The site is currently a flat, previously developed, 0.49 acre lot. The building is
surrounded on the east and south sides by road rights-of-way and 10 foot concrete
sidewalks, with the north side being adjacent to a 20 foot wide alley right-of-way.
Existing vegetation consists of lawn areas and minimal landscape plantings. There
are no other features of any significance on the site.
The developer is proposing the addition of 2,575 square foot of restaurant area to
the existing 1,750 square foot Dolphin Restaurant and Lounge. The project will
increase the building size to 4,325 square feet, and will provide a one-story sit
down restaurant with 164 seats and a 33 space parking area to the west of the
building. (see Exhibit "B" - proposed site plan/landscape plan).
A traffic statement was not submitted. The agent, prior to receiving
permits on the building expansion, must provide a traffic analysis verifying

that levels of service standards are maintained. The city relies on the Palm
Beach County Traffic Division for review for compliance with the county's
traffic performance standards.
Conceptual drainage information was provided for the city's review. The
city's concurrency ordinance requires drainage certification at time of site
plan approval. The Engineering Division is recommending that the review
of specific drainage solutions be deferred to time of permit review.
Proposed on-site traffic circulation consists of two access points off of S.E.
I't Avenue; one 18 foot wide, one-way drive and one 27 foot wide, two-
way drive, both connecting to the 20 foot alley right-of-way to the north.
The parking areas proposed include 33 spaces on site west of the building.
No parallel parking spaces are provided on U.S. Highway 1 or S.E. 1st
Avenue. The standard 9 feet by 18 feet parking spaces will be provided in
all proposed parking areas. That portion of the parking area containing
angled spaces is proposed with code deficient dimensions per City parking
lot regulations. This portion of the lot must be expanded to accommodate
the necessary dimensions, or a variance must be justified, requested and
obtained. Central Business District zoning allows the required parking
count to be reduced by 50 % if all spaces provided (excluding handicapped
spaces) remain unrestricted and available to the public. According to the
standard methodology, 66 parking spaces are required, which is reduced
to 33 per CBD parking provisions. On-site parking, based on the total
required, includes the required number of two (2) spaces designated as
handicapped accessible. All parking needs can be satisfied on site, as
similar to the circumstance with the former use of the property. To
accommodate redevelopment within the Community Redevelopment Area,
the city is pursuing implementation of a downtown parking study which
will lead to a comprehensive parking program, based on the shared
concept, and will include the plan for additional public parking facilities
and methods for raising revenue for related facilities and improvements.
According to shared-parking concepts, this restaurant use would contribute
to the needed balance of uses in this vicinity, as its peak hour
characteristics would differ from the use characteristics of other nearby
(predominantly retail or office) uses.
A set of landscape plans have been submitted and reviewed. The plan
provides the appropriate plantings required of all projects in the Central
Business District. Landscape regulations will be fully met when staff
comments are incorporated into the permit drawings, including the
requirement to enhance plantings at the southeast corner of the
building/porch consistent with the "Dolphin Square" redevelopment plan.
The proposed building facade, as viewed from U.S. Highway 1, will
enhance the character of the adjacent intersection and also delineates the
southern boundary of the historical downtown core. Based on anticipated
future redevelopment ofthe historical 500 block of Ocean Avenue, and the
close proximity to the future Ocean A venue Promenade / Marina
revitalization projects, staff recommends that the proposed structure be

