Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments. Comments should be e.mailed to
Sherie Coale and I no later than 5:00 P.M, on October 24,2001. When preparing your comments,
please separate them into two categories; code deficiencies with code sections referenced and
recommendations that you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:
1.
Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments.
2.
The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by the
reviewer by contacting Lusia Galav, or myself.
3.
Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4.
Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with
other departmental impro-.ements.

5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the
comment and the specific code section may be included in their review comments with the name of
the appropriate TRC Member that is responsible for the review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within the time
frame stated above, to me. The memorandum shall state that the plans are approved and that they
do not have any comments on the plans submitted for review and that they recommend the project
be forwarded through the approval process.
All comments shall be typed, addressed and transmitted or e-mailed to Sherie Coale and I for distribution
to the applicant. Please include the name and phone number of the reviewer on this memorandum or e-
mail. Lusia Galav will be the Planning and Zoning staff member coordinating the review of the project.
First review comments will be transmitted to the applicant along with a list of Technical Review Committee
(TRq) members.

I. The site plan and master plan design documents shall adhere to Chapter 9 of the
Code of Ordinances ofthe City of Boynton Beach entitled "Fire Protection and
Prevention." This ordinance adopts NFPA I, Fire Prevention Code, 1997 edition,
and NFPA 101, Life Safety Code, 1997 edition.
2. Design documents shall demonstrate compliance with LDR Chapter 6, Section 16,
which provides requirements for hydrants. Hydrants in commercial applications
shall be no more than 300 ft. apart and the remotest part of any structure shall be
no more than 200 ft. from a hydrant. Connections shall be to mains no less than 6
inches in diameter. In addition to domestic requirements at a residual pressure of
not less than 20 psi, a fire flow of at least 1500 gpm is required.
3. Design documents where underground water mains and hydrants are to be
provided, must demonstrate that they will be installed, completed, and in service
prior to construction work per NFP A I, (1997) Section 41-2.3.2.
4. Pursuant to City Ordinance 9-3F, the Fire Marshal has developed an
Administrative Order dated May 9, 2001, that provides the minimum performance
for all security gates and emergency access. Another Administrative Order dated
May 15, 2001 addresses Knox Box storage ofinfoITnation forresponding
emergency personnel.
5. Design documents must demonstrate compliance with the requirements for fire
lanes that are provided in Section 9-21 ofthe City Ordinances. Signing and
marking are described in LDR Chapter 23 Section B2.
6. Fire Lanes shall be provided at the start of a project and be maintained throughout
construction for access per NFP A I, Section 41-2.1.

1 have reviewed the above referenced Site Plans, forwarded to me on October 18, 2001, against the
requirements outlined in the City of Boynton Beach Code of Ordinances. Following are my comments
with the appropriate Code and Land Development Regulations (LDR) referenced.

1. On the Site Plan, add a general note that all plans submitted for specific permits shall meet the City's
Code requirements at time of application. These permits include, but are not limited to, the following:
paving, drainage, curbing, excavation, fill, work within the public right-of-way, site lighting,
landscaping and irrigation. Permits required from other permitting agencies such as Florida
Department of Transportation (FDOT), South Florida Water Management District (SFWMD), Lake
Worth Drainage District (LWDD), Florida Department of Environmental Protection (FDEP), Palm
Beach County Health Department (PBCHD), Palm Beach County Engineering Department (PBCED),
Palm Beach County Department of Environmental Resource Management (PBCDERM) and any
others, shall be included with the permit request.
2. Provide a signed and sealed survey, not older than 6 months, in accordance with the requirements of
the LDR, Chapter 4, Section 7.A and Chapter 23, Article I, Section S.B.2.
3. Show all existing utilities and connections on Site Characteristics Map (Survey) and Site
Development plan (LDR, Chapter 4, Section 7.A.3).
4. Show drawing scale graphically and in writing on each sheet.

