INTRODUCTION
Contained herein is a description of the subject project. The existing facility is situated on 0.65 acres of
land zoned M-1, light Industrial and located on Industrial Avenue at the northwest corner of Boynton
Beach Boulevard and 1-95. It consists of a one-story, 3,618 square foot office/warehouse building, above
ground fuel storage tanks and three existing fuel dispensers, The applicant proposes to retain the
existing facilities, add a fuel dispenser station with three multi-grade dispensers capable of serving two
trucks simultaneously, and site improvements.

STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11,2.D of the Land Development Regulations contains the following standards to which
conditional uses are required to conform. Following each of these standards is the Planning and Zoning
Division's evaluation of the application as it pertains to standards.
1, Ingress and egress to the subject property and proposed structures thereon, with the particular
reference to automobile and pedestrian safety and convenience, traffic flow, and control, and
access in case off ire or catastrophe.
The subject property currently has two (2) points of ingress and egress both located along the
east property line accessing Industrial Avenue, The applicant proposes to close the existing 25
foot driveway located on the southeast portion of the site, leaving only one (1) driveway
connection to Industrial Avenue on the east side, and replace it with a new driveway along the
south property line. This will greatly improve the flow of truck traffic on and off-site. Access for
emergency vehicles is adequate and meets code requirements,
2, Off-street parking and loading areas where required, with particular attention to the items in
subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will
have on adjacent and nearby properties, and the city as a whole.
The existing site has no formal parking area designated, The majority of the site is already paved
to accommodate the trucks that load and unload fuel. The zoning code requires five (5) parking
spaces, The applicant proposes to provide seven (7) regular parking spaces and one 1)
handicapped space along the north property line,
3. Refuse and service areas, with particular reference to the items in subsection 1 and 2 above,
No dumpster is being provided on site.
Current waste generation will remain unaltered, which is currently serviced using trash cans
rather than a dumpster.
4. Utilities, with reference to locations, availability, and compatibility.
Water and sewer utilities are currently provided to the site. With incorporation of Utility
Department comments, utilities are available and consistent with the Comprehensive Plan
policies and City regulations,
5. Screening, buffering and landscaping with reference to type, dimensions, character.
The applicant is proposing to provide landscaping on the site to meet the City's current zoning
code regulations, A landscape buffer ranging from 4 feet to 12 feet in width, including a
continuous hedge, and required buffer trees will be provided along the road right-of-way and
vehicular use areas, These changes represent major improvement to the existing site as no
landscaping currently exists, With incorporation of staff comments, screening and buffering will
meet the code.

6, Signs and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and
compatibility and harmony with adjacent and nearby properties,
There is one existing sign on the building fac;:ade. No new signs are proposed for the site.
New site lighting consists of two (2) pole fixtures located on the proposed pump island. At the
time of permitting, lighting levels will be evaluated for minimum illumination and excessive glare,
No increased conditions regarding glare are anticipated from the proposed development.
7. Required setbacks and other spaces,
The setback requirements for the M-1 district are 15 feet for the front and side yards and 20 feet
for the rear yard, The proposed addition of the fuel pump island meets the required minimum yard
setbacks for the zoning district. The code allows sites with setback non-conformities to be
improved as long as non-conformities are not worsened by building expansions,

Foster Oil Corp" a bulk fuel facility is currently operating on this site, The applicant is proposing to
add one (1) new pump island and modify the existing fuel dispenser to meet state requirements.
Although the subject property is located within 300 feet of residentially zoned property, triggering
the Conditional Use requirements, it does not directly abut any residential development. It is
totally surrounded by other industrial uses. The current zoning and land use for the site and the
adjacent property is M-1 and Industrial, respectively, which are appropriate for the use.
9, Height of building and structures, with reference to compatibility and harmony to adjacent and
nearby properties, and the city as a whole,
The maximum height of any structure on site is 35 feet for the existing storage tanks, The
proposed pump island will not exceed this height which is within the maximum 45 feet allowed by
the zoning code,
10, Economic effects on adjacent and nearby properties, and the city as a whole.
The applicant is proposing to improve the current operation of distributing bulk fuel and to meet
recently imposed state and federal requirements regarding this business, In addition, the
applicant has agreed to upgrade the site to meet City zoning requirements. Not only will the
proposed additions and modifications improve the economic viability of this business but also
improve the overall appearance of the site,
11, Conformance to the standards and requirements which apply to site plans, as set forth in the
Land Development Regulations, Chapter 4, Site Plan Review,
With incorporation of staff comments, the proposed project will comply with requirements stated
within this section of city code,
12, Compliance with, and abatement of nuisances and hazards in accordance with the performance
standards within Section 4 of the zoning regulations; also, conformance to the City of Boynton
Beach Noise control Ordinance,

