Sorry to dump this on you. I understand you have a history with Barbara Bradshaw on Manor Drive relative to the Park
Shores Manor Bed and Breakfast. Barbara is very complimentary of you by the way. Barbara visited me this morning
because she was recently passed from several departments and finally ended up with me. She is purchasing a property
across the street from her property in an effort to clean up a neighborhood eyesore, so she says. As part of the purchase
process, the Title Insurance company has raised concerns about the status of streets in the area. In particular, the Title
company has evaluated access agreements for those portions of Manor Drive that are privately owned. The company
found that agreements/easements on Manor are in order. However, the Title company expressed its opinion that Mariner,
north of MLK is private street and does not have the necessary access agreements for Manor Drive. Thus, the Title
company is opining that the subject parcel on Manor is landlocked and as such they are blocking the sale of the property.
I tried to research this the best I could since I don't really have any files over here at PW. I looked at the plat book in the
Clerk's office and it appears that there is a small portion of Marine north of MLK that is dedicated, yet our street records
from Engineering show it as private. Thus, I could not give Barbara a definitive answer.
I advised Barbara that I would ask for your help. Again, she was pleased that I was going to talk to you since she admires
you (she does not have the same admiration for many other staff). Could you please contact her? She is planning to buy
653 Manor Drive (PN 08-43-45-22-00-003-0080). Her phone number is 734-9142. Time is of the essence for her.
I will help any way that I can. I have a vested interest in the street ownership issues.

in contact with me in reference to your licensure position. They indicated a need to do an
inspection of your property, of which we require a passing grade before issuing you an
Occupational License for "Bed and Breakfast".
As soon as that is done, we will issue you your "first" Bed and Breakfast license.

copied for staff review. If plans will not be fully revised and brought to the scheduled TRC
meeting, contact Lusia Galav in this office by the Thursday prior to the scheduled meeting date.
Projects deviating from the original schedule are eligible for review at subsequent meetings,
which are held every Tuesday. To reschedule, contact Blythe Williamson, by the Thursday prior
to the Tuesday TRC meeting that you desire to attend. The remainder of the review schedule

Dear Mr. Rumpf:
I received a call from Barbara Bradshaw, a property owner in Boynton Beach. She is
currently trying to establish a Bed & Breakfast on her property. There seems to be some
concern over her landscaping. A request was made for someone to explain what a
"Certified Florida Yard" means.
The University of Florida developed a statewide Florida Yards and Neighborhoods (FYN)
program based on landscape maintenance practices which could help reduce stormwater
runoff and non-point source pollution dumping into our water bodies. Many counties around
the state are participating in the program, including Palm Beach County.
There are nine (9) principles to the FYN program including water efficiency, use of native
plants and attracting wildlife, Due to our rapid urbanization many of our native habitats
have been destroyed reducing the area where birds, butterflies, rabbits and other wildlife
inhabit. Once established, native plants require less water. fertilizer and pesticides to
remain. vigor04~~ Se..condly, these plants provide native habitat for wildlife in urban areas,
Barbara Bradshaw has indicated she has several native trees and shrubs on her property.
She also has two pairs of woodpeckers, song birds and a variety of butterflies making use
of the natural habitat she is providing.
Studies have shown that turfgrass requires one of the highest uses of water, fertilizer and
pesticide. therefore, increasing the amount of nitrates and phosphorus going into our
waterways. In addition, lawn mower emissions are 50 times greater than that of a new car.
The use of trees and shrubs is a preferred method to reduce stormwater runoff and also
improve both water and air quality.
A Florida certified yard must score a minimum of 36 points from a checklist defining
maintenance practices denved from FYN's nine principles. I have enclosed a copy of our
brochure, checklist and property owner Questionnaire that must be filled out to even be

Dear Ms. Bradshaw,
As per your earlier conversation with staff and my discussion with Peter Schmidt earlier today
regarding the status of your project, please be advised that the approval of your request for a
conversion of the nine existing rental units on the property at 658 Manor Drive into a bed and
breakfast establishment is contingent upon the full compliance with current regulations, in
particular regulations pertaining directly to such establishments as contained in Chapter 2,
Section 16 of the Code.
Section 16, p. g(l) states that "there shall be no cooking facilities or food storage in any rental
room/unit". This provision reflects the generally accepted character of bed and breakfast
accommodations in the U.S and elsewhere. Exempt from this provision in the code are one-
room cottages with existing kitchenettes. Your property includes one such one-room cottage;
however, the remaining buildings do not come under the definition of a "one-room cottage"
and thus the presence of kitchen facilities in units contained in these buildings is not consistent
with the current regulations.
Please note that the language of the selected sections of the Ordinance 098-42, which provided
for the establishment and related regulations for bed and breakfast establishments, was altered
for the fmal reading and passage of this Ordinance on December 1, 1989. In particular, at first
reading of the Ordinance, Section 10 read:" Conversion of small cottages with optional
kitchenette would be considered applicable to the intent of this Ordinance". Although the Code
does not provide a definition of a cottage, this language would have accommodated your
circumstances and such was an initial intent of this provision. I believe the language was
altered in response to concerns about the ambiguity of the term" cottage", and thus "one-
room" was added for an additional clarification. No one, including you or your representative,
made any comments on this Ordinance at the public hearing for the final reading and passage
on December 1. Unfortunately, as altered, a term "one-room cottage" cannot possibly be
applied to the two buildings proposed for the conversion.