Please find attached the first review comments for your project. To stay on the
current review schedule, please do the following steps listed below, and bring all
documents to the TRC scheduled for Tuesday October 30, 2001.
1. Revise your plans incorporating all comments listed herein, including the addition of
notes on plans to confirm response to general statements/ comments, and bring 10 copies
to the TRC review meeting (full sets including all pages originally submitted);
2. Submit the additional information as requested within the attached comments; ( i.e, traffic
analysis, engineering certification, etc.)
3. Prepare a written response (7 copies) consisting of a list briefly summarizing how each
comment has been addressed on the revised plans or with the supplemental information
including location on the plans ( this promotes an expeditious 2nd review by staff and
your project representatives during the TRC meeting );and
4. Submit reductions (8 Yz X 11) for the proposed site plans, elevations and landscaping plan
(this is required for the final report and public presentation).
The applicant should not attend a TRC (2nd review) until all documents have been revised and
copied for staff review. If plans will not be fully revised and brought to the scheduled TRC
meeting, contact Lusia Galav in this office by the Thursday prior to the scheduled meeting date.
Projects deviating from the original schedule are eligible for review at subsequent meetings,
which are held every Tuesday. To reschedule, contact Sherie Coale, by the Thursday prior to
the Tuesday TRC meeting that you desire to attend. The remainder of the review schedule will
be adjusted accordingly. If you have questions on the attached comments, please contact the
respective reviewer using the attached list of TRC representatives.
If the plans are reasonably complete and all significant comments are addressed following TRC
(2nd review), the project is forwarded to the Planning and Development Board Meeting that falls
approximately 2 to 3 weeks following the TRC meeting. An "*,, by any comment identifies a
comment that must be addressed prior to moving forward to the Planning and Development
board.
Note: Items recognized by staff as typically outstanding at this point include a traffic report
and/or confirmation of the traffic concurrency approval from the Palm Beach County
drainage certification by a licensed engineer, signed "Rider to Site Plan Application"
form and colored elevations ofthe proposed project. This information is necessary for

PROPOSAL SUMMARY
Contained herein is a description of the subject project. The proposed daycare / preschool will be operated out
of the existing Bible Church of God fellowship hall located at ]390 North Seacrest Boulevard. The current R-
I-A zoning allows a church, but daycare is subject to conditional use approvaL The daycare operation will
have a 55-child capacity. In addition, the site plan proposes to fence in 10,721 square feet of outside playing
area to meet the requirements under State regulations. Except for the play area fence, no structural changes
are proposed either inside or outside the existing building.

East - A parcel ofland zoned Community Commercial, C -3 and farther east the FEC railroad tracks;
South - Right-of-way of the South Florida Water Management District (SFWMD) C-16 Canal and farther
south residential development zoned Residential, R-2; and
West - Right-of-way for Seacrest Boulevard and farther west vacant land owned by the Bible Church of God
zoned Residential, R-1.
STANDARDS FOR EVALUATING CONDITIONAL USES AND ANALYSIS
Section 11.2.D of the Land Development Regulations contains the following standards to which conditional
uses are required to conform. Following each of these standards is the Planning and Zoning Division's
evaluation of the application as it pertains to standards.
The Planning and Development Board and City Commission shall consider only such conditional uses as are
authorized under the terms of these zoning regulations and, in connection therewith, may grant conditional
uses absolutely or conditioned upon the conditions including, but not limited to, the dedication of property for
streets, alleys, recreation space and sidewalks, as shall be determined necessary for the protection of the
surrounding area and the citizens' general welfare, or deny conditional uses when not in harmony with the
intent and purpose of this section. In evaluating an application for conditional use approval, the Board and
Commission shall consider the effect of the proposed use on the general health, safety and welfare of the
community and make written findings certifying that satisfactory provisions have been made conceming the
following standards, where applicable:
I. Ingress and egress to the subject property and proposed structures thereon, with particular reference to
automobile and pedestrian safety and convenience, traffic flow and control, and access in case of fire
or catastrophe.
The subject property has one point of ingress/egress at Seacrest Boulevard. This western access is a
20-foot wide opening which serves the entire site. It is a long narrow shaped parcel and this access
road runs along the south side adjacent to the SFWMD C-16 Canal approximately 250 feet at which
points it widens to 34 feet of paved area. It connects to the two parking areas located behind the
existing fellowship hall building. A gate is proposed at the location where the road begins to widen.
This gate will be equipped with a Knox box to ensure access for emergency vehicles. In addition, a fire
lane will be designated along the wider paved area adjacent to the south side of the building.
The church currently parks between two and three passenger transport buses along this roadway. As a
condition of approval for the daycare use, these vehicles would have to be parked in the parking lot
behind the existing fellowship hall.
The pick-up and drop-off area for the children will be located in the back of the building convenient to
the entrance door. Pedestrian/vehicular conflict is minimal at this location.

