above. Lesser areas than those set out in Table 1 may be
approved for PUD in a specific case upon findings by the planning
and development board and the governing body that particular
circumstances justify such reduction, that the requirements for
PUD and the benefits to be derived from PUD can be met in such
lesser area, and that permitting such lesser area for POD is in
conformity with. the comprehensive plan.
Section 6. Unified control.
All land included for purpose of development within PUD
district shall be under theccon~~of the applicant (an
individual, partnership, or corporation or group of individuals,
partnerships, or corporations). The applicant shall present
satisfactory legal documents to constitute evidence of the
unified control of the entire area within the proposed PUD. The
applicant shall agree to:
A. Proceed with the proposed development according to the
provisions of those zoning regulations and conditions
attached to the zoning of the land to POD;
B. Provide agreements, contracts, deed restrictions and
sureties acceptable to the city for completion of the
development according to the plans approved at the time
of zoning to PUD and for continuing operations and
maintenance of such areas, functions and facilities as
are not to be provided, operated or maintained at public
expense; and
C. Bind their successors in title to any commitments made
under A and B above. All agreements and evidence of
unified control shall be examined by the city attorney
and no zoning of land to POD classification shall be
adopted without a certification by the city attorney that
such agreements and evidence of unified control meet the
requirements of these zoning regulations.
Section 7. Uses permitted.
In a POD District, buildings or structures, or land, or water
shall be used only for the following purposes:
A. Single-family dwellings;
B. TwO-family dwellings or duplexes;
C. Multiple-family dwellings, townhouses, garden apartments
and cluster housing;
D. Private, nonprofit clubs, community centers, civic and
social organization facilities;

TRC COMMENTS - EAST RIDGE - 3rd SITE PLAN REVIEW
After reviewing the submitted plans for the subject project, the Building Division recommends
that the project go forward subject to compliance with the following prior to permitting for
construction:
l. Show proof that the lOft. utility easement shown on the survey has been legally
removed (Official Record Book 859, Page 752).
2. All four properties tied together under one title (legally recorded).
3. The sidewalk extended across lots 15 and 16 and around the circle.
4. All signs be submitted in compliance with the City's Sign Code.
5. Table 600 of the 1994 Standard Building Code be met.
In addition, two matters that are not code issues but should be considered in the approval process
for this project are as follows:

Development makes no provision for guest parking.
Being contiguous to the F.E.C. Railroad, additional effort should be made to
provide and maintain an effective sight and sound barrier to t is development.

The Recreation and Park Department has reviewed the revised master plan for the East Ridge P.U.D.
Due to the reduction of dwelling units from 34 single family units to 33 single family dwelling units,
the new recreation dedication requirement is computed as follows:
33 s.f. D.U. x .018 acres/d.u. = .594 acres.
There are no plans for private recreation. The full dedication is required as cash in lieu ofland.

SUBJECT: East Ridge Master Plan - 3rd Review
We offer the following comments on this project:
1) No trees, except Palm trees, will be allowed within utilities easements.(Sec. 7.5-
18.1)
2) Dept. of HRS permits will be required for the water and sewer systems serving
this project.
3) A utilities easement must also be shown over those water and sewer lines within
the roadway access easement. This may be done by also defining the access
easement as a utilities easement for water and sanitary sewer maintenance by the
City of Boynton Beach.
4) Based upon 33 single family homes with 3/4" x 5/8" meters, the capacity
reservation fee for this project will be $4,573.80. This fee is payable within 30 days
of the site plan approval, or when the HRS permit applications are submitted for
approval by this office, whichever comes first.(Sec. 26-34(E))
We have no objection to this project proceeding through the review process.

