Objective: This report i, intended to provide a basic assessment of the site
lignting and is not intended to be a comprehensive certification of compliance to
aU current ordinances. The specific area to be addreued pertains to the impact
the parking lot lighting may have on the adjacent residential properly to the north.
The site was visited between 9:00PM and 9:20PM on Thursday, April 18, 2002.
Summary: Under current Boynton Beach City Ordinances. offensive spillover or
glare onto residential property is not permitted. Residential property bounds this
site on the North side. Previous surveys had indicated that fixture adjustments
'Nere needed to comply with this requirement. At this time. tho.. ad;Ultments
have been made. Based on my ob8ervations of April 18, 2002. it is my opinion,
the lighting at this site il not creating any offensive glare or spillover onto the
adjacent residential property along the north p~rty line.

ADDITIONAL CONDITIONS OF APPROVAL
RELA TED TO OUTDOOR ACTIVITIES
1. Outdoor activities are approved for a period of 90 days, limited as
follows:
Hours of operation:
Noon to 8:00 p.m" Monday through Thursday
Noon to 10:00 p.m. on Friday, Saturday and Sunday
2. This temporary approval of outdoor activities is to allow applicant a
test period to demonstrate that outdoor use of the property, during the hours
applicant has proposed, can be conducted without creating a disturbance to
surrounding residential properties.
3. The City's temporary approval of outdoor use shall be considered'
provisional and is subject to reviewed by the City Commission at a public
hearing to be held on 8/20/02. At the 8/1102 Commission meeting, the
Commission shall reconsider only the outdoor use provisions of the
conditional use applicant. The City Commission shall thereafter complete
the conditional use application process, in accordance with the conditional
use review process set forth in the City's LDR, imposing conditions it deems
necessary to protect the interest of the public.
4. Applicant shall reimburse the City the costs of providing notice of the
8/20/02 public hearing.
5. With the exception of the outdoor use issue, the approval of
application for conditional use is a final development order when issued by
the City Clerk. With respect to the outdoor use, no development order shall
be considered final until the Commission concludes its review on 8/20/02
and the City Clerk issues a final development order.

I received the letter from Ms, Collomb dated May 14, 2002. I have reviewed the conditions of approval for status of same
and conclude the following:
1) (condition #3) Provide an original (sealed) letter from Mr. Brannon, who certified that the site would comply with the
lighting requirements of the city regarding "bleeding" of light. A faxed copy was provided with a note that an original
would be provided (I did not find an original in the file);
2) (condition #4) A response to the sound analysis requirements was previously provided by a Mr. Donald Colton in the
form of two submittals both containing partially handwritten and typed text and graphics. I realize that time was of the
essence at that point but clarity is important for our records which can be improved by typing the entire response,
consolidation of the two responses, including in the response the ordering of the response to correspond to the specific
analysis requirements of Chapter 2. Zoning, Section 11.2 (0)(13) ("a" through "d") as included below as an excerpt from
the code:
"13. Required analysis. All conditional use applications for bars, nightclubs and similar establishments
shall include the following analysis:
a. Data on the sound emitting devices/equipment and the methods and materials to be used to assure
that the acoustic level of the City Code will be met.

The analysis shall specify the authority and/or basis for determination of the acoustic level of the
emitting devices/ equipment,
The analysis of any sound retention, reduction or reflection shall include information such as the

It shall also verify that sound standards shall be met during the normal opening of doors for
entering and exiting the establishment. "
This formal, more organized format will enable the review for conformance with all four requirements.

added in accordance with this condition (a permit is not required as long as no other parking area alterations are made,
the markings and signage complies with standard drawings B-98001 and B-90013, and the parking area complies with all

license, agreeing to the other conditions listed in the development order; and

Regarding the above-referenced issue, the purpose of this memorandum is to communicate
information relative to the planned review of outdoor noise pursuant to the development order (90 -
day test period).
I have discussed this issue with both applicable city staff and the representative for the applicant, Ms,
Lisa Collomb, and determined that A) outdoor activities (with sound) at the use have continued since
approval, but have been limited to Sundays only, and between the hours of 4:00 p.m. and 8:00 p.m
(see attached letter); and B) that no applicable complaints have been received by the Police
Department or Code Compliance,
Lastly, please note that the applicant has not applied for a license modification for a nightclub at this
location, but still plans to pursue this license as evident by the recent compliance with items of the
development order (etc. submittal of sound data, parking lot modifications, affidavit).

