UNITY OF TITLE
In consideration of the issuance ofa permit to HOME DEPOT U.S.A., INC., for the construction of
Expo Design Center in the City of Boynton Beach, Florida, the Undersigned hereby agrees to restrict the use
of the property described in Exhibit A hereto in the following manner:

I. Said property shall be considered as one plot and parcel of land, and that no portion of said
plot and parcel ofland shall be sold, transferred, devised or assigned separately, except in its
entirety as one plat or parcel of land.
2. The Undersigned further agrees that this condition, restriction and limitation shall be deemed
a covenant running with the land, and shall remain in full force and effect, and be binding
upon the undersigned, their heirs and assigns. Release of this Unity of TitIe must be approved
by the administrative head of the Boynton Beach Department of Development and ratified by
the City Commission.
3. The Undersigned further agrees to record this instrument in the Public Records of Palm
Beach county at his (her) expense.

SCHARLlN, TRUSTEE ("Scbarlin") (collectively, ''Grantor'') to and for the benefit of the
CITY OF BOYNTON BEACH, FLORIDA ("Grmtee").
STATEMENT OF BACKGROUND
A. Home Depot is the ovvner of certain property located at the southeast intersection
of Purple Heart Way and S.W. 8th Street, Boynton Be1lch. Palm Beach. Florida and being more
particularly described on Exhibit A hereto (the "Home Depot Property')
B. Scharlin is the ovvner of certain real property adjacent to the Home Depot
Property and being more particularly described in the legal description attached hereto as Exhibit
B (the "Scharlin Property"; the Home Depot Property and Scharlin Property are hereinafter
collectively refernod to as "Grantor's Property'').
C. Home Depot and Scharlin wish to grant to the City and easement far the surface
drainage of water from Purple Heart Way across the Home Depot Property and the Scharlin
Property.
NOW, THEREFORE, for and in consideration ofTen and No/100 Dollars ($10.00), in
ha."\d paid by Grantee to GTantor, and for other good and valuable considerations, the receipt,
adequacy and sufficiency are hereby acknowledged, Grantor and Grantee do hereby covenant and

Emergency lights in the res!rooms are shown on detail 3/E5.0, Restrooms-Lighting and Power
Plan. There i:; one type "JJ" battery unit in each restroom. Each unit has two low voltage
lighting heads that automatically illuminate during power outage.

DRAINAGE EASEMENT
THIS IS A DRAINAGE EASEMENT made this _ day of March, 1998, by HOME
DEPOT U.S.A., INC-, a Delaware corporation ("Home Depot") and HOWARD R.
SCHARLIN, TRUSTEE ("Schar]in") (collectively, "Grantor") to and for the benefit of the
CITY OF BOYNTON BEACH, FLORIDA ("Grantee").
STATEMENT OF BACKGROUND
A. Home Depot is the owner of certain property located at the southeast intersection
of Purple Heart Way and S.W. 8th Street, Boynton Beach, Palm Beach. Florida and being more
particularly described on Exhibit A hereto (the "Home Depot Property").
B Scharlin is the owner of certain real property adjacent to the Home Depot
Property and being more particularly described in the legal description attached hereto as Exhibit
B (the "Scharlin Property"; the Home Depot Property and Scharhn Property are hereinafter
collectively referred to as "Grantor's Property").
C. Home Depot and Scharlin wish to grant to the City and easement for the surface
drainage of water from Purple Hearl Way across the Home Depot Property and the Scharlin
Property .
NOW, THEREFORE, for and in consideration ofTen and No/I00 Dollars ($10.00), in
ha.,d paid by Grantee to Grantor, and for other good and valuable considerations, the receipT,
adequacy and sufficiency are hereby acknowledged, Grantor and Grantee do hereby covenant and
agree as follows:
J. Grantor hereby grants, b<ll'gains, sells and conveys to Grantee, its successors and
assigns, a perpetual easement across Grantor's Property for the surface drainage of water from
Purple Heart Way over, on and across the Home Depot Property and the ScharJin Property,
together with the right to have such surface water run-off treated by the pre-treatment detention
facilities located on Grantor's Property.

2. Grantor reserves unto itself the use and enjoyment of Grantor's Property for all
legal puxp05eS not inconsistent with and which do not interfere with, impede or diminish the
rights and privileges of Grantee created and existing under any by virtue of this Agreement.
3. Whenever the term "Grantor" or the term "Grantee" is used herein, the same shall
mean and include the party named herein as "Grantor" or Grantee", as the case may be, and their
respective heirs, successors, assigns, trustees, representatives and successors-in-title.
4. This Agreement shall be governed by and construed under the State of Florida.

