1998, I am forwarding this letter to YOll today to advise you that the Owners of the Boynton
Commerce Center, Parcels 3A. 3B and 3C, arc considering a minor modification to the Master
Plan referenced above and approved by the City of Boynton Be"ch City Commission on Februa.ty

Attached to this letter vou will find two (2) copies of Master Plans for Boynton Commerce Center
II. The coPy marked Exhibit "An is the Master Plan as approved by the City of Boynton Beach at
the February 17, 1998 Commission meeting. The Master Plan matked Exhibit "B" is a revised
Master Plan showing the changes we propose to make to the previously approved Master Plan for
purposes of this letter. You will note that Master Plan Exhibic "8" shows three (3)
office/disttibution buildings as opposed to the six (6) individu~1 office/distribution buildings on
the previou.ly approved Masrer Plan (Exhibir "A"). We arc contemplating connecting rhe six
buildings and constructing thtee larger buildings rather than six individual buildings at this time.
The new proposed Master Plan will increase the square footage of the ptoject from 206,460 to
231,160 for an increase of 24,700 square feet. In addition to combining the six building. into
three buildings, we propose to relocace OUr fountain feature. to the front of the driveway ateas
adjacent to Buildings B, D and F. Furrhermote, we will bc deleting sever-al overhead doors and
truck loading areas behind the former Building E 'no be replacing those areas with additional
parking to compensate for the parking we will Ios. by combining Building's E and F.

The Palm Beach County Traffic Division has reviewed the revised
Traffic Equivalency Statement information, dated 4/8/98, for the project
entitled Boynton Commerce Center, pursuant to the Traffic Performance
Standards in Article 15 of the Palm Beach County Land Development
Code.
Boynton Commerce Center is identified on the City's list of Previous
Approvals as being approved for 358,490 square feet of industrial and
249,600 square feet of office. The Traffic Statement contains land use
information which I assume is accurate. The attached table shows the
approved, built, and approved land uses shown in the Traffic Statement,
and the trips associated with each. Since the traffic from the proposed
and built development is less than the traffic from the original approved
development, the Traffic Division has determined that the project meets
the Traffic Performance Standards of Palm Beach County. If you have
any questions regarding this determination, please contact me at 684-

Dear Mr. Gainsborg:
Please be advised that as a follow-up to our meeting, I have asked Bob Donovan and Dan
DeCarlo of my staff to review the overall status and work with you to facilitate the timely
completion of your project. I understand that you would like to have the site plan revised by
merging six buildings into three. After further discussion, we have decided that it would be best
to take a two-prong approach.
First, you should submit your response to the City's second review comments for buildings "E"
and "F" so that they may be processed in a timely fashion. Our next two amended plan deadlines
are March 31st and April14tfi 1998. If you can meet this schedule, your project would be heard
by the Planning and Development Board on April 28th or May 12 and the City Commission on
May 19th or June 2nd
Second, we should process the changes you are requesting to the site plan approved at the City
Commission's February 17, 1998 meeting as either a major or minor site plan modification.
While staff feels that it should be processed as a minor site plan modification, the City's Land
Development Regulations are clear that this decision is for the City Commission to decide.
Special attention should be given to showing that you have not exceeded the 40 percent lot
coverage ratio requirement and that you are within the approved parking ratios that correspond
with the square footage increases of your buildings. Therefore, I recommend that you file an
application for a major site plan modification that will be processed concurrently with your site
plans for buildings "E" and "F" above. This will allow the Development Department to review
both projects for consistency at the same time.

The City of Boynton Beach has completed its first review of the documents submitted
for the above-referenced project Attached are comments made by the reviewing
departments during their initial review of your project
In order to complete the review process, the site plan and documents must be amended
to comply with these comments within 90 days of the date of this letter. (If amended
plans are not submitted in 90 days, a new application fee will be required.) When there
are comments made by the reviewers that you feel are not applicable to the approval of
the project or will be addressed separately and you have not amended the plans to
comply with the comment(s), you must prepare written explanation for each comment
stating why the comment is not applicable and return the explanation with the amended
plans and documents.
After amending the plans and documents, please submit twelve (12) complete sets
(including surveys) of the plans to Planning and Zoning. When the amended plans and
documents have been submitted to Planning and Zoning, they will be distributed to the
reviewing departments for second review and recommendation to the appropriate
boards for approval or denial. A recommendation for denial will be made if there are
major comments that have not been addressed on the resubmitted plans.

