Following up on our meeting last week with attorneys for the developer!s
attorneys, Conrad Damon and Nick Bouyoucas, see below:
1. At issue is Item 25 of the Development Order (as taken from
the Stipulation and Settlement Agreement) f which requires and states,
"Construction of the six foot zoning boundary wall shall be coordinated with
the governing association of the adjacent residential property and the
existing buffer hedge shall be removed and replaced with sod and landscaping
to the specification of the governing association at no cost to the
governing association. II
2. Mr. Damon is in the process of finalizing an Amendment to
the Declaration of Covenants and Restrictions. Boynton Leisureville
Community Association has already executed a Certification requesting that
the hedge remain. Mr. Damon is supposed to be sending this document to us
for review and has asked that the City "join in" on the Declaration
Amendment. I will be following up with Mr. Damon tomorrow if I have not
received the Proposed Amendment. Since the original Declaration and the
Amendment will not govern or restrict the rights of the City, the city can
agree to lIconsent toll or rrhave no objection!! to the Amendment to
Declaration, rather than "joining inll as a party. Such action would require
City Commission approval. I would foresee this being a consent item
supported by a resolution consenting to the Amendment to Declaration
(Certification from Boynton Leisureville will be an attachment to the
resolution) .
3. To deal with the issue of the Court's retention of
jurisdiction over the Stipulation and Settlement Agreement, we suggest
filing with the Court the Resolution Consenting to the Amendment, the
Certification from Boynton Leisureville evidencing their request that the
hedge remain, and the Amendment to Declaration once finalized.
4. The developing party has requested that this matter be
considered by the City Commission at its first meeting in June.
5. There may be an issue that arises with respect to the
issuance of a Certificate of OccupancYI since this hedge removal requirement
is a condition of approval. If this does arise, the building official could
issue, if warranted, a temporary C.O. under the City'S current policy of
requiring a bond in the estimated amount necessary to comply with the
particular condition(s) .
The above is an overview of what is happening with the subject property.

further, please do not hesitate to contact me.

Dear Mr. Rumpf:
On behalf of our client, Centex Homes, we are conducting due diligence investigations on the property
described in the attached survey. The purpose of this letter is to determine if replatting the subject property
will be required. Based upon our client's intended use, no further subdivision of the property would be
required. However, based upon my conversation with City staff, David Kelly and Dick Hudson, it was their
impression that since previous development of an ACLF on the adjacent western parcel had created three
parcel, the subject property would be required to replat. My concern is that had any prior development on
the adjacent parcel resulted in the creation of three parcels, then replatting should have been required
concurrent with the ACLF's approvals. Further, the third parcel identified by staff (highlighted on the
attached survey), does not appear to be a usable parcel and according to the waiver provisions of Chapter 5
of the City Code of Ordinances, should not trigger replatting.

Pursuant to your facsimile received yesterday late morning, this memorandum response is
being trans-mitted to you and will take your questions individually. I have also been advised that
you had a telecom with Mr. Michael Rumpf, Director of the Planning and Zoning Division, this
morning in regards to the court order allowing only a AClF on the remaining part of said Tract 4.
Therefore, before any consideration can be given to a proposed multi-family unit development, a
circuit court determination will be required from your client to allow for such multi-family use
instead of an AClF.
Obviously, the application procedure through the Planning and Zoning Division for a site plan
approval, P & Z Board hearing(s) and City Commission approved would precede the generation
of construction plans.
Your requested information.
1) What permits we need to get from the City of Boynton Beach?
Response: Currently, in regards to Engineering, application and plans (3 copies) of the
Paving and Drainage Segment(s), are submitted through the Building Division of the
Development Department for a permit tracking number. Copies will be forwarded to the
Engineering Division for review and approval and/or comments that will need to be
addressed. Water and Wastewater application and plans (4 copies) are submitted to the
Utilities Department for review and approval prior to submitting to the Palm Beach County
Health Department for the FDEP permit. Fees will be required with each agency.
Please be advised that the processing of proposed construction application and plans will
probably change in the reasonably near future as the Engineering Division issues a new
design criteria handbook for consultants use. The new handbook will contain all the
design requirements, permitting procedures, applicable forms to be used, platting
requirements, construction standards and 'as-built' procedures and requirements.