The following is a list of 3rd review comments regarding the subdivision master plan
review of the plans for the above-referenced project.
SUBDIVISION MASTER PLAN REVIEW COMMENTS:
1. Provide unified control documents for the development as required by
LDR, Chapter 2.5, Section 6.
2. Complete the LUI computation by identifying the allowed FAR, OSR, LSR
and RSR in square feet. Also identify the proposed LUI elements in
square feet rather than acres.
3. It is recommended, that in order to minimize the detrimental effect of the
railroad operation, the height of the proposed 2'-6" landscape buffer along
the eastern property line be increased to 6 feet.

proposal crcatcs a scvcrc public safcty concern. Positioning sidewalks in the rear of a residential area invites
criminal opportunitics and does not insure safety for residential property owners. Thcre will bc no privacy
fcnccs allowcd to be crccted by homcowners and the sidewalk is proposcd to be constructcd very ncar the
homes. Thc homes, and proposed shrubbery, will providc more than adequatc cover for burglaries to occur,
pccping toms, and leave children vulnerable to molestation. Police patrol cannot vicw the sidcwalks, and
activitics, in the rear of homes. There is no proposed lighting for the sidewalk to be lightcd in the rear of the
homes. Therefore the sidewalks will bc a dark passage for children during early morning walking/riding to bus
stops. Should any crime, or accidental injury occur on these sidewalks, cmergency access is not obtainablc,
cxcept through cascmcnts ofthc homes. Thc sidcwalks arc proposed to be 8 foot wide. The dcveloper
advised that the constructcd material would be eithcr "pavers" or "concrcte". Eight feet would invite vehicular
travel to thc rcar of the rcsidents. Thc sidewalks are proposcd to abutt N .E. 4 St., thcrcby appearing as an
"alley" or privatc driveway. Again, I would not recommend approval of the sidcwalk variance.

EAST RIDGE PUD - SIDEWALK WAIVER REQUEST
Subject applicant has requested a waiver of the sidewalk requirements contained in LDR Chapter
6, Article III, Section 11, paragraph A, page 6-3. which reads as follows:
Section 11. Sidewalks.
A. PLATTED OR UNPLATTED SUBDIVISIONS. Sidewalks shall be constructed
on both sides of all local and collector streets, and on one side of marginal access
streets in all areas. They shall be constructed concurrent with building
construction.
I. Waiver. A required sidewalk may be waived by the technical review
committee in platted or unplatted subdivisions when it determines that
adequate pedestrian circulation is provided by bicycle/pedestrian paths.
The control,jurisdiction and maintenance obligation of bicycle/pedestrian
paths not located within a public right-of-way shall be placed in a property
owner's association or an improvement district. Bicycle/pedestrian paths
shall be constructed concurrently with other required improvements.
This waiver will be considered at the September 25 TRC meeting. Please be prepared to discuss
this waiver and to vote on it.

Staff has reviewed the above referenced project and offer the following comments:
I. Unobstructed access to utility facilities must be provided. Please provide a
minimum easement of 12' (twelve feet) south of lot 17 and west of lots 17, 18,
and 19. The minimum acceptable distance from a structure to a water or sewer
main pipe is 10' (ten feet), (Sec. 26.33(a)).
It is our recommendation that the plan proceed through the review process.

1. A homeowners' association will be required to be established to control
and operate the common area. It is strongly recommended that
homeowners' association documents be submitted now, rather than
delaying them to the plat review (Chapter 5, Article V, Section 2.A.4) to
guarantee a greater level of property and structure maintenance.
2. Provide unified control documents for the development as required by

1.0 Introduction
This report constitutes a Phase I Environmental Audit of a
parcel of property in Boynton Beach Florida located in Section
15, Township 45 South, Range 43 East, Palm Beach County
(Figures 1 & 2) prepared in order to satisfy requirements for
a commercial real estate transaction.
1.1 Puroose of a Phase I Environmental Audit
A Phase I Environmental audit is a study, consisting
mainly of background research, to assess environmental
conditions of- a site. It is based on information of
present and historical land uses of the subject property
(the Site) and research into off-site conditions which
could have a potential adverse impact on the site.
Because the Phase I Audit is only designed to assess the
probability of environmental impact, no sub-surface
explorations or soil and water sampling and analysis were
conducted.

the Florida East Coast (FEC) Railroad tracks and N.E. 4th. St.
and between N.E. 20th and 22nd Ave. in Boynton Beach, Florida.
It is bounded on the north by Boynton Animal Clinic, VFW Post
5335, and Northside Condo; on the east by the FEC tracks and