upgraded to include similar architecturally historical elements of adjacent
500 block buildings. The desired architectural additions shall be
distinctive and complement the E. Ocean A venue corridor through
consistency with adjacent historic commercial buildings. If staff comments
are addressed correctly, this project will provide a greater complement to
the historical district than it currently represents.
Signage:
A wall sign elevation was submitted with the current architectural plans.
A proposed signage detail was not submitted for site plan review. Any
signage proposed within the Central Business District shall be designed to
be consistent with the requirements of the Visions 20/20 Redevelopment
Plan and the City's Land Development Regulations. The conditions of
approval address site lighting, sign lighting, and that these be consistent
with fixtures to be used along Ocean Avenue and at the planned marina.
Downtown Redevelopment:
Although the subject project could represent a positive improvement in the
downtown, staff must recognize and describe how the proposed project
compares and contrasts with the redevelopment plan recommendations for
this property/use. The redevelopment plan recommends a 2 story
restaurant/retail building be placed similar to the proposed expansion (and
construction techniques will allow for a future 2nd floor addition), and a
second two-story restaurant/office placed immediately west of the first
restaurant described at the comer. A partial courtyard is created by the
placement of the two, two-story buildings, and is to include pedestrian
linkages to Ocean Avenue, US-I and SE I SI Street. The alley is to be
abandoned and replaced with the walkway to US-I. Parking is proposed
for the remaining land ( currently built and not owned by the subject
owner) located immediately west of the courtyard. In contrast, the subject
project proposes vehicular use for the interior area, including maintenance
of the alley, and a 33-space parking lot. The applicant claims to have been
unsuccessful at negotiations to purchase the remaining land on the block,
which is necessary for the parking lot and the implementation of the
"Dolphin Square" project.
As the expanded building will be designed to accommodate a 2nd floor
expansion, and since the parking area could ultimately be converted into a
theatre/courtyard, this project could be construed as a possible first phase
of the "Dolphin Square" redevelopment plan. It should also be noted that
the proposed expansion is the subject of a grant for economic development
funding through Palm Beach County.
RECOMMENDATION:
The Planning and Zoning Division recommends that this request for site plan approval be approved,
subject to the comments included in Exhibit "c" - Conditions of Approval. Staff also recommends that the
deficiencies identified in this exhibit be corrected on the set of plans submitted for building permit.

PUBLIC WORKS
Comments:
1. Waste removal in connection with construction process must be serviced
by the City of Boynton Beach. Place note on dumpster detail to indicate
same.
2. As per section 10-25 in the City Code, free dumping access to containers
at all times shall be provided by the user.
3. Applicant must delineate path of truck using dotted lines showing
entrance to facility and to the dumpster as well as exit.
UTILITIES
Comments:
4. Fire flow calculations will be required demonstrating the City Code
requirement of 1500 g.p.m. as stated in LDR chap. 6, Art. IV, Sec.
16, or the requirement imposed by insurance underwriters, whichever
is greater. (see Sec. 26-16(a)). Please submit these calculations with
your building permit submittal.
5. Water and sewer lines to be owned and operated by the City shall be
included within utility easements. Please show all proposed easements
on the engineering drawings, using a minimum width of 12 feet. The
easements shall be dedicated via separate instrument to the City as stated
in Sec. 26-33(a) of the Code.
6. This office will not require surety for installation of the water and
sewer utilities, on condition that the systems be fully completed, and
given to the City before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
certificate of occupancy.
7. It appears the existing water meter will be providing water service to the
existing and proposed building. Please provide calculations
indicating that the meter is sufficiently sized for the intended use.
8. Appropriate backflow preventers will be required on the domestic water
service to all buildings, and the fire sprinkler line if there is one, in
accordance with Sec. 26-207.

9. A building permit for this project shall not be issued until this office has
approved the plans for the water and/or sewer improvements
required to serve the project. (Sec. 26-15)

ENGINEERING DIVISION
Comments:
lO. All plans submitted for specific permits shall meet the City's code
requirements at time of application. These permits include, but are not
limited to the following: site lighting, pavmg, drainage, curbing,
landscaping and irrigation. Permits required from other permitting
agencies, such as FDOT, PBC, SFWMD, DERM, L WDD, DEP and any
others, shall be included with your permit request.
l1. Correct the dimensions for the angled parking stalls and drive aisle width
to accommodate the 4' deficiency and design in conformance with City
Standard Drawing B-900 13.
12. Correct the color of the handicap symbol and the stripes within the
accessible path.
13. Provide an Engineer's certification that the drainage system will conform
with all City rules, regulations and codes. [LDR Chapter 4, Section 7.F.]
14. On the Paving and Drainage Plans show all necessary traffic control
devices such as stop bars, stop signs, double yellow lane separator
stripes, directional arrows and Do Not Enter signs. [LDR Chapter 4,
Section 7.B.]
15. Provide specifications for those areas of new paving on the Paving Plan
and indicate whether the existing paving will receive an overlay.
l6. Indicate that Type "D" curb will be installed around all landscaped
islands.

