November 28, 2000. It is our understanding that this postponement is necessary because it was not
possible for approval of the hearing notices (tor the rezoning and the variance) to be obtained from
the City Attorney's office in time for them to be mailed 30 clays in advance of the scheduled meeting
date. It is my understanding that the applications will be heard by the City Council on December
5th.

requesting for this project. Unfortunately, we did not learn that you would. not support all of our
requested variances until last Thursday, which does not allow sufficient time to adjust and respond

not indicated in your first comments report and was not verbalized at the TRC meeting. In fact we

Bob talked to me in your absence. I told him site plan review is your baby, but he continued to give me excuses.
He says that in pre-app, you and Mike agreed that he only needed to address the new uses and not those already
permitted on the site. Also, that the city has no standards for drive lengths but relies on County standards. County
requires that for less than 500 trips/day 25" is sufficient. 500-2,000 tpd, 50' throat is required and above 2000 tpd, 100'
throat is required. His traffic study shows 1.128 tpd therefore 50' is sufficient. I told him I would pass it on to you.

Sorry for the late update.
The reviews went well. Both submittals appeared complete including plan reductions and environmental audit. The one
significant issue I am aware of is the Boynton Shoppes deficient entrance on Woolbright Road. It appears they
disregarded, and Martin was unaware of, the comment requiring the 100 ft driveway throat if a major driveway. Placed
right on the plans at the entrance is the traffic figure which places it into a major driveway class. They will go to the traffic
engineer to confirm situation and go from there. They are to let you know the status which would include whether they will
go for another variance and if they will delay the project to let the variance the catch up. I would be rather strict on this
review in anticipation of the Board's position. It seems rather tight and could get congested so let's cover ourselves as
best we can. Let me know if you have any questions. MR.

Pursuant to the meeting held on September 28, 2000 regarding the above referenced project, the
schedule for approval has been modified. Based on design changes that you have made to address
staff comments, the project must be resubmitted for a third review by the TRC. This meeting is
scheduled for Tuesday, October 10, 2000 at 9:00 A.M. in Conference Room C, 2nd Floor, West
Wing of City Hall. You will be charged a third review fee based on the hourly rate of each TRC
member involved and the time spent on the review of the changes to the project. A total of ten
(10) full sets of plans must be submitted for the TRC meeting. Also include one (1) set of 81/2" X
11" copies of the site plan; landscape plan and elevation drawings.
The project is scheduled for the November 14, 2000 Planning and Development Board meeting
and the November 21, 2000 City Commission meeting. These dates also apply to the requests for
the side yard setback variance and the rezoning required for the project. Both requests must be re-
advertised. A ten (10) day notice to property owners is required for the variance and a 30 day

Dear Ms. Galav:
Please accept this letter and the enclosed revised plans as our response to the First review comments
received for the amendments to the Boynton Shoppes project. We believe that we have adequately
and appropriately addressed and resolved all ofthe issues raised in your letter dated August 11,2000.
Our responses are provided below in the order that they appear in your comment communication, as
follows:
PUBLIC WORKS:
1. A detailed drawing of the proposed dumpster enclosure has been added to the site plan, as
requested.
UTILITIES: (Updated 8/17/00)
1. Utility easements for existing facilities have been added to the utility and landscape plan, as
requested.
2. Per the Palm Beach County health Department, a sewer permit does not need to be applied
for if a 4" or 6" sewer lateral is proposed and water permit does not need to be applied for
if the water service is smaller than a 2" line.
3. There are two fire hydrants within 200 feet of the proposed building. The fire flow
calculations previously submitted with the original Boynton Shoppes have been included as
a part of this submittal.
4. The capacity reservation fee will be paid within 30 days of final site plan approvaL