3.0 PhYSical F_tures of the Site
A site investigation was conducted on May 3, 1995. The Site is
undeveloped and consists of three separate lots (Figure 3).
The portion of Lot 27 is the southeast part of the Site. There
is a pile of trash and debris where N.E. 20th Ave. ends and
meets the Site. The debris consists of chairs, lamps, concrete
debris, plastic oil cans, paint cans, carpeting, tile and
discarded fencing. The rest of Lot 27 is undeveloped scrub
habitat with vegetation characterized by scrub oak with some
Brazilian pepper. There is a discarded suitcase within a small
copse of trees in the eastern part of the Site near the
railroad tracks. Along the south fence line was a pump house
in disrepair which contained a pressure tank and likely an old

well. There were also what appeared to be remnants of a
driveway or a house foundation and ornamental plants which are
not native to Florida such as Shefflera, asparagus fern, and
ornamental cactus. The 1965 aerial photo shows a house which
had a driveway access across the tracks from u.s. Hwy 1.
Lots 28 and 29 are also scrub habitat with wooded vegetation"
ranging from scattered to dense throughout the Site. The scrub
vegetation includes scrub oak, slash pine, sand pine, cabbage
palm and snake plant. Household trash was observed along the
south fence line of Lot 28 opposite the second of three houses
which border this portion of the Site.
There was a junk pile in the northeast corner of the Site in
Lot 29 which contained lumber, a freezer, paint cans,
household trash, ~VC pipe, carpeting, fluorescent bulbs, and
shelving. Further to the west was asphalt debris. The soil
around the paint cans, oil cans and other containers of
potentially hazardous compounds was inspected and showed no
evidence of staining nor had any unusual petroleum, solvent or
paint odor.
Utilities
The Site is presently not being served by water and sewer
utilities.
Soil
According to the U.S. Soil Conservation Service Soil Survey
for Palm Beach County (1979), the soil on the Site consists of
St. Lucie sand, 0 to 8 percent slopes a nearly level to
sloping,. excessively drained, deep sandy soil with a water.
table below a depth of six feet. The surface layer is gray
sand about five inches thick. Below this is white sand that
extends to a depth of 80 inches or more. Permeability is very
rapid. The available water capacity, organic matter content

and natural fertility are low throughout. Natural vegetation
is sand pine, scrub oak, saw palmetto, rosemary, cacti,
reindeer moss, pineland three-awn and natalgrass.
Review ot Historical Aerial Photolmlvhs
A review of the aerial photographs from 1965, 1968, 1971,
1973, 1977, 1984, 1989, and 1993 indicates there was a house
on the southern part of the Site in 1965, but by 1968 it was
gone. The house was accessed from U. S. Hwy 1 across the
railroad tracks. After 1968, the Site was vacant with little
change in the p~ysical appearance to the present time. The
general area was sparsely developed to the north with a large
cleared area north of N.E. 22nd Ave and a citrus grove beyond
that. The first structures were the veterinary clinic building
adjacent to the Site and several commercial buildings in the
divided portion ~f N.E. 22nd Ave. The building now occupied by
the Cumberland Farms convenience store at the southeast corner
of N.E. 22nd Ave. and N.E. 4th st. was constructed between
1968 and 1971. By 1984, the condo and the VFW hall directly
north of the Site and multifamily units in the formerly large
cleared area were constructed by 1984. Also by thi~ time the
strip mall on the south side of 22nd Ave. had been
constructed, and the divided center of 22nd St. was limited to
parking and one commercial building. The citrus grove was
being residentially developed in 1989, and by 1993 all roads
and multi-family buildings had been finished. The houses and
trailer park south of the Site were present prior to 1965, and
the area along the water east of U.S. Hwy 1 was developed, as
well.
Site History
According to the Palm Beach County Property Appraisers Office,
the Site is owned by Kirsch Holding Company (Parcels 1 & 2)
and Irving B, & Clara Kirsch (Parcels 3 & 4). The Chain of

The surrounding area is mostly residential. There is a condo-
minium complex to the north of the site along N.E. 4th St.,
and beyond that is a Cumberland Farms Convenience S~ore. There
were no fuel facilities associated with the convenience store.
North of the Site to the east was a veterinary clinic and a'
VFW hall. There was an engine on the grounds of the veterinary
clinic, but there was no evidence that maintenance activities
of the engine had impacted the Site. Beyond the clinic and the
VFW hall was a small shopping center on the south side of
Gateway Blvd. (N.E. 22nd Ave.) which was occupied by a beauty
shop, a Dollar Store, a dog groomer, and a small food store.
Next to the strip center was Royal Coin Laundry which was
abandoned. The laundry advertised dry cleaning, but there were
no drums on the premises. It was likely a pick-up 'location.

