Gentlemen:
I have examined at the request of my client BAPS Development, Inc., title information furnished
under file no. 06-99-8827, prepared by Attorneys' Title Insurance Fund, Inc. for the purpose of
determining ownership and encumbrances of five parcels abutting three legal descriptions depicted on
surveys prepared by Associated Engineers & Surveyors of South Florida Corporation under job no.99-503.
Based on such examination I am ofthe opinion that together with my client. the ostensible owners
of the underlying land which is subject to road rights-of-way as depicted on such surveys are:
I. As to Lot 7 of Sunny Oaks Addition the owner is Patricia Bush and such property is
encumbered by a mortgage held by Principal Residential Mortgage, Inc.
2. As to Lots 8 and 9 of Sunny Oaks Addition the owner is Donald J. Fisher and Barbara
Fisher and the property is subject to a mortgage in favor of Fidelity Federal Savings Bank
of Florida.
3. As to Boynton Village property for which the legal description is attached as exhibit "A",
the owner is Pita General Corporation. The property is subject to a long term lease to AHC
Tenant. Inc. and is encumbered by a mortgage in favor of First National Bank of Chicago
as Trustee.
4. As to the Hatteras Apartments located on Lots 3 through 24 and part of Lot 25 of Happy
Lanes Subdivision the owner is The Hatteras Apartments, Limited, and the property is
encumbered by a mortgage to World Savings and Loan Association.
