PZ 99-007 TO: Chairman and Members, Planning and Development Board Michael W Rumpf, Acting Planning and Zoning Manage~~ THRU: FROM: Daniel DeCarlo, Assistant Planner DATE: January 8, 1999 Peter Browne Alley Abandonment (ABAN 98-006) SUBJECT: NATURE OF REQUEST/BACKGROUND Mr. Peter Browne, the property owner of land located at 125 SW 1" Avenue, is requesting abandonment of the following easement segment: . That portion of a 20 foot wide alleyway lying northerly of and adjacent to lots #35 and #36, Block 12, bounded on the north by the southerly line of lots #10 and #11, Block 12, and bounded on the east by the northerly extension of the easterly line of lot 36, Block 12, and bounded on the south by the northerly line of lots #35 and #36, Block 12, all being and lying in the plat of Boynton Heights revised plat recorded in Plat Book 10, Page 64 of the Public Records of Palm Beach County, Florida, Two, two-story duplexes, occupy the property abutting the alley, The attached Exhibit "A" is a location map that shows the general vicinity ofthe alley right-of-way and legal description of the portion of the easement to be abandoned. Both duplexes encroach into the alley by 0,70 foot, and an existing concrete sidewalk encroaches the alley by 3.3 feet. The encroachment, and therefore the necessity for the Clbandonment was determined when the property was recently being prepared to be sold. As historic building records may be incomplete and disbursed, staff was only able to quickly determine the original construction date as 1959. Abandonment of the 20 foot alley will increase the depth of the subject property by 10 feet (one-half the width of the alley), which would eliminate the encroachment problem. However, staff has not detemnined if the concrete walkway will encroach over the required easements. Said encroachment would likely be accepted by the utility with a legal instrument ensuring peaceful access and a "hold harmless" agreement against property damage, ANALYSIS Public notice has been g' :en to the property owners that abut the right-of-way to be abandoned, and has been advertised in the newspaper. A summary of the review by the utility companies and city staff is as follows: CITY DEPARTMENTS Engineering Utilities Planning and Zoning No objection. Replace with an eleven-foot easement along the south portion of the alley. No objection as long as conditions of approval are met. PUBLIC UTILITY COMPANIES Florida Power and Light Bell South Replace with ten-foot utility easement centered over existing distribution facilities. Replace with twelve foot utility easement for both buried and aerial cables. No objection. Florida Public Utilities Company / Page 2 Memorandum No. PZ 98-188 ABAN 98-004 Cable Company (Comcast Telemedia, and Adelphia) Comcast requires a ten foot utility easement. The city's Utilities Department, Comcast, Florida Power and Light and Bell South require easement rights in exchange for the alley abandonment. This is effectively dealt with in the con.ditions of approval, whereby the applicant must show that this easement is recorded prior to tinal approval of this request. The following is a description of the zoning districts and land uses of the properties that surround the subject request (see Exhibit "B" - Site Plan). North - East South - West - Single family home, zoned R-1. Multi-family apartment building, zoned R-2 S.W. 1" Avenue R.W.O. and farther south vacant parcels, zoned R-2. Duplex dwelling units, zoned R-2.