1 7. Add to the floor plan and site plan a labeled symbol that represents the
location of the accessible entrance door to the facility.
18. Add to the floor plan and site plan a labeled symbol that represents the
location and path of the accessible route that is required from the
accessible parking space(s) to the accessible entrance door of the
building. Place a note on the drawing, next to the symbol, indicating that
the accessible route is in compliance with Section 4.3 (Accessible Route)
and 4.6 (Parking and Passenger Loading Zones) of the Florida
Accessibility Code for Building Construction. Also, show and identify
the width and type of material proposed for the route through its entire
length.
19. To determine what impact the proposed construction will have on the
existing facility, a survey of the subject property is required. Additional
comments may be generated following the submittal of a current survey.
20. To determine what impact the proposed new improvements will have on
the existing facility, add the below listed information to the Project Info
chart found on sheet S 1 :
a. Identify the total number of seats that are currently licensed at the
existing facility.
Indicate the use of the existing and new square footage. Also, identify
the classification of the bar/grill (restaurant) - is it a high turnover sit
down restaurant or quality restaurant? Identify the total number of new
seats.
21. Add a drawing that identifies and shows the location of all seating.
Chronologically number all seats.
22. Indicate and show on the site plan and floor plan drawing the use of the
covered patio area. If there are seats proposed for the patio area show
them on the plans.
23. Within the footprint of the new and existing building that is shown on
the site plan (sheet S 1) and the proposed floor plan drawing, identify the
proposed finish floor elevation (N.G.V.D.). Add to the Project Info
found on sheet S 1 the flood zone that the building is located within
including, where applicable, base flood elevation. If there is no base
flood elevation, indicate that on the plans. Also, add to the Project Info
data, notes and computations that will verify the proposed finish floor
elevation is in compliance with the minimum elevation required by the
Flood Zone and verify that the proposed finish floor is six inches or
more above the crown of the abutting right(s)-of-way.
24. Considering that the request did not include a site sign place the
following note on the site plan: "Site signage is not approved for this
project. Separate site plan review and approval is required for site
signage. "

25. To verify that the size of the proposed wall sign is in compliance with
the limitations of the Sign Code identify the length of the wall where the
wall sign is mounted. Identify the total sign area including providing
computations that verify the sign area is in compliance with the
limitations of the Sign Code. Drawings of the signage shall comply with
the applicable regulations specified in the Sign Code (Chapter 21 of the
Land Development Regulations).

to the accessible entrance of the building. Place a note on all three drawings, next to the
symbol, indicating that the accessible route is in compliance with Section 4.3 (Accessible
Route) and 4.6 (Parking and Passenger Loading Zones) ofthe Florida Accessibility Code for
Building Construction. Identify the width and type of material proposed for the route
through its entire length. Where the symbol of the accessible route shows the route crossing
over a change of material, identify the material and show or note that the elevation of the

5. Add to sheet A3 the seating layout. Indicate with a symbol the difference between the bar
seats and restaurant seats. Chronologically number both types of seats. Indicate and show
the use of the covered patio area.
6. Within the footprint of the new and existing building that is identified on the site plan (sheet
1), identify the proposed finish floor elevation (N.G.V.D.). Also, identify the finish floor
elevation within the footprint of the building that is illustrated on sheets Aland A3. Omit
sheet A2. Add to the site data found on sheet 1 the flood zone that the building is located
within including, where applicable, base flood elevation. Add to the project info
information, notes and computations that will verify the proposed finish floor elevation is in
compliance with the following minimum standards:
a) Minimum elevation required by the Flood Zone.
b) Show that the finish floor is not less than six inches above the crown of the abutting
right( s )-of- way.
7. Define on sheet 1 what Phase One means. Add to all plan view drawings of the site a
labeled symbol that represents the location and perimeter of phase one.
8. The information that is found on sheets A2, A4, and A 7 is not reviewed at site plan
review; therefore, remove the sheets. Block out the bar area shown on sheet A6. Show
and label the north and east property lines on the other two detail drawings illustrated on
sheet A6. Show and label the north and east property lines on sheet AI. Also, show and
label the north and east property lines on sheet A3 and the east property line on sheet A5.
Indicate on all drawings the dimension from the property line to the building. Renumber
the drawings accordingly.
9. Provide detailed and dimensioned elevation views of the site signage including stating the
total sign area and height of the sign. Also, show and dimension on the plan view
drawings the distance the site sign is located from the adjacent property lines (note; ten
feet is minimum) or place the following note on the site plan: "Site signage is not
approved for this project. Separate site plan review and approval is required for site
signage." Drawings ofthe signage shall comply with the applicable regulations specified
in the Sign Code (Chapter 21 of the Land Development Regulations). If applicable,
delineate on the landscape plan the location of the landscaping that is required for site
slgnage.

