THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING ORDINANCE NO 80-19 OF SAID CITY
BY REZONING A CERTAIN PARCEL OF LAND

FLORIDA FROM R-1AA (PLANNED UNIT
DEVELOPMENT) PUD TO C-l. (OFFICE
PROFESSIONAL) SAID PARCEL BEING MORE
PARTICULARLY DESCRIBED HEREIN; AMENDING
THE REVISED ZONING MAP ACCORDINGLY;
PROVIDING A CONFLICTS CLAUSE; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING AN
EFFECTIVE DATE; AND FOR OTHER PURPOSES.

WHEREAS, the City commission of the City of Boynton Beach,

Florida, has heretofore adopted Ordinance No. 80-19, in which a
11
Revised Zoning Map was adopted for said City; and
12
WHEREAS, Robert A. Eisen, agent for Milnor corporation,
13
property owner, has heretofore filed a Petition with the City of
14
Boynton Beach, Florida, pursuant to section 9 of Appendix A-
15
Zoning, of the Code of Ordinances, City of Boynton Beach,
16
Florida, for the purpose of rezoning a certain parcel of land
17
consisting of approximately 4.01 acres located within the
18
municipal limits of said City, said property being more
19
particularly described hereinafter, from R-1AA PUD (Planned Unit
Development) to C-1 (Office Professional); and
21
WHEREAS, Ordinance 89-38, which is the Comprehensive Plan
22
for the City of Boynton Beach, shows the property in the Local
23
Retail Commercial land use category, and section 163.3202 (1) ,
Florida Statutes, requires that the City'S land development
regulations be amended in order to bring these regulations into
compliance with the Comprehensive Plan; and
WHEREAS, the City commission has heretofore entered into a
stipulation and Settlement Agreement in Palm Beach Circuit Court
Case No. CL-89-6178-AN, which requires in part rezoning of the
property; and
WHEREAS, the city Commission deems it in the best interests
of the inhabitants of said City to amend the aforesaid Revised
Zoning Map as hereinafter set forth.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, THAT:

That the aforesaid Revised Zoning Map of the

13 conflict herewith are hereby repealed.

Should any section or provision of this

Ordinance or any portion thereof be declared by a court of
16 competent jurisdiction to be invalid, such decision shall not

affect the remainder of this Ordinance.
