SUBJECT: BJ WHOLESALE CLUB'S OPERATING AGREEMENT
Tim Large and I reviewed BJ Wholesale Club's Operating Agreement and offer the following'
comments:
I. Article I, Definitions - All definitions shall be consistent with those that are adopted in the
1997 Standard Building Code, as amended, and the Boynton Beach Code of Ordinances,
Land Development Section.
2, Article IV, Operation of the Shopping Center, Section 4.1 - Verbiage should be added that
the use shall be consistent with the requirements of the Boynton Beach Code of Ordinances,
Chapter 2.
3. Article IV, Operation ofthe Shopping Center, Section 4.2 - Verbiage should be added that
parking requirements shall be consistent with the Florida Accessibility Code and with the
Boynton Beach Code of Ordinances, Chapter 2, parking requirements sections.
4. Article IV, Operation of the Shopping Center, Section 4.2E -Verbiage should be added that
building finish floor elevations shall meet Federal Emergency Management Agency and
South Florida Water Management District requirements.
5. Article IV, Operation of the Shopping Center, Section 4.4 - Verbiage should be added that
site lighting shall comply with the requirements of the Boynton Beach Code of Ordinances.
6. Article IV, Operation of the Shopping Center, Section 4,5 - Verbiage should be added that
all signs shall comply with the Boynton Beach Code of Ordinances, Chapter 21.
7. Article IV, Operation of the Shopping Center, Section 4,7 - Add verbiage that parking
requirements shall be consistent with the Florida Accessibility Code and the Boynton Beach
Code of Ordinances, Chapter 2, parking requirements sections.
8. Article V, Miscellaneous, Section 5.17A - Verbiage should be added that the landscape
buffer shall meet the requirements of the Boynton Beach Code of Ordinances. The applicant
is indicating that they will be using barbed wire on top of their buffer wall. Barbed wire is
only allowed in M-l zones per the Boynton Beach Code of Ordinances.
9, Article V, Miscellaneous, Section 5.17C - Add verbiage "ofthe Boynton Beach Code of
Ordinances" after the word "requirements."
10. Article V, Miscellaneous, Section 5.17E - Add verbiage that rooftop equipment shall be
screened from view a minimum of 600 feet from the building in all directions per the
Boynton Beach Code of Ordinances.
The above will ensure compliance with all applicable codes and ordinances.

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that the Planning and Development Board will conduct a PUBLIC
HEARING at the LIBRARY PROGRAM ROOM, BOYNTON BEACH LIBRARY, 208 S.
SEACREST BLVD., on Tuesday November 28, 2000. The City Commission of the CITY OF
BOYNTON BEACH, FLORIDA, will also hold a public hearing at CITY HALL COMMISSION
CHAMBERS, 100 E. BOYNTON BEACH BOULEVARD, BOYNTON BEACH, FLORIDA, on
Tuesday, December 05, 2000. Both meetings scheduled for 7:00 p.m. to consider a roadway
easement abandonment request submitted by Kimley Horn & Associates Inc. agent for
University of Florida Foundation, Inc., a Florida Corporation and University of Florida
Foundation, Inc., a Florida Corporation, as Trustee for a special purpose easement more
particularly described as follows:
The 30.00 foot Road Right-of-Way lying in Palm Beach Farms Company Plat
No.8, as recorded in Plat Book 5, Page 73, of the Public Records of Palm
beach County, being described as follows:
Bounded on the North by the South Right-of-Way line of Boynton Beach
Boulevard (S.R. 804), bounded on the East by the West line of Lots C, 0, E,
Block 4 and Lots A, B, C, 0, E, Block 29, bounded on the West by the East
line of Lots C, 0, E, Block 5 and Lots A, B, C, 0, E, Block 28 and bounded on
the South by the Easterly extension of the South line of Lot E, Block 28, all
lying in Palm Beach Farms Company Plat No.8.
All interested parties are notified to appear at said hearings in person or by attorney and be
heard. Any person who decides to appeal any decision of the Planning and Development Board
or City Commission with respect to any matter considered at these meetings will need a record
of the proceedings and for such purpose may need to ensure that a verbatim record of the
proceedings is made, which record includes the testimony and evidence upon which the appeal
is to be based.

The department is in receipt of the abandonment application request for the above noted location, received
on October 23,2000. The subject request is to abandon a portion of the roadway right-of-way within the
City, specifically:
That part of a 30-foot Road Right-of-Way lying in Palm Beach Farms Company Plat No.
8, according to the plat thereof as recorded in Plat Book 5, Page 73, of the Public Records
of Palm Beach County, Florida; bounded on the North by the South right-of-way line of
Boynton Beach Boulevard (SR 804), on the East by the West line of Lots C, D, E, Block 4
and Lots A, B, C, D, E, Block 29, bounded on the South by the Easterly extension of the
South line of Lot E, Block 28, and bounded on the West by the East line of Lots A, B, C,
D, E, Block 28, and Lots C, D, E, Block 5, all lying in said Palm Beach Farms Company
Plat No.8.
This petition for this requested abandonment lies within the proposed development known as BJ's
Wholesale Club, which has been before the Technical Review Committee for the past two (2) months; the
proposed development has been conceptually accepted, subject to various conditions. Therefore, this
department recommends approval of the application for right-of-way abandonment. If you have any