A traffic study was not required because a 55-child day care use would generate slightly less than 200
average daily trips (ADT). The cut-off for concurrency review by the Palm Beach County Traffic
Division is 200 ADT. The applicant has provided a written statement limiting the daycare use to 55
children.
2. Off-street parking and loading areas where required, with particular attention to the items in subsection
1 above, and the economic, glare, noise, and odor effects the conditional use will have on adjacent and
nearby properties, and the city as a whole.
The parking required for the proposed daycare is calculated based on one space for each 300 square
feet of gross floor area. The indoor area allocated for the daycare use totals 4,116 square feet, which
requires 14 parking spaces, The existing parking lot has 105 spaces including three handicap spaces.
There is sufficient parking currently on site to accommodate the daycare use.
3. Refuse and service areas, with particular reference to the items in subsection 1 and 2 above.
The existing dumpster is located in the northeast corner of the first parking area in back of the existing
building. It is enclosed, is not visible from the street and does not inteifere with the daycare operation.
4. Utilities, with reference to locations, availability, and compatibility.
Consistent with Comprehensive Plan policies and city regulations, all utilities, including potable water
and sanitary sewer are in place via construction of the original permitted fellowship hall facility.
5. Screening, buffering and landscaping with reference to type, dimensions, and character.
The children's play area is proposed to be located in the front (west) and north side of the existing
fellowship hall. The plans indicate that it will contain a total of 10,721 square feet. No play equipment
is planned for the area at this time. A four (4) foot chain link fence is proposed to enclose the area
along the front and sides of the play area up to the front building line of the fellowship hall. Thefence
will continue along the north side at five (5) feet high until it reaches the end of the first parking lot. A
six(6)footfence is proposed along the south side of the property adjacent to the SFWMD C-16 Canal
and along the rear of the first parking area. The entrance to the first and second parking lot areas will
be gated.
The north side perimeter landscape buffer contains an existing native Florida Privet hedge that is the
same height as the proposed five (5) foot fence. This provides an adequate buffer for the residential
property to the north. The interior and parking areas contain a wide variety of plants, shrubs, and
trees, which were approved with the original site plan.
6. Signs, and proposed exterior lighting, with reference to glare, traffic safety, economic effect, and

The site contains one free standing monument sign located at the front of the property adjacent to
Seacrest Boulevard. No new signage or lighting is proposed with this application.

7. Required setbacks and other open spaces.
The building meets or exceeds all setback requirements required of the R -l-A zoning district. The
outside play area will encompass 10,721 square feet. Thisfenced area will be located in the front and
north side of the existing fellowship hall building. The open space required for the project is not
affected by this proposal.
8. General compatibility with adjacent property and other property in the zoning district.
In general, the proposed project is compatible with the existing church use. There will be minimal on-
site impact and no adverse effects will occur because the proposed daycare use will not conflict with
the regularly scheduled church services. There will be little or no impact to the adjacent properties or
to the general area.
9. Height ofbui]ding and structures, with reference to compatibility and harmony to adjacent and nearby
properties, and the city as a whole.
No new structures are proposed with this application. The daycare use will operate out of the existing
one story fellowship hall building. The City Commission approved the original site plan on November
21, 1989. The existing fellowship hall building was subsequently constructed as Phase One.
10. Economic effects on adjacent and nearby properties, and the city as a whole.
Daycare is a needed social service in this area. The proposed use will constitute additional
convenience and choice for the members of the Bible Church of God and for the residents of the
surrounding neighborhood.
11. Conformance to the standards and requirements which apply to site plans, as set forth in Chapter 19,
Article II of the City of Boynton Beach Code of Ordinances. (Part III Chapter 4 Site Plan Review).
With incorporation of staff comments, the proposed project will comply with all requirements of
applicable sections of city code.
]2. Compliance with, and abatement of nuisances and hazards in accordance with the performance
standards within Section 4 of the zoning regulations; also, conformance to the City of Boynton Beach
Noise Control Ordinance.
With incorporation of all conditions and staff recommendations contained herein, the proposed
daycare ! preschool use would operate in a manner that is in compliance with the above-referenced
codes and ordinances of the City of Boynton Beach. In particular. the applicant will have to apply for
and obtain all necessary approvals and licenses from all applicable governing bodies, including but
not limited to the Palm Beach County Health Department and Florida State Department of Health,
which are required for the daycare ! preschool operation.