10. Label the north direction on the framing plan. It appears the configuration of the building
illustrated on the elevation view drawings does not match the configuration of the
building illustrated on the framing plan. Correct the drawings accordingly.
11. On the east elevation view drawing of the building found on sheet A8, identify the length
of the building. To identify the size of the proposed wall sign, add dimension lines and
dimensions to the proposed wall sign. Identify the total sign area including providing
computations that verify the sign area is in compliance with the limitations of the Sign
Code. Drawings of the signage shall comply with the applicable regulations specified in
the Sign Code (Chapter 21 of the Land Development Regulations). Indicate on the
drawing whether the sign will be illuminated and specify type of illumination.
12. Lighting specifications are reviewed at time of permit review. Therefore, add a note
(large letters) to sheet 5 (lighting plan) indicating that the lighting plan is showing type of
pole, type of fixture and proposed location of pole and fixtures only. Also, include with
the note that the other lighting specifications will be evaluated for consistency with code
regulations at time of permit review. Site illumination shall be consistent with the
specifications identified in the City's Land Development Regulations (Paragraph 7 and 8
of Section 8A of Article III of Chapter 7.5 and paragraph A of Article II of Chapter 23 of
the regulations).
13. On the site plan sheet 1, identify the symbol that represents the property line.
14. To verify that the proposed structure does not encroach into an easement, show, label and
dimension on the site plan all easements depicted on the survey. Also, show, dimension
and label proposed new easements.

We have reviewed the subject plans and offer the following comments that should be addressed prior
to the project being forwarded for Board review:
1. All plans submitted for specific permits shall meet the City's code requirements at time of
application. These permits include, but are not limited to the following: site lighting, paving,
drainage, curbing, landscaping and irrigation. Permits required from other permitting agencies,
such as FDOT, PBC, SFWMD, DERM, L WDD, DEP and any others, shall be included with your
permit request.
2. Correct the dimensions for the parking stalls to show 18' long stalls and a 27' back-up distance for
the westernmost parking stalls, either relocate the chain link fence to provide a 27' back-up
distance or reconfigure the stalls for 600 parking and one-way ingress from SE 1 st Avenue per
City Standard Drawing B-900 13.
3. Relocate the north parking lot island so that it does not encroach into the 20' alley.
4. Add a note on the Paving Plan that all striping and markings shall be in accordance with City
Drawing B-9800 1 and correct the color of the handicap symbol and the stripes within the
accessible path.
5. On the Lighting Plan, specify that the light poles shall withstand 110 MPH wind load. Add a note
that the fixtures shall be controlled by photo electric switch and to remain on until 2 a.m. [LDR
Chapter 23, Article II] Also add a note that the lighting design shall provide an average of one
foot candle at ground level.
6. Provide an Engineer's certification that the drainage system will conform with all City rules,
regulations and codes. [LDR Chapter 4, Section 7.F.]
7. Show the handicap accessible route from the sidewalk to the new front entrances.
8. On the Site Plan and Paving and Drainage Plans show all necessary traffic control devices such as
stop bars, stop signs, double yellow lane separator stripes, directional arrows and Do Not Enter