ENGINEERING DIVISION:
5. We understand the requirements for building permit applications, and will comply.
6. We have revised the proposed site plan to show the dumpster location (and have provided a
detail), site lighting and an off-street loading space.
7. Traffic control devices have been shown on the site and civil plans, as requested. We have
shown the pavement markings and signs requested.
8. The first two parking spaces along the west property line have been eliminated, as requested,
to increase the throat depth for the driveway.
9. We have modified the site plan and civil plan to show the required HlC ramp, as requested.
10. The civil plan has been corrected to reflect the sidewalks shown on the site plan.
11. The location of the menu board for the drive-thru lane has been added to the site and civil
plans, as requested.
12. The adjustments recommended to the ingress and egress lane widths have been made to our
site and civil plans.
13. The two notes identified have been added to the civil plans.
14. The "proposed" on the cross access has ben deleted from the plans, as requested.
15 . We have corrected the inaccurate dimension from the west property line to the proposed
building, as requested.
16. The callout of the dimension from the east side setback is correctly noted as an interior side
setback. We discussed this issue with the Planning & Zoning Division prior to submitting our
application, and agreed on this issue. We have submitted a side setback variance application
for the required 30 foot setback.
17. The parking calculations have been revised, as requested.
18. Although the proposed project will not generate either 3,000 single-direction trips per day or
250 single-direction peak hour trips, we have prepared and submitted a traffic analysis to the

Palm beach County Traffic Division, and copies have been provided to the City for review.
The County has approved the traffic report (copy attached).
BUILDING DIVISION:
19. The location of the handicap accessible door to each tenant space has been noted on the site
plan, as requested.
20. We have noted the floor plan as conceptual, as requested. We have also noted the handicap
accessible entrance doors.
21. We have reduced the number of parking spaces on the site plan, and in doing so we have
reduced the number of handicap spaces too one (1) space. It should be noted that the number
of parking spaces required is based on the overall PCD project, not just the proposed
addition. The overall PCD complies with the requirements of the Code.
22. The path of travel for accessible routes to each tenant space have been added to the site plan,
as requested. The access routes comply with the handicap Code requirements.
23. The proposed finished floor elevation (15.02 feet) has been added to both the site plan and
the civil plan, as requested, and the requested text has been added to the civil plan by the
project Engineer. The flood zone information from the FIRM map has been added to the
plans, also.
24. The property line has been clearly labeled on the site plan, as requested.
25. The site plan drawing has been modified to note within the footprint of the building that the
building is one (1) story high, as requested. The overall height of the building has been added
to the tabular data.
26. The floor plan drawing has been amended to note that the proposed building will be one (1)
story.
27. The plans have been corrected to all match, with respect to the uses of the building.
28. The setbacks of the proposed building have been clearly marked on the site plan, as requested.
As noted above, we have submitted a variance application for the east side setback, necessary
due to the constrained width of the property and the established driveway along the west side.

29. We understand that signed and sealed working drawings will be required at the time of
building permit application.
30. The site plan has been modified to note that the proposed restaurant will be a fast food

PARKS & RECREATION:
No comments received.
FORESTER/ENVIRONMENT ALIST:
32. We understand that any existing landscaping that is damaged during construction will have
to be replaced.
PLANNING & ZONING DIVISION:
33. Prior to submitting this application we met with Lusia Galav and reached an agreement that
the plans submitted need only address the portion of the site proposed for the new building,
and that the already developed portion of the site would not be included.

driveways over 2000 TPD. Our driveway volume falls into the 50 foot
required throat depth and the proposed site plan complies with that standard.
35. We are enclosing a copy of the unified control documents for the project herewith, as
requested.
36. A permitted monument sign at the project entrance will be used by the proposed building.
The location of this sign is shown on the site plan.
37. The landscape plan for the project has been modified to be at the same scale as the site plan,
to show site lighting and the nearest fire hydrant, and to show proposed dumpster screening.
38. A floor plan has been provided in the plans set. The architectural elevations have been
modified to call out the proposed colors and paint chips have been provided herewith.
Colored building elevations are also submitted herewith, as required.
We believe that we have adequately addressed all of the issues raised in the First review comments
letter. We look forward to proceeding through the approval process. We will provide the required
81/2" X II" copies of the plans for the public hearings as soon as we are advised that the project has
been certified to proceed to hearings.