Dear Mike,
Thank. you for your time last week, it is a pleasure to work with such a helpful
professional. As we discussed, I have spoken with Lisa regarding the more formalized
sound engineer's report and the original sealed lighting engineer's report. She will be
bringing them to your office this week. Alse, I will be emailing you some photos of the
signs and parking lot striping to show you that the work was done.
The operation has continued since we were given the conditional approval back in May,
Since it is the slow seaso~ the outside music has been going on between 4 p.m. and 8
p.m. on Sundays only. There have been no contacts with the police, no incidents, DO
requests to lower the music from neighbors or the city.
Since the last three months have been very successful, and since this patio dining and
music is really an integral part of the restaW'8llt, it is our hope that the Conunission will
give a final approval to the outside use,
We are in the process of fulfilling the requirements for the previously approved
conditional use upstairs, the docwnents mentioned above should conclude our fmal
necessary documentation.

Designing for optimum Performance
The performance of single wythe eMU walls has proven that the mass
of concrete masonry results in high STC ratings. ..-1\.. recent study was
conducted by the Institute for Research in Construction (I.R.C.) as part
of a research study sponsored by the Ontario Concrete Block
Association. This study found that when concrete blocks are used in
conjunction with furring, insulation, and drywall, the masonry advantage
becomes even clearer.
Wall mass has been proven to be inversely proportional to sound
transmission through that mass. This new research shows that this is not
the only factor that should be observed. "'hen sound vibrates one side of
a wall, the more massive the wall, the less vibration will be translated
through the wall. \Vhen furring and drywall are introduced into the
system, the sound waves vibrate through the mass of the bloc~ then
through the air in the cavity, and finally through the drywall into the
listening area. An enclosure as such has a specific frequency at which
sound energy is magnified, its resonance frequency. As the volume of air
within the cavity, increases, the resonance frequency of that enclosure is
lowered. This type of technology is used to optimize the performance of
high fidelity audio speakers. As the air space in a cavity wall is
increased, the STC rating will increase as well. This is known as the
Mass-Air-Mass factor. Overall conclusions of this study are the
following:

absorption coefficient - the amount of sound energy absorbed by a surface, varies with
frequency and it applies to 1 square foot of the material, multiply the absorption coefficient
by the square feet of the material to find the sabines of absorption for the given frequency in
the room.

boomy - excessive bass in a system or room, a parking garage would be an example of a
very boomy room, imagine trying to mix in a parking garage.

broadband - covers a wide band of frequencies
MDF - medium density fiberboard, it is very heavy and dense. made from fine sawdust
much finer than particle board
MTC - music transmission class, a wall rating system from CS gypsum, see STC
pink noise - random noise with equal enerK,V per octave, usually used as the test signal for a
spectrum analyzer
resilient channel - (RC for short) a z shaped piece of sheet metal that goes between the the
wall frame and the drywall. It allow the drywall to vibrate independent of the frame,
reducing amount sound transmitted through the wall
room mode - a resonant frequency of a room caused by the standing wave of a room
dimension, a square room would put aU o::the room modes together and cause those
frequencies to build up making the room sound boomy and uncontrolled

This report covers the sound transmission values found at CAFE LANOTTE on the two
days that tests were conducted.
Ail values are in db:
Equipment used to produce the inside sound:
3-5000 watt crown power amps
I ~3-way crossover
1-31 band eq
1- Rane disco mixer
I-compressor limiter
4-JBL, 3 way full range speaker cabinet (mount on ceiling around the dance floor-aimed
towards center)
4- ARS, 3 way full range speaker cabinet (as above)
2- 18" sub-woofer cabinets mounted
The main room is round with the dance floor being in the middle (see diagram) The walls
of the main room are 12'" concrete ar.d have a min. of 56 db attenuation.
The inside of the wall is covered with sound diffusion surfaces, which reduce the sound
wave from reaching the concrete surface reducing the transmission even more.
The windoVl-'S and frames are sealed dual paneled with nitrogen or other inert gas as filler.
This type of glass also has a high STC as parts of its make-up. No doors exist directly
from the main room except the fire doors, which remain shut during operation.

