Subject: Bible Church of God - Day Care Accessory Use Permit
Quintus,
As a follow-up to our conversation, I would appreciate your follow-up with appropriate staff on the issuance of
the building permit for the remodeling necessary for the Church to pursue their plans for a day care facility.
The facility would be located in the Church and has, according to my information, received the sign off by all
departments except for a requirement of a traffic study to evaluate the impact, if any, of the facility on
Seacrest. As I understand it, the Church secured a Conditional or Special Use Permit following a public
hearing with paD/City Commission review. That took place in 1997. Unfortunately, the Church got a slow
start on their building permit. While the zoning clearances were achieved before the County impact
procedures were in place, the issuance of the building permit got stalled and the Church is in sort of a limbo of
new regulations being put into effect after they had received zoning approvals and possibly after they applied
for the building permits.
My request is for you to review this with staff to determine if the Church can be "grandfathered" because they
did receive zoning approval before the traffic impact regulations took effect.
Please contact Shirley Waters at 737-4510 or Bishop Banks at 278-2386.
I'd like to give them an answer in a week as they have been patiently waiting on the City.
Thanks,
Kurt

Subject: Bible Church of God Day Care (COUS 98-006)
Dear Ms. Waters:
In follow-up to our meeting held on May 22,2001, I am writing to document the steps necessary to re-initiate the above-
referenced application. A summary of what we had discussed is as follows:
I) Submit a letter stating the maximum children to be accommodated at the proposed day care;
2) Submit a revised site plan (12 sets) incorporating all applicable comments from the current list;
3) Identify "phase 2" and any other unimproved/planned improvements as "unimproved/future phase" on the
submitted drawings (since the plans will also be reviewed by the Board and Commission, all documents should be
as neat and legible as possible);
4) Resubmit current listings of property owners within 400 feet of the church property including mailing labels for
each property owner address, postage and map showing the 400 foot radius line;
5) Remit payment for a new legal advertisement in the amount of $132.83 (as originally quoted); and
6) Provide documentation of the approval of the day care use by the appropriate state/county agency.
As indicated to you, following submittal all of the above-listed information, the revised plans will be presented to the
city's Technical Review Committee (TRC). The TRC will revise their comments and update the existing list. The TRC
and Planning staff will then determine, based on the final comments, if the project is complete enough to be forwarded to
the Planning & Development Board. Once it is certain that the project will be forwarded to the Board, the legal ad will be
sent to the Clerk's office for transmittal to the Palm Beach Post. Please note that even though this may not be the most
expeditious method for processing this application, I do not want to jeopardize the legal ad by publishing it before it is
certain that the project will go forward to the Board. A draft timeline will be prepared based on the submittal date of your
revised application.
r trust r have adequately described the information needed to proceed with the review of this project, and the anticipated
review process. However, if you have any questions, please do not hesitate to contact me.
Sincerely,
AGe

March 17, 1999
Ms. Shirley Waters
1390 N. Seacrest Blvd.
Boynton Beach, FL
Dear Ms. Waters:
The purpose of this letter is to inform you of the current status of your project with respect to our
review process and to update the facsimile sent to you on 3/5/99, I recently met with the
engineer Malek to provide him with the additional information to be shown on the plans. I also
relayed to him the minimum requirements of the Palm Beach County Traffic Division for project
traffic data. Since you are changing the pattern that traffic will be generated by the church, the
traffic impacts on the roadways must be evaluated and reviewed by the County. I discussed this
directly with the County to determine the absolute minimum data necessary to review and
approve the traffic impacts.
As for timing, since you were not able to submit plans for the TRC meeting of March 2nd, the
project could not proceed on to the public meetings to which we had postponed review. Since
we are only allowed one postponement of a project that has been advertised publicly before we
must advertise again, a second advertisement must now be processed prior to forwarding to the
Planning and Development Board and City Commission. The cost of this advertisement will be
$132.83. Since property owner notices will also have to be processed, you will also have to pay
for the postage for these notices. I hope this does not present a problem to you. These
advertisement tasks are required by law to ensure that the public is adequately notified of your
application. Before we process this second advertisement, I suggest we wait until the plans are
complete and processed through the Technical Review Committee (TRC) and ready to be
forwarded to the Planning and Development Board and City Commission.
Regarding your claim that we advertised the project knowing the deficiencies in your plans, you
should realize that this office finalized the ad and forwarded it for legal review on January 25,
1999, and that it was faxed to the Palm Beach Post by our City Clerk on January 26th; the same
day as the TRC meeting when your project was reviewed. (The property owner notices are
processed concurrently with the legal ad.) The meeting did not adjourn until after the ad was