We offer the following comments on this project:
GENERAL COMMENTS
1) All utilities easements shall be shown on the rectified landscaping drawings so that we may determine
which trees may interfere with utilities. In general, palm trees will be the only tree species allowed
within utility easements. Canopy trees may be planted outside of the easement so that roots and
branches will not impact those utilities within the easement in the foreseeable future. LDR Sec. 7.5-
18.1 gives public utilities the authority to remove any trees that interfere with utility services, either in
utility easements or public rights-of-way.
2) Fire flow calculations will be required demonstrating the City Code requirement of 1500 g.p.m. as
stated in LDR chap. 6, Art. IV , Sec. 16, or the requirement imposed by insurance underwriters,
whichever is greater. (see Sec. 26-16(a)). Please submit these calculations with your building permit
submittal.
3) Comp Plan policy 3C.3.4 requires the conservation of potable water. City water may not, therefore, be
used for irrigation where other sources are readily available.
4) Provide an engineer's written certification that drainage will conform with all rules of the City and the
South Florida Water Management District. (LDR Chap. 4, sec. 7F)
SPECIFIC CONDITIONS
1) Water and sewer lines to be owned and operated by the City shall be included within utility easements.
Please show all proposed easements on the engineering drawings, using a minimum width of 12 feet.
The easements shall be dedicated via separate instrument to the City as stated in Sec. 26-33(a) of the
Code.
2) This office will not require surety for installation of the water and sewer utilities, on condition that the
systems be fully completed, and given to the City before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the certificate of occupancy.
3) LDR chap. 6, Article IV, Sec. 16 requires that all points on each building will be within 200 feet of an
existing or proposed fire hydrant. It is unclear from your plan whether the fire hydrant adjacent to the
proposed new building is existing or proposed. Please clarify. If proposed, provide details and plan
view on the connection to our water main.
4) It appears the existing water meter will be providing water service to the existing and proposed
building. Please provide calculations indicating that the meter is sufficiently sized for the intended
use.
5) Appropriate backflow preventers will be required on the domestic water service to all buildings, and
the fire sprinkler line if there is one, in accordance with Sec. 26-207.
6) A building permit for this project shall not be issued until this office has approved the plans for the
water and/or sewer improvements required to serve the project. (Sec. 26-15)
7) Provide drainage calculations showing the amount of rainfall to be retained on-site. Please be advised
that there will be a fee for improvements the City is planning to make for off-site stormwater treatment
and conveyance, as part of the Downtown Watershed Stormwater Improvement Project.(Sec. 26-406)

Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments to me no later than 5:00 P.M. on ADril
20.1999. When preparing your comments, please separate them into two categories; code
deficiencies with code sections referenced and recommendations that you believe will enhance
the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by
the reviewer by contacting Scott Barber.
3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.
4. Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with
other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the
comment and the specific code section may be included in their review comments with the name
of the appropriate TRC Member that is responsible for the review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within the time
frame stated above, to me. The memorandum shall state that the plans are approved and that
they do not have any comments on the plans submitted for review and that they recommend the
project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted to me for distribution to the applicant. Please
include the name and phone number of the reviewer on this memorandum. Scott Barber will be the
Planning and Zoning staff member coordinating the review of the project. First review comments will be
transmitted to the applicant along with a list of Technical Review Committee (TRC) members.

The site is currently a flat, previously developed, 0.49 acre lot. The building is
surrounded on the east and south sides by road rights-of-way and 10 foot concrete
sidewalks, with the north side being adjacent to a 20 foot wide alley right-of-way.
Existing vegetation consists of lawn areas and minimal landscape plantings. There
are no other features of any significance on the site.
The developer is proposing the addition of 2,575 square foot of restaurant area to
the existing 1,750 square foot Dolphin Restaurant and Lounge. The project will
increase the building size to 4,325 square feet, and will provide a one-story sit
down restaurant with 164 seats and a 33 space parking area to the west of the
building. (see Exhibit "B" - proposed site plan/landscape plan).
A traffic statement was not" submitted. The agent, prior to receiving
permits on the building expansion, must provide a traffic analysis verifying