Running standard "rock and roll" at 114 db:
1. Music playing in center of dance floor
2. Outside at bottom of steps, north-side.(1eve1 at 60 HZ is airconditioner)
3.Further west along north side of building.
4. Edge of dock southeast side. Noise is boat, airplane, and, heavy construction
equipment on East Side of river.
Please note, *" dock levels" are background noise and exceeds all levels of leakage from
the structure.

Dear Mike,
I would like to thank you for taking the time to work out all the conditions set forth
for the May 7,2002 City Commission Meeting for the Cafe La Notte. My attorney
Betty Resch felt very confident that all the necessary wrinkles were worked out
ahead of time with the City Staff.
I feel confident that I will now be able to create a more positive and harmonious
relationship with the City of Boynton Beach and with my adjacent neighbors.
Although you can't please all the people all the time but I will strive to please some
of the people most of the time!
We had a very successful Mother's Day Sunday with music poolside from 2:00pm
to 8:00 pm and they will be coming back next Sunday. Unfortunately Julie
Symkowski put a damper on my holiday luncheon with my elderly handicapped
mother whom I brought to the restaurant for Mother's Day. She called me at the
restaurant at the height of the lunch rush to tell me she recieved my message on her
answer machine that I left asking her to refrain from walking her dog on my
property which I left on that Friday prior to Sunday. My security guard and chef
took notice that Friday morning and many other mornings in the past that she was
not using any kind of a pooper scooper. I acknowledged her when she called me
that Sunday at the restaurant to discuss my message and I told her that we were
quite busy serving lunch and I could not talk to her about it at that time so she hung
up and called back immediately conversing the same conversation to my bartender
who apoligized for not being able to acknowledge the issue as she was busy

This letter is to explain the data fOnTIS accompanying this report.
A sound test was done on the site of Cafe Lanotte to confirm the sound transmission
Ofthe P A system in the upstairs club.
# 1 M'JSic playing center of dance floor = 114 db
#2 outside at bottom of steps north side (below Air conditioner)
Sound on chart is the air conditioner
#3 further west along north side
#4 on edge of dock soutaeast side. Noise is boat, airplane, and heavy construction
equipment on East Side of river.
The sound transmission of the system or lack of transmission falls below the standards
set aside for the city. For all intents their indoor system can not be heard at all at the
property lines. This is in part to double glass; nitrogen tilled windows and poured cement
Walls.

The test device used is a Audio Control SA-3052 ANSI Class II real-time audio Analyzer

Dear Mr. Rumpf,
Thank you very much for the time you took to meet with me yesterday regarding the restrictions
on the operation of La Notte. It was encouraging to be able to come to so many aareements on
the terms and conditions. I spoke with Lisa after our meeting. and she confIrmed with me that all
but one of the items was totally acceptable to her. As a matter offaet, Lisa is meeting with your
Chief of Police this afternoon.
As I mentioned yesterday, there will be an audition for a band at the site on Friday, May 3, at
about 6:30. Also, in order to do an acoustic level check. there will be a live band out by the pool
from about 3 'til 7 on Sunday night. This is when the sound engineer will do his readings for his
report.
As you know, the use of the outdoor area is important to the successful operation of La Notte.
Ms Collomb is also aware, and sbares the concern regarding the potential impact of tile activity
on her residential neighbors. In light of the fact that she has such close residential neighbors. Ms
Collomb is not asking for tbe extended hours that "Two George's" and the "Banana Boat" are
enjoying II short distance south on the Intracoastal. It is my understanding that those operations
are allowed to be open with music until two a.m., the closing time. Ms Collomb, in tbe spirit of
cooperation and goodwill, is only asking to be able to be allowed to be open pools~de from Noon
until eight p.m. during the week, and nom noon 'til ten p.m. on Friday, Saturday and Sunday. In
addition, since there was a concern regarding bikini contests in the past, Ms Collomb agrees not
to hold them at the site.
I thank you for your consideration of our request, and will call you Monday to discuss oue status.

