NOTICE TO APPLICANTS FOR APPROVAL OF LAND
EVELOPMENT ORDERS OR PERMITS
Please be advised that all applications for the following land development orders and permits which are submitted on or after
June 1, 1990 will be subject to the City's Concurrency Management Ordinance, and cannot be approved unless public facilities
(potable water, sanitary sewer, drainage, solid waste, recreation, park, and road facilities) would be available to serve the
project, consistent with the levels of service which are adopted in the City's Comprehensive Plan:
Building permit applications for the construction of improvements which, in and by themselves, wouid create demand
for public facilities.
Applications for site plan approval.
Applications for conditional use approval.
Applications for subdivision master plan approval.
Applications for preliminary plat approval.
Applications for final plat approval.
Applications for rezoning to planned zoning districts.
Applications for revisions to any of the applications listed above, which would increase the demand for any public
facility.
Any other application which, in and by itself, would establish the density or intensity of use of land, or a maximum
density or intensity of use of land.

Applications for development orders and pemnits submitted after February 1, 1990 and which generate more than 500
net vehicle trips per day, must comply with the Palm Beach County Traffic Performance Standards Ordinance, unless
exempt from that ordinance.

Each applicant shall submit to the Planning and Zoning Department the following plans and exhibits in the number
of copies specified by the Planning and Zoning Department, together with a Site Plan Review application and a
fee adopted by resolution by the City Commission.

alleys and driveways, and also illustrating:
1. Existing natural features, including but not limited to lakes. trees and other vegetation and
soils and topography.
2. Existing buildings, building elevations. other structures, including use, height, dimensions
and setbacks.
3. Existing utility lines and all easements.
4. Existing elevations (corner, street and finished floor)
B. Site develoDment plan:
1. A scaled drawing clearly illustrating proposed buildings and other structures, and any
existing buildings and structures which are to be retained, including use, height, dimensions
and setbacks,

PROGRAM AGREEMENT
THIS AGREEMENT, made and entered into this ~ day of /Y/] 199 t,
by and between CITY OF BOYNTON BEACH, a Florida municipal corporation, 100
East Boynton Beach Boulevard, Boynton Beach, Florida (hereinafter "City") and
The Coquina Cove Neighborhood, Inlet Cove Neighborhood Association
ocated within the limits of the City of Boynton Beach, in the State of Florida,
hereinafter "Grantee").
WIT N E SSE T H:
WHEREAS, City has established Neighborhood Assistance Program (hereinafter
"Program") to provide grants for qualified organizations to complete specified
projects, which program and projects constitute a public purpose; and
WHEREAS, all grant monies and/or materials, under this Program, shall be
expended solely for the construction and completion of the specified project
(hereinafter "Project"); and
WHEREAS, the City has absolute sole discretion in selecting projects
appropriate for the Neighborhood Assistance Program; and
WHEREAS, the Program is conditioned upon satisfactory completion of the
Project as well as contribution of a "matching grant" from the Grantee as further
defined herein.
NOW, THEREFORE, in consideration of the mutual covenants described herein,
and other good and valuable consideration, which the parties hereby determine to be
sufficient, the parties agree as follows:
1, Above Provisions: The above provisions are hereby incorporated into this
Agreement.

3. Matching Grant: Grantee hereby agrees to provide a matching grant in the

4. Financial Reauirements: Upon award of the grant hereunder, Grantee shall
open a two-signature bank checking account at a recognized banking institution into
which the City will deposit the grant money described in this Agreement. One
signature on the account must be of the designated City representative and one
signature must be of the Grantee except as described in paragraph 14.
5. Deoosit: City ar:Id Grantee shall deposit the sums specified herein into the

6. Conditions: The matching grant provisions of paragraphs 2 and 3, above,
are conditions of this Agreement and any obligations and responsibilities imposed
upon City hereby. Grantee shall designate a President, Secretary and Treasurer, and
shall inform Grantor of the designees.
7. Proiect: Grantee agrees to perform, or supervise the work performed as a
part of the Project. The parties hereto agree that the Project shall be as defined in
Appendix c.
8. Maintenance: Grantee shall adhere to the maintenance plan for the
constructed project. The City will not provide maintenance above code requirements
on City property and shall not provide maintenance for improvements performed on
private property unless defined in Appendix C as in kind services. If the project is
not maintained per this Agreement, City will send written notice of said default to
Grantee via certified mail, return receipt requested. Grantee has twenty (20) days
from the date of the notice to cure said default. Grantee acknowledges and agrees
that should Grantee fail to cure the default within said twenty-day period, City may
cure said default, and bill Grantee for the materials and services performed. Grantee
acknowledges and agrees that it shail be liable for all costs for materials and services
incurred by City in curing said default.