Since, under your circumstances, bringing the property to compliance with the Code may be
cost-prohibitive, you may prefer to apply for the modification of the regulations, which, if
approved, could possibly reinstate the original intent of the said section 10.

AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF BOYNTON BEACH, FLORIDA, AMENDING
CHAPTER 2 - ZONING, OF THE BOYNTON BEACH LAND
DEVELOPMENT REGULATIONS, SECfION 16, BED AND
BREAKFAST, BY AMENDING SUBSECfIONS AS
FOLLOWS: B. REGULATIONS AND STANDARDS,
PROVIDING FOR CLARIFICATION OF DEFINmONS AND
AN AMENDMENT TO USE RESTRICTIONS; PROVIDING
FOR CON FUCfS, SEVERABILITY, CODIFICATION AND
AN EFFECfIVE DATE.
WHEREAS, the City Commission of the City of Boynton Beach, Florida,
adopted Ordinance 098-42, which provided for the establishment of bed and
breakfast establishments; and
WHEREAS, it has been determined that this Section should be amended to
clarify definitions as well as to amend certain use restrictions; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
BOYNTON BEACH, FLORIDA, THAT:
Section 1. That Chapter 2, Section 16, Bed and Breakfast, Subsection B. 1.
Regulations and Standards, is hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in struck-through type, as
follows:
1. "Bed and breakfast establishment" shall be defined as follows: A
private owner occupied residence having more than three and less than ten guest
bedroom units. The bed and breakfast establishment is subordinate and incidental
to the main residential use of the building.
Section 2. That Chapter 2, Section 16, Bed and Breakfast, Subsection B. 2.
Regulations and Standards is hereby amended by adding the words and figures in
underlined type and by deleting the words and figures in struck-through type, as
follows:
2. In addition to the requirements of the underlying zoning district, all
other applicable general regulations, parking regulations, special conditions imposed
through the conditional use process, and local, state and federal building codes, the
following requirements shall apply to bed and breakfast establishments;
a. Each application to the Department of Development shall be
accompanied by:
(1.) A detailed site plan illustrating the location of all structures and
improvements, parking, buffering, landscaping the location of guest
rooms/units and guest parking spaces and signs shall be submitted for
conditional use approval by the City.
(2.) Floor plans drawn to scale of the d'Nelling unit showing each of
the bed ;:md breal<fust guest units to be designated and the access to, and
egress from, each such unit. All walls separating bed und brcal<fust guest
units in a structure shall be fireguarded to the two hour time limit.
d. Parking: Required parking spaces shall be calculated on the
basis of one space per each employee, manager or owner and one parking
space for each guest room/unit. Newly created parking may be located only
in the rear and side yard.
g. Restrictions on use and employees:
(1) Except as hereinafter provided, there shall be no cooking facilities
or food storage in any guest unit. Breakfast shall be the only meal provided
for paying overnight guests. rentul room/unit. ~~euls shull be served by the

bonufide guests of the munuger und/or O'vvner. Brcul<fust shull be se~ed by

guests who ure using the fucility overnight und their guests. The breakfast
meal shall not be served after 11:00 A.M.
(2) The maximum stay for each individual who is using the facility
shall be 14 consecutive days and not more than 14 days during any 45 9G
day period. The owner and/or manager shall maintain a guest book, which
accurately identifies all customers for each night's lodging. This register of
guests shall be available to City Inspectors during reasonable business hours.

Existing kitchenettes within one or more guest units of a Bed and Breakfast
Establishment are considered within the scope of this section and will not have to be
removed.
Section 4. All other provisions of Chapter 2 - Zoning, Section 16. of the
Boynton Beach Land Development Regulations, not herein specifically amended shall
remain in full force and effect, as previously enacted.
Section 5. All ordinances or parts of ordinances in conflict herewith be and
the same are hereby repealed.
Section 6. Should any section or provIsion of this ordinance or portion
hereof, any paragraph, sentence or word be declared by a court of competent
jurisdiction to be invalid, such decision shall not affect the remainder of this
ordinance.
Section 7. Authority is hereby granted to codify said ordinance.
Section 8. This ordinance shall become effective immediately upon
passage.
