WHEREAS, the City Commission of the City of Boynton Beach, Florida, upon recommendation of staff, does hereby accept the Final Plat for East Ridge PUD, subject to the conditions set out in the attached Development Order. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT: Section 1. The City Commission of the City of Boynton Beach, Florida, upon the recommendation of staff, hereby approves acceptance of the Final Plat for East Ridge PUD, subject to the conditions set out in the attached Development Order. Section 2. That this Resolution shall become effective immediately upon passage. City Manager Bressner stated that he had a memorandum from Mr. Sugerman regarding the Letter of Credit which does exist and it has not expired. It automatically extends for an additional one year period unless we are notified in writing 90 days before the expiration date. Motion Commissioner Black made a motion to approve Item IV-E. Vice Mayor Weiland seconded the motion that carried 5-0. Palm trees shall be the only tree species allowed within utilities X easements. Canopy trees may be planted outside of the easement so that roots and branches will not impact those utilities within the easement in the foreseeable future, LDR Sec 7,5-18.1 gives public utilities the authority to remove any trees that interfere with utility services, either in utility easements or public rights.of-way. The plan shows several apparent conflicts with proposed water and sewer lines, and other utilities. These conflicts must be addressed on the permit set of drawings by either relocating the trees or changing to a palm species.