Playing the coordinator of this process, I understand the following:
Jim will work with Jeff Livergood using site characteristics, Police records and historic knowledge to prepare an "expert
testimony" for the meeting (testimony by police or Jeff). This testimony will include an analysis of the parking and
circulation system taking into account peak activity, and requirements to ensure quick and safe emptying of the parking
area without any impact upon the adjacent residential neighborhood. A recommendation(s) will be drafted and
consolidated with the other proposed revisions to be offered to the Commission. These recommendations should
address at minimum exit routes, traffic control including signalization, barriers to steer traffic, and possibly the
requirement that on-duty officers manage these traffic situations. Chief Gage will assist Jeff in drafting the appropriate
text for the proposed modification to the conditions.
Chief Gage will draft a recommendation(s) that requires reimbursement of over-time expenses when caused by incidents
during a nightclub event.
I will draft the other proposed changes as discussed this morning with staff and the applicant. A new condition will state
that the additional data satisfying criteria #13 for conditional use approval, which regards technical sound analysis, in
supplement to the condition that no sound shall be emitted from the building, be required as a condition of approval. I
would recommend that this become a condition to be met prior to receiving an occupational license, rather than holding
her to it prior to the meeting. I take the blame for this not being a part of the original conditions, which is a result of staff
using a previous report as a template for preparing the report for Cafe LaNotte which excluded the newest criteria #13.
The least we can do is allow her sufficient time to obtain the engineering data without delaying commission's review and
requiring a second advertisement.
Please complete these tasks and draft these comments, ideally prior to next Friday, and forward them to me for
consolidation and forwarding to the applicant prior to the May hearing.
Please correct or clarify these tasks as deemed necessary.

SUBJECT: Cafe LaNotte
The Public Works Staffhas evaluated parking and traffic conditions at Cafe LaNotte to
determine if any off or on site improvements are either necessary or desirable given the
proposed use of the restaurant building. Staff provides this report and notes that no
traffic counts have been conducted nor has staff calculated any trip generation figures.
Rather, staff has evaluated the existing off and on site parking and roadway
improvements to determine if existing conditions will support full use of the existing
parking lot.
Staff believes that the site is reasonably well situated on Federal Highway given its close
proximity to the traffic signal located at Federal Highway and Gateway Blvd./Las Palmas
Parkway. The site can be entered from either northbound Federal Highway or Las
Palmas. Thus, access to the site is convenient from all directions. Patrons can exit the
site from either a right turn only driveway onto Federal Highway or by accessing the
traffic signal on Las Palmas. Staff believes, therefore, that ~ccessibility to the site is very
good.
Staff does find, however, that traffic conditions related to the site could be of concern
should there ever be an event at the restaurant where all patrons would leave the grounds
at the same time. The capacity at the intersection of Federal and Las Palmas would be
strained in this scenario. Fortunately, it is most likely that instances such as this,
although probably rare, would occur during non-peak traffic periods on Federal Highway
such as evenings and weekends. The restaurant manager should refrain from schedulin..z ~
l} ~vents that will result in customers leavin at the same time during weekday afternoon
Qeak hours. The surrounding highway network should be able to accommo ate the ?
., \ departure of a fully loaded parking lot when the departures of the customers are staggered r
7 ~ J over time.
Staffhas no evidence to suggest that parking provided on site is, or is not, satisfactory for
the proposed use. Planning staff should evaluate parking requirements or other parking
issues related to potential use of valet parking. There is obviously little or no overflow
parking available in the immediate area.
Public Works Staff did find the need for a number of on site traffic related improvements
that should be undertaken. These are as follows.

The existing parking lot and entryways appear to favor one-way traffic
movement throu the arkin ch that traffic travels eastbound in the

be additional signage and striping on site to clarify the traffic moveI?ent and also
to minimize the potential accidents on the private property.

be appropriate to restrict right turns exiting the site onto Las Palmas to minimize P J
disruption on the local neighborhood. Thus, staff recommends tha(a "no righ~

Las Palmas is restricted to parking and is posted as a tow away zone. This will no
doubt discourage parking on street.

