The site is currently a flat, previously developed, 0.49 acre lot. The building is surrounded on the east and south sides by road rights-of-way and 10 foot concrete sidewalks, with the north side being adjacent to a 20 foot wide alley right-of-way. Existing vegetation consists of lawn areas and minimal landscape plantings. There are no other features of any significance on the site. The developer is proposing the addition of 2,575 square foot of restaurant area to the existing 1,750 square foot Dolphin Restaurant and Lounge. The project will increase the building size to 4,325 square feet, and will provide a one-story sit down restaurant with 164 seats and a 33 space parking area to the west of the building. (see Exhibit "B" - proposed site plan/landscape plan). A traffic statement was not submitted. The agent, prior to receiving pennits on the building expansion, must provide a traffic analysis verifying / Memorandum No. PZ 99-156 b. Drainage- Driveways: Parking Facility: Landscaping: Community Design: Page 2 that levels of service standards are maintained. The city relies on the Palm Beach County Traffic Division for review for compliance with the county's traffic performance standards. Conceptual drainage information was provided for the city's review. The city's concurrency ordinance requires drainage certification at time of site plan approval. The Engineering Division is recommending that the review of specific drainage solutions be deferred to time of permit review. Proposed on-site traffic circulation consists of two access points off of S.E. 1'1 Avenue; one 18 foot wide, one-way drive and one 27 foot wide, two- way drive, both connecting to the 20 foot alley right-of-way to the north. The parking areas proposed include 33 spaces on site west of the building. No parallel parking spaces are provided on U.S. Highway 1 or S.E. 1'1 Avenue. The standard 9 feet by 18 feet parking spaces will be provided in all proposed parking areas. Central Business District zoning allows the required parking count to be reduced by 50 % if all spaces provided (excluding handicapped spaces) remain unrestricted and available to the public. According to the standard methodology, 66 parking spaces are required, which is reduced to 33 per CBD parking provisions. On-site parking, based on the total required, includes the required number of two (2) spaces designated as handicapped accessible. All parking needs can be satisfied on site, as similar to the circumstance with the former use of the property. To accommodate redevelopment within the Community Redevelopment Area, the city is pursuing implementation of a downtown parking study which will lead to a comprehensive parking program, based on the shared concept, and will include the plan for additional public parking facilities and methods for raising revenue for related facilities and improvements. According to shared-parking concepts, this restaurant use would contribute to the needed balance of uses in this vicinity, as its peak hour characteristics would differ from the use characteristics of other nearby (predominantly retail or office) uses. A set of landscape plans have been submitted and reviewed. The plan provides the appropriate plantings required of all projects in the Central Business District. Landscape regulations will be fully met when staff comments are incorporated into the permit drawings, including the requirement to enhance plantings at the southeast comer of the building/porch consistent with the "Dolphin Square" redevelopment plan. The proposed building facade, as viewed from U.S. Highway 1, will enhance the character of the adjacent intersection and also delineates the southern boundary of the historical downtown core. Based on anticipated future redevelopment of the historical 500 block of Ocean Avenue, and the close proximity to the future Ocean Avenue Promenade / Marina revitalization projects, staff recommends that the proposed structure be ~ Memorandum No. PZ 99-156 Page 3 upgraded to include similar architecturally historical elements of adjacent 500 block buildings. The desired architectural additions shall be distinctive and complement the E. Ocean Avenue corridor through consistency with adjacent historic commercial buildings. If staff comments are addressed correctly, this project will provide a greater complement to the historical district than. it cllITently represents. Signage: A wall sign elevation was submitted with the current architectural plans. A proposed signage detail was not submitted for site plan review. Any signage proposed within the Central Business District shall be designed to be consistent with the requirements of the Visions 20/20 Redevelopment Plan and the City's Land Development Regulations. The conditions of approval address site lighting, sign lighting, and that these be consistent with fixtures to be used along Ocean Avenue and at the planned marina. Downtown Redevelopment: Although the subject project could represent a positive improvement in the downtown, staff must recognize and describe how the proposed project compares and contrasts with the redevelop~ent plan recommendations for this property/use. The redevelopment plan recommends a 2 story restaurant/retail building be placed similar to the proposed expansion (and construction techniques will allow for a future 2nd floor addition ), and a second two-story restaurant/office placed immediately west of the first restaurant described at the comer. A panial courtyard is created by the placement of the two, two-story buildings, and is to include pedestrian linkages to Ocean Avenue, US-l and SE 111 Street. The alley is to be abandoned and replaced with the walkway to US-I. Parking is proposed for the remaining land ( currently built and not owned by the subject owner) located inunediately west of the courtyard. In ,Contrast, the subject project proposes vehicular use for