LAND DEVELOPMENT REGULATIONS, PROVIDING
FOR THE ESTABLISHMENT OF BED AND BREAKFAST
ESTABLISHMENT AS A CONDITIONAL USE;
CREATING A NEW SEmON ENTITLED "BED AND
BREAKFAST", PROVIDING A DEFINITION FOR "BED
AND BREAKFAST ESTABLISHMENT'; PROVIDING FOR
APPLICATION REQUIREMENTS AND FOR STANDARDS

WHEREAS, the City Commission of the City of Boynton Beach, Florida,
based upon recommendation of staff, has determined that Bed and Breakfast
Establishments should be permitted as a conditional use in residential zoning
districts and the zoning code should be amended to provide for such use and
establish standards in granting the use.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. Purpose. It is the purpose of this section to provide a
minimum set of standards to allow bed and breakfast establishments within
certain zoning districts of the city, while setting forth criteria to differentiate them
from boarding or rooming houses. Bed and breakfast establishments shall be
approved through the pl~nning bo~rd Deoartment of Develooment and City
Commission by special land use and building permit procedures.
Section 2. Regulations and Standards:
A.. Bed and Breakfast Establishment shall be defined as follows: A
private owner occupied residence having more than three and less than ten
guest bedrooms units. The bed and breakfast establishment is subordinate and
incidental to the main residential use of the building.

1 B. In addition to the requirements of the underlying zoning district, all
other applicable general regulations, parking regulations, special conditions
imposed through the conditional use process, and local, state and federal

I building codes" the following requirements shall apply to Bed and Breakfast
Establishments:

from, each such unit. All walls separating bed and breakfast units in a structure
shall be fireguarded to the 2 hour time limit.
c, Where exterior changes are proposed, an elevation, or other
visual representation, of the facade to be changed sufficient to show the
architectural character of the dwelling is maintained as a single family structure.
Efforts should be made to ensure the structure is consistent with the integrity of
the neighborhood in which it is located.
2. Zoning restrictions: Such facilities shall be allowed only upon land
that is zoned for residential structures.
3. Licenses and permits: The establishment shall obtain all required
business licenses and health permits and shall otherwise comply with all building,
sign, sanitary and fire codes. Prior to obtaining an occupational license, which
shall be renewed annually, the City Building Official shall conduct an inspection of
the property to determine compliance with the current requirements of the City's
Land Development Regulations and State Building Codes.
4. Parking: Required parking spaces shall be calculated on the basis
of one space per each employee, manager or owner and one parking space f Jr
each guest room/unit. Newly created parking may be located only in the rear
and side yard.
S. Common Area: Within each Bed and Breakfast establishment, a
common area must be provided for a central dining area and for at least one (1)
sitting/reading/discussion room.
6. Number of Units: The number of bedrooms and bathrooms
provided should be as existed when the structure was originally constructed,

including additions, unless modifications are necessary to comply with Building,
Fire and/or Health codes,

: i a. There shall be no cooking facilities or food storage in any
! I rental room/unit. Meals shall be served bv the Manager and/or owner only to
! I the Manager and/or owner, and nonpaying bonafide guests of the manager
i! and/or owner. Breakfast shall be served bv the Manager and/or owner and shall
I: be the only meal provided for paying guests who are using the facility overnight
I Jnd their gueZ. The breakfast meal shall not be served after 11:00 A.M.
b, The maximum stay for each individual who is using the
facility shall be fourteen (14) consecutive days and not more than fourteen (14)
days during any ninety (90) day period. The owner and/or manager shall
maintain a guest book, which accurately identifies all customers for each nightls
lodging. This register of guests shall be available to City Inspectors during
reasonable business hours. Check-in and check-out shall take place between
8:00 A.M. and 8:00 P.M. only.
7.
Restrictions on Use and Employees:
c. The owner of the bed and breakfast establishment must
reside in the inn or elsewhere on the premises.
8. Signage: All signs shall conform to the regulations of the
underlying zoning district.
9. Items for Sale: Commercial social events and sale and/or display of
merchandise is prohibited in the bed and breakfast establishment.

considered ;)pplic;)ble to the intent of this Ordin;)nce. One room cottages with
existing kitchenettes would be considered within the scooe of this Ordinance and
will not be reauired to remove the kitchenettes.
Section 3. All other provisions of Chapter 2 - Zoning, of the Boynton
Beach Land Development Regulations, not herein specifically amended shall
remain in full force and effect, as previously enacted.
Section 4. All ordinances or parts of ordinances in conflict herewith be
and the same are hereby repealed.
Section 5. Should any section or provision of this ordinance or portion
hereof, any paragraph, sentence or word be declared by a court of competent

! jurisdiction to be invalid, such decision shall not affect the remainder of this

WHEREAS, on December I, 1998 the City Commission of the City
of Boynton Beach, Florida, based upon the recommendation of staff,
adopted Ordinance No. 098-42 providing for the establishment of Bed
and Breakfast Establishments as a Conditional Use in residential
zoning districts; and
WHEREAS, Section 16, of Chapter 2 of the Zoning Code was
amended to provide for such use and to establish standards in
granting such use; and
WHEREAS, due to (a) certain ambiguities set forth in Ordinance
No. 098 -42, -and as heretofore codified in the Zoning Code; and (b)
the recommendation of staff, it is in the interest of the City of
Boynton Beach, Florida, to amend and restate Section 16, Chapter 2
of the Zoning Code.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
OF BOYNTON BEACH, FLORIDA, THAT SECTION 16, CHAPTER 2 OF THE ZONING
CODE IS AMENDED AND RESTATED, AS FOLLOWS:
Section 1. Purpose: It is the purpose of this section to
provide a minimum set of standards to allow Bed and Breakfast
Establishments within certain residential zoning districts of the
City, while setting forth criteria to differentiate them from
boarding or rooming houses. Bed and Breakfast Establishments shall

bathroom, a living area, and, if permitted, a kitchenette. The Bed
and Breakfast Establishment is, and shall be, subordinate and
incidental to the main residential use of the single family
residence, or the multi-family dwelling.

