This request is for perimeter and entry way landscaping and a buffer wall approval for
the East Ridge PUD, The subject PUD is currently under construction, The purpose
of this proposal is to ensure installation of a 6 foot high buffer wall along the northern
property line, as requested by the City Commission as a condition of rezoning
approval and required perimeter landscaping, see Exhibit "B" - Site Plan,
On November 19 of 1996, the City Commission approved a rezoning request to
change the zoning on 5,05 acres of property located on the east side of N.E. 4th
Street, approximately 300 feet south of N.E. 22"0 Avenue, from R-3 (Multiple Family
Dwelling District) to Planned Unit Development with a Land Use Intensity of 7 (PUD
w/LUI=7), The proposed East Ridge PUD provides for the construction of 33 single
family, detached homes with a gross density of 6,5 units per acre, Subsequently, a
plat of the development was submitted to the City and is being processed, Since
there are no common areas proposed for this development, no site plan application is
necessary, However, in order to meet the City Commission conditions of approval of
the master plan, specifically the installation of a 6 foot buffer wall between the
northern property line of East Ridge and the southem lot lines of adjacent businesses
and offices to the north, a site plan application was requested and received, Also,
the site plan application contains code required perimeter landscaping to screen the
vehicular use areas,
Traffic
Traffic concurrency was addressed at the time of the approval of the
rezoning master plan,
Drainage - Drainage concurrency was addressed at the time of the approval of
the rezoning master plan and will be finally approved as a part of the
platting process,
The driveways were addressed at the time of the approval of the rezoning master
plan,
The on-site parking was addressed at the time of the approval of the rezoning master
plan,
The landscaping will fully meet the code requirements when staff comments are
incorporated into the drawings submitted for permit.

The Planning and Zoning Division recommends approval of this site plan request, subject to the comments

I. Palm trees shall be the only tree species allowed within utilities
easements. Canopy trees may be planted outside of the easement so that
roots and branches will not impact those utilities within the easement in
the foreseeable future. LDR See 7.5-18.1 gives public utilities the
authority to remove any trees that interfere with utility services, either in
utility easements or public rights-of-way. The plan shows several
apparent conflicts with proposed water and sewer lines, and other
utilities. These conflicts must be addressed on the permit set of drawings
by either relocating the trees or changing to a palm species.

ENGINEERING DIVISION
Comments:
2. All plans submitted for specific permits shall meet the city's code
requirements at time of application. These permits include, but are not
limited to, the following: site lighting, paving, drainage, curbing,
landscaping and irrigation. Permits required from other permitting
agencies such as FDOT, PBC, SFWMD, DERM, L WOD, DEP and any
others, shall be included with any permit requests.
3. All requirements of LDR, Chapter 5 (Platting) must be complied with,
including previous development order comments.
4. On sheet 3 of 7, change name of drawing from master plan to site plan as
a master plan with all TRC signatures is already approved.
5. Paving and drainage review has been made under the required
improvement plans associated with the plat. Any remaining comments
will need to be addressed prior to issuance of a land development permit.

We offer the following comments on this project:
1) In general, palm trees will be the only tree species allowed within utilities
easements. Canopy trees may be planted outside of the easement so that roots
and branches will not impact those utilities within the easement in the
foreseeable future. LDR Sec. 7.5-18.1 gives public utilities the authority to
remove any trees that interfere with utility services, either in utility easements
or public rights-of-way. The plan shows several apparent conflicts with our
proposed water and sewer lines, and other utilities. These conflicts must be
addressed by either relocating the trees or changing to a palm species.

4. Technical Review Committee member(s) shall identify in their comments when the plans
depict or when the location and installation of their departmental required improvements
may conflict with other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review
responsibility, the comment and the specific code section may be included in their review
comments with the name of the appropriate TRC Member that is responsible for the
review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within
the time frame stated above, to the Planning and Zoning Director. The memorandum shall
state that the plans are approved and that they do not have any comments on the plans
submitted for review and that they recommend the project be forwarded through the
approval process.
All comments shall be typed, addressed and transmitted to the Director of Planning and Zoning
for distribution to the applicant. Please include the name and phone number of the reviewer on

As requested in Engineering Memo #97-10 I, this office has reviewed the Declaration of
Covenants, the Bylaws and the Articles ofIncorporation for East Ridge Development for legal
sufficiency. The Articles ofIncorporation and the Bylaws are acceptable as to this office.
However, the Declaration of Covenants require some additions:
I. The sentence, "Under no circumstances shall the City of Boynton Beach be
responsible for the maintenance and repair of abandoned, partitioned, subdivided,
encumbered or transferred Association property" should be added to Section IV.I.
on p.7 of the Declaration documents.
2. Section VI.D. on page IO may require some clarification by the Public Works
Director to assure that the City of Boynton Beach would be responsible for solid
waste removal. Accordingly, the section may have to be amended.
3. Subsection D should be added to Article XIII on p. 25 to state, "Notwithstanding
anything contained herein to the contrary, any amendment to this Declaration
which would adversely affect the maintenance, care, and repair of or pertaining to
common areas of the Property must have the prior administrative approval of the
City of Boynton Beach," or something similar.
Once you have received all comments, and a revised set of documents is turned in, please
provide me with a black-lined copy only, indicating the changes that were made by the developer.