1. Revise your plans incorporating all comments listed herein, including the addition of
notes on plans to confirm response to general statements/ comments, and bring 10 copies

5. All plans submitted for specific permits shall meet the City's code requirements at
time of application. These permits include, but are not limited to the following: site
lighting, paving, drainage, curbing, landscaping and irrigation. Permits required
from other permitting agencies such as FDOT, PBC, SFWMD, DERM, L WDD,
DEP and others, shall be included with the permit request.
6. Show the proposed locations of the following:
a. Dumpster - Chapter 4, Section 7 B.
b. Site Lighting - Chapter 4, Section 7 B.
c. Off-Street loading space (12' x 35'). Chapter 2, Section II J.
7. On the site and civil plans, add the following traffic control devices per Chapter 4,

a. Add a right-turn only pavement arrow at the egress driveway and a
corresponding post sign underneath the stop sign. Also show a one-way
arrow sign in the median.
b. Show a stop sign and bar at the egress aisle of the eight stall parking lot.
c. Show double, yellow lane separation stripes at the entrance.
d, Locate the HlC post sign in the HlC parking space.
S, Delete the fIrst two parking spaces along the west property line to eliminate
vehicular back-up into the east parking lot entrance.
9. On the site and civil plans, show the sidewalk at the same elevation as the HlC
accessibility path with an accessible ramp up on both sides per the Florida
Accessibility Code.
10. Correct the civil plan to reflect the sidewalks to the building shown on the site plan.
11. On the site and civil plans, show the location of the menu board for the drive-thru
facility.
12. Due to the traffic speed along Woolbright Road, it is highly recommended that the
ingress driveway be restriped to a 15 foot wide aisle for a more efficient transition to
the site: the egress driveway would be reduced to 12 feet wide.
13. Add the following note and engineers' certifIcation to the civil plans:
1. All striping, signage and markings shall conform to city standard
drawing B-9S001 correct the parking detail on the site plan accordingly.
2. The drainage will conform with the city's land development regulations,
and specifIcally, with Chapters 6 and 23.
14. Delete the work massage, "Proposed Cross Access" on the site plan.
15. The 27 foot dimension from the west property line to the east side of the building is
incorrect. Delete the callout or correct the number to read 54 feet.
16. The site is part ofthe P.C.D. parcel, which has its front setbacks along Congress
Avenue. The 30' side setback callouts should reflect front and rear setbacks.
Submit a variance to reduce the rear setback from 40 feet to 17.5 feet.
17. The building elevations plan indicates both businesses to be "retail food", Revise
the required parking calculations to reflect the uses shown.
IS. If this addition to the P.C.D. will generate 3,000 single-direction vehicular trips per
day or 250 single direction vehicular trips in a one hour period, then submit a traffic
impact analysis to Palm Beach County Engineering with copies to the Planning
Division and the Engineering Department.
BUILDING DIVISION
Comments:
19. Add to the building that is depicted on the drawing titled site plan a labeled symbol
that identifIes the location of the handicap accessible entrance door to each tenant
space of the proposed new building.
20. The building plans are not being reviewed for compliance with the applicable
building codes. Therefore, add the words "Floor plan layout is conceptual" below