faxed to the newspaper, I assure you that I would not have processed the advertisement had I
known of the deficiencies in advance. Please understand that we have an obligation to process
applications according to an established schedule. In order to process our applications at the
earliest possible public meetings, the advertisement deadline occurs in close proximity to the
TRC meeting. A problem arising from this schedule is rare, Most plans processed are
sufficiently complete and are forwarded on. Furthermore, the extension allowed to the process is
intended to provide time for further corrections to the plans without jeopardizing the legal
advertisement. Also realize that the extension granted was for approximately one (I) month.
This should have been sufficient time to complete the plans and address most staff comments.
Ms. Waters, you will recall my commitment to assisting you through this process. However, I
must follow the existing review schedule, processing steps, and legal requirements. To further
assist you, I have outlined below the steps to follow to continue in our review process:
1) Have your plans revised to address all comments already provided to you; (I discussed this
with Melek and he appears to have an understanding of staff comments and the required plan
revisions)
2) Have traffic data assembled for the application as discussed with Malek your engineer;
3) Contact this office approximately 4 calendar days prior to the TRC meeting that you plan to
attend;
4) Present your plans before the TRC;
5) If the application and plans are complete at this time, a second advertisement will be
prepared at an approximate cost of$133 fmthe ad and $63 for the postage required for the
direct mailing; and
6) The project will then be forwarded to the Planning and Development Board and City
Commission in accordance with the schedule established in the advertisement.
I would advise, based on the technical nature of this application, that you be represented by an
engineer or designer that is both familiar with your project and the city's review process. The
same professional assistance should be used in this process that was originally used when you
had your facility designed.
So I can continue to adequately assist you, please contact me if you have any questions and when
your plans have been prepared for TRC review.
Sincerely,
'"""Jtt-. ~ .-z:..--

Dear Ms. Waters:
I have written this letter in response to your request for an explanation for why you (Bible
Church of God) must submit an application for conditional use approval as a pre-requisite for
day care, given that the church site plan was processed by the city only four (4) years ago,
The site plan review conducted for the Bible Church of God focused only upon the church site
layout and performance (impact) of the church at this location. It is important to understand that
the conditional use process, although nearly identical to the site process, is intended to provide
for the review of uses which may have the potential for negatively affecting adjacent properties
within a given zoning district. In order to provide for a thorough review, the environment where
the particular use will be contained and managed must be carefully examined, This examination
includes a review of interior and exterior space, proximity or exposure to, and impact upon,
adjacent single family homes, a review for adequate parking to accommodate the new use, and a
review to ensure the continued compliance with all city regulations, Furthermore, as conditional
uses may not be desirable at all geographic locations, and even found undesirable by some
adjacent property owners, this process also requires notification of adjacent property owners
(those within 400 feet of the subject property), and a legal to be placed in the local newspaper.
This type of review was not conducted when the church was originally processed. Pursuant to
the Land Development Regulations, Chapter 2. Zoning, as recently aP"ended by your application
for code review, day care uses at churches within single family zoning districts, are allowed
through the conditional use process, Although this may seem duplicative, special criteria unique
to the conditional use process will be used to evaluate this use and property. It is to your
advantage that the church site plan was processed so recently. If these documents are not
available from the original consultant/designer, they should be available, at the cost of
duplication, at the Building Division.
With respect to fees, the fee for conditional use approval is $1,500 for over 3 acres and $1,000
for a project under 3 acres. As indicated above, a review for the addition of day care at the
existing site requires an additional review above that conducted when the site was originally
planned, and therefore, a fee to cover the processing of this new review. Processing costs

primariiy are based upon staff review time and public advertising costs (the conditional use
process requires public notification via direct mailing to property owners and an advertisement in
the newspaper which costs approximately $350).
I trust I have adequately responded to all of your questions; however, if you have further

Dear Ms. Waters:
The purpose of this letter is to inform you of the current status of your project with respect to our
review process and to update the facsimile sent to you on 3/5/99. I recently met with the
engineer Malek to provide him with the additional information to be shown on the plans. I also
relayed to him the minimum requirements of the Palm Beach County Traffic Division for project
(raffic data.
(The property owner notices are
processed concurrently with the legal ad.) The meeting did not adjourn until after the ad was

faxed to the newspaper. I assure you that I would not have processed the advertisement had I
known of the deficiencies in advance. Please understand that we have an obligation to process
applications according to an established schedule. In order to process our applications at the
earliest possible public meetings, the advertisement deadline occUrs in close proximity to the
TRC meeting. A problem arising from this schedule is rare. Most plans processed are
sufficiently complete and are forwarded on. Furthermore, the extension allowed to the process is
intended to provide time for further corrections to the plans without jeopardizing the legal
advertisement. Also realize that the extension granted was for approximately one (I) month,
This should have been sufficient time to complete the plans and address most staff comments.
Ms. Waters, you will recall my commitment to assisting you through this process, However, I
must follow the existing review schedule, processing steps, and legal requirements, To further
assist you, I have outlined below the steps to follow to continue in our review process:
I) Have your plans revised to address all comments already provided to you; (1 discussed this
with Melek and he appears to have an understanding of staff comments and the required plan
revisions)
2) Have traffic data assembled for the application as discussed with Malek your engineer;
3) Contact this office approximately 4 calendar days prior to the TRC meeting that you plan to
attend;
4) Present your plans before the TRC;
5) If the application and plans are complete at this time, a second advertisement will be
prepared at an approximate cost of $133 for the ad and $63 for the postage required for the
direct mailing; and
6) The project will then be forwarded to the Planning and Development Board and City
Commission in accordance with the schedule established in the advertisement,
I would advise, based on the technical nature of this application, that you be represented by an
engineer or designer that is both familiar with your project and the city's review process. The
same professional assistance should be used in this process that was originally used when you
had your facility designed,
So I can continue to adequately assist you, please contact me if you have any questions and when
your plans have been prepared for TRe review.
Sincerely,
?t-..C,/~
