. Close off every other aisle opening to the north and south for a safer circulation
pattern. The new areas should be landscaped and curbed.
C. Reduce both frre lane aisles and add a third lane within the major driveway for
north and south turning movements into the aisles.
D. Place stop signs and stop bars throughout the development where there is a
question of right-of-way. Examples: At east side ofBarnesINoble for northbound
traffic; in the center of the two Walgreens drive-thm lanes; at both ends of the two
aisles between Video Ave. and Walgreens for east and westbound traffic.
E. ConSider the use of City approved road humps within the major driveway for
speed control.
F. To discourage vehicles parking or standing in the fire lanes, stripe a six foot wide,
cross-hatched area parallel with the curbed sidewalks encompassing the words
"Fire Lane" (facing on coming traffic).
G. Reduce north and south fire lanes from 30' to 24' and use additional 12' to create a
third lane in major east/west driveway for turning maneuvers into aisles.

Please be advised of the following comments relative to the rJrSt. review of the above-
referenced request:
1. On the site data, change the number of required loading areas from eight (8) to nine
(9). Modify the plans to show nine (9) loading areas and the required screening.
Also specify on the plans, the dimension of the loading zones in compliance with the
city standards.
2. Show on the master plan the location of the stuccoed block wall that is required to
screen the truck well and two loading areas shown at the rear of the south building.
3. Indicate on the master plan the typical backup dimension for all parking spaces.
Also indicate the width of all access aisles not associated with parking spaces.
4. Indicate on the master plan a typical width and length dimension for handicapped
and regular parking spaces including handicapped access aisle.
5. It is recommended that the hedges be shown on the plans, along the Old Boynton
Road side of the site wall, to reduce the possibility of someone defacing the wall.
It is recommended that where all site walls are required or proposed that hedges or
vines be planted on the side of the wall that is closest to the property line.
6. Show on the master plan the lane configuration within Old Boynton Road between
Congress Avenue and Winchester Park Boulevard. Also show the location and
width of the existing ingress/egress located on the north side of Old Boynton Road.
7. Modify the on-site egress at Congress Avenue by omitting the left egress lane and
delineating that there is one egress which will allow right turn out only. To further
stop cross over traffic, between the proposed center and the existing center located
on the east side of Congress Avenue, it is recommended that the raised median be
elongated to form the specific required turning movements.
8. Omit from the plan the "right in - right out" only driveway on Old Boynton Road.
If the driveway on Old Boynton Road Is desired, modify the driveway to show a
distanee of one hundred (100) feet from the property line into the site to the first
access aisle or parking space. If this distance is less than 100 feet, a request for a

parking lot variance will be required to be processed concurrently with the proposed
rezoning request. If the variance application is submitted by July 19, 1996, the
variance will be scheduled for Commission review on August 20, 1996. Parking lot
variance applications are available in the Planning and Zoning department.
9. To provide a safer driveway and internal traffic flow, redesign the on-site traffic
flow where the traffic traveling east and west, on the north side of Bed & Bath and
Walgreens intersects the traffic entering or exiting the site at the proposed Old
Boynton Road driveway.
10. Submit for review six (6) copies of the traffic analysis that properly identify and
show the proposed driveways and requested turning movements into and out of the
site. This includes providing the correct language in the planning data found on
page 2 of the report.
11. Amend the plan by relocating the landscape appeal information found on the plan
to location adjacent to the area involved with the appeal. Delineate on the plan the
specific area of the appeal. Also indicate on the plan that the appeal was granted on
October 17, 1996.
12. It is recommended that the bank of 23 parking spaces located north of Majors 3 and
4 be redesigned to not allow a backing movement into the main access that runs east
and west in front of the building. It is further recommended that the bank of 24
parking spaces, located on the south side of the main east west access aisle, be
redesigned to not allow a backing movement into the main access aisle.
13. Clarify the desigu of the separation between the bank of eight (8) parking spaces
located north and west of the Video Ave leased outparcel building and the north side
of the access aisle leading to Bed and Bath. It appears the front end of a vehicles
parked in the eight (8) parking spaces will overhang into the abutting access aisle.
On the plan identify the width of the island that separates the parked vehicles from
the access aisle.
14. Amend the site data to identify there are five (5) single tenant outparcel buildings.
Also specify on the plan that each out parcel building and all tenants will occupy
leased tenant spaces.
15. Within each building footprint, identify the number of stories tall the building is and
whether there is a mezzanine within the building.
16. Provide a copy of the city approved and executed unified control documents.
17. Revise the handicapped parking computations to correctly identify no less that the
required number of handicapped spaces. Also indicate the ratio used to determine
the number of requIred spaces. Identify the number of spaces provided in the
computations and show on the plans the number provided.
18. Dimension the width of all driveways.
19. Delineate on the plan with notes and symbols, whether the area around the
perimeter of all buildings is impervious, pervious or a combination.
20. Submit appropriate data to meet the submission requirements as defined in the letter
dated July 9, 1996 from Michael Rumpf, Senior Planner.

21. A review of amended plans, showing compliance with staff comments, is required
for the proposed master plan prior to the rezoning request being sent forward for
board and commission review. To maintain the original schedule, amended plans
are required to be submitted to the Planning and Zoning Department no later than
5:00 PM on July 19, 1996.
22. Place a note on the master plan indicating the following result of Palm Beach
County's analysis of the 6,782 net daily trips and 1998 build-out date for the
proposed project:
"An improvement to the intersection of Lawrence Road and Gateway
Boulevard is required before more that 40% of the project traffic is allowed.
This required intersection improvement is included in the improvement of
Gateway Boulevard that is scheduled for construction in FY 96/97."
23. Submission of a rectified master plan showing compliance with conditions of
approval will be required to be submitted the Planning and Zoning Department in
triplicate prior to platting and site plan approval of the project.

. With respect to deficiencies in the general application, please submit the justification/documentation
statement by July 11th, and all remaining infonnation as indicated above by July 15, 1996 in order
to allow for the continued processing of this request. As for revisions necessary to the proposed
master plan, a revised version of the document should be submitted to staff by July 19th which
incorporates both those deficiencies indicated herein, and those comments currently being generated
by technical staff. If any of this deficient infonnation which was submitted in connection with the
recent application for a master plan modification is information to also be used in the current
application, please either provide an additional copy of the respective document(s), or communicate
to staff which previously submitted documents should apply to the current application. If this
communication cannot be achieved, I would suggest that your staff review the existing files to
identify those relevant documents which are to apply to the current application.