9. Term: The work activities to be performed by the Grantee, as part of the
Project, are to commence on the t.s:1 day o{ ~, 199 s., and shall be

extension, Grantee shall submit l written-;equest to City for such an extension not
later than thirty (30) days prior to tht:: termination date described herein. The City's
grant of an extension shall in no way constitute a waiver of any of the other terms of
this Agreement.
10. Aoolicable Laws: The Grantee must comply with all applicable laws,
ordinances and codes. Grantee shall, at their own expense, secure and pay for all
permits and be responsible for all other fees or charges associated with the
performance of the project or any other activities under this Agreement, unless
specifically waived by this Agreement as in kind services on the part of the Grantor
11. Indemnification: The Grantee shall indemnify and hold the City harmless,
including its elected officials, agents and employees, from and against all claims,
damages, losses, and expenses, including but not limited to, attorney's fees and
costs, arising out of or resulting from the carrying out of this Agreement, arising out
of any work activities performed under this Agreement, or constituting a breach of
any term of this Agreement.
12. Covenant Not To Sue: Grantee covenants with Grantee, City that it
will never at any future time sue the City for or on account of any claim for any
damages arising out of performance of this Agreement or construction of the Project
specified herein.
13. Termination: The City shall have the right to terminate this Agreement for
any breach of any term of this Agreement. A breach shall include, but not be limited
to, failure to meet the match requirements described in paragraphs 2 and 3, failure to
begin work in the time and manner specified in paragraphs 5 and 6, failure to provide
volunteer labor as specific in paragraph 3, failure to provide equipment or materials
adequate to perform the project, or failure to complete the project by the designated

dates which shall entitle the City to recovery of it's grant.
14. Notice of Termination: Upon the City's determination that Grantee has
breached any term of this Agreement, City will provide Grantee written notice of said
breach, and provide, in the written notice, the corrective action that Grantee must
take. If Grantee does not take the above-described corrective action within fifteen
(15) days of Grantee's receipt of the written notice, this Agreement shall terminate
without any further notice. The corrective action must be acceptable to the City in
order to avoid termination hereunder.
15. Subseauent to Termination: City shall provide Grantee with a letter
confirming termination of the Agreement. Within thirty (30) days of receipt of this
letter, Grantee shall submit to the City a cashier's check as repayment of the grant
provided by the City under the terms of this Agreement. The City shall be entitled to
send notice of termination to the bank and at its sole discretion direct disbursement
of funds.
16. Neighborhood Associations as Indeoendent Contractors: It IS agreed
between the parties that the Grantee is an independent contractor and IS not an
employee Dr agent of the City.
17. Insoectors: The City reserves the right to place inspectors at the work
site or at the place of shipment or delivery of materials under this Agreement, or at
the factory or in the neighborhood, in order to confirm the legitimacy of monies
expended under this Agreement, but not to observe the quality of the work done or
the materials used. City does not assume any liability for the work performed or
injuries incurred, in any manner, and does not act in a supervisory capacity.
18. Monthlv Reoorts: Monthly project reports must be submitted to the
Office of Neighborhood Project Specialist on a timely basis to be determined by the
Neighborhood Project Specialist. Receipts, invoices and volunteer sheets must be
submitted with the monthly project reports. City will not sign for any draw on the
account without satisfactory support, which decision will be made in the sole

discretion of the City designated representative.
19. Audit: City maintains the right to review and audit any and all financial
records or any other records having to do with this Agreement, at any time.
20. Remainin9 Funds: Within thirty (30) days of completion or termination
of the project, as determined by the City, all remaining funds in the subject account
will be apportioned to the respective parties at the sole discretion of the City and
dispersed to the respective parties.
21 . Misaoorooriation of Funds: Any misappropriation of funds may result in
civil action and criminal prosecution to the fullest extent permitted by law.
22. Grantee Labor as Portion of Matchina Grant: Grantee agrees that no more
than 25 % of the matching resources under this Agreement may consist of money.
Accordingly, at least 75% of the matching resources shall consist of volunteer labor,
materials or other similar matching resources as approved by Grantor. The hourly
value of volunteer labor shall be determined by the City, at its sole discretion, prior to
entering into this Agreement, which determination is incorporated into this
Agreement in paragraph 3.
23. Eauipment: For organizations purchasing or receiving equipment as part
of their project, should the organization be dissolved or should the equipment not be
used in accordance with the grant agreement, the City will have the right to
reappropriate the equipment.
24. Amendments: The City Commission shall have the authority to enter into
amendments to this Agreement for the City. Any such amendments must be
mutually agreed upon by the parties and must be in writing.
25. Notice: Any notices to the Grantee, under this Agreement, shall be mailed

Project Purpose
The purpose of this project is to landscape, irrigate, and light the entrance to
Coquina Cove which at present is composed of two un-landscaped,
haphazardly planted islands that span the distance from Federal Highway to
the beginning of Ocean Inlet and Shore Drives. This plan calls for the two
islauds to be made into one which will be more aesthetic and will also have
the benefit of reducing traffic in the Coquina Cove entrance while still
permitting exit traffic from Yachtsman's Plaza. This plan is in accordance
with the Boynton Beach Neighborhood Revitalization Strategy and Vision
20/20.