Comments:
I. Public Works has no objections to the location of the dumpster enclosures
but we would request to see drawings for enclosures for dimensions height
and width.
UTILITIES
Comments:
2. All utilities easements shall be shown on the rectified landscaping drawings
so that we may determine which trees may interfere with utilities. In
general, palm trees will be the only tree species allowed within utilities
easements. Canopy trees may be planted outside of the easement so that
roots and branches will not impact those utilities within the easement in the
foreseeable future. LDR Sec. 7.5-18.1 gives public utilities the authority to
remove any trees that interfere with utility services, either in uti I ity
easements or public rights-of-way.
3. Dept. of HRS permits will be required for the water and sewer systems
serving this project. (sec. 26.12).
4. Comp Plan policy 3C.3.4 requires the conservation of potable water. City
water may, therefore, not be used for irrigation where other sources are
readily available.
5. Sec. 26-34(E) of the City Code requires that a capacity reservation fee be
paid for this project either upon my request for signature on the Health Dept.
application forms or within 30 days of site plan approval, whichever occurs
first. This fee will be determined based upon final meter size, or expected
demand.
6. Comp Plan policy 3C.3.4 requires the conservation of potable water. City

7. Provide an engineer's written certification that drainage will conform with all
rules of the City and the South Florida Water Management District. (LDR

SPECIFIC CONDITIONS
8. Water and sewer lines to be owned and operated by the City shall be included
within utilities easements. Please show all proposed easement~ on the
engineering drawings, using a miuimum width of 12 feet. The easements
shall be dedicated via separate instrument to the City as stated in Sec. 26-
33(a) of the Code.
9. The plan indicates proposed parking and landscaping along the east side of
the property within the existing 25-foot utilities easement, and also over two
existing water supply wells. The proposed parking cannot be built over the
supply wells, and must be reduced in scope in order to allow this Department
continued access to the wells for operation and maintenance purposes. We
require a 100 linear foot clear space within the easement, to the north
and south of each well, for effective operation and maintenance of the
facilities. This is absolutely necessary in order to protect the City's right
to use that land within the easement for utilities purposes. Safe access
from paved areas to the easement must also be provided
10. Approval from Palm Beach County Environmental Resources management
must be obtained for the proposed construction within wellfield zones, under
the County's Wellfield Protection Act. This approval must be fumished to
the City prior to our approval of sewer, and drainage plans.
I!. Appropriate backflow preventers will be required on the domestic water
service to the building, and the fire sprinkler line if there is one, in
accordance with Sec. 26-207. Note that fire sprinkler systems with a
booster pump will require installation of a reduced pressure zone device, as
specified in the City's Code.
12. The waste stream from the manufacturing process must meet the City's
pretreatment requirements. A sampling point must be provided to allow
monitoring of this waste stream. (Sec. 26-]43, 26-147)
13. Water mains shall be looped wherever possible, in compliance with Health
Department Design Standards. This item will be addressed during review
of the Health Department permit set of plans.

23. Add to the phase II site data, computations that would identify the
accessible parking spaces that are required and provided for the phase.
24. To clarify the location of phase II add to sheets A-2e and A-2f the line that
represents the location of phase II.
25. To clarify the location of the parking spaces for phase II chronologically
number on the site plan all the parking spaces provided within phase II.
26. To properly identify the site plan remove the word master from the title of
sheet A-I.
27. Add to the proposed Site Plan and Floor Plan drawings a note and/or symbol
that specifically identifies the location of the accessible route that is required
from the abutting street to the accessible entrance of the building and each
tenant space. Also identify the type of material proposed for the route
including specifying the slope and surface finish. Where the slope requires
an accessible ramp show and identify the location of the ramp including
specifying the type of material, surface finish, landings, width, length, slope
and, where required, the appropriate handrails. All aspects of the accessible
route shall comply with the regulations specified in the accessibility code.

28. Add to the proposed Paving Drainage & Water Management Plan and
Landscape Plan a note and/or symbol that specifically identifies the location
of the accessible route that is required from the abutting street to the

match the route shown on the site plan [Florida Accessibility Code for
Building Construction, Section 4.3, Accessible Route]
29. The submittal does not include specifications for proposed wall or site
signage. Therefore place a note on the Site plan and elevation view
drawings indicating that approval of a sign program is required before a sign
permit will be issued. Contact the Planning and Zoning Division regarding
the submittal procedures and contact the Building Division to determine
what documents are required to be submitted for a sign program. [Chapter
21-Sign Code]

30. The landscape plans and property survey indicate 3 shade and II palm trees
on the site. The application should indicate which trees will be preserved,
relocated and removed/replaced. This would be in addition to those trees
required by the landscape code.
Code Reference: Code of Ordinances Environmental, Chapter 7.5 Tree
Protection. The project should continue in the normal review process.
31. West greenbelt needs to be reinstated as per previously approved plans.
32. Lake littoral zone plantings must be installed. Provide landscaping plans
for this area.