2. What other agencies we need to get permits from in Palm Beach County?
Response: Palm Beach County Engineering Department (Land Development
Division) for any connection to Golf Road (aka SW 23rd Avenue) and your surface
water management permit, and the Lake Worth Drainage District (for any outfall
into the L.W.D.D. Lateral No. 27 Canal).
3. Utility providers.
Response: City of Boynton Beach Utilities Department for water and wastewater
systems, City of Boynton Beach, Department of Public Works, Engineering
Division and the LWDD for stormwater issues, Florida Power and Light Co. (for
electric), BellSouth (for telephone), Florida Public Utilities Company (for gas),
Adelphia Cable (for cable TV), and Palm Beach County Engineering Department
(Traffic Engineering Division) for the TIA and turn lane requirements. No fiber
optic cables are in this area yet.
4. Are roads around property in your jurisdiction?
Response: They lie with the city's corporate limits, however only SW 13th Street
is under the city's jurisdiction. Golf Road (aka SW 23rd Avenue) is in Palm Beach
County's jurisdiction. Permits will be required from either or both agencies,
depending on the approved site plan.
Other issues and/or requirements may present themselves, depending of the approved

It came to my attention that there was some question regarding the interpretation of units
as it relates to this agreement. On page 2, under Article II Section A(2) the term units is
used synonymously with the term beds. Therefore. this agreement should be interpreted
to mean a maximum of 248 beds are allowed. How those beds are to be distributed
among a 1, 2, or 3 bedroom design is left up to the developer (Le. 248 one bedroom, 124
two bedrooms or 82 three bedrooms or some combination of the above). Please place this
in the file for future inquires. Thank you.

Motion
Mayor Pro Tem Tilltili!m moved to waive confidentiality of appraisals the City has obtained on
two parcels of land associated with Pond project "S". Commissioner Oenahan seconded the
motion that carried unanimously.
2. Alhambra Square South - Proposed amendment to an agreement to
clarify the number of units permissible
Attorney Cherot reminded the Commissioners that a long time ago, the City entered into an
agreement with respect to Alhambra South that made reference to a fixed number of units (248
units). The language of the document referred to the 248 units as being the minimum number
of units. However, what the parties intended was that the maximum number of units would be
248. The property owner, through the agent, has requested that the City join in a corrected
instrument to property reflect that the 248 is a maximum and not a minimum. Attorney Cherof
recommended that the Commission authorize execution of the instrument of correction.
Motion
Commissioner Denahan moved to accept the instrument of correction. Commissioner Titcomb
seconded the motion.
Vice Mayor Jaskiewicz questioned whether or not clarification was also reqUired regarding the
size of the apartments. Attomey Cherof responded negatively. He said there is no language in
the instrument of correction !/'Iat speaks to that specific issue.
The motion carried unanimously.
XII. UNFINISHED BUSINESS:
A. Commission Action of Code Compliance Soard Matters:
1. Approval of Code Compliance Soard's decision to reduce the lien
imposed in Case #97-2452 from $1,325 to $250.
Scott Blasie, Code Compliance Administrator, had no comments to offer other than what was
included in the back-up material. He advised that the applicant was not present even though he
was notified by mail sent on June 30, 1998. He has had no contact with the applicant.
Mayor Taylor pointed out that once the tenant was evicted, the property owner immediately
began work to gain compliance. Mr. Blasie agreed. The property owner appeared at the
original hearing and pled "no contest", They requested 60 days for compliance. However, it
took longer than 60 days to evict the tenants.
Mr. Blasie confirmed for Commissioner Denahan that staff researched past records and
determined that the violator never appeared before the Code Compliance Board other than for
this particular case,

Dear Mr. Michael:
The court settlement between your corporation and the City allows
the construction of 248 ACLF units on the property that you own
on the southeast corner of Congress Avenue and Golf Road.
It has been brought to our attention that a sign has recently
been placed on the property indicating that the site is approyed
for 248 senior apartments.
In November of 1992 the City Commission rejected your request to
use the property for senior apartments and, to the best of my
knowledge, the original court order remains in place.
BaBed on the court order we are asking that this sign be removed
immediately. If the sign is not removed within seven (7) working
days of the date of this letter, I will ask our Code Enforcement
Division to cite you as the owner of the property under Section
21-20 of the Code of Ordinances of Boynton Beach. This sectio~
deals with misleading advertising. (see attached).
We have attempted to contact Ann Grandell of R.W. Realty Sales
since Tuesday February 9 but to no avail. This letter is being
written because of their failure to respond in a timely manner.

Sec. 21.19. Signs not to constitute traffic hazard.
No sign or other advertising structure as regulated by this
chapter shall be erected at the intersection of any streets in such
a manner as to obstruct free and clear vision; or at any location
where, by reason of the position, shape or color, it may interfere
with, obstruct the view of or be confused with any authorized

Sec. 21.20. Obscene matter, misleading advertising prohib-
ited.
It shall be unlawful for any person to display upon any sign or
other advertising structure any obscene, indecent or immoral
matter.
It shall be unlawful for a person to display false or misleading
statements upon signs, calculated to mislead the public as to any.
thing sold, any services to be performed or information dissemi-
nated. The fact that any sign or display shall contain words or
language sufficient to mislead a reasonable and prudent person
in reading same, shall be prima facie evidence of a violation of
this section by the person displaying the sign or permitting same

Sec. 21.21. Aesthetic qualifications.
The aesthetic quality of a building or an entire neighborhood is
materially affected by achieving visual harmony of the signs on
or about a structure as it relates to the architecture of the building
or the adjacent surroundings. In addition to the mechanical lim-