With incorporation of all conditions contained herein, the use would operate in a manner that is in
compliance with the above-referenced codes and ordinances of the City of Boynton Beach.
SUMMARY/RECOMMENDA TION
The applicant, F,H, Foster, Oil Corp., is requesting site plan approval to address certain on-site
deficiencies that are the result of new state and federal requirements for this type of use, In addition to
providing for the required modifications, the site will be upgraded to meet current zoning requirements for
this use including landscaping, parking, drainage and lighting,
In April, 1996 there was discussion by the Planning and Development Board and City Commission
related to Comprehensive Plan Objective 1,10 which states: "By the Year 2000, eliminate nonconforming
commercial and industrial uses which are located in residential zoning districts, and all uses which create
a significant risk of fire, explosion, toxic or other hazard to existing or future dwellings located in
residential land use categories", At that time the use of the subject property was considered a "possible"
high risk, The objective was adopted in 1989 and never codified, No action has been taken over the
years to address this policy,
The site is appropriately zoned for the current bulk fuel facility use. The existing use has been in
operation for many years with no hazardous incidents. A Texaco gas station is located just west of the
subject property at the intersection of Industrial Avenue and Boynton Beach Boulevard. As indicated
above, the subject site is surrounded by other industrial uses, Appropriate buffering is in place to
separate these commercial and industrial land uses from the neighboring residential area,
The only outstanding issue at this time involves the review of the traffic statement. Palm Beach County
requested that trip generation be based on the service station rate (per fueling position) which doesn't
realistically apply to the bulk fuel operation, Based on this trip generation assumption the County wants
an evaluation of the accessed link (Boynton Beach Boulevard west of 1-95), These issues must be
resolved so that the project meets the Traffic Performance Standards of Beach County prior to
application for a building permit.
Staff recommends that the application be approved subject to meeting all the conditions in Exhibit "C",
which includes the Palm Beach County Traffic Performance Standards.

V The Public Works Department is asking FH Foster Oil to show how the
garbage and trash will be removed. If a dumpster is to be used, a proper
enclosure according to Code will need to be built.

Comments:
V All utilities easements shall be shown on the rectified landscaping
drawings so that we may determine which trees may interfere with
utilities, In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within
the easement in the foreseeable future, LDR Sec. 7.5-18,1 gives public
utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way,

INTRODUCTION
Contained herein is a description of the subject project. The existing facility is situated on 0,65 acres of
land zoned M-1, light Industrial and located on Industrial Avenue at the northwest corner of Boynton
Beach Boulevard and 1-95. It consists of a one-story, 3,618 square foot office/warehouse building, above
ground fuel storage tanks and three existing fuel dispensers, The applicant proposes to retain the
existing facilities, add a fuel dispenser station with three multi-grade dispensers capable of serving two
trucks simultaneously, and site improvements,

STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11,2,D of the Land Development Regulations contains the following standards to which
conditional uses are required to conform, Following each of these standards is the Planning and Zoning
Division's evaluation of the application as it pertains to standards,
1, Ingress and egress to the subject property and proposed structures thereon, with the particular
reference to automobile and pedestrian safety and convenience, traffic flow, and control, and
access in case of fire or catastrophe,
The subject property currently has two (2) points of ingress and egress both located along the
east property line accessing Industrial Avenue, The applicant proposes to close the existing 25
foot driveway located on the southeast portion of the site, leaving only one (1) driveway
connection to Industrial Avenue on the east side, and replace it with a new driveway along the
south property line. This will greatly improve the flow of truck traffic on and off-site, Access for
emergency vehicles is adequate and meets code requirements,
2. Off-street parking and loading areas where required, with particular attention to the items in
subsection 1 above, and the economic, glare, noise, and odor effects the conditional use will
have on adjacent and nearby properties, and the city as a whole,
The existing site has no formal parking area designated, The majority of the site is already paved
to accommodate the trucks that load and unload fuel. The zoning code requires five (5) parking
spaces, The applicant proposes to provide seven (7) regular parking spaces and one 1)
handicapped space along the north property line.
3, Refuse and service areas, with particular reference to the items in subsection 1 and 2 above,
No dumpster is being provided on site,
Current waste generation will remain unaltered, which is currently serviced using trash cans
rather than a dumpster,
4. Utilities, with reference to locations, availability, and compatibility.
Water and sewer utilities are currently provided to the site, With incorporation of Utility
Department comments, utilities are available and consistent with the Comprehensive Plan
policies and City regulations.
5, Screening, buffering and landscaping with reference to type, dimensions, character,
The applicant is proposing to provide landscaping on the site to meet the City's current zoning
code regulations, A landscape buffer ranging from 4 feet to 12 feet in width, including a
continuous hedge, and required buffer trees will be provided along the road right-of-way and
vehicular use areas. These changes represent major improvement to the existing site as no
landscaping currently exists, With incorporation of staff comments, screening and buffering will
meet the code,

6, Signs and proposed exterior lighting, with reference to glare, traffic safety, economic effect. and
compatibility and harmony with adjacent and nearby properties,
There is one existing sign on the building faQade, No new signs are proposed for the site,
New site lighting consists of two (2) pole fixtures located on the proposed pump island, At the
time of permitting, lighting levels will be evaluated for minimum illumination and excessive glare,
No increased conditions regarding glare are anticipated from the proposed development.
7, Required setbacks and other spaces.
The setback requirements for the M-1 district are 15 feet for the front and side yards and 20 feet
for the rear yard, The proposed addition of the fuel pump island meets the required minimum yard
setbacks for the zoning district. The code allows sites with setback non-conformities to be
improved as long as non-conformities are not worsened by building expansions.
8, General compatibility with adjacent property and other property in the zoning district.
Foster Oil Corp" a bulk fuel facility is currently operating on this site. The applicant is proposing to
add one (1) new pump island and modify the existing fuel dispenser to meet state requirements.
Although the subject property is located within 300 feet of residentially zoned property, triggering
the Conditional Use requirements, it does not directly abut any residential development. It is
totally surrounded by other industrial uses, The current zoning and land use for the site and the
adjacent property is M-1 and Industrial, respectively, which are appropriate for the use.
9, Height of building and structures, with reference to compatibility and harmony to adjacent and
nearby properties, and the city as a whole,
The maximum height of any structure on site is 35 feet for the existing storage tanks. The
proposed pump island will not exceed this height which is within the maximum 45 feet allowed by
the zoning code,
10, Economic effects on adjacent and nearby properties, and the city as a whole,
The applicant is proposing to improve the current operation of distributing bulk fuel and to meet
recently imposed state and federal requirements regarding this business, In addition, the
applicant has agreed to upgrade the site to meet City zoning requirements, Not only will the
proposed additions and modifications improve the economic viability of this business but also
improve the overall appearance of the site.
11, Conformance to the standards and requirements which apply to site plans, as set forth in the
Land Development Regulations, Chapter 4, Site Plan Review.
With incorporation of staff comments, the proposed project will comply with requirements stated
within this section of city code.
12, Compliance with, and abatement of nuisances and hazards in accordance with the performance