the new drawing titled Floor Plan. Add to tbe floor plan drawing a labeled symbol
that identifies the location of the handicap accessible entrance door to each tenant.
The location of the doors shall match the location of the accessible entrance doors
that are depicted on the site plan drawing.
21. The site plan shows that twenty-seven (27) parking spaces are being added to the
site for the proposed new building. Therefore, two (2) handicap accessible spaces
are required. Amend the drawings to show no less than the required number of
accessible spaces. The quantity of the spaces shall be consistent with the regulations
specified in the Florida Accessibility Code for Building Construction. The
accessible parking spaces that serve a use shall be located on the shortest safely
accessible route of travel from adjacent parking to an accessible entrance. The
Florida Accessibility Code for Building Construction states that buildings with
multiple accessible entrances shall have accessible parking spaces dispersed and
located closest t the accessible entrance.
22. Add a labeled symbol to the site plan drawing that represents and delineates the path
of travel for the accessible route that is required between the accessible parking
spaces and the accessible entrance doors to each tenant space, The symbol shall
start at the accessible parking spaces and terminate at the accessible entrance doors
to the building. The symbol shall represent the location of the path of travel, not the
location of the detectable warning or other pavement markings that are required to
be installed along the path. The location of the accessible path shall not compel the
user to travel in a drive/lane area that is located behind parked vebicles. Identify on
the plan the width of the accessible route. (Note: The minimum width required by
the code is forty-four (44) inches). Add text to the drawing that would indicate that
the symbol represents the accessible route and the route is designed in compliance
with Section 4.3 (Accessible Route) and 4.6 (Parking and Passenger Loading Zones)
of the Florida Accessibility Code for Building Construction. Please note that at time
of permit review the applicant shall provide detailed documentation on the plans that
will verify that the accessible route is in compliance with the regulations specified in
the Florida Accessibility Code for Building Construction. This documentation shall
include, but not be limited to, providing fmish grade elevations along the path of
travel.
23. Identify within the site data the fmish floor elevation (lowest floor elevation) that is
proposed for the building. Verify that the proposed elevation is in compliance with
regulations of the code by adding specifications to the site data that address the
following issues [Section 3 107. I .2, Chapter 31 of the Boynton Beach amendments
to the 1997 edition ofthe Standard Building Code]:
a) The design professional-of-record for the project shall add the following text to the
site data. "The proposed fmish floor elevation _ _ NGVD is above the
highest 100-year base flood elevation applicable to the building site, as determined
by the South Florida Water Management District's surface water management
construction development regulations.
b) From the FIRM map, identify in the site data the title of the flood zone that the
building is located within, Where applicable, specify the base flood elevation. If
there is no base flood elevation, indicate that on the plans.
c) Identify the floor elevation that the design professional has established for the
building within the footprint of the building that is shown on the drawings titled site
plan, floor plan and paving/drainage (civil plans).
24. On the drawing titled site plan, identify and label the symbol that represents the
property line.
25. On the site plan, indicate within the footprint of the proposed new building the
number of stories that are in the building including, where applicable, mezzanines.
Add to the site data the number of stories in the new building including identifying
mezzanines, where applicable. Also, indicate the overall height ofthe new building
within the site data.

26, On all floor plan drawings, indicate within the footprint ofthe building the number
of stories that are in the building including, where applicable, mezzanines.
27. The plans are inconsistent with respect to identifying the use of the facility. The site
plan drawing indicates the use ofthe two tenant spaces as Retail and Fast Food
w/drive through and the floor plan indicated RetaillFood for both tenant spaces.
Correct the plans accordingly.
28. Identify on the site plan drawing the actual distance that the building is set back
from the south and west property lines. Please note that overhangs, covered
walkways, canopies, awnings or other appurtenances that are attached to the
building shall be considered when identifying building setbacks. Therefore, identify
the width of the proposed awnings that extend out beyond the main walls of the
building as shown on the elevation view drawings. The building setbacks shall
comply with setback regulations specified in the Zoning Code.
29. At time of permit review, submit signed and sealed working drawings of the
proposed construction.
30. To properly determine the impact fees that will be assessed for the project, identify
on the site plan if the restaurant is a high quality, eat-in high turn over, or fast food
with drive-through type of restaurant. Also, identify on the site plan and floor plan
drawing the number of seats for each tenant space. Add to the site plan the total
number of seats provided for both tenants. On the floor plan, show and
chronologically number all seats.
31. Add to all plan view drawings of the site a labeled symbol that represents the
location and perimeter of the limits of construction proposed with the subject
request.
PARKS AND RECREATION