UNITY OF TITLE

Re: Shoppes of Woolbright PCD--Master Plan Modification
As you know, The Home Depot wishes to build its new EXPO Design Center in Boynton Beach,
Florida. To this end, the enclosed submittal modifies the master plan for the undeveloped 14.6 acres
at the Shoppes of Woolbright.
The proposed master plan modification places 108,004 retail s.f. (88,004 s.f. EXPO Design Center
and 20,000 s.f. retail) in line with the existing Home Depot store at Woolbright Road and S.W. 8
Street. To complete the development, a 3.79 acre "outparcel" between S.W. 8 Street and the Design
Center contains a total of 49, 1 06 s.f. for future retail development. This modification is consistent
with the 313,896 s.f. previously approved and vested for traffic concurrency (MTP Group, Inc.
statement attached). This site is partially developed and utilities are stubbed out to the property.
Soils testing indicates that soil conditions are suitable to support the proposed development.
The enclosed survey shows a number of slash pines remaining on this site. Kevin Hallahan has
asked that these trees be mitigated by the creation of additional scrub jay habitat along the east
property line. This new area is shown on the landscape plans included in the site plan submittal.

We have been requested to prepare a traffic statement to support the proposed retail development
at Woolbright Place PCD/PUD. The existing development has been approved for the following
land uses:
85 Single-family residential units
548 Multi-family
16 Duplex units
A church
3,710 square-feet restaurant
6,745 retail out-parcel
3,115 square-feet fast-food restaurant
A gas station with convenience store
9,970 square- feet restaurant
102,250 square-feet Home Depot
157,000 square-feet retail
To date, the duplex units, the church and the 157,000 square feet of retail have not received site
plan approval. Design Expo is proposing to include 108,000 square feet of retail with this
submission. Therefore, once Design Expo receives site plan approval, Woolbright Place
PCD/PUD still has an additional 49,000 square-feet of retail, 16 duplex units and a church which
are vested for traffic concurrency purposes.
In January of this year, we prepared a trip generation study to show the amount of vested traffic
for the approved land uses at Woolbright Place. This study was summarized in a letter addressed
to Mr. Hukill and dated January 17, 1997. A copy of this letter is attached for your infonnation.
The study was reviewed by Mr. Dan Weisberg (Senior Registered Civil Engineer at Palm Beach
CountY Traffic Division) to determine compliance with Palm Beach County Traffic Performance
Standards. The study was found to be in compliance and Mr. Weisberg letter to this effect is also
attached for your information.

MTP Group, Inc. has prepared the attached trip ieneration comparison of the approved versus the
proposed land uses at Woolbright Place PCDJPUD. The analysis has been performed using the trip
generation rates included in the Palm Beach Coumy Land Development Code Section 10.8: Fair Share
Road lmpaa Fees. This analysis is a revision of our previous analysis to incorporate the proposed 3,710
square feet restaurant in one of the out-parcels previously assumed as a 4,000 square feet retail.
We are attaching tables 6, 7, 8, 9 and 10 which summarizes the trip generation comparison usini Palm
Beach County standards. We have used the same table numbers for purpose of comparison with our
previous study. As shown in these tables, the net external trip generation potential of the proposed
development is lower than that of the approved development. Therefore, there is no additional traffic
impact resultini from the proposed chlll1ie.

We have been requested to prepare a traffic statement to support the proposed retail development.
at Woolbright Place peD/PUD. The existing development has been approved for the following
land uses:
85 Single-family residential units
548 Multi-family
16 Duplex units
A church
3,710 square-feet restaurant
6,745 retail out-parcel
3,175 square-feet fast-food restaurant
A gas station with convenience store
9,970 square-feet restaurant
102,250 square-feet Home Depot
157,000 square-feet retail
To date, the duplex units, the church and the 157,000 square feet of retail have not received site
plan approval. Design Expo is proposing to include 108,000 square feet of retail with this
submission. Therefore, once Design Expo receives site plan approval, Woolbright Place
PCD/PUD still has an additional 49,000 square-feet of retail, 16 duplex units and a church which
are vested for traffic concurrency purposes.
In January of this year, we prepared a trip generation study to show the amount of vested traffic
for the approved land uses at Woolbright Place. This study was summarized in a letter addressed
to Mr. Hukill and dated January 17, 1997. A copy of this letter is attached for your information.
The study was reviewed by Mr. Dan Weisberg (Senior Registered Civil Engineer at Palm Beach
County Traffic Division) to determine compliance with Palm Beach County Traffic Performance
Standards. The study was found to be in compliance and Mr. Weisberg letter to this effect is also
attached for your information.

MTP Group, Inc. has prepared the attached trip generation comparison of the approved versus the
proposed land uses at Woolbright Place PCD/PUD. The analysis has been performed using the trip
generation rates included in the Palm Beach County Land Development Code Section 10.8: Fair Share
Road Impact Fees. This analysis is a revision of our previous analysis to incorporate the proposed 3,710
square feet restaurant in one of the out-parcels previously assumed as a 4,000 square feet retail.
We are attaching tables 6,7, 8, 9 and 10 which summarizes the trip generation comparison using Palm
Beach County standards. We have used the same table numbers for purpose of comparison with our
previous study. As shown in these tables, the net external trip generation potential of the proposed
development is lower than that of the approved development. Therefore, there is no additional traffic
impact resulting from the proposed change.