Highway station. Groundwater and soil contamination were
discovered in July 1988, and the facility is in the state of
Florida Reimbursement Program, a state-funded program to
assess and remediate petroleum contaminated sites.

underground gasoline tanks and one (1) SSO gallon underground
waste oil tank at the Texaco station. Soil an~ groundwater

Phase I Environmental Audit.

There was one transformer on a power pole on the south
property line in Lot 28. It was in good condition, and there

The following is a list of 1 st review comments regarding the subdivision master plan
review of the plans for the above-referenced project.
SUBDIVISION MASTER PLAN REVIEW COMMENTS:
1. On the Sheet 2 of 6, Master Plan, delineate proposed property lines of all
lots, parcels and common areas, as they will appear on the plat (LDR,
Chapter 3, Article III, Section 1.A). Label the common areas with a tract
designation, such as: Tract A, Tract B, etc.
2. Eliminate inconsistences between the proposed master plan, sheet 2 of 6
and landscape plan, sheet 6 of 6 with respect to the shape and size of a
typical residential lot.
3. Indicate the anticipated form of ownership of the housing stock units
(LDR, Chapter 3, Article III, Section 1.A).
4. A homeowners' association will be required to be established to control
and operate the common area. It is strongly recommended that
homeowners' association documents be submitted now, rather than
delaying them to the plat review (Chapter 5, Article V, Section 2.A.4) to
guarantee a greater level of property and structure maintenance.
5. All information as specified in Chapter 3, Master Plan Review of the Land
Development Regulations is required to be shown or referenced on the
Master Plan, sheet 1 of 1.
6. Indicate all setbacks for the proposed development. Either show the
setback dimensions on the drawing or create a chart that references and
identifies all the setbacks.
A. perimeter setbacks
B. setbacks of residential lots from proposed right-of-way or roadway
easement (front yard setbacks).
C. all other setbacks (side yard and rear yard setbacks).
7. Provide unified control documents for the development as required by
LDR, Chapter 2.5, Section 6.
8. Indicate appropriate access easement to every residential lot as required
by LDR, Chapter 2.5, Section 9.A.

9. On the Sheet 2 of 6, Master Plan, indicate the following

10. Dimension the width of the vegetative buffer that separates the proposed
development from adjoining properties. Also identify the height, width and
spacing of the landscape material at the time of planting. Establish and
dimension a maintenance setback of the landscape buffer between the
property line and the hedge. Indicate these dimensions on the Master
Plan, sheet 1 of 6.
11. Indicate that the easement in the southwest portion of the property will be
vacated during the replating process.
12. According to LDR, Chapter 6, Article III, Section 11.A sidewalks should be
provided on both side of streets. Amend your plans accordingly, or if the
location of the sidewalk is to remain as proposed, file a waiver application
with the Engineering Division.
13. Specify on the plan the proposed height of the residential structures. Also
specify how many stories the building will have.
14. Indicate in note form on the plan that each residential unit has two (2)
parking spaces.
15. Complete the LUI computation by identifying the allowed FAR, OSR, LSR
and RSR in square feet. Also identify the proposed LUI elements in
square feet rather than acres.
16. Prior to the project moving forward for rezoning, the plans shall be
amended to comply with staff comments and resubmitted (12 complete
sets of assembled plans) to the Planning and Zoning Department no later
than 5:00 P.M. on August 5, 1996.

ITEM 1
OVERVIEW OF DRAINAGE FACILITIES
East Ridge is a planned residential development (P.U.D.)consisting of 33 single family homes.
The development will have a 0.73 acre dry retention area at its East side, and a smaller 0.09 acre dry
retention area directly to the west of the main dry retention area.
The drainage system will be constructed in one phase. Storm water runoff will be directed via valley
gutter curb to two inlets located at low points, adjacent to the smaller dry retention area. The runoff will
then be directed from the smaller retention area into the main retention area. Since there is no body of
water in the vicinity of the project, the site will be designed to retain up to a 25 year, 3 day storm. The
control elevation for the site will be 7.6 feet, which is approximately 6 feet below the existing average
site elevation of 13.6 feet.
The proposed project is in a favorable flood plain (Zone C). There are no wetlands on the site, and there.
have not been any other facilities previously approved to date.

