EXTENSION OF LAND DEVELOPMENT PERMIT
This office received your memorandum PZ 01-021 containing the property owner's request for an
extension to the Land Development Permit for the above noted project. Please be advised that we have
the project's current status and find it to be in the same stage as when we last inspected last fall.
With its' expiring date of March 8, 2001 upon us, and the proposed new developer wishing to complete
the project, this department has no objection in granting an additional extension of time for the
completion of this project. If you have any questions regarding this matter, please advise the sender.

extension.

Water and Sanitary Sewer Improvements
Dear Mr. Staley:
The purpose of this is to acknowledge both your letter of May 31,2000 and your
memo/fax of June 7,2000 regarding the cancellation of the letter of credit for the East
Ridge project, and also to state our intentions regarding possible claims against said letter
of credit.
At this point in time, the Utilities Department has accepted the potable water system
associated with this project for operation and maintenance, and has also been given a bill
of sale for the potable water system only. The sanitary sewer system has also been
accepted for operation and maintenance, but we have not received a bill of sale for that
system. Our standard bill of sale form also states that the system is free from all liens and
encumbrances.
In consideration of the clause contained in the letter of credit requiring 90 notice of non-
renewal, and in the absence of having received such notice prior to your June 7
memo/fax, we will consider this letter of credit to expire on Sept. 5, 2000 which is 90
days after your June 7 notice of cancellation. Your amendment letter of last year did not
specifically state that the letter would not be renewed, and therefore does not meet the
requirement as stated in the original letter of credit.
In order to complete the utility systems without defaulting, we require that the following
items be furnished and/or completed by August 15, 2000:
1. The developer/owner must furnish a completed and fully executed bill of sale for
America's Gateway to the Gulfstream

the sanitary sewer system (blank copy enclosed).
2. Conduct a final inspection of both the water and sanitary sewer systems,
accompanied by representatives from the project engineer's office and my staff, in
order to compile a punch list of items requiring attention.
3. Complete the repair, replacement or adjustment of all items listed on the punch
list.
Once all of the above items have been satisfactorily addressed, my staff will then begin
the procedure to release the letter of credit.

The development wiD have a 0.72 acre dry retention area at ils East side, and a smaller 0.09 eete dry
retention area directly to the -' of the main dry retention area.

OVE:RVlEW OF DRAINAGE FACIUTIES
East Ridge is a planned residential development (P.U.D.) consisting of 33 single family homes.
The development will have a 0.72 acre dry retention area at its East side, and a smaller 0.09 acre dry
retention area directly to the west of the main dry retention area.
The drainage system will be constructed in one phase. Storm water runoff will be directed via valley
gutter curb to two inlets located at low points, adjacent to the smaller dry retention area. The runoff will
then be directed from the smaller retention area into the main retention area. Since there is no body of
water in the vicinity of the project, the site will be designed to retain up to a 25 year, 3 day storm. The
control elevation for the site will be 7.6 feet, which is approximately 6 feet below the existing average
site elevation of 13.6 Feet. Building Floor Elevation will be based on the 100 year, 3 day storm event.
The proposed project is in a favorable flood plain (Zone C). There are no wetlands on the site, and there
have not been any other facilities previously approved to date.
According to the U.S. Soil Conservation Service Soil Survey for Palm Beach County (1979), the soil on
the site consist of St. Lucie Sand. This is an excessively drained, deep sandy soil with a water table
below a depth of six feet. Since the project will retain up to the 25 year, 3 day storm. There will be no
adverse impacts to the surrounding sites.

2. Provide Declaration of Covenants and Restrictions of the proposed development for
staff review prior to recordation. Complete recordation of the Declaration of
Covenants and Restrictions document for East Ridge prior to the City Commission
approval of the plat.
Engineering Division
Plat Comments (Chapter 5 of the Land Development Regulations):
I. In the title, place the letters "P.U.D." behind the plat name and at the same size.
Article V, Section DA.
2. Identify on the key map that sheet 3 is the sheet depicting the site. Article V, Section
I.D.I
3. * Identify the private streets as tracts, not parcels including the dedication. Also add
to the end of the dedication, ... .assigns "without recourse to the City of Bovnton or
anv other Dublic agencv". Article V, Section I.D.3.
4. Under the dedication, add the letters, "P.U.D." after "East Ridge".
5. Regarding the legal description of the total parcel, identify the point of beginning
from the nearest quarter section comer, section corner or government corner. Article
V, Section l.D.5 and Section 1.7.c.
6. Identify the drainage easement on the east side of the parcel as a water management
tract and dedicated to the entity responsible for its maintenance. LDR Chapter 6,
Article IV, Section 5.B.
7. Also add the wording mentioned in item * to the end of items 3,4 & 5 in the
dedications.
8. Add to dedication item 3 that "The City of Boynton Beach has the right but not the
obligation to maintain any portion of the drainage system.
9. Correct the discrepancy between the distance to the point of beginning shown on the
legal description and that shown on the survey.
10. Since the portion oflot 27 and all oflots 28 & 29 of Sam Brown Jr's. Hypoluxo
subdivision is included in the metes and bounds description of the whole parcel,
provide an explanation for (or delete) the individual subject lots identified as "parcels
1,2&3".
II. Reduce the size of the location maps on sheet one, condense the legals,
acknowledgments, certifications and consents so as to have them all on sheet one and
eliminate sheet two. Article V, Section I.D.2.

15. Add the following to the title certification after the words ... "have been paid" as
required bv Section 197.05 L Florida Statutes. as amended;
16. Provide a certification by the surveyor that the plat map mathematically closes within
one hundredth (.01) of a foot.
17. At the end of the legal description, add the total site acreage.
18. The roads shall be identified as tracts including ownership and maintenance
responsibilities, Article V, Section LD.3.
19. SpecifY the entity responsible for the maintenance of the access easements. Article V,
Section I.D.3.
20. The corner lot lines intersecting rights-of-way shall be the long chord of a 25' radius.
Also, add a note specifYing that "No Plantings over 30" shall be allowed on corner
lots within the safe sight distance based on the crown elevation of the street".
21. IdentifY the 3 parcels west of units 1,27 & 26.
22. SpecifY a 5' L.A.E. (limited access easement) across the parcels abutting the east side
ofNE 4th Street. Chapter 6, Article IV, Section lO.W.
23. The property owners association documents shall provide for the association to pay
for the operation of a street light system within the development. Chapter 6, Article
III, Section 14, and Chapter 5, Article V, Section 2.AA.
Regarding the Paving & Drainage Plans:
I. Applicant's attention is directed to Chapter 7 of the L.D.R. regarding surety
requirements.
2. The minimum dimensions of all residential parking spaces shall be 12' X 18' and be
drained so as to prevent danger to the public and/or adjacent property owners.
Chapter 2, Section II.H.2.
3. Provide certification by Developer's engineer that drainage plan complies with all city
codes and standards. Chapter 6, Article V, Section 5.A.
Other Comments:
I. Submit engineer's certified estimate of cost of the required improvements as specified
in Chapter 6 of the city's L.D.R., Article V, Section 4.BA.
2. All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following; site
lighting, paving, drainage, curbing, landscaping, irrigation and traffic control devices.
Permits required from agencies such as the FDOT, PBC, SFWMD and any other
permitting agency shall be included with your permit request. Chapter I, Article I,
Section 6, par. A.
