Dear Mr. McGinley:
Please be advised that on Tuesday, June 17, 1986 the City
Council continued its preliminary review of your request in
the form of conducting public hearings for an amendment to
the Future Land Use Element of the Comprehensive Plan from
High Density Residential to Local Retail Commercial and for
rezoning from R-3 (Multi-Family Residential) to PCD (Planned
Commercial Development District) for the purpose of allowing
construction of a mixed use office/commercial building and a
15,000 square foot office building, on the north side of
West Boynton Beach Boulevard, east of Congress Avenue. The
City Council has taken the position that they are in favor
of this request, including staff comments and ten (10) voluntary
conditions that the applicant imposed upon himself.
The second phase of this process will commence in early July
when your request will be forwarded to the Department of
Community Affairs, as required by State Statute, Chapter
163.3184. The Department of Community Affairs is given
ninety (90) days within which it must complete its review,
at which point the second phase of the process will have

been completed. Pending their approval, the third and final
phase of approval will be commenced. This phase requires
approval of Ordinances to amend the Comprehensive Plan and
rezone. It is anticipated that said Ordinances will be
approved in either November or December of 1986.

Dear Mr. Cassandra:
As authorized agent for the referenced project, I am offering the
following voluntary conditions, to be placed on subject site upon
approval, in order to reduce potential confl icts to surrounding land uses:
1. Developer shall construct a six-foot concrete wall between the retail
portion of the project and the north property line, supplemented by a
six-foot berm with a 4:1 slope within the 25 foot greenspace;
2. Developer shall provide landscaping along the northern property line
or within the greenspace by planting trees an average of 20 feet on
center with an average height of 15 feet;
3. Developer shall provide a 1:1 screening for all roof equipment;
4. Design of materials and scale shall be compatible with single-family
and multi-family residential uses.
5. Architectural fascia on rear of building shall be the same as on the
front of the building;
6. Lighting shall be directed away from residential areas;
7. Building height shall be restricted to 15 feet, as measured to the
underside of the supporting roof structure;
8. Office building use shall be restricted to those uses allowed under
C-I Zoning District;
9. Developer shall not utilize ~djacent waterbodies for recreational
purposes; and
10. Developer shall provide owners of the Villager Shopping Center with a
cross access easement agreement.

the above referenced project. Verbal authorization for our work was
received from you on March 27, 1986.
The exfi ltration test was performed on March 28, 1986 in general
accordance with guidelines published by the South Florida Water
Management District for the "Usual Open Hole Test". The test location
was approximately 50 feet north and 100 feet west of the southeast
property corner, at the location chosen by yourself.

the above referenced project. Verbal authorization for our work was
received from you on March 27, 1986.
The exfiltration test was performed on March 28, 1986 in general
accordance with guidelines published by the South Florida Water
Management District for the "Usual Open Hole Test". The test location
was approximately 50 feet north and 100 feet west of the southeast
property corner, at the location chosen by yourself.
Pertinent test data and results, along with the test location soil
profile, are presented on the attached data sheet. If we can answer

Oear Mr. Rogers:
Attached please find the results of one exfiltration test performed at
the above referenced project. Verbal authorization for our work was
received from you on March 27, 1986.
The exfiltration test was performed on March 28, 1986 in general
accordance with guidelines published by the South Florida Water
Management District for the "Usual Open Hole Test". The test location
was approximately 50 feet north and 100 feet west of the southeast
property corner, at the location chosen by yourself.
Pertinent test data and results, along with the test location soil
profi le, are presented on the attached data sheet. If we can answer
any questions, or be of further service, please contact us.