compliance with the above-referenced codes and ordinances of the City of Boynton Beach,
SUMMARY/RECOMMENDA TION
The applicant, F,H. Foster, Oil Corp" is requesting site plan approval to address certain on-site
deficiencies that are the result of new state and federal requirements for this type of use, In addition to
providing for the required modifications, the site will be upgraded to meet current zoning requirements for
this use including landscaping, parking, drainage and lighting.
In April, 1996 there was discussion by the Planning and Development Board and City Commission
related to Comprehensive Plan Objective 1,10 which states: "By the Year 2000, eliminate nonconforming
commercial and industrial uses which are located in residential zoning districts, and all uses which create
a significant risk of fire, explosion, toxic or other hazard to existing or future dwellings located in
residential land use categories", At that time the use of the subject property was considered a "possible"
high risk. The objective was adopted in 1989 and never codified. No action has been taken over the
years to address this policy,
The site is appropriately zoned for the current bulk fuel facility use. The existing use has been in
operation for many years with no hazardous incidents, A Texaco gas station is located just west of the
subject property at the intersection of Industrial Avenue and Boynton Beach Boulevard, As indicated
above, the subject site is surrounded by other industrial uses, Appropriate buffering is in place to
separate these commercial and industrial land uses from the neighboring residential area.
The only outstanding issue at this time involves the review of the traffic statement. Palm Beach County
requested that trip generation be based on the service station rate (per fueling position) which doesn't
realistically apply to the bulk fuel operation. Based on this trip generation assumption the County wants
an evaluation of the accessed link (Boynton Beach Boulevard west of 1-95), These issues must be
resolved so that the project meets the Traffic Performance Standards of Beach County prior to
application for a building permit.
Staff recommends that the application be approved subject to meeting all the conditions in Exhibit "C",
which includes the Palm Beach County Traffic Performance Standards,

1. The Public Works Department is asking FH Foster Oil to show how the
garbage and trash will be removed. If a dumpster is to be used, a proper
enclosure according to Code will need to be built.
UTILITIES
Comments:
2. All utilities easements shall be shown on the rectified landscaping
drawings so that we may determine which trees may interfere with
utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within
the easement in the foreseeable future. LDR Sec. 7.5-18.1 gives public
utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
3. Dept. of Health permits may be required for the water and sewer systems
serving this project. (Sec. 26-12).
4. Fire flow calculations will be required demonstrating the City Code
requirement of 1500 g.p.m. as stated in LDR chap. 6, Art. IV, Sec. 16, or
the requirement imposed by insurance underwriters, whichever is
greater. (see Sec. 26-16(a)). Please submit these calculations with your
Health Department permit submittal.

8. This office will not require surety for installation of the water and sewer
utilities, on condition that the systems be fully completed, and given to

demonstrate that the plan meets this condition, by showing all
hydrants.
10. A building permit for this project shall not be issued until this office has
approved the plans for the water and/or sewer improvements required to

11. The waste stream from the manufacturing process must meet the City's
pretreatment requirements. A sampling point must be provided to allow

Foster Oil- New Site Plan - I" Review
We offer the following comments on this project:
GENERAL COMMENTS
I) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utility easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Dept. of Health permits may be required for the water and sewer systems serving this project. (Sec.
26-12).
3) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. IV, Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your Health
Department permit submittal.
4) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may not,
therefore, be used for irrigation where other sources are readily available.
5) Provide an engineer's written certification that drainage will conform to all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
I) Water and sewer lines to be owned and operated by the City shall be included within utility
easements. Please show all proposed easements on the engineering drawings, using a minimum
width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in
Sec. 26-33(a) of the Code.
2) This office will not require surety for installation of the water and sewer utilities, on condition that
the systems be fully completed, and given to the City before the first permanent meter is set. Note
that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy.
3) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants.
4) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec. 26-15)
5) The waste stream from the manufacturing process must meet the City's pretreatment requirements.
A sampling point must be provided to allow monitoring of this waste stream. (Sec. 26-143, 26-147)

The Public Works Department is asking Foster oil to show how the garbage and trash
will be removed. If a dumpster is to be used, a proper enclosure according to Code will
need to be built.
