The facility would be located in the Church and has, according to my information, received the sign off by all departments except for a requirement of a traffic study to evaluate the impact, if any, of the facility on Seacrest. As I understand it, the Church secured a Conditional or Special Use Permit following a public hearing with paD/City Commission review. That took place in 1997. Unfortunately, the Church got a slow start on their building permit. While the zoning clearances were achieved before the County impact procedures were in place, the issuance of the building permit got stalled and the Church is in sort of a limbo of new regulations being put into effect after they had received zoning approvals and possibly after they applied for the building permits. My request is for you to review this with staff to determine if the Church can be "grandfathered" because they did receive zoning approval before the traffic impact regulations took effect. A summary of what we had discussed is as follows: I) Submit a letter stating the maximum children to be accommodated at the proposed day care; 2) Submit a revised site plan (12 sets) incorporating all applicable comments from the current list; 3) Identify "phase 2" and any other unimproved/planned improvements as "unimproved/future phase" on the submitted drawings (since the plans will also be reviewed by the Board and Commission, all documents should be as neat and legible as possible); 4) Resubmit current listings of property owners within 400 feet of the church property including mailing labels for each property owner address, postage and map showing the 400 foot radius line; 5) Remit payment for a new legal advertisement in the amount of $132.83 (as originally quoted); and 6) Provide documentation of the approval of the day care use by the appropriate state/county agency. As indicated to you, following submittal all of the above-listed information, the revised plans will be presented to the city's Technical Review Committee (TRC). The TRC will revise their comments and update the existing list. The TRC and Planning staff will then determine, based on the final comments, if the project is complete enough to be forwarded to the Planning & Development Board. Once it is certain that the project will be forwarded to the Board, the legal ad will be sent to the Clerk's office for transmittal to the Palm Beach Post. Dear Ms. Waters: I have written this letter in response to your request for an explanation for why you (Bible Church of God) must submit an application for conditional use approval as a pre-requisite for day care, given that the church site plan was processed by the city only four (4) years ago, The site plan review conducted for the Bible Church of God focused only upon the church site layout and performance (impact) of the church at this location. It is important to understand that the conditional use process, although nearly identical to the site process, is intended to provide for the review of uses which may have the potential for negatively affecting adjacent properties within a given zoning district. In order to provide for a thorough review, the environment where the particular use will be contained and managed must be carefully examined, This examination includes a review of interior and exterior space, proximity or exposure to, and impact upon, adjacent single family homes, a review for adequate parking to accommodate the new use, and a review to ensure the continued compliance with all city regulations, Furthermore, as conditional uses may not be desirable at all geographic locations, and even found undesirable by some adjacent property owners, this process also requires notification of adjacent property owners (those within 400 feet of the subject property), and a legal to be placed in the local newspaper. This type of review was not conducted when the church was originally processed. Pursuant to the Land Development Regulations, Chapter 2. Zoning, as recently aP"ended by your application for code review, day care uses at churches within single family zoning districts, are allowed through the conditional use process, Although this may seem duplicative, special criteria unique to the conditional use process will be used to evaluate this use and property. It is to your advantage that the church site plan was processed so recently. If these documents are not available from the original consultant/designer, they should be available, at the cost of duplication, at the Building Division. With respect to fees, the fee for conditional use approval is $1,500 for over 3 acres and $1,000 for a project under 3 acres. As indicated above, a review for the addition of day care at the existing site requires an additional review above that conducted when the site was originally planned, and therefore, a fee to cover the processing of this new review. Furthermore, as conditional uses may not be desirable at all geographic locations, and even found undesirable by some adjacent property owners, this process also requires notification of adjacent property owners (those within 400 feet of the subject property), and a legal to be placed in the local newspaper. This type of review was not conducted when the church was originally processed. Pursuant to the Land Developmp.nt Regulations, Chapter 2, Zoning, as recently amended by your application for code review, day care uses at churches within single family zoning districts, are allowed through the conditional use process. Although this may seem duplicative, special criteria unique to the conditional use process will be used to evaluate this use and property. It is to your advantage that the church site plan was processed so recently, If these documents are not available from the original consultant/designer, they should be available, at the cost of duplication, at the Building Division. I also relayed to him the minimum requirements of the Palm Beach County Traffic Division for project traffic data. Since you are changing the pattern that traffic will be generated L j the church, the traffic impacts on the roadways must be evaluated and reviewed by the County. I discussed this directly with the County to determine the absolute minimum data necessary to review and approve the traffic impacts. As for timing, since you were not able to make the TRC meeting of March 2nd, the project could not proceed on to the public meetings that we had postponed review to. Since we are only allowed to postpone a project one time that has been advertised publicly before we must advertise again, a second advertisment must be processed. The cost of this advertisement will be $132.83. Since property owner notices will also have to be processed, you will have to also pay for the postage for these notices. I hope this does not present a problem to you. These advertisement tasks are required by law to ensure that the public is adequately notified of your application.