INCA is committed to enhancing the residential nature of its community and
to improving the general appearance and impression of the contiguous areas
of Federal Highway. This project is also in line with one of INCA's founding
goals: to enhance the quality oflife and property.
What benefits will the neighborhood and/or the City realize from this project?
Both the City and INCA residents will benefit from improved appearance of
the entries to the three communities that abut Federal Highway. Specifically,
pleasant, appropriately landscaped residential properties along the Federal
Highway corridor will enhance the City's ability to attract new businesses
that contribute to the family-oriented objectives outlined in Vision 2020.
Successful self-help programs, aided by the City will serve as models for other
neighborhoods that want to improve their appearance and quality of life.
Enhanced landscaping at the entrance not only will instill a sense of pride
and community spirit, but will also serve as a model for care and
maintenance of individual residences. Moreover, it is believed that well-
designed and maintained entrances more clearly delineate the neighborhoods
and discourage problems of crime and trespass.

We have reviewed the subject plans and recommend that the request not be forwarded for Board review
until all of the outstanding comments are shown in compliance on the site plan submittal set of drawings
The request for site plan approval has been submitted three (3) times (I st April 24, 1998, 2nd June 2, 1998
and the current 3rd submittal on August 18, 1998) A review of the current submittal has produced
basically the same comments that were generated trom the 2nd review. It is strongly recommended that
the applicant ohtain all TRC comments Irom the 3,,1 review and amend the plans to show compliance with
the comments before the request is presented to the Planning and Development Board.
Build;n!! Division (Site Specific and Permit Comments)
I. The maximum allowed square footage for the proposed pole sign is sixty-four (64) square feet
The site plan identifies the area of the pole sign as seventy-three point twenty-five (73.25) square
feet Therefore, amend the size of the pole sign to comply with maximum allowed square footage
and all applicable sign code regulations. [Chapter 21-Sign Code, Article IV, Section 2. B.]
2. The submittal did not include elevation drawings of the building. Therefore the following
comment remains. The maximum area ofa wall sign that is allowed to be dedicated for non-word
depiction signage is twenty (20) percent ofthe sign erected Verify that the non-word depiction
area of the proposed wall signage complies with the maximum area allowed Where applicable,
modify the sign to comply with the code regulations. [Chapter 9-Community Design Plan, Section
10.14]
3. The width of the sidewalk located in the front of the building shown on the Handicap
Ramp/Striping Detail drawing does not match the width dimensioned on the Site Plan. Amend the
width of the walk on the detail drawing to match the six- (6) foot width specified on the site plan.
4. Amend the length of the bottom landing shown on the Handicap Ramp/Striping Detail drawing and
the Site Plan drawing to comply with the accessibility code. The plans show a five- (5) foot long
landing and the accessibility code requires the landing to be six (6) feet long. [Florida
Accessibility Code for Building Construction, Section 4.8.4 (2)].
5. Amend the engineering plans to show no more than a two percent (2%) slope in the sidewalk at the
accessible entrance to the building.
6. The submittal is deticient a survey, Iloor plan, sign age (including colors) and elevation view
drawings of the building. Amend the submittal to include a complete set of drawings

Public Works can not approve this project for the following reasons:
I.) With the closure of Shore Drive the turning radius is to small.
2.) The backing distance is to short with the 450 angle in curb.
Public Works asks that the curb on the East side of the property be extended 20' Feet to
the north to connect the curbing from the East. We would also ask to have the last
parking space in the East comer be eliminated and be made into a 'No Parking Zone'
along with the extension of the parking lot. 1fthese conditions can be meet it would
solve the problems of Public Works vehicles being able to enter and exit this site.

The location of the additional hydrant next to Shore Drive in not acceptable as

Parking lot turn-around for vehicles would cause access blockage to the site.