(2) hour time limit.
c. Where exterior changes are proposed to the Bed
and Breakfast Establishment, an elevation, or other visual
representation, of the facade of the single family residence, or
the multi-family dwelling, to be changed, sufficient to show that
the architectural character of the single family residence, or the
multi-family dwelling, is maintained as a single family residence,
or as a multi-family dwelling. Efforts should be made to ensure
that the Bed and Breakfast Establishment is consistent with the
integrity of the neighborhood in which it is located.

(i. e. breakfast only) area and for at least ONE (1)
sitting/reading/discussion room.
6. Number of Residential Units: The number of guest
bedrooms and bathrooms provided in a Residential Unit within each
Bed and Breakfast Establishment should be as existed when the

was constructed, including additions, unless modifications are
necessary to comply with all building, sign, sanitation, utility,
police, and fire codes of the City.
7. Restrictions on Use and Employees:
a. Except as hereinafter otherwise provided, there
shall be no cooking facilities, or food storage, in any Residential
Unit within a Bed and Breakfast Establishment. Lunch and dinner
may be served by the manager, and/or owner, only to the manager,
and/or owner, and nonpaying bonafide guests of the manager, and/or
owner. Breakfast shall be served by the manager, and/or owner, and
shall be the only meal ser~ed to paying overnight guests of the Bed
and Breakfast Establishment. The breakfast meal shall not be
served after 11:00 A.M.

b. The maximum stay for each paying overnight guest
at the Bed and Breakfast Establishment shall be FOURTEEN (14)
consecutive days, and not more than FOURTEEN (14) days during any
NINETY (90) day period. The manager, and/or owner, of the Bed and
Breakfast Establishment shall maintain a guest registration book,
which accurately shall identify all paying overnight guests for
each night's lodging. The register of paying overnight guests
shall be available to City inspectors during reasonable business
hours. Check-in and Check-out shall take place only between 8:00
A.M. and 8:00 P.M.
c. The manager, and/or owner, of the Bed and
Breakfast Establishment must reside within ONE (1) of the
Residential Units, or otherwise within the single family residence,
or the multi-family dwelling.
8. Signage: All signs shall conform to the regulations
of the underlying zoning district.
9. Items for Sale: the sale of, and/or the display of,
merchandise,- and the conducting of commercial social events is
prohibited in the Bed and Breakfast Establishment.
10. Kitchenettes: Existing kitchenettes within ONE (1)
or more Residential Units within a Bed and Breakfast Establishment,
which is located within an R-3 zoning district, are considered to
be within the scope of this Ordinance, and will not be required to
remove the kitchenettes prior to obtaining an occupational, or
other license, from the City.
Section 3. All other provisions of Chapter 2 - Zoning, of the
Boynton Beach Land Development Regulations, not herein specifically
amended shall remain if full force and effect, as previously
enacted.
Sect ion 4. All ordinances, or part s of ordinances, in
conflict herewith be, and the same hereby are, repealed.
Section S. Should any section or provision of this Ordinance,
or any portion hereof, any paragraph, sentence, or word be declared
by a court of competent jurisdiction to be invalid, such decision
shall not affect the remainder of this Ordinance.

Code, 1991 Edition, which requires that habitable rooms have ceiling heights of not less
than 7 feet 6 inches.
Based on the testimony of Peter H. Schmidt, and the evidence presented, the
Board finds that a basis for relief has been established. Accordingly,
IT IS ORDERED THAT.
The request for Relief from Section 2001.2.1, Standard Building Code, 1991
Edition, which requires that habitable rooms have ceiling heights of not less than 7 feet
6 inches is hereby granted, subject to the following conditions:
1 Relief for Units #6 and #7 be granted provided that no electrical fans shall
be allowed in the ceiling, and that this document be recorded for any future reference.

RESOLUTION NO. 64-AA
WHEREAS, the City Council of the CITY OF BOYNTON BEACH,
has heretofore by the enactment of Resolution No. 62-II and
esolution No. 62-NN, vacated certain portions of the Plat of WILMtl WAY,
ecorded in Plat Book 23, Page 110, public records of Palm Beach County,
lorida, to wit: Lots 1 through 9 inclusive and Lots 18 through 26 inclusive;

WHEREAS, in said Resolutions the City Council specifically
eserved the five foot public utilities easements along the rear of subject Ids,
nd
WHEREAS, the owner of lots formerly described as Lots 18
hrough 2;3 inclusive, WILMS WAY, has requested the enactment of a Resolution
bandoning said five foot easement along the rear of subject property; and
WHEREAS, after public hearing and favorable recommendation
f said application by the Municipal Planning Board, it appears that no valid
eason exists why subject easement should not be abandoned;
NOW. THEREFORE. be it resolved by the City Council of the
ITY OF BOYNTON BEACH. FLORIDA, that the following described public
tilitiy easement is hereby vacated, nullified, closed and abandoned and said
rea is hereby returned to acreage for purposes of taxation;
That certain five foot easement for public utilities purposes
lying along the south side of that certain area formerly
described as Lots 18 through 23 inclusive, WILMtl WAY,

Florida.