FORESTER/ENVIRONMENT ALlST
Comments:
32. The applicant has indicated on the landscape plan the intended use of all the existing
trees and landscaping on the site. The existing wax myrtle hedge along the West
perimeter may have to be replaced with another native hedge material. Any of the
existing landscaping / irrigation that is destroyed during construction, will have to be
replaced prior to the fmallandscape approval.
PLANNING AND ZONING
Comments:
33. Revise the application to clarify the site plan site data. The plans and application
should include all PCD site elements, not just the additional building.
34. Revise the site plan to include the following:
a. Handicapped spaces required - 5 (15 are shown)

General
The site is located on the southeast corner of Woolbright Road and Congress Avenue.
Bordering on the north side of the project is Congress Avenue, on the south by the
existing Boynton Shoppes (retail/commercial), on the east by an existing office building,
and on the west by an existing McDonalds / Amoco gas station. The total acreage for
the Boynton Shop pes PCD is 3.63 acres of which this project is a part of.
Drainage Criteria
The site is located within the C-16 Drainage Basin. The drainage design for the
proposed development will contain dry detention. The perimeter berm design elevation
is based upon the 25 year 3 day storm event or 13.5 ft. NGVD. The proposed
development will also meet the site discharge criteria of 62.6 CSM as required by the
South Florida Water Management District in the C-16 Basin.
The L-27 Canal provides this development with the required legal positive outfall via the
existing drainage system on Congress Avenue. The L-27 canal is a part of the Lake
Worth Drainage District's system. The existing drainage system within the Boynton
Shoppes project is connected to the Congress Avenue system via a control structure.
All drainage design shall be in accordance with the City of Boynton Beach, South
Florida Water Management District, and the Lake Worth Drainage District.
The finished floor of the building shall be designed based upon the 100 year 3 day zero
discharge storm event or 15.0 ft. NGVD per the South Florida Water Management
District permit. Water quality criteria is met in the dry retention area and on-site
exfiltration trench.

control. in compliance with the City of Boynton Beach Code of Ordim-lnces and condil1ons of approval
of all Development Orders or Development Permits issued for the property, without recourse lO the
city or any other public agency. The name or title of the entity respo~sible for developing. operating

SITE PLAN REVIEW PROCEDURES

Find attached for your review the plans and exhibits for the above-referenced project. Please review the
plans and exhibits and transmit formal written comments or e-mail to Blythe Williamson and I no
later than 5:00 P.M. on Fridav AUQust 4th, 2000. When preparing your comments, please separate
them into two categories; code deficiencies with code sections referenced and
recommendations that you believe will enhance the project.
Adhering to the following review guidelines will promote a comprehensive review and enable the
applicant to efficiently obtain Technical Review Committee approval:
1. Use the review standards specified in Part IV, Land Development Regulations, Site Plan Review
and the applicable code sections of the Code of Ordinances to review and formulate comments.
2. The documents submitted for the project were determined to be substantially complete with the
exception of traffic data, however, if the data provided to meet the submittal requirements is
insufficient to properly evaluate and process the project based on the review standards or the
documents show code deficiencies, additional data and/or corrections should be requested by
the reviewer by contacting Lusia Galav, or myself.
3. Each comment shall reference the section of the code that is incorrectly depicted on the
documents.

4. Technical Review Committee member(s) shall identify in their comments when the plans depict or
when the location and installation of their departmental required improvements may conflict with
other departmental improvements.
5. When a TRC Member finds a code deficiency that is outside of his/her review responsibility, the
comment and the specific code section may be included in their review comments with the name
of the appropriate TRC Member that is responsible for the review specified.
6. If a TRC member finds the plans acceptable, he/she shall forward a memorandum, within the time
frame stated above, to me. The memorandum shall state that the plans are approved and that
they do not have any comments on the plans submitted for review and that they recommend the
project be forwarded through the approval process.
All comments shall be typed, addressed and transmitted or e-mailed to Blythe Williamson and I for
distribution to the applicant. Please include the name and phone number of the reviewer on this
memorandum or e-mail. Lusia Galav will be the Planning and Zoning staff member coordinating the
review of the project. First review comments will be transmitted to the applicant along with a list of
Technical Review Committee (TRC) members.