Dear Ms. Heyden:
In accordance with the first review of the Master Plan by the City agencies transmitted herewith are
the following for the above referenced project:
1. Ten (10) prints of the Boundary Survey (including Topo and Trees)
2. Ten (10) prints of the Master Plan.
3, Ten (10) prints of the Grading, Paving and Drainage Plan, signed and sealed.
4. Ten (10) sets of the Landscape and Tree Management Plan.
Our response to comments from William Hukill, P.E., City Engineer are as follows:
1. All plans submitted for specific permits will meet the City's code requirements at time of
application.
2. All documents have been be revised to reflect all comments.
3. A unity of title document will be forwarded to you next week
4. No building, structure, screen enclosure, pool, or portion thereof will be within setbacks,
either now or in the future, and a note to that effect has been added to the master plan.
5, ParkslRecreation fee will be submitted in lieu ofland dedication when it becomes due.

6. The master plan shall comply with the provisions of Chapter 2, Section 9C of the Land
Development Regulations, specifically a comparison indicating less impact to the City for the
proposed rezoning is indicated in the application submitted July 3, 1996.
7. A note has been added to the master plan stating that the project will have underground
utilities to residential units.
S. A note has been added to the master plan stating that all utilities are available and will be
provided by appropriate agencies.
9. An updated Traffic Impact Analysis will be provided to you upon completion of updating the
original submittal. We do not anticipate any changes to the original report,
10. A master storm water management plan and drainage calculations were submitted on July 3,
1996.
II, The street names on the master plan have been revised to be consistent with the requirements
of the Land Development Regulations.
12. * It is understood that plat review and approval is required.
13. In lieu of sidewalks on both sides of the street we propose to provide an S' wide
bicycle/pedestrian path as shown on both the master plan and the Grading, Paving and
Drainage Plan. This provides for the required pedestrian circulation. Attached is a request
for waiver on this item.
14.. Deed restrictions will be established to provide for property owner's association to pay for
the operation of a street light system within the development
15, * Approvals from SFWMD and LWDD will be obtained prior to Engineering approval.

treatment and water quantity will be provided in the dry retention areas shown on the Master
Plan and the Grading, Paving and Drainage Plan.

19. Utility easements and drainage easements will not be combined, however they do cross each
other at five (5) locations.
20. The typical road section calls for a pavement width of22' of asphalt plus two (2) feet of valley
gutter for a total width of24' to serve as an ingress/egress, utilities and drainage easement.
Chapter 6, Article IV, Section 10C of the Land Development Regulations indicate minimum
right-of-way requirements and as indicated in our submittal we are rezoning the property to
PUD to provide for approval of the 24' wide ingress/egress,utility and drainage easement.
21. A minimum pavement width of 22' is being provided which complies with the requirements
of chapter 6, Article IV, Section 10C of the Land Development Regulations.
22. The cul-de-sac has been increased to a 90' diameter which is in compliance with Chapter 6,
Article IV, Section lOD, of the Land Development Regulations. The cui de sac is located
within the ingress/egress, utility and drainage easement
23. · Any details required for sanitary sewer easements that are crossed by drainage swales will
be provided in the engineering plans.
24.. All applicable surety requirements as outlined in the Land Development Regulations will be
met.
25.. County and/or State pennits are not required for construction in the RO.W. as all road right-
of-way adjacent the subject property is City right-of-way.
26. * AJllandscaped areas will be provided with an automatic water supply system.
27. * All areas subject to erosion will receive sod.
28. Proposed elevations in relation to abutting properties are shown on both the survey and the
Grading, Paving and Drainage Plans. We have added a drainage easement abutting the
property line behind Units 17-20 and the cui de sac to convey historical runoff.
29. All driveways provide for minimum access widths.
Additional Comments - The Master Plan and Landscape Plan have been made consistent.
30. A note has been added to the master plan stating that all requirements of Table 600 of the

proposes units not lots and that the property line of the unit is the footprint of the unit.
10. The vegetative buffer has been dimensioned as to its width, height at the time of planting, and
setback, on both the landscape plan and the master plan.
11. A note has been added to the master plan to indicate that the easement shown on the property
survey, in the southwest portion of the property will be vacated during the replatting process.
12. We have revised the sidewalk to eight (8) feet in width and as indicated in our response to BiII
Hukill regarding same, we are seeking a waiver on the sidewalk.(copy attached)