After review of the changes to the proposal I have the following comments;
1. The removal of the second ingress/egress presents a hazard to vehicular and pedestrian traffic within the
parking lot.
2, All deliveries must be made before or after normal business hours. As a direct result of design, any delivery
vehicles arriving or departing during business hours would present a traffic hazard within the parking area.
3. At the exit from the facility, I would prefer a "RIGHT TURN ONLY" sign instead of a "NO LEFT TURN"
sign to be attached below the STOP SIGN,
4, The area of the truck turn around will need to be striped and posted for no parking.
Shore Drive is a public right of way owned and maintained by the city. At this time a previous agreement
between the City and the Homeowners Assoc. of Shore Drive has forced the removal of the north
ingress/egress. This presents a hazard to vehicular and pedestrian traffic within the parking area of the site,
vehicular traffic northbound on State Road 5 and pedestrian traffic on the East side walk of State Road 5.
I also do not understand why the city is holding AUTOZONE responsible for the improvement of the medians
on Shore Drive when they will not gain from its improvement. The preexisting agreement for the improvement

We have reviewed the subject plans and recommend that the request be forwarded for Board

I. The maximum allowed square footage for the proposed pole sign is sixty-four (64) square
feet. The plans show the area as seventy-three point fifteen (73.15) square feet.
Therefore, amend the size of the pole sign to comply with maximum allowed square
footage. [Chapter 21-Sign Code, Article IV, Section 2. B.]
2. The maximum area ofa wall sign that is allowed to be dedicated for non-word depiction
signage is twenty (20) percent of the sign erected. Verify that the non-word depiction
area of the proposed wall sign on the front wall complies with the maximum area
allowed. Where applicable, modify the sign to comply with the code regulations.
[Chapter 9-Community Design Plan, Section 10. 14.]
3. The width ofthe sidewalk located in the front of the building shown on the Handicap
Ramp/Striping Detail drawing does not match the width dimensioned on the Site Plan.
Amend the detail drawing accordingly.
4. Amend the length of the bottom landing shown on the Handicap Ramp/Striping Detail
drawing and the Site Plan to comply with the accessibility code. The plans show a five
(5) foot long landing and the accessibility code requires the landing to be six (6) feet long
(Florida Accessibility Code for Building Construction, Section 4.84 (2)). Add to the
ramp detail drawing the edge protection required by section 4.8.7. of the accessibility
code.

GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utilities easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of HRS permits may be required for the water system serving this project. (Sec. 26-12)
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap, 6, Art. , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your HRS permit
submittal,
4) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept, application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utilities
easements, Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
Sec. 26-33(a) of the Code. A sewer cleanout shall be installed at the property line, and all work
within the public right-of-way shall be constructed to this Department's standards.
2) This office will not require surety for installation of the water and sewer utilities, on condition that
the systems be fully completed, and given to the City before the first permanent meter is set, Note
that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy.
3) LD R chap. 6, Article IV, Sec, 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
4) Appropriate backflow preventers will be required on the domestic water service to the building,
and the fire sprinkler line if there is one, in accordance with Sec. 26-207.
5) A building permit for this project shall not be issued until this office has approved the plans for the
water and sewer improvements required to serve the project. (Sec, 26-15)
6) The waste stream from the manufacturing process must meet the City's pretreatment requirements.
A sampling point must be provided to allow monitoring of this waste stream, (Sec. 26-143, 26-147)

proposed sign. The detail drawings shall depict the sign and sign structure in compliance with
Article IV, Section 2 of Chapter 21 - Sign Code and Section 10. I. of Chapter 9 - Community
Design Plan. The drawing shall include the following information
a. Dimension the distance from linish grade to the highest point of the sign and/or sign structure
(maximum height allowed is 20 feet).
b. Show the sign copy
c. Dimension the width and length of the sign face including indicating the total area in square
feet (maximum area allowed is 64 sq ft)
d Dimension the size of the structure or frame that the sign will be attached to.
e. Identify the color name, color code and manufacturer of the colors proposed for the signage.

f Indicate with a note whether the sign is illuminated and, where applicable, specify type of
illumination.
g. With a note identify on the landscape plan the location of the landscape material that is

"Signs shall be designed and treated as part of the architecture of the building and shall be
reviewed at time of site Dlan review." therefore, add to the submittal, the detail drawings of

a. Identify where the building signage is located on the face of the building by dimensioning
their location on the elevation view drawings. The location shall show the distance from the
edge of the building to the edge of the proposed signage including dimensioning the distance

b. Identify the size of the building signage by dimensioning on the elevation view drawings, the
width and height of the proposed building signage Also indicate in tabular form, on the

I. All plans submitted for specific permits shall meet the city's code requirements at time of
application. These permits include, but are not limited to, the following: site lighting, paving,
drainage, curbing, landscaping and irrigation. Permits required from other permitting agencies,
such as FDOT, PBC, SFWMD, DERM, LWDD, DEP and any others, shall be included with your
permit request.
2. Show 25' long double yellow 4" stripes at the Shore Drive driveway to delineate the ingress/egress

4. Install one-way arrow sign in median opposite U.S. #1 egress aisle per FDOT standards.