that levels of service standards are maintained. The city relies on the Palm
Beach County Traffic Division for review for compliance with the
county's traffic performance standards.
Conceptual drainage information was provided for the city's review. The
city's concurrency ordinance requires drainage certification at time of site
plan approval. The Engineering Division is recommending that the review
of specific drainage solutions be deferred to time of permit review.
Proposed on-site traffic circulation consists of two access points off of S.E.
1't Avenue; one 18 foot wide, one-way drive and one 27 foot wide, two-
way drive, both connecting to the 20 foot alley right-of-way to the north.
The parking areas proposed include 33 spaces on site west of the building.
No parallel parking spaces are provided on U.S. Highway 1 or S.E. 1st
Avenue. The standard 9 feet by 18 feet parking spaces will be provided in

obtaiRed. Central Business District zoning allows the required parking
count to be reduced by 50 % if all spaces provided (excluding handicapped
spaces) remain unrestricted and available to the public. According to the
standard methodology, 66 parking spaces are required, which is reduced
to 33 per CBD parking provisions. On-site parking, based on the total
required, includes the required number of two (2) spaces designated as
handicapped accessible. All parking needs can be satisfied on site, as
similar to the circumstance with the former use of the property. To
accommodate redevelopment within the Community Redevelopment Area,
the city is pursuing implementation of a downtown parking study which
will lead to a comprehensive parking program, based on the shared
concept, and will include the plan for additional public parking facilities
and methods for raising revenue for related facilities and improvements.
According to shared-parking concepts, this restaurant use would contribute
to the needed balance of uses in this vicinity, as its peak hour
characteristics would differ from the use characteristics of other nearby
(predominantly retail or office) uses.
A set of landscape plans have been submitted and reviewed. The plan
provides the appropriate plantings required of all projects in the Central
Business District. Landscape regulations will be fully met when staff
comments are incorporated into the permit drawings, including the
requirement to enhance plantings at the southeast corner of the
building/porch consistent with the "Dolphin Square" redevelopment plan.
The proposed building facade, as viewed from U.S. Highway 1, will
enhance the character of the adjacent intersection and also delineates the
southern boundary of the historical downtown core. Based on anticipated
future redevelopment of the historical 500 block of Ocean Avenue, and the
close proximity to the future Ocean Avenue Promenade / Marina
revitalization projects, staff recommends that the proposed structure be

upgraded to include similar architecturally historical elements of adjacent
500 block buildings. The desired architectural additions shall be
distinctive and complement the E. Ocean Avenue corridor through
consistency with adjacent historic commercial buildings. If staff comments
are addressed correctly, this project will provide a greater complement to
the historical district than it currently represents.
Signage:
A wall sign elevation was submitted with the current architectural plans.
A proposed signage detail was not submitted for site plan review. Any
signage proposed within the Central Business District shall be designed to
be consistent with the requirements of the Visions 20/20 Redevelopment
Plan and the City's Land Development Regulations. The conditions of
approval address site lighting, sign lighting, and that these be consistent
with fixtures to be used along Ocean Avenue and at the planned marina.
Downtown Redevelopment:
Although the subject project could represent a positive improvement in the
downtown, staff must recognize and describe how the proposed project
compares and contrasts with the redevelopment plan recommendations for
this property/use. The redevelopment plan recommends a 2 story
restaurant/retail building be placed similar to the proposed expansion (and
construction techniques will allow for a future 2nd floor addition ), and a
second two-story restaurant/office placed immediately west of the first
restaurant described at the corner. A partial courtyard is created by the
placement of the two, two-story buildings, and is to include pedestrian
linkages to Ocean Avenue, US-I and SE I't Street. The alley is to be
abandoned and replaced with the walkway to US-I. Parking is proposed
for the remaining land ( currently built and not owned by the subject
owner) located immediately west of the courtyard. In contrast, the subject
project proposes vehicular use for the interior area, including maintenance
of the alley, and a 33-space parking lot. The applicant claims to have been
unsuccessful at negotiations to purchase the remaining land on the block,
which is necessary for the parking lot and the implementation of the
"Dolphin Square" project.
As the expanded building will be designed to accommodate a 2nd floor
expansion, and since the parking area could ultimately be converted into a
theatre/courtyard, this project could be construed as a possible first phase
of the "Dolphin Square" redevelopment plan. It should also be noted that
the proposed expansion is the subject of a grant for economic development
funding through Palm Beach County.
RECOMMENDATION:
The Planning and Zoning Division recommends that this request for site plan approval be approved,
subject to the comments included in Exhibit "C" - Conditions of Approval. Staff also recommends that
the deficiencies identified in this exhibit be corrected on the set of plans submitted for building permit.