the interior area, including maintenance of the alley, and a 33-space parking lot. The applicant claims to have been unsuccessful at negotiations to purchase the remaining land on the block, which is necessary for the parking lot and the implementation of the "Dolphin Square" project. As the expanded building will be designed to accommodate a 2nd floor expansion. and since the parking area could ultimately be converted into a theatre/courtyard, this project could be construed as a possible first phase of the "Dolphin Square" redevelopment plan. It should also be noted that the proposed expansion is the subject of a grant for economic development funding through Palm Beach County. RECOMMENDATION: The Planning and Zoning Division recommends that this request for site plan approval be approved. subject to the comments included in Exhibit "C" - Conditions of Approval. Staff also recommends that the deficiencies identified in this exhibit be corrected on the set of plans submitted for building permit. Waste removal in connection with construction process must be serviced by the City of Boynton Beach. Place note on dumpster detail to indicate same. X 2. As per section 10-25 in the City Code, free dumping access to containers at all times shall be provided by the user. X 3. Applicant must delineate path of truck using dotted lines showing entrance to facility and to the dumpster as well as exit. UTILITIES Comments: "--- --- X 4. Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as stated in LDR chap. 6, Art. IV, Sec. 16, or the requirement imposed by insurance underwriters, whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with vour buildimz permit submittal. X 5. Water and sewer lines to be owned and operated by the City shall be included within utility easements. Please show all proposed easements on the engineering drawings, using a minimum width of 12 feet. The easements shall be dedicated via separate instrument to the City as stated in Sec. 26-33(a) of the Code. X 6. This office will not require surety for installation of the water and sewer utilities, on condition that the systems be fully completed, and given to the City before the first permanent meter is set. Note that setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy. X 7. It appears the existing water meter will be providing water service to the existing and proposed building. All plans submitted for specific permits shall meet the City's code requirements at time of application. These permits include, but are not limited to the following: site lighting, paving, drainage, curbing, landscaping and irrigation. Permits required from other permitting agencies, such as FDOT, PBC, SFWMD, DERM, L WDD, DEP and any others, shall be included with your pennit request. X II. Correct the color of the handicap symbol and the stripes within the accessible path. X 12. Add to the floor plan and site plan a labeled symbol that represents the location of the accessible entrance door to the facility. 17. Add to the floor plan and site plan a labeled symbol that represents the location and path of the accessible route that is required from the accessible parking space(s) to the accessible entrance door of the building. Place a note on the drawing, next to the sYmbol, indicating that the accessible route is in compliance with Section 4.3 (Accessible Route) and 4.6 (Parking and Passenger Loading Zones) of the Florida Accessibility Code for Building Construction. Also, show and identify the width and type of material proposed for the route through its entire length. 18. To determine what impact the proposed construction will have on the existing facility, a survey of the subject property is required. Additional comments may be generated following the submittal of a current survey. 19. To determine what impact the proposed new improvements will have on the existing facility, add the below listed information to the Project Info chart found on sheet S 1 : a. Identify the total number of seats that are currently licensed at the existing facility. __ __ ___ Indicate the use of the existing and new square foot8ge~- Also, identify the classification of the bar/grill (restaurant) - is it a high turnover sit down restaurant or quality restaurant? Identify the total number of new seats. 20. Add a drawing that identifies and shows the location of all seating. Chronologically number all seats. 21. Indicate and show on the site plan and floor plan drawing the use of the covered patio area. If there are seats proposed for the patio area show them on the plans. 22. Within the footprint of the new and existing building that is shown on the site plan (sheet S 1) and the proposed floor plan drawing, identify the proposed finish floor elevation (N.G.V.D.). Add to the Project Info found on sheet S 1 the flood zone that the building is located within including, where applicable, base flood elevation. If there is no base flood elevation, indicate that on the plans. Considering that the request did not include a site sign place the following note on the site plan: "Site signage is not approved for this project. Separate site plan review and approval is required for site signage." X 24. . To verify that the size of the proposed wall sign is in compliance with the limitations of the Sign Code identify the length of the wall where the wall sign is mounted. Identify the total sign area including providing computations that verify the sign area is in compliance with the limitations of the Sign Code. Drawings of the signage shall comply with the applicable regulations specified in the Sign Code (Chapter 21 of the Land Development Regulations). X 25. Site lighting specifications are reviewed at time of permit review. Therefore, amend the note found on sheet S5 to indicate that the lighting plan is showing type and height of pole, type of fixture and proposed location of pole and fixtures only.