JVERVIEW OF DRAINAGE FACIL .ES
East Ridge is a planned residential development (P.U.D.)consisting of 34 single family homes on
primarily 45' x 75' lots.
The development will have a 0.80 acre dry retention area at its East side, and a smaller 0.10 acre dry
retention area directly to the west of the main dry retention area.
The drainage system will be constructed in one phase. Storm water runoff will be directed via valley
gutter curb to two inlets located at low points, adjacent to the smaller dry retention area. The runoff will
then be directed from the smaller retention area into the main retention area. Since there is no body of
water in the vicinity of the project, the site will be designed to retain up to a 25 year, 3 day storm. The
control elevation for the site will be 7.7 feet, which is approximately 6 feet below the existing average
site elevation of 13.6 feet.
The proposed project is in a favorable flood plain (Zone C). There are no wetlands on the site, and there
have not been any other facilities previously approved to date.
See the Paving, Grading and Drainage Plan for details of the facilities described herein.

1.0 Introduction
This report constitutes a Phase I Environmental Audit of a
parcel of property in Boynton Beach Florida located in Section
15, Township 45 South, Range 43 East, Palm Beach County
(Figures 1 & 2) prepared in order to satisfy requirements for
a commercial real estate transaction.
1.1 PUl"D08e of a Phase I Environmental Audit
A Phase I Environmental audit is a study, consisting
mainly of background research, to assess environmental
conditions of' a site. It is based on information of
present and historical land uses of the subject property
(the Site) and research into off-site conditions which
could have a potential adverse impact on the Site.
Because the Phase I Audit is only designed to assess the
Drobabilitv of environmental impact, no sub-surface
explorations or soil and water sampling and analysis were
conducted.

The Site is an approximate five acre parcel located between
the Florida East Coast (FEC) Railroad tracks and N.E. 4th. St.
and between N.E. 20th and 22nd Ave. in Boynton Beach, Florida.
It is bounded on the north by Boynton Animal Clinic, VFW Post
5335, and Northside Condo; on the east by the FEe tracks and

3.0 Phvsica1 Features of the Site
A site investigation was conducted on May 3, 1995. The Site is
undeveloped and consists of three separate lots (Figure 3).
The portion of Lot 27 is the southeast part of the Site. There
is a pile of trash and debris where N.E. 20th Ave. ends and
meets the Site. The debris consists of chairs, lamps, concrete
debris, plastic oil cans, paint cans, carpeting, tile and
discarded fencing. The rest of Lot 27 is undeveloped scrub
habitat with vegetation characterized by scrub oak with some
Brazilian pepper. There is a discarded suitcase within a small
copse of trees in the eastern part of the Site near the
railroad tracks. Along the south fence line was a pump house
in disrepair which contained a pressure tank and likely an old

well. There were also what appeared to be remnants of a
driveway or a house foundation and ornamental plants which are
not native to Florida such as Shefflera, asparagus fern, and
ornamental cactus. The 1965 aerial photo shows a house which
had a driveway access across the tracks from U.S. Hwy 1.

Lots 28 and 29 are also scrub habitat with wooded vegetation
ranging from scattered to dense throughout the Site. The scrub
vegetation includes scrub oak, slash pine, sand pine, cabbage
palm and snake plant. Household trash was observed along the
south fence line of Lot 28 opposite the second of three houses
which border this portion of the Site.

There was a junk pile in the northeast corner of the Site in
Lot 29 which contained lumber, a freezer, paint cans,
household trash, ~VC pipe, carpeting, fluorescent bulbs, and
shelving. Further to the west was asphalt debris. The soil
around the paint cans, oil cans and other containers of
potentially hazardous compounds was inspected and showed no
evidence of staining nor had any unusual petroleum, solvent or
paint odor.