Jeff, from your memo I have formulated specific comments/conditions related to traffic for your confirmation.
1) Events should be scheduled with ending times that would not conincide with weekday, afternoon peak
traffic periods (i.e. between 4:00 p.m. and 6:00 p.m. If this is unavoidable, traffic management shall be
coordinated with, and to the satisfaction of the Boynton Beach Police Department.
2) For special events that have specific ending times, owner or operator shall be required to have a traffic
management plan to avoid traffic congestion at the nearby intersection/roadway network which shall be
coordinated wtih and accepted by the Boynton Beach Police Department.
3) Replace the bent and faded "no left turn" sign exiting the northerly drive onto Federal Highway.
4) Stripe and provide signage within the parking lot to direct one-way traffic movement such that traffic travels
eastbound in the southerly aisle and then westbound in the northerly aisle. reinforce this concept.
Jeff, I drafted items #1 and #2 adding coordination with the Police Department. I know that we had talked
about possibly requiring a minimal number of on-site staffing from the business or hired by the business to
manage/control people/cars during closing periods. Based on the fact that many of the compliants regarded
nuisance activity associated with closing periods, what do you both think of the following:
5) The operator shall allocate a minimum of three personnel to patron/traffic management within the parking
area during closing periods to expidite the vacating of the parking lot, prevent nuisances, and to prevent
traffic/patrons from entering the residential neighborhood of Las Palmas.
6) For special events, the owner/management shall close the parking area once filled preventing over-crowding
and congestion of site.
7) Nightclub/special event attendance shall be counted at all times to prevent occupancy from exceeding
fire/safety capacity.
Keep in mind that current condition #14 (under additional eRA comments) still stands:
12. If/when regular attendance at the proposed nightclub meets or exceeds
capacity, or when special events are anticipated to attract same, the Police
Department shall be consulted to determine optimal policing/security to
prepare for and avoid potential noise and other related problems, and to
ensure that special events meet parking requirements. Special events that
would not meet parking requirements on site or off site as represented by a
special parking plan for the event, shall not be permitted. Recommendations
from Police Department shall be adhered to.
Please forward comments on these as soon as possible copying everyone above so all are aware of the progress being
made. Let's try to finalize them before the end of the day in preparation for Monday's pre-agenda conference.

Hi, I met with the sound analyst this afternoon... he was there while the band was
playing.. we are below the db level.. he said the waves at the south of the city owned
lot next to the condo were louder than the music..he is going to make a report that will
be ready tuesday. The closest neighbor wi II come Tuesday and testify that he has no
objection.... are you aware of the double glass wall that separates the club from the
Las Palmas homes? It makes a huge difference. I met with List today, and we agree
that we would be happy to agree to no amplified music on the outside second story
deck. I am assuming that you have been there, if not, lets try to make a time so that
you can be aquainted with it.

1. Add to the building that is depicted on the drawing titled site plan a labeled symbol
that identifies the location of the handicap accessible entrance doors to the
building. Florida Accessibility Code for Building Construction, Section 4.1.2, 4.3.
2. Add a labeled symbol to the site plan drawing that identifies the location of the
handicap accessible parking spaces. The quantity of the spaces shall be
consistent with the regulations specified in the Florida Accessibility Code for
Building Construction. The accessible parking spaces that serve a use shall be
located on the shortest safely accessible route of travel from adjacent parking to an
accessible entrance. The Florida Accessibility Code for Building Construction
states that buildings with multiple accessible entrances shall have accessible
parking spaces dispersed and located closest to the accessible entrance. Florida
Accessibility Code for Building Construction, Section 4.1.2(5), 4.3, 4.6.
3. Add a labeled symbol to the site plan drawing that represents and delineates the
path of travel for the accessible route that is required between the accessible
parking spaces and the accessible entrance doors to the building. The symbol
shall start at the accessible parking spaces and terminate at the accessible
entrance doors to the building. The symbol that is required to be installed along the
path shall represent the location of the path of travel, not the location of the
detectable warning or other pavement markings. The location of the accessible
path shall not compel the user to travel in a drive/lane area that is located behind
parked vehicles. Identify on the plan the width of the accessible route. (Note: The
minimum width required by the code is forty-four (44) inches). Add text to the
drawing that would indicate that the symbol represents the accessible route and
the route is designed in compliance with Section 4.3 (Accessible Route) and 4.6
(Parking and Passenger Loading Zones) of the Florida Accessibility Code for
Building Construction. Please note that at time of permit review, the applicant shall
provide detailed documentation on the plans that will verify that the accessible
route is in compliance with the regulations specified in the Florida Accessibility
Code for Building Construction. This documentation shall include, but not be
limited to, providing finish grade elevations along the path of travel.
4. On the drawing titled site plan, identify and label the symbol that represents the
property line.
5. As required by Chapter 4, section 7 of the Land Development Regulations, submit
a current survey of the subject property.
6. Add to all plan view drawings of the site a labeled symbol that represents the
location and perimeter of the limits of construction proposed with the subject
request.