4. Fire flow calculations will be required demonstrating the City Code
requirement of 1500 g.p.m. as stated in LDR chap. 6, Art. IV, Sec.
16, or the requirement imposed by insurance underwriters, whichever
is greater. (see Sec. 26-l6(a)). Please submit these calculations with
your buildin12: permit submittal.
5. Water and sewer lines to be owned and operated by the City shall be
included within utility easements. Please show all proposed easements
on the engineering drawings, using a minimum width of l2 feet. The
easements shall be dedicated via separate instrument to the City as stated
in Sec. 26-33(a) of the Code.
6. This office will not require surety for installation of the water and
sewer utilities, on condition that the systems be fully completed, and
given to the City before the first permanent meter is set. Note that
setting of a permanent water meter is a prerequisite to obtaining the
certificate of occupancy.
7. It appears the existing water meter will be providing water service to the
existing and proposed building. Please provide calculations
indicating that the meter is sufficiently sized for the intended use.

agencies, such as FDOT, PBC, SFWMD, DERM, L WDD, DEP and any
others, shall be included with your permit request.
11. Correct the color of the handicap symbol and the stripes within the
accessible path.
l2. Provide an Engineer's certification that the drainage system will conform

13. On the Paving and Drainage Plans show all necessary traffic control

17. Add to the floor plan and site plan a labeled symbol that represents the
location and path of the accessible route that is required from the
accessible parking space(s) to the accessible entrance door of the
building. Place a note on the drawing, next to the symbol, indicating that
the accessible route is in compliance with Section 4.3 (Accessible Route)
and 4.6 (Parking and Passenger Loading Zones) of the Florida
Accessibility Code for Building Construction. Also, show and identify
the width and type of material proposed for the route through its entire
length.
18. To determine what impact the proposed construction will have on the
existing facility, a survey of the subject property is required. Additional
comments may be generated following the submittal of a current survey.
19. To determine what impact the proposed new improvements will have on
the existing facility, add the below listed information to the Project Info
chart found on sheet S 1 :
a. Identify the total number of seats that are currently licensed at the
existing facility.
Indicate the use of the existing and new square footage. Also, identify
the classification of the bar/grill (restaurant) - is it a high turnover sit
down restaurant or quality restaurant? Identify the total number of new
seats.
20. Add a drawing that identifies and shows the location of all seating.
Chronologically number all seats.
21. Indicate and show on the site plan and floor plan drawing the use of the
covered patio area. If there are seats proposed for the patio area show
them on the plans.
22. Within the footprint of the new and existing building that is shown on the
site plan (sheet S 1) and the proposed floor plan drawing, identify the
proposed finish floor elevation (N.G.V.D.). Add to the Project Info
found on sheet S 1 the flood zone that the building is located within
including, where applicable, base flood elevation. If there is no base
flood elevation, indicate that on the plans. Also, add to the Project Info
data, notes and computations that will verify the proposed finish floor
elevation is in compliance with the minimum elevation required by the
Flood Zone and verify that the proposed finish floor is six inches or more
above the crown of the abutting right(s)-of-way.

proposed portion of building), and wrap parapet around entire

greater parapet to interrupt continuous plane of the roof line and
match the 500 block building.
c) Add decorative cornice along entire perimeter parapet (both
existing and proposed), similar to that proposed for the 500
block.
d) Windows (including on south side) shall match windows
proposed for front fa~ade.
e) Raise rear parapet and cornice, similar to recommendation for
front fa~ade. Existing and proposed parapet should be similar in
height.
f) Add columns on all sides similar to front fa~ade (approximately
eight (8) along rear fac;ade, beginning with column at each end).
Awning on existing building should be broken up or enhanced
by similarly designed columns.