sent to the Clerk's office for transmittal to the Palm Beach Post. Please note that even though this may not be the most
expeditious method for processing this application, I do not want to jeopardize the legal ad by publishing it before it is
certain that the project will go forward to the Board. A draft timeline will be prepared based on the submittal date of your

Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:

2. The documents submitted for the project were determined to be substantially complete with the

As a follow-up to our discussion last night. I called Ms. Shirley Waters the director for the day care about the fact that they
had not applied for a building permit. She advised me that they do not need a building permit since all the infrastructure for
the day care is in place. It is in the sanctuary and the pews are to be moved for the day time program. The FD has issued
permits as has the City Occupational License Division (two years ago). It is now up to Planning and Zoning, according to
Ms. Waters to grant them authorization to operate pursuant to their special use permit. I could not remember if your permit
print-out shows these prior approvals or not. Bottom line: if they need a traffic study and sign off by the City and County,
we need to work with them to expedite the release of their permit to operate. As I told you last night. I cannot and will not
authorize any waivers of the City requirement. The key question is whether or not a traffic study is indeed needed. That is
what must be researched by your office. If so. we will need to address how we can help them get the traffic study done
and reviewed. If no traffic study is needed, they must be allowed to open. I'm respectfully asking that staff make the extra
effort to move this along. I don't like getting involved in permit issues unless it is at last resort.

As a follow-up to our conversation, I would appreciate your follow-up with appropriate staff on the issuance of the
building permit for the remodeling necessary for the Church to pursue their plans for a day care facility. The facility
would be located in the Church and has, according to my information, received the sign off by all departments except
for a requirement of a traffic study to evaluate the impact, if any, of the facility on Seacrest. As I understand it, the
Church secured a Conditional or Special Use Permit following a public hearing with P&D/City Commission review.
That took place in 1 997. Unfortunately, the Church got a slow start on their building permit. While the zoning
clearances were achieved before the County impact procedures were in place, the issuance of the building permit got
stalled and the Church is in sort of a limbo of new regulations being put into effect after they had received zoning
approvals and possibly after they applied for the building permits.
My request is for you to review this with staff to determine if the Church can be "grandfathered" because they did
receive zoning approval before the traffic impact regulations took effect.

I'd like to give them an answer in a week as they have been patiently waiting on the City.

We offer the following conunents on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may
determine which trees may interfere with utilities. In general, palm trees will be the only tree
species allowed within utility easements. Canopy trees may be planted outside of the easement so
that roots and branches will not impact those utilities within the easement in the foreseeable future.
LDR Sec. 7.5-18.1 gives public utilities the authority to remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
2) Sec. 26-34(E) of the City Code requires that a capacity reservation fee be paid for this project
either upon my request for signature on the Health Dept. application forms or within 30 days of site
plan approval, whichever occurs first. This fee will be determined based upon final meter size, or
expected demand.
3) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may, therefore, not
be used for irrigation where other sources are readily available.
4) Provide an engineer's written certification that drainage will conform with all rules of the City and
the South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utility
easements. Please show all existing or proposed easements on the engineering drawings, using a
minimum width of 12 feet. The easements shall be dedicated via separate instrument to the City as
stated in Sec. 26-33(a) of the Code.
2) This office will not require surety for installation of the water and sewer utilities, on condition that
the systems be fully completed, and given to the City before the first permanent meter is set. Note
that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy.
3) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of
an existing or proposed fire hydrant. Please demonstrate that the plan meets this condition, by
showing all hydrants on the site plan.
4) Appropriate backflow preventers will be required on the fire sprinkler line if there is one, in
accordance with Sec. 26-207.
5) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec. 26-15)
6) A scaled drawing showing the site drainage plan shall be submitted. (LDR Chap. 4, sec. 7F)