Utilities
The Site is presently not being served by water and sewer
utilities.

According to the U.S. Soil Conservation Service Soil Survey
for Palm Beach County (1979), the soil on the Site consists of
St. Lucie sand, 0 to 8 percent slopes a nearly level to
sloping,. excessively drained, deep sandy soil with a water.
table below a depth of six feet. The surface layer is gray
sand about five inches thick. Below this is white sand that
extends to a depth of 80 inches or more. Permeability is very
rapid. The available water capacity, organic matter content

and natural fertility are low throughout. Natural vegetation
is sand pine, scrub oak, saw palmetto, rosemary, cacti,
reindeer moss, pineland three-awn and natalgrass.
Review of Historical Aerial PhotollraDM
A review of the aerial photographs from 1965, 1968, 1971,
1973, 1977, 1984, 1989, and 1993 indicates there was a house
on the southern part of the Site in 1965, but by 1968 it was
gone. The house was accessed from U. S. Hwy 1 across the
railroad tracks. After 1968, the Site was vacant with little
change in the p~ysical appearance to the present time. The
general area was sparsely developed to the north with a large
cleared area north of N.E. 22nd Ave and a citrus grove beyond
that. The first structures were the veterinary clinic building
adjacent to the Site and several commercial buildings in the
divided portion ~f N.E. 22nd Ave. The building now occupied by
the Cumberland Farms convenience store at the southeast corner
of N.E. 22nd Ave. and N.E. 4th St. was constructed between
1968 and 1971. By 1984, the condo and the VFW hall directly
north of the Site and multifamily units in the formerly large
cleared area were constructed by 1984. Also by this time the
strip mall on the south side of 22nd Ave. had been
constructed, and the divided center of 22nd St. was limited to
parking and one commercial building. The citrus grove was
being residentially developed in 1989, and by 1993 all roads
and multi-family buildings had been finished. The houses and
trailer park south of the Site were present prior to 1965, and
the area along the water east of u.S. Hwy 1 was developed, as
well.

The surrounding area is mostly residential. There is a condo-
minium complex to the north of the site along N.E. 4th St.,
and beyond that is a Cumberland Farms Convenience S~ore. There
were no fuel facilities associated with the convenience store.
North of the Site to the east was a veterinary clinic and a .
VFW hall. There was an engine on the grounds of the veterinary
clinic, but there was no evidence that maintenance activities
of the engine had impacted the Site. Beyond the clinic and the
VFW hall was a small shopping center on the south side of
Gateway Blvd. (N.E. 22nd Ave.) which was occupied by a beauty
shop, a Dollar Store, a dog groomer, and a small food store.
Next to the strip center was Royal Coin Laundry which was
abandoned. The laundry advertised dry cleaning, but there were
no drums on the premises. It was likely a pick-up location.

There are three (3) 12,000 gallon underground gasoline tanks
and one (1) 8,000 gallon underground diesel tank at the
Highway station. Groundwater and soil contamination were
discovered in July 1988, and the facility is in the state of
Florida Reimbursement Program, a state-funded program to

underground gasoline tanks and one (l) 550 gallon underground
waste oil tank at the Texaco station. Soil an~ groundwater
contamination were reported in August 1987, and the facility
is on the Reimbursement Program.

Five underground gasoline tanks were removed from the U-Haul
facility in March 1994. No problems were reported.

Lists, there are no Superfund or NPL sites within one mile of
the Site.
Soil and Water Samulinll and AnalVBis
There is no record that sub-surface soil and groundwater on
the Site has ever been sampled and analyzed for possible
contamination. Empire Environmental, Inc. did not feel
collection of soil and/or water samples and chemical analysis
were necessary in order to perform this evaluation for a
Phase I Environmental Audit.

10.0 Polychlorinated BluhenvlB
There was one transformer on a power pole on the south
property line in Lot 28. It was in good condition, and there
was no evidence of leaking or soil staining.

11.0 Conclusions
1. Present and past uses of the property have not resulted
in situations of environmental concern.
2. There is no evidence that the site has been impacted by
off-site sources.
